MOUNT JOY BOROUGH COUNCIL April 7, 2025, Minutes The Mount Joy Borough Council held its regular meeting on April 7, 2025. President Hall called the meeting to order at 7:00 PM. Roll Call- Present were Councilors Matthew Crider, David Eichler (via Zoom), Lu Ann Fahndrich, David Greineder, Mary Ginder, William Hall, Bruce Haigh, Philip Kark, Brian Youngerman and Mayor Timothy Bradley, Jr. (via Zoom). Staff present were Manager, Mark G. Pugliese 1; Chief Robert Goshen; Public' Works Director, Dennis Nissley; Codes and Zoning Officer, Brett Hamm; Assistant Borough Manager/lFinancial Director, Jill Frey; Grants, Projects, and Community & Economic Development Administrator, Rachel Stebbins; and Administrative Assistant, Lisa Peffley. Mayor Bradley gave the invocation, and the Pledge of Allegiance followed. Executive Session - There were no Executive Sessions held by Council between March 3, 2025, and April 7, 2025. On a MOTION by Haigh, and a second by Greineder, a request was made to accept the agenda for the April 7, 2025, Council meeting. An AMENDMENT by Youngerman, and a second by Kark, to remove 12g from the agenda. Fahndrich added the words "for the 2025 calendar year" to 13a. Amendment passes. Motion as amended carries unanimously. Public Input Period David Weiser, 616 Water St., expressed his concerns regarding DUI enforcement within the Borough. Dominic Castaldi, 1059 Reagan St., said there has been some concerns regarding the loading rations in the proposed area of development in Florin Hill and the weather this past weekend just reinforces their concerns. Fred Bean, 1112 Collina Ln., spoke on a number of issues, one of them being the impact the runoff due to the weather and construction in Florin Hill had on the neighborhood. He said he never seen anything like it before. Another issue he had was the placement of the portable toilets, dumpsters and parking location of construction vehicles. Todd Kennedy, 205 Weldon Aly., expressed his concerns about the runoff issue in Florin Hill due to the weather and construction and the impact it has on the environment. He feels the builder should be held accountable. Mitchell Scordo, 313 Brittany Ln., expressed his concerns of the impact on the wildlife in the pond from the recent runoff incident in Florin Hill due to the weather and construction. Brandon Lehman, property owner of 1087 Wood St., said he is supportive of item 12h on the. Agenda and feels the rezoning is a much better fit for that area. Chris Trave, 404 Keinath St, said he is very upset with the amount of runoff from Phase 3 in Florin Hill with the recent incident due to weather and construction and the effects it had in the community of Florin Hill. Ned Sterling, 13 W. Main St., said he is supportive of Dave Christian's suggestions regarding 12F on the. Agenda. He asked when the code violations at 15 W Main St will be addressed and also inquired about the four missing street trees and the number of trees at the new Municipal Building. Regarding Florin Hill, Hall said the Borough has had people on site Friday and Monday and there is a cease and desist order until they get things straightened out. Pugliese said the Conservation District was notified and the District told Charter Homes they had to do adjustments to correct what failed. Hall said he will have thel Manager get the equipment and portable toilets moved. Presentations Garret Moore with PFM gave a presentation of the Final Bonds for the construction of the new Municipal Services Building. Dave Christian, with the Rotary Club, gave a presentation regarding a Harold Billows Memorial in Memorial Park. On a MOTION by Haigh, and a second by Ginder, Council will issue al letter of support for a memorial of the Malmedy Massacre on Borough property. Motion carries unanimously. President Hall issued a proclamation naming April as Sexual Assault Awareness Month. 1 Report of Mayor Mayor Bradley provided his report to Council for the month of March 2025. Report of the Chief of Police Robert Goshen, Police Chief, provided a monthly written report for February 1, 2025, through February 28, 2025. The report showed 21 traffic arrests and 13 criminal arrests for the month. There was a total of 470 incidents for the month of January, with a total of 958 incidents year to date. Report of Fire Department Mount Joy (FDMJ) Brett Hamm, FDMJ Fire Chief, provided a written monthly report for February 2025. Report of PSH Life Lion LLC February 2025 report provided. Report of EMA Phil Colvin provided a written report for period February 20, 2025, to March 19, 2025. Report of the Milanof-Schock Library (MSL) Joseph Mcllhenney provided a written report for February 2025. Report of Codes/ Zoning & Stormwater Administrator Brett Hamm, Codes, Zoning & Stormwater Administrator, provided a written monthly report for March 2025. Report of Grants, Projects, and Community & Economic Development Administrator Rachel Stebbins, Grants, Projects, and Community & Economic Development Administrator provided a written monthly report for March 2025. Report of Public Works Director Dennis Nissley, Public Works Director, provided a written monthly report for March 2025. Report of the Borough Authority Manager Scott Kapcsos, Authority Manager, provided a written monthly report for March 2025. Report of the Assistant Borough Manager/Finance Officer Jill Frey, Assistant Borough Manager/Finance Officer, provided a written monthly report for March 2025. Report of the Borough Manager Mark G Pugliese I, Borough Manager, provided a written monthly report for March 2025. Approval of the Minutes of the Previous Meeting On a MOTION by Kark, and a second by Ginder, approval was given for the minutes of the regular Borough Council meeting held on March 3, 2025. Motion carries unanimously. Building Ad Hoc Committee Deering said there was no meeting held for the month of March. Major site work is now underway. In response to Sterling question regarding the number of trees, he said there will be a total of 73 trees. Administration and Finance Committee On a MOTION by Youngerman, and a second by Kark, a request was made to approve the 2025 Memorandum of Understanding with the Lancaster County Conservation District and to authorize the Borough Manager to sign and return the MOU to the Conservation District. An AMENDMENT by Haigh, and a second by Youngerman, to add the following language to item 2c1, LCCD will not issue a notice termination without prior consultation with the Municipality". Amendment passes. An AMENDMENT by Haigh, and a second by Youngerman, for 3ab to read inspections will be performed. Municipalities need to be invited to all inspections with emphasis on initial compliance, origination compliance and termination inspection". Amendment passes. An AMENDMENT by Haigh, and a second by Youngerman, to add the following language to 3d, LCCD will thoroughly consult with Municipality of all proposed enforcement actions". Amendment passes. An AMENDMENT by Haigh, and a second by Youngerman, on page 4 under, Municipal Responsibilities 1 insert a new paragraph b, moving all the other ones down, "Notify LCCD of any earth disturbance activities involving between 5,001square feet and one acre of earth disturbance. Amendment passes. Motion carries unanimously as amended. 2 Youngerman acknowledged receipt of the GSAB 75 Information Report for the fiscal year ending December 31, 2024. On a MOTION by Youngerman, and a second by Kark, a request was made to authorize the Council President Hall & Assistant Borough Manager Frey to attend the PSAB Annual Conference & Exhibition in Hershey, PA from June 1 - 4, 2025, and to pay for or reimburse expenses as provided by Section 701 of the Borough Code. Motion carries unanimously. On a MOTION by Kark and a second by Ginder, a request was made to grant access easement to Cornerstone Lot W4 to KCI/Kinsley Properties. Motion carries 8-1, Youngerman voting no. On a MOTION by Youngerman, and a second by Ginder, a request was made to authorize the Manager and Council President to meet with VistaBlock developers to discuss an agreement with regards to the Chiques Crossing project for the benefit of Mount Joy Borough. Motion carries unanimously. On a MOTION by Youngerman, and a second by Kark, a request was made to authorize staff to begin the process of rezoning a portion of Wood Street from Light Industrial to Medium Density Residential. An AMENDMENT by Haigh, and a second by Youngerman, a request was made to allow Borough staff to revise section 270 62 NN. Amendment passes. Main motion as amended carries unanimously. Report of the Public Safety Committee On a MOTION by Fahndrich, and a second by Crider, a request was made to have the Borough sponsor the following events for the 2025 calendar year and carry appropriate liability for said events; Car Show and Cuisine, National Night Out, Fall Fest/Spooktacular Event, and Winter Fest. Motion carries, Hall voting No. Report of the Public Works Committee On a MOTION by Greineder, and a second by Youngerman, a request was made place the Pickleball Courts in Borough Park by Kunkle Field along North Market Street should financial resources become available. Motion carries unanimously. On a MOTION by Ginder, and a second by Greineder, a request was made to approve the request from Saint Luke's Episcopal Church for the use of Memorial Park on June 29th from 10:00 am until noon. Motion carries unanimously. On a MOTION by Ginder, and a second by Greineder, a request was made to award the base bid for the 2025 Roadway Project, Contract #2, Walnut Street paving to Pennsy Supply, Inc. in the amount of $130,760.72. Motion carries unanimously. On a MOTION by Haigh, and a second by Greineder, a request was made to approve the contract to RETTEW's for stormwater management for the Compost Site at 200 S. Jacob Street. Motion carries unanimously. Public Input Period RaeAnn Schatz, property owner of 1090 W Main St., asked if the modifications to BMP 127 & 107 will happen in 2025. David Weiser, 616 Water St., said he feels the DUI arrest in the Borough have been down in the last four years. Josh Deering, 33 Frank St., thanked the Public Work Department for putting the Donegal Championship sign up. He thinks al EV charging station would be a good addition to the Municipal Building project. Dave Christian, 227 Park Ave., presented five things to Council that he would like Council to consider for the upcoming meeting with the developer of Chiques Crossing. Any other matter proper to come before Council Haigh passed out and reviewed a checklist he compiled of multiple concerns he has/had with Florin Hill. Youngerman commented on his previous questions/comments at last month's Council meeting with the developer of Florin Hill and the Jurisdictional determination for the unnamed tributary to Donegal Creek. Eichler said in regards to the Borough resident that commented on the Police Department and his concerns regarding the number DUI arrests in the Borough, that he has the upmost respect, trust and confidence in the Mount Joy Borough Police Department and seeing that there are no other complaints he has no concerns regarding this issue. He said there are 14 lights out on Henry Street that should be looked into. 3 Authorization to Acknowledge the Payment of Bills On a MOTION by Youngerman, and a second by Kark, Council approved paying the bills as presented. Meetings and dates of importance See the yellow calendar for the month of April. Executive Session Council went into Executive Session at 10:30pm, to discuss a pending legal matter.
