BACKGROUND AND FINDINGS: The City Charter, Article III, Section 5 requires that the Council select one of their members to serve as Mayor Pro Tempore for the ensuing year. RESOLUTION NO. 2025- A RESOLUTION CREATING A VACANCY IN THE OFFICE OF CITY COUNCIL MEMBER PLACE 2 WHEREAS, Aransas Pass City Councilmember Jason Knight, Place 2 has been elected and accepted the office of Mayor on May 13, 2025 leaving a vacancy in the office for a term expiring May 2026; and WHEREAS, pursuant to Texas Election Code, S 201.025 If an officer accepts another office and the two offices may not lawfully be held simultaneously, a vacancy in the first office occurs on the date the person qualifies for the other office; and WHEREAS, Article III, Section 6 of the city charter states: when a vacancy occurs, for any reason, the remaining council members shall within thirty (30) days, appoint a qualified person to serve until the next general city election, when it shall be filled for the unexpired term, if any, by the regular election procedure. MOTION TO RECONSIDER A motion to reconsider must be made at the meeting where the item was first voted upon. The motion to reconsider may be seconded by any member of the city council regardless of how they voted on the original motion. If a member of the council who voted in the minority on the original motion seeks to make a motion to reconsider, it MUST be ruled out of order by the Mayor. RULES OF DECORUM The City Charter, Article III, Section 11 - Rules of Procedure, states that the Council shall determine its own rules of procedure. The City Council of the City of Aransas Pass hereby adopts "Roberts Rules of Order", 11th Edition, to govern the basic order of meetings and additionally adopts the following "Rules of Decorum". The purpose of the Rules of Decorum are to: 1) to ensure that meetings of the City Council are conducted in a way that allows the business of the City to be effectively conducted, 2) to ensure that members of the public who attend meetings of the City Council can be heard in a fair, impartial and respectful manner, and 3) to ensure that meetings of the City Council are conducted in a way that is open to all viewpoints, yet free from distracting and intimidating behavior. City Council, city staff and members of the audience shall be courteous, polite and respectful of one another, SO that the City Council may hear all sides of an issue and by due deliberation act in the best interest of all citizens. The mayor, as Presiding officer, has the primary responsibility for ensuring that the council's rules of procedure are followed and for maintaining the dignity of council meetings. Rules for Speakers: a. Members of the public may address the City Council at the following times during a meeting: - During the citizens comment period. - During a public hearing on an agenda item. b. Speakers must limit their comments to three (3) minutes. All comments shall be addressed to the Mayor and City Council and not to the council members as individuals. C. The vote upon the passage of all ordinances and resolutions shall be taken by the "ayes" and "nays" and entered upon the minutes, and every ordinance or resolution, upon its final passage, shall be recorded in a book kept for that purpose, and shall be authenticated by the signature of the presiding officer and the person performing the duties of City Secretary. i. COUNCIL TRAVEL City Council travel/business expenses are for the purpose of training, exchanging new ideas, accomplishment of a specific purpose, solution of a definite problem, or purchase of items related to council business. Travel for the Mayor and Council Members is approved through the budget process. Each Council Member will carry out the purpose of his/her trip in an effective and economical manner. The City will reimburse Council Members for all reasonable expenses which are incurred while on City business up to the approved annual budgeted amount for individual Council travel/business expenses. Reimbursement will be on an actual basis supported by a travel expense report with supporting documentation. SECTION 2. PURPOSE: Request to change the pro-rata fees, removing calculations in the standards manual and replacing with fees in code of ordinances along with changes to introduction, sample ordinance, and planning section to match present processes. BACKGROUND AND FINDINGS: Pro-Rata is when one entity extends utilities and any other entity that comes within 7 years of the utility installation will connect to the initial extension. The fees paid are returned in part to the entity that did the initial extension. A local developer inquired about this ordinance since he was extending utilities that may be tapped by other property owners in the future. It was found by many department heads that the calculation for fees under the standards manual was confusing and not direct. When different people tried to calculate the point system, they all came out with different amounts. The same fee was found in Sec 29-41 in the code of ordinances that had a simple rate that made sense to everyone and easier to calculate. Hence the standards manual is being amended to remove confusing fees to simple and clear fees along with minor changes for the introduction, sample contract, and planning processes mentioned in the standards manual. If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to any person or set of circumstances, is for any reason held to be unconstitutional, void, or invalid, the validity of the remaining provisions of this Ordinance shall not be affected, and it is the intent of the City Council in adopting this Ordinance that no portion, provision, or regulation herein shall become inoperative or fail by reason of any unconstitutionality, voidness, or invalidity of any other portion, provision or regulation, and all provisions of this Ordinance are declared to be severable for that purpose. 5. Final Plat Approval by the Planning and Zoning Commission Once a notice to proceed is issued, the City will place the subdivision on the Planning and Zoning Commission agenda for final plat approval. 1. Some Requirements for Final Plat Recordation a. Water and Sewer Tapping Fees - Along with the inspection fee, there will be a water and sewer tapping fee which must be paid prior to the utility construction. The cost for tapping fees can be obtained from the City's billing department. b. Street Signs Within the corporate limits oft the city, the Developer shall install required street signs in accordance to city standards. C. Construction Certificate - Upon completion of construction, a certificate signed by the Project Engineer shall be provided to the city, acknowledging that all improvements have been completed in accordance with the approved construction plans. The Contractor will also submit a certificate, for a one- year letter of warranty. The warranty shall become effective after the issuance of an acceptance notification by the Development Services Department. d. Improvement Construction Approval - A city representative will inspect all the construction and inform the Development Services Department whether it conforms to the approved construction plans and specifications, and in according to city specifications. If satisfactory, the inspector will issue a clearance memorandum to the Development Services Department. The Development Services Department will notify the developer and engineer the improvements have been accepted as part of the overall system of the City of Aransas Pass City Council. The City will then assume operations and maintenance. e. As-built Construction Plans The Project Engineer must submit to the Development Services Department as-built plans, signed and sealed by the engineer of record. The City will not record the subdivision until the. As-built drawings have been received -hareeepyand-l-dakeeR-HeCAD) electronically through the portal and A a final inspection is scheduled by the Development Services Staff with all Department Heads and the Project Engineer at the site, at the request of the Project Engineer. If everything complies with the City of Aransas Pass requirements and city council approves the improvements, the recordation process continues. Otherwise, another final inspection will be scheduled until all requirements are met. A charge of$300.00 will be paid by the Engineer/Developer for additional final inspection meetings, prior to rescheduling.
