To begin, I will briefly go over the procedure for today's meeting. A brief presentation will be given by the consultant for the project. The DAC members will then give their comments on the projects. The meeting will then be opened up for anyone in attendance that may have questions or comments about the plan. Today's meeting is recorded. Minutes are taken from the recording. There is also an attendance sheet on the back table. We have two plans on today's agenda. We will go in the order in which they are listed. The first plan on the agenda is 310 Nilles Lanes. My name is Mitch Ensor and I am with Bay State Land Services. Weare located at 2012 Rock Spring Road, Forest Hill, Maryland 21050. The proposal today is located at 310 Nilles Lane. It is a private road. This property does have rights to access that private road. The property itselfis zoned commercial industrial and consists ofapproximately 2.4 acres. Itis currently occupied by a vacant residential dwelling and the proposal is to demo that building and construct a 5,000 square foot construction services building. The occupants of the building are a mechanical heating air conditioning company. And we are fortunate enough to have them move here to Harford County from Baltimore County, SO they are coming out to get a little bit closer to where a significant number of their employees are from and they have said that the environment here in Harford County is a better situation than where they currently are. So they are happy to be moving up to Harford County. They do, as a heating and air company, have approximately eleven employees. Most ofthose employees work out oftheir utility van vehicles and do not report to this office location but they would have approximately 5 staff members that are office staff that would be here on a daily basis. The site is proposed to be served by public sewer. We would extend a public sewer line in Nilles Lane and that would service the property. And the site would be serviced by a private well. I do note that that well layer was frozen and on the site plan the well location did not show. We have shown that location to the health department and will show that on a future plan that comes in to Planning and Zoning for approval. The site is significantly forested, to that end we did as much as possible to not clear forest and impact non-tidal wetlands. To that ends we did request a Board of Appeals case, that case was 6022 and that case did approve a reduction in the front yard setback and an impact to the NRD (Natural Resource District). The reduction in the front yard setback did allow us to reduce the impacts to the Natural Resource District and that's why it was supported by the County staff and the hearing examiner. To support this plan we have submitted a FSD and a FCP, a Forest Stand Delineation and a Forest Conservation Plan. Also submitted is a Stormwater Management Plan and a Landscape Plan for the project. On the Landscape Plan we did not show site lighting, the owners said that they would not expect to have parking lot lights with respect to the residential property back behind us and would only have lighting above the doorways because most of their activities would be during the daylight hours they would not have evening hours. I did read the Health Department comments and there was a question about whether the general public would be coming to the building. As they are a services building they would not have any kind of sales happening out of this building. I would envision that there could be an occasional person who may be local and want to stop by to pay their bill to the office staff but they're not a walk-in kind of business. It's more of a you have an issue at your building or your home, you call in, they send a service van over at their convenience based on how local they are to that location. We have submitted a Stormwater Management Concept Plan for review and we do understand that this site would require a set of Erosion Control Plan as well and we will work diligently towards getting those approved. We do have a sewer construction plan that's ready to be submitted for the extension ofthe sewer and we are looking forward to having this company move into Harford County. To begin, I will be reading the comments from Emergency Operations from Justin Mannion. Justin Mannion = Emergency Operations (read by Crysta Draayer) The address shall remain 310 Nilles Lane. The proposed building must display 10 = 12 inch address numbers and letters. The address must be clearly visible from Nilles Lane. Public safety wireless radio communications inside the building is essential to the safety ofthose occupying the building plus fire, law enforcement, and emergency medical providers responding to a call for help. Buildings that are greater than 5,000 square feet, higher than 50 feet, contain underground storage or parking or are constructed of materials that impede wireless radio signals that may adversely affect the response of public safety providers please consider including wiring, electrical connections and other infrastructure that may be needed for an in- building 700-800 MHz amplifier. The Department of! Emergency Services will test coverage in the facility when the construction is finished. They provided a phone number for additional information. Clarence Cullum Soil Conservation District Thank you Crysta. Good morning Mitch, good morning all. The proposed construction will require an adequate sediment and erosion control plan. The erosion control plan must meet the minimum standards per the 2011 Maryland Standards and Specifications for Soil Erosion and Sediment Control. The sediment and erosion control plan should be integrated with the SWM strategy during the design phases. Prior to the "Final Plan" submission for sediment control review, please provide our office with the plan review fee and voucher. The site appears to be located within a Maryland Tier II High Quality Watershed. Tier II buffers should be noted and shown on the final plans. Sites located within a Tier II High Quality Watershed may need an additional level of controls. Please contact Angel Valdez of the Maryland Department of the Environment (MDE) @ 410-537-3606 or Angel. Valdez@marlandgov for more information and recommendations. The proposed plan appears to present a disturbance of greater than 1 acre, as such an NDPES permit will be required for the site. Please contact MDE at (410) 537-3019 for more information about the current NPDES permitting process. Dustin Ferguson - Harford County Health Department Thank you Crysta. This plan proposes to develop a 5,000 square foot building for retail/trade Development Advisory Committee Minutes April 16, 2025 Page 4 of15 services for AJ Michaels. HCHD records indicate there is an existing house and an existing on- site disposal system (OSDS) on the property. The plan proposes to connect the building to the public sewer system and use a private well. The site plan requires additional information in order to get approval from the Health Department. 1. The site plan must show the location of the proposed water supply well that will serve the building. The site plan must also show the 100-foot radius of the well and show the water line connection from the well to the building. 2. Provide more detail as to whether the facility will be accessible to members of the general public or if it will be restricted to employee access only. If open to the public, will public restrooms be provided. This information is required in order to assign the appropriate classification to any potential public water system designation. That is all. Chris Dombeck - Department of Public Works Water & Sewer Thank you Crysta, Water & Sewer is going to request a new version. A new version of the plan is required to address the following: Coordinate with the Health Department to show the proposed well location for the parcel as required by their agency and adhere to COMAR 26.04.04.04 for well construction. Provide and label a thirty-foot (30') wide public drainage and utility easement along the extent ofthe Niles Lane right-of-way from the Bel Air Road right-of-way to the property line dividing parcel 363 and parcel 177. The following comments shall be included as conditions of Site Plan approval for the above described project and are subject to change based on the above comments: Public clean-outs shall be located at the edge ofthe public right-of-way and will be the limit of Harford County maintenance. Any sewer cleanouts that are located within a paved area shall be installed using the County cleanout in paving detail S-28. The detail shall be shown on the utility plan and referenced on the plan and/or profile drawing. The sewer contract number for this project is 20368. The number shall be placed on the utility construction drawings before their initial submittal to the county for review. A Public Works Utility Agreement (PWUA) is required for the construction ofthe public sewer main associated with this project prior to the issuance of a building permit. A building permit cannot be issued until the public utilities that serve them are either operational or bonded for construction. It is the developer'slowner's: or their representative's responsibility to contact the Development Advisory Committee Minutes April 16, 2025 Page 5 of15 Division of Water and Sewer, W&S Administration Section at gmindhwfasiumomdenw to request the preparation of the PWUA concurrently or following the submittal of the water and sewer contract drawings for review. The property on which this project is proposed is currently in the S-6 category in the Water and Sewer Master Plan. It is the property owner/developer's responsibility to request in writing to the Division of Water and Sewer to have the category designation revised to the S-3 category after the Site Plan has been approved by the Department of Planning and Zoning. To effect this change, a public hearing must be held in front of the Harford County Council to review and approve this request. The sewer category designation must be revised to S-3 before sewer construction drawings for the project may be approved. The sewer construction drawings must be approved before a subdivision plat may be recorded for the project. Robert Anderson - Department of Public Works Engineering Good morning. The following comments are offered by the division of environment and sustainability on the subdivision plan submitted. We will also need a new series. Required Design Standards . MDE- Maryland Standards and Specifications for Soil Erosion and Sediment Control, Dec 2011, or latest edition. Required Plan Approvals A sediment control plan is required for the development of this site. . A grading permit is required. Stormwater management must be addressed. Suitable outfalls must be provided for the stormwater management facilities and shall be approved at the time of final design. . Additional topo shall be shown for the outfall to ensure that the adjacent property owner will not be adversely affected by runoff from the site. Maintenance . Maintenance of the stormwater management facilities is the responsibility of the lot owner (s) and shall be stipulated in the association documents. . Practices located on individual lots are the maintenance responsibility ofthe owner. SWM Design Comments . A Stormwater Management Concept Plan shall be submitted for review and must be approved before preliminary plan approval. . Stormwater Management practices designed for and located on individual lots shall be constructed and inspected before the issuance of use and occupancy permits. . Discharge pipe locations for proposed stormwater management facilities must be shown on the plans. . Please investigate the need for an Industrial Stormwater NPDES (National Pollutant Discharge Elimination System) Permit through the Maryland Department of the Environment. . Please show storm drain locations and flow directions. Highways has no comments. That'si it for us. State Highway Administration = Read by Crysta Draayer The following comment is from the State Highway Administration. SHA has reviewed the site plan and has no objections to the approval. Eric Vacek - Planning and Zoning Thank you. Mitch welcome. This site plan proposes to construct a 5,000 square foot commercial structure and associated parking on a parcel of record. The property is zoned CI commercial industrial and totals 2.408 acres +/-. Parking has been provided as required. This plan is subject to all of the conditions as noted in the Harford County Board of Appeals case #6022. Mitch outlined what the case was or what the request was through the board. The preliminary plan must be submitted to the Harford County Department of Planning and Zoning for review delineating or adding the appropriate easements or Forest Retention Areas, Natural Resource Districts, or any additional easements as required. The consultant also noted that the Forest Stand Delineation and a Forest Conservation Plan were submitted and approved to the Development Advisory Committee Minutes April 16, 2025 Page 7 of15 Department of Planning and Zoning. A Landscape Plan has been submitted and is currently under review. An itemized landscaping cost estimate totaling $1680.00 was submitted to the department. A revised plan would be required which should include the required landscape material notes, plan and substitution notes, and protective measures. Harford County Historic Preservation Commission is not required for this plan. Mitch touched upon lighting and those questions. No lighting or certain parking lighting is proposed at this time. Ifyou have any lighting in areas not noted or shown in this submission we would want to take a look at that. We would also state that any proposed lighting shall be directed downward and away from adjacent residential properties. No signage is proposed at this time. If: signage is proposed in the future it must conform to the Harford County Sign Code. Permits shall be obtained from the Department of Planning and Zoning and if you are proposing to demolish the house, the existing house, the department would need the appropriate permits to be applied for and executed. No. Does anyone in attendance have any questions or comments about this plan? Public Comments: Mitch Ensor - Bay State Land Services Crysta ifI could just finish. The L.O.D., limit of disturbance, on the plan is currently under 1 acre, ifwe are able to meet the conditions ofthe NOI for not having to apply. I know 1 acre is one ofthose limits and I think Bob and Clarence both mentioned that. But we will look into any other conditions that might be applicable because ofthe Tier II category. And certainly knowing that there is a commercial site downgrade from our site and we would very likely put additional controls in on the sediment erosion control plan just in respect to the downgrade over and it's predominantly a large parking lot SO we want to make sure we protect that for the users of that site. And then one note, we did, being good neighbors with our residential neighbor to the back, prior to the Board of Appeals case we did have a meeting with that landowner, both myself and the folks who are going to occupy the building. And sat down and had a very good meeting. We were very forthright with what we were doing and she was, she was happy that we sat down with her and she actually wrote a letter of support on the Board of Appeals. We plan to be very good neighbors to the residential neighbor to the rear of us. Thank you. My name is Bob Capalongo from EN Engineering, we are located at 1630 Robin Circle, Suite A, Forest Hill, Maryland 21050. I am here to present the redevelopment of a commercial property to a 7 Brew. It's at 2 Forest Valley Drive, at the intersection of Forest Valley Drive and Maryland Route 24. We highlight some basics on it. So the existing condition is a produce stand. The site is pretty much, I would say 95% paved, maybe a little more than that even. We are actually removing some paving along some of the perimeter edges, removing some paving to allow for installation of landscaping; we do have requirements for that. There is an existing force main that runs into the site from the west along Forest Valley that DPW Water & Sewer requests that we abandon that force main, we are going to abandon that force main and we are going to install a new gravity sewer line that connects to the sewer line running to the right of way to Route 24. Water service is going to remain the same. We will bend the meter, keep the water line intact but bend the meter here and have a new water line going into the building and have a meter that is installed inside the building per DPW requirements. The um, we have previously been through the process of review from the stormwater concept with the Filtera system I believe, we are using a Filtera inland system at this corner SO it's redevelopment we will actually have considerably less paving in the final condition than what is there today. It is reutilizing the Filtera system and like I said a similar concept has already been through the process earlier a few months ago came through approved and moving on to the architectural final. Pursuant to the comments we receive. We believe we meet all ofthe county requirements for parking setbacks, etc. Once again I think it is going to be an upgrade from is out here with additional landscaping. Ifyou out there now it's a produce stand but it is pretty scarce as far as any sort oflandscaping but when we're done it will be fully landscaped along the perimeter and around the building some and it will look much nicer from both locations, it will be an asset to Harford County. The parcel is served by the existing Harford County public sewer and Maryland American Water supply. To request a food service facility review package, the owner and her agent should contact our Permits and Plan Review Division. If the plan is recognized as a prototype you will also have to contact and be required by the Maryland Department of Health (MDH), Division of Food Control, Center of Facility and Process Review. If there are any questions regarding that review, the applicant should contact Maryland Department ofHealth or our office. So ift they are still working with MDH they would work both with our office and MDH sO ifthat prototype might be done by now or could be in the works they would still need to be within two ofthem SO it would be a dualled review between our office and MDH. He is working with the different health departments to try to come up with, I am not sure how it works but... .yeah he is working on filling out each submission for each county. He is trying to come up with some sort of revised approval... Cari Biscoe - Harford County Health Department Correct. Yeah SO it depends on where it is and how it is functional SO if this approval wants to get done prior to that but we would be in contact with MDH with our office. Bob Capalongo - EN Engineering Yeah, he told me that some jurisdictions like Harford County require grease traps even though there is no grease per se. But depending on the health department there is differences in whether or not they require grease traps I think sO he is working on that. Cari Biscoe Harford County Health Department It would be based on the products within use of their HACCP (hazard analysis and critical control points). So whatever, it doesn't matter ifi it is liquid or not, depending on what their usage, what they are putting down their drains is where the requirement would be. So yeah that would be per the food department would make that determination. Bob Capalongo - EN Engineering Okay Thank you Cari Biscoe - Harford County Health Department And of course, as always, the wonderful Harford County Health Department the owner/developer is reminded that during the development of this project when soil moisture conditions are low, measures must be implemented to prevent the generation of dust until a Development Advisory Committee Minutes April 16, 2025 Page 12 of 15 permanent vegetative cover is established and all paving is completed. And that is all the comments we have. Chris Dombeck - Department of Public Works Water & Sewer Thank you Crysta. Department of Water & Sewer is not requesting a new series. The following comments shall be included as conditions of Site Plan approval for the above described project and are subject to change based on the above comments: The existing water and sewer may be too small for the proposed use. Ifa new service is required, the unused water service must be abandoned in accordance with standard Harford County requirements as part of the utility work for this project. The locations of the services and a description of the work shall be shown on the utility plan submitted with the Commercial Service Application. The proposed use requires a testable backflow prevention device for the water service. The location of the meter and backflow device will be determined during the Commercial Service Application (CSA). The Public clean-out shall be located at the edge ofthe public right-of-way and will be the limit ofHarford County maintenance. Any sewer cleanouts that are located within a paved area shall be installed using the County cleanout in paving detail S-28. A Commercial Service Application must be completed by the owner and approved by Harford County before a building permit will be issued for this project. The existing access off Forest Valley Drive needs to be reconstructed to meet the current commercial standards. As such, a Commercial Access Permit is required. Sidewalks . Sidewalk handicap ramps shall be constructed at the entrance. Design Comments The entrance width shall be 35' with 25' minimum curb radii. . The driveways must be paved within the County right-of-way before the issuance of any use and occupancy permits. . The property is less than 40,000 square feet and is therefore not subject to Forest Conservation Regulations. The property at 2 Forest Valley Drive is not designated as, adjacent to, or within 500 feet of a Harford County Historic landmark or district. Lighting shall be designed and controlled SO that any light shall be shaded, shielded or directed SO that the light intensity or brightness does not adversely affect the adjacent properties or roadways. No signage is proposed at this time. Ifs signage is proposed in the future it must conform to the Harford County Sign Code and permits shall be obtained from the Department ofPlanning and Zoning.
