TOWN OF NEWLAND 4/16/25 SPECIAL MEETING - CAMPERS AND RV'S TH CAR 3 ATTENDING: MAYOR: Derek Roberts ALDERMAN: James Johnson, Gail Haller, Dave Calvert, Kenan Foxx, Christie Hughes (absent) GUEST: Vicki Caraway, Kenny Caraway, Mike Tolson, Donetta McKinney, Nathan Gittner, David Angrisani, Theresa Foxx STAFF: Town Manager/Finance Officer Sandy Lewis, Town Clerk Jessica Buchanan, Police Chief Michael Fields, Public Works Supervisor Gary Lewis, Town Attorney Gerald McKinney Mayor Roberts called the special meeting to order at 5:00 p.m. and asked what was happening with the camper across from UCB. Sandy said when Kim Robertson got permission from the board to put her new mobile home behind Braswell Realty, she texted Spencer Turbyfill, the manager of Church's Mobile Home Park. She told her not to put anything back in that spot, not a camper, mobile home, or tent, and there was to be no resident allowed there. She took a while, but it showed up. She came in to pay. her utility bills, and Jess and I were in Jessica's office. Sandy asked Spencer if she remembered the text she had sent her on February 28th from Gary's work phone, saying not to put anything back in that spot. Spencer said yes, and something about this guy losing his home. Sandy said she told her it didn't matter and was told not to put anything back in that spot. She never came and asked for permission to put anything there, and yet there sits a camper. Sandy told her she had seven days to get it out of there, or we would tow it. It's still sitting there because, after that discussion, we decided to have this meeting. Now, we need to bring it up because, from her understanding, it looks even worse. Mayor Roberts said it does because of all of thej piping and trash. Sandy said she's sure it has black and gray tanks. Mayor Roberts said it isn't like a normal camper that would go in Big Mike's. Vicki Caraway said there is one behind that one that looks even worse. Sandy said she was getting ready to bring up that one. It started with some regular wire fencing she thought to keep a dog in. Then all of a sudden, there's this black plastic wrapped around the fence, she guesses, sO the dogs couldn't see and become agitated. She said she believed they were the same dogs that got out and were chasing a little boy and then chasing the public works truck. Mayor Roberts told Gary he had received complaints from over there that we still have some open sewage somewhere; however, he has not been there to look yet. He asked Gary ift they could meet in the morning to take a look. Gary asked ifthey had told him where, and Mayor Roberts said he would ask again. Sandy asked the board if they got the proposal from the mobile home park on Old Vale. She said she thought it was a great proposal, and they just spelled out what they were going to do. She also says it would be great to have a proposal from Church's Mobile Home Park. Something in writing states what they are going to do to rectify the situations they are going through, even if a property management company does not manage them. Gary said they had a leak on Asa Street, but it's hard to tell when you look at a manual leader and it's turning. You don't know whether there is a leak, or someone is using water. When he turned it back on, the water immediately started moving again. He said part of this camper deal was that they would not move anything in there because that was Kim's spot, and we would allow her to move her new mobile home. Once Kim didn't move back there, we are back to having too many home sites on that property. Alderman Calvert said he wanted to make sure that he was on the same page and ensure they all heard what he thought they all heard. At the meeting that Spencer was here for, there was a question concerning a couple of the mobile homes or one in particular. It would be replaced by Samaritan's Purse or one of those other organizations. Thel board allowed specific stipulations specifically and only for those mobile homes, and he thought the rest of the Town heard that. He asked if they were on the same page. Sandy asked if he was talking about Ms. Flores and Ms. Robertson. Mayor Roberts said to his knowledge, both of them had taken their homes to different properties, and Maria was moving to Crossnore. Sandy asked what she was going to do with her old mobile home, and he said he said he didn't know. Sandy said maybe she filed a PPDR. Mayor Roberts asked if they were still doing PPDRS, and Sandy said they were. She said we put it on our website and Facebook page. It says this is the number you call, and if nobody answers, please leave a message, and they will call you back. At that point, they will send al link to fill out the application because they're not doing the meetings like before. They met in Banner Elk, Crossnore, and Elk Park, where you could go, and they would help you fill out the application. Now, you call them, and they will tell you whaty you need to do and what documents you need to submit. We put out a notice for all Newland citizens and small business owners who had debris that also needed to be picked up. The Town had to file al PPDR for our 1989 Oakwood mobile home to be removed, and we still haven't heard back from them. Alderman Calvert asked what we: needed to do to move forward with this. How do we take responsibility and do our diligence to get those moved? Because it sounds like she's going to continue to do whatever she wants to do, which is outside of what our ordinance says. He said if we do not act on this swiftly, we will end up with a second campground. Attorney McKinney passed around a drafted ordinance dealing with public nuisances. It defines it as a condition or activity regarding real property that amounts to an unreasonable interference with the community's health, safety, morals, or comfort. He said that is taking language out of the statute. Then, below, he put by way of illustration and not limitation, a public nuisance shall include campers or other easily movable residences being occupied regularly, which is not connected to the health source system or shows evidence of lease there from being disposed ofi in a safe and sanitary manner. In other words, if they arei not hooked on or showing how they are getting rid of their waste, then we are saying that's a public nuisance. He also included abandoned motor vehicles instead of having them as we did before, where they were under our junked vehicle ordinance. He said he believes it's done better here. It says public nuisances are prohibited within corporate limits and are enforceable byi injunction abatement, and the statute gives us the authority to do sO without a hearing. Sandy asked Attorney McKinney about the part that says it shall include campers or other easily movable residences that are not connected. What happens in an instance like this, where they have it connected to a sewer outlet somewhere with Church's Mobile Home Park? He said this is just an illustration and doesn't necessarily keep them prominent. It is still an unreasonable interference with the health, safety, morals, or comfort oft the Town and is still considered a public nuisance. Sandy said she wanted to make sure they couldn't get around it. Gary asked if this ordinance would be superseded because they weren't supposed to move: anything else in, to begin with. Sandy said there would be no grandfathering. Alderman Johnson asked if they could do some permit to hook onto the water and sewer before they move in, in case nobody notices when they move. Sandy said they are supposed to, but the issue with that is they are on her private property and connected to the sewer system somewhere within the park. It is the same issue with the mobile home park 011 Old Vale, They both have their own inter mobile home park system, and we have the one hook-up where we provide water and sewer. However, ifyou refer back to the health thing, that's definitely not healthy. Attorney McKinney asked ifi it was an unreasonable interference with health, and he thinks the issue is to what degree it becomes unreasonable. David Angrisani said when he and his wife Vanessa fixed up that little building at the back of their property, part of Tommy's permit inspection was to ascertain whether the addition of the toilet and the shower could run through their sewer. line. They were told that if they added anything else, they would need another connection. He said he wasn't sure it was the fact that she tapped into an existing one, but he still thinks the Town should have some oversight into how many people are tapped in. Mayor Roberts said he didn't think we. had oversight into who's allowed to tap in, and they have to get aj permit. Mr. Angrisani asked if we needed the ordinance; what are they in violation oft today that caused this whole thing to kick off? Mayor Roberts said it was a trailer park that got washed out, and our ordinance states that you are: not allowed to put anything back. He said we are trying to upgrade because there are a lot ofold and unsightly trailers over there, and it's not being kept up. When it got washed out, they decided to start rolling campers in there, and it's beginning to look like the backside of Buck Mountain, Sandy said the ordinance states that only four residences should be on an acre, Since they were grandfathered and as those residences go away, we are saying not to put anything back there. She already has like 20 residences there and a little over two acres. Sandy said the same thing goes for the one Spencer is living in. Helene ruined her mobile home, and it's still sitting there. However, she also lives in this camper which makes at least three or four that have been moved in since Helene. Gary said there were ten mobile homes in just one parcel, and that does not include the campers. He said the other side probably has ten on: it as well. Mayor Roberts asked Attorney McKinney ifhe was proposing that the board can use this to help them focus in and protect the Town? He said he didn't know the extent of the way things were in that campground. But does it meet the standard of unreasonably interfering with the health, safety, and comfort of the Town and the community? Is it such ai mess that it unreasonably interferes with the biggest concern, the health and safety of the community? Mayor Roberts asked if anyone could telll him what Attorney McKinney. just said. Attorney McKinney said we could take action after this and declare it a public nuisance. This is causing people problems now, and he doesn't believe there is grandfathering with aj public nuisance. Vicki Caraway said Spencer was told no. Sandy said she was told no twice and to move: it, but she: failed to comply either. Gary said it has probably never been looked into before, and he wasn't sure of the exact specifications, but what is the allowance for a four-inch sewer. line? Mayor Roberts said we should add something to the ordinance saying that ifyou tap into our sewer lines, you must have a permit. For the simple fact for us to know how many people are tapped in. We can't wake up one day when there are fifteen people and two meth labs who have tapped into our lines, and we didn't know about it. He asked if they needed to have another special meeting or ifthey could tell Attorney McKinney to add that. Sandy said we are talking about campers and RVs. Campers and RVs need sewer and water, sO she thinks that would be part of it. Mayor Roberts said he wanted to make sure it was broad enough. For example, when he has a chance to do his, he can't just go out there and start digging with a track hoe without Gary or someone from the Town knowing he has tapped into the system. Donetta McKinney asked if they were going to allow campers in these places in the future. Mayor Roberts said no, and Donetta said that's what she thought other than a campground like Big Mike's. Mayor Roberts said we needed to address the issue of whether you're allowed to have a camper parked in your front yard because some towns allow it. He said a house beside Church's Park should have been condemned because the roofhad been leaking for two years. A gentleman bought it, and he lives in the house part-time and the camper while he is working on the house. He said he keeps his in the County, but will the Town allow it? Sandy said they don't use their camper but keep it parked at their house. Mayor Roberts said he thought her slide-outs were out, sO it may appear that somebody might be staying there. He asked if this was something the board wanted to address. Gary said there are two things you should look at: how close is it to the street, and is it in the right-away? Like the Helene situation, don't you want to punish somebody because of a disaster or something like that, but there needs to be a timeframe. It's like we told the people in the trailer park. They could move a new trailer in, but they had one year to find a new place and get it out. Mayor Roberts said they could show an actual plan. For example, if someone stays in a camper until they receive their ChiefCares house, we ask them for paperwork to see when they are moving out and to let the clerk know what is happening. Mayor Roberts said another reason he wanted to bring up was what the Town wanted to do about private residents, like himself, having his RV parked in his yard or across the street. There is an issue with Scott Rhodes, and apparently, there is nothing in our ordinance that says he can't do what he's doing. Sandy said it was notj just parked there, but he was living in it, It would have been different ifit had just been parked there and they had not been hooking up the sewer or water, She said she feels there is a difference, but she is just one person. Mr. Angrisani asked if they were talking about the one in the alleyway, and they said yes. He said there was a pipe that goes oyer some drain. Mayor Roberts said we had an opportunity to fix all this, but our ordinançe clearly states that as long as you deliver your sewage to a safe clean-out, technically, he is. Again, we would know ifwe had aj permitting system because he would have had to come in and fill out aj permit. Sandy said as long as he's ten feet offt the street right- away. He is complying in one aspect but not in the other. Mayor Roberts said that somebody should have said that while he was getting chastised for asking these questions. Sandy said she thought Jessica had replied and given you guys the ordinance. It was the older one, but at least it said you must be off the street right-away. It said twenty-five feet at the time, but now: it is ten feet, He said the one he saw was from Alderman Hughes, saying we didn't have one. Sandy said Jessica replied to everyone with a snippet of the previous ordinance that said twenty-five feet, which would be even better, but it's only ten feet. Gary said he thought we were waiting on this meeting for more clarification on campers because we didn't really have a clear definition. Mayor Roberts asked if the board had a problem with Attorney McKinney adding permitting for water or sewer. He believes the Town Manager and maintenance should sign off on permits. Attorney McKinney said he thinks it's up to them to demonstrate that the connection is reasonably functional. Sandy said they would file for a permit, and then Gary would go out and inspect it. Alderman Johnson suggested charging a fee, and Sandy said yes, they would charge a fee for Gary to go out. Gary said he was sure it wasn't going to be fully functional because it is at least five inches where it goes in, Donetta McKinney asked how long people have been allowed to do that. Mayor Roberts said, apparently, not until tomorrow when he goes by and talks to Mr. Rhodes, She asked about how long you could have a camper on your property. Mayor Roberts said he would like to finalize that conversation on whether the Town will allow it. Great example: Sandy has one sitting in her yard. He understands what Sandy and Gary will say; that's where they parki it and enjoy it every other weekend. He's sure Mr, Caraway has one in his yard because he does a lot of camping. He asked if we would have something in the ordinance that allows town citizens to keep it on their property. Alderman Johnson said those are recreation vehicles, and they aren't living in them. They also have a house right next door they are living in. Mayor Roberts explained that his son is getting out of the Air Force next month. Since he has yet to get his man cave hooked up to sewer and water, he is going to park the RV out front, The Town has no ordinance saying anything, sO how will you stop him? He said he would argue, saying he didn't know if someone lived out there. He asked if they saw the problems they were creating. He said that's all a scenario, and that wasn't what he would do. Gary said ifhis son came up: for a weekend, he would stay in the camper because they don't have any room in the house. Mayor. Roberts said that was the point he was trying to get across. Gary asked if you could write in the ordinance that the camper cannot be a full-time residence. Attorney McKinney said hej put it in there to say that it is occupied regularly and not connected. Gary said they were thirty or forty feet off the road and way back off the driveway. Mayor Roberts said he would play devil's advocate, but his regular and your regular could be different. Attorney McKinney said you could say sO many months a year or days in a month. Mayor Roberts asked again how we determine who will stay on top of it. We have an ordinance against junk or abandoned cars, and nobody enforced it for forty years. Somebody could live in a camper for ten years until somebody actually complains about it. Nathan Gittner told Mayor Roberts that he probably wouldn't like his answer and would just go with it. He said it was the mayor and council's responsibility. The police chief will enforce any law and does a brilliant job. Mayor Roberts said the problem is that they aren't making laws; they are making ordinances. Mr. Gittner said this is the group that makes these decisions, and this is where the buck stops. Mayor Roberts told him that his big brain was so far down the road that they needed to catch up with what he was thinking. He understands what Mr. Gittner is saying and where he is going with this. Let's get to what we are actually going to say because he is trying to get to the mechanism that stops it. Mr. Gittner said this is the group who can do this, and you can do it tonight. Mayor Roberts said that's what they were there to do. Donetta McKinney asked if we could have a permit for somebody like Kenny, whose family wanted to stay for a week, or that mayor's son who wanted to come and stay. Is there something that the Town could have, and they could apply for to notify the Town that they will have somebody come and stay in their camper for this number of days? Mayor Roberts said he understood what she was saying; however, most people who live in a Town understand and know they need a permit to do certain things. Everybody knows ifyou're going to remodel a house, you'll need some type of permit because somebody will come and look at it. He sees what she is saying, but he thinks we are getting into a situation where that's such an out-of-the-normal thing. This is an out-of-normal conversation for a town; how many people will think they need to run over to the Town and see what they need? He said he wouldn't think about checking with the Town to see ifhe needed a permit. Attorney McKinney said instead of saying being occupied regularly, we could say more than seven days in a calendar month. Alderman Calvert asked what his thoughts were on ten days in case somebody wanted to stay for two weekends. Attorney McKinney said picking the number was up to the board. Alderman Johnson asked what would happen if they said recreational vehicles could be occupied full-time. He said he didn't think a board should sit here and tell people what they can and cannot have on their property. You pay the taxes, and you own the property. To play devil's advocate, there's a big difference between a camper being occupied full-time in a mobile home park and a recreational camper. And that's where you have to differentiate. Gary asked if we had any commercial property, and they said no. He said in Hickory or Conover; they would say this wouldn't be allowed in business or commercial versus residential. Sandy said we didn't have zoning. Gary asked if they needed to tackle that first, and Sandy said they had already tried that. Vicki Caraway said that mobile home parks are simply that. They are recognized as a mobile home park. There is an RV park, and it's recognized as an RV park. There are not any: mobile homes in there, and there should not be any RVs in a mobile home park. She said we could start with that designation because they are designated for particular structures. Alderman Johnson said we may need to add something saying they have to be underpinned and inspected. Mayor Roberts said if they were to underpin, then it would be permanent, Sandy said you can't pull out and take off: for a weekend if you have to underpin it. Alderman Johnson said he was talking about mobile home parks. Mayor Roberts said mobile homes should definitely be underpinned and blocked in. Kenny Caraway said the ordinance wel have right now says they are supposed to be underpinned. He said he thought the whole point they were meeting this evening was to solve the problem that was happening right now. It looks like we are looking at weeks and months down the road to figure out what we are going to do. We need to get back to fixing thej problem we have right now instead because they are considered a health hazard. Mayor Roberts said he believes the purpose oft this meeting is to fix those that are health hazards and to look ahead while we've got some time before this next meeting. That way, we don't have to come back in six months to say, well, now we've got to do this. Mr. Caraway said the employees at the town already have enough to handle. Somewhere along the line, you're going to need an enforcement officer. Who will investigate and issue violations because you can'tput this off for two or three weeks? Mayor Roberts asked Gary if we had an extra pickup truck that had a sticker on the side. He thinks it is the 250 Gary didn't drive often, and the plow could be taken off. Gary said it had the Town sticker on it. Mayor Roberts asked Mr, Caraway ifhe would like to ride around and enforce the ordinance. Mr. Caraway said if someone came in right now and went to Sandy to let her know that this was a problem, how could shel handle everything else she had going on? Mayor Roberts asked ChiefFields if they could pick one officer, and while he's out patrolling and sees something or something gets reported to Town Hall, this could be one of their additional duties. They could handle all of the paperwork and everything. For instance, Banner Elk has an officer who checks the ABC store, right? He asked Attorney McKinney ifit would be possible to tell one ofthe police officers, not all of them, but that one officer would receive any complaints. Mr. Caraway asked what would happen if someone came in and that officer was off, and we weren't sure the next time he would be on duty. Mayor Roberts said he thinks that ify you assign it to one officer, he understands that while he is out patrolling, that needs to be an additional thing he will look for. He thinks it ends up being overlooked ifs you go and tell all the officers. He asked Mr. Caraway if he thought it would be better to have all the officers doing it, and he said no,just one officer. Mr. Caraway asked who would enforce the plan Equivest submitted, and Mayor Roberts said it was Sandy right now. Sandy said it was her, along with Chief and Gary. Mayor Roberts said he thinks they need to talk with the Chief at some point and let him choose the officer that has the best personality to do that. Ift they see an ordinance violation, they can send it to him. He said the Sheriff gave them little town ordinance books back in the day, and they could go around writing town ordinance citations. Maybe we could do something like that for the Town, Alderman Calvert said he would love to find out how we will go ahead and enforce ordinances. Mayor Roberts asked Attorney McKinney if this was one way we could enforce them. Sandy said the code enforcement officer could. Mayor Roberts said the enforcement officer is additionally assigned to a police officer, and Attorney McKinney said we could do that. He said he knows we are brainstorming and asked what ifl he added to the language about being hooked into the sewage system where it says, it shall be presumed that campers within a mobile home park are considered a public nuisance. They can show you it's not, but we will presume it's a public nuisance if a camper is in a mobile home park. Mayor Roberts asked if we go that route, and Sandy and Gary would have to come in and show us that they're not in a mobile home. Sandy said he was talking about living in a mobile home park, in a camper. Attorney McKinney said you make it sound very general, but you're targeting them, Gary said you're defining a mobile home park as a mobile home park, not a campground. David Angrisani asked Attorney McKinney about the part where it says, 'not limited to.' He wondered if that ordinance passes ifit would give some teeth to Vanessa and him and the problem they are dealing with in the house next to them. Attorney McKinney said he thinks ifyou start with the general definition ofi it, then this is one illustration ofi it, but it doesn't mean that's the only one. Mr. Angrisani said he would love for this to pass, and then they could include all the other stuffi regarding public nuisances. Attorney McKinney said we. have the part about not being hooked to the sewer system. Below it, he could add that it is presumed that campers placed within a mobile home park constitute a public nuisance. That means they can come and show you that everything has been hooked up and everything is good if you want to. However, it will be presumed that you can't doi it, and you have to show that it is: not a public nuisance. Mayor Roberts asked ifwe send a newly appointed ordinance officer to tell this person they can't do this, then would they come and see Sandy to fill out paperwork? Attorney McKinney said yes, trying to prove that it was not. Mayor Roberts asked what the mechanism was after that. Mr. Caraway asked what they would do with the ones already there, and Mayor Roberts said they would be jerked out. Mr. Caraway asked who would do that, and Mayor Roberts said he had a truck. Attorney McKinney said ifi it is declared a public nuisance, the Town has the right to remove it. The State statute gives us the authority to remove it summarily. Chief Fields asked who would make that decision. Mayor Roberts said they were given the opportunity to come: in to appeal. Then Sandy will go out and look at it and say no because it doesn't meet our guidelines. He said Sandy can sometimes be too black and white and asked the board ift there could be one more layer to which Sandy could: refer. Sandy said she would email the appeal to the board. Chief Fields said that's how the process goes with most of our ordinances. Ifyou read it, it talks about starting with the Police Department, then it goes to Sandy, and then she sends it to the board. Mayor Roberts said he thinks the board needs to respond within 48 hours because he agrees with Mr. Caraway. He is tired of it taking sO long for us to get stuff accomplished. Chief Fields said a lot of these ordinances have a timeline of forty-eight hours to appeal. Mayor Roberts said with this new ordinance, the enforcement officer shows up and tells you you're out of whack. Then he tells them they can see the Town Manager to appeal this. Ifthey don't want to appeal it, then they have forty-eight hours to remove it, Buti if they come. in and appeal it, then Sandy has forty-eight hours to go and take a look at it. After she looks at it, the second set of forty-eight hours starts, and she emails the board to let us know. The board has forty-eight hours to respond. We should have an answer within a week's time to have them removed. Sandy asked if we needed to continue doing things as we had been. The clerk will fill out the form, and the code enforcement officer takes it out and tells them they are in violation. Then he writes the date and time on there, signs it, and that point is when the forty-eight hours will begin. Mayor Roberts said you didn't have to see them. You could post it on the door and take a picture as prooft that you didi it. Sandy said we could make two copies: one: for the officer to leave and one for them to bring back. Mayor Roberts said to do three sO the officer can keep one. Attorney McKinney said we have a method of dealing with abandoned and junk vehicles in that ordinance. It says you don't! thave to give them the right to a hearing or notify them. He suggested we make it as close to those guidelines as possible, sO we do not have two separate ways ofhandling things. He said he had re-drafted some of our procedures regarding abandoned junk vehicles to make them fit the guidelines of the new statute. Vicki Caraway said that Mr. Webb took offense that his vehicles were called abandoned. She asked if there was a definition that could be given to someone who considers their vehicle abandoned. Mayor Roberts said it's not licensed, the state of North Carolina does not properly tag it, and you can't walk up to it, stick a key, and crank it. Attorney McKinney said the statute doesn't do a particularly good job of doing it because, in the beginning, it talks about abandoned junk vehicles. Later on, the statute says abandoned vehicles or junk vehicles. He said there isn't a model of clarity, but there is a statutory definition of a junk vehicle. It is a vehicle that doesn't have a current license plate and one of three things. Those three things are ifit is partially dismantled or wrecked, cannot be self-propelled or moved in a manner in which it was originally intended to: move, or is more than five years old and appears to be worth less and you can plug in the amount between $100 and $500. Sandy asked ifyou only needed one of those instances to go with the other, and he said yes. Attorney McKinney said he has tried to define an abandoned vehicle and told the board they could tweak it and work with it. He said that for the purposes of this chapter, the term abandoned vehicle means a vehicle that has been left on public or private property, not owned by its registered owner, and has no apparent intent by its owner to reclaim it. In other words, somebody has walked off and left the vehicle. Mayor Roberts said to go ahead and add all of that. Attorney McKinney said it's not defined in the statute, and iti is talking about abandoned and junk vehicles the way it is drawn up. He said we can also declare a vehicle as a nuisance vehicle. Mayor Roberts said therei is a pickup truck on Summer Haven, and they keep throwing their trash in it. Attorney McKinney said it would be helpful if you could see these little orange stickers on the side of the car that's torn up, meaning they have not abandoned it; it's just torn up. Sandy asked ifthis applied to lawnmowers and tractors. Nathan Gittner said it has to be licensed, sO no. Attorney McKinney said that was true. Mayor Roberts said let's talk about that because he could get a DUI on a lawnmower. Attorney McKinney said he lost a jury trial on that. Mayor Roberts asked him if he could add something to the ordinance about motorized vehicles. Attorney McKinney said he would prefer to add an additional section because we know we are okay here. Gary asked what about a boat? Mr. Gittner said boats are. licensed, and trailers are too. David Angrisani asked why the item mattered because a pile oft trash is considered a nuisance. Mayor Roberts said that's what he thought, but when you go back to the tarps and lawnmowers, they are all considered a public nuisance and an eyesore. Donetta McKinney asked if the Town removes a junk vehicle and where they would take them. Mayor Roberts said that was a good point, and he was going to suggest that we set up a system. Then we would enter into a contract because he knows guys that will pay. Wec can tell folks the Town is taking this car, and they will get a check from the tow truck company. They will come to pick it up, take it where it needs to go, and get paid. He said he just had six vehicles junked at his mechanics because they didn't work anymore and made $1,800. Donetta asked about the towing fee, and Mayor Roberts said it would be taken out before the Town received a check. He said if we can find tow truck companies and people that will show up for the Town, we can tell them to go onto this property. We will have the police there in case of any trouble. They will retrieve it at no cost to the' Town because they will: make money off ofit when they sell it for scrap. He thinks we should offer the person who is losing their vehicle $100. Mr. Gittner asked ifthis was about the house up there around the corner, and Mayor Roberts said no, there were several. Attorney McKinney said he believes he has marching orders and can have the ordinances ready by the May meeting. Alderman Johnson asked if we needed to have a public hearing before, and Attorney McKinney said no. Mayor Roberts told Sandy before May 1st that we: needed to create the triplicate paperwork for the newly appointed ordinance officer. We need to come up with a couple of contractors willing to pick up vehicles, and they need to understand that their pay will come from the vehicle when they sell it. We: need to decide if we will offer $50 back to the previous owner. He said all oft that needs to be determined before the May board meeting. David Angrisani asked if we give them a citation and tell them to call one of the contractors to haveit removed, then they should get the proceeds. Ifthe Town calls one of the contractors asking them to remove it, the proceeds should return to the Town. Mayor Roberts asked ifeveryone felt like they had a game plan for lawnmowers, cars, RVs, campers helicopters, and boats.
