Chairman Sayer presided with Commissioners Michael Bennett, Frankie Teasley and Joey Dorsey were present. Commissioner Jeff Brown was out of town. 1. Prayer Commissioner Dorsey offered prayer. 2. Commissioners Reports Commissioner Bennett thanked all the volunteer firefighters and first responders for risking their health and lives to help protect Hart County citizens from major fires within the last weeks. Commissioner Teasley echoed Commissioner Bennett's thanks to the volunteer firefighters and Public Safety workers. Also, Commissioner Teasley offered condolences to Hart County Coroner Mike Adams and family members on the loss of Coroner Adams' Mother. Commissioner Dorsey offered condolences to the Adams family as well. 12. Old Business a) Chapter 46 Land Development Amendment (3rd Reading) Commissioner Dorsey moved to accept the 3rd and Final Reading of Chapter 46 Land Development Amendment and approval of the Amendment with the changes. Attorney Zac Parkard, Staff Council of the National Association of Home Builders Association addressed the Board concerning the national housing crisis. Minimum three acreages will add greatly to the cost of a new home, therefore homeowners are being priced out of the market. Home construction is a significant driver of jobs in Hart County, with a reduction of home building, reducing income for construction workers. Mr. Parkard and the NAHB feel two different standards are applied to two similarly situated sets of individuals. Performance bonds are a financial barrier to developers. Chairman Sayer quoted economic findings that in an area comparable with Hart County, residents with one child will need to build a one-million dollar home for tax revenue to cover services offered. Chairman Sayer further stated, the State provides the standards being applied too different individuals. Commissioner Dorsey explained the Hart County Level I, II, III subdivision ordinances were enacted to help control the growth while trying to maintain as much of the rural areas of Hart County as possible. Commissioner Dorsey also stated we are proud to have one of the lowest tax millage rates in the State of Georgia. Commissioner Teasley provided a second to the motion. The motion carried 3-1. MEMORANDUM Terrell Partain, County Administrator May 8, 2025 RE: Item 12 E Amendment to Chapter 46 Exemptions I believe we have left a time requirement out ofthe final Ordinance. During most if not all oft the debates and conversation concerning the division of property, specifically the exemption (3) One division of land into two total parcels, each parcel being of a minimum size od one (1) acre or sufficient size and standards to meet requirements oft the health department, whichever is greater. There were multiple discussions as to what time period would have pass before either parcel could be divided again. This is not listed in the current Ordinance. I have had a few that were divided and re-divided again in a matter of weeks since the ordinance went into force. This allowed them to take an original parcel of 4 acres or more and divide it the first time into 2 lots of2 acres or more then file the plats, then come right back and divide those 2 into 4 one acre lots. Allowing a subdivision consisting of 4 or more one acre lots instead requiring the three-acre minimum lot size requirement of the subdivision ordinance would have required This is a loophole that I assure you will be exploited and used to circumvent the requirements on subdivision lot size. Requiring larger lot sizes for subdivision lots was the purpose of amending the original Ordinance. The Board makes the rules, it is my. job to enforce them, but I believe this was an oversite that will not allow the desired effect on growth to be achieved without making another amendment to specify the minimum time period between splits covered under this exemption. We still have the old dock that we damaged during Helene the question is what do we do with the old dock. Do we take the usable parts and modify to replace one ofthe smaller docks at one of our other park / ramp locations? Salvage it? Etc. We can probably replace an existing dock but to add an additional dock we would have to go through the permitting process with the Corps of Engineers. I'm looking for guidance. MEMORANDUM Terrell Partain, County Administrator May 8, 2025 s RE: Item 12 G Addition of Powerlift stretcher mount to ambulance purchase We approved the emergency purchase of a new ambulance several meetings ago. Since then, there have been new state and federal requirements announced by the Office of EMS and Trauma that will go into effect in January of 2027 requiring different types of stretcher mounts that meet a new federal requirement. Although the information is not very clear about retrofitting existing units with one of the two approved mounting systems, we feel that we should go ahead and have the approved mounting system that corresponds with our stretchers to install this in the unit while it is being completed. There is an additional cost involved that was not in the original approved purchase. The original approval amount needs to be amended to add this. Archway WHEREAS, the Participants agree to cooperate in the development, and the Hart County Archway Partnership focusing on community and economic implementation, continuation of County; and development issues for Hart WHEREAS, the Participants agree to the creation or continuation ofthe Hart Executive Committee (the "Executive County Archway Partnership Committee") to offer the Community Partners representation and influence into the strategic planning and management of the Hart County appropriate Partnership. Archway NOW THEREFORE the parties hereto agree as follows: SECTIONI The UGA Partners shall: 1. Agree to facilitate the work of the Executive Committee in support oft the overall goals oft the Hart County Archway Partnership. 2. Subject to Section III, Paragraph 7 herein, employ a UGA faculty member (the Professional") who will dedicate time as needed to the project and work directly with "Archway the Hart County Archway Partnership's Executive Committee. Such Archway Professional may, in the sole discretion oft the UGA Partners, be a full- or part-time employee ofUGA. 3. Establish minimum qualifications and determine the total salary to be paid to the Archway Professional, and agree to perform periodic evaluations ofthe Archway Professional in with UGA human resources rules and regulations as any other UGA employee. accordance 4. In either such case, the UGA Partners agree that they will seek to replace the Archway any in accordance with the qualifications and salary guidelines described in Section 1, Professional 3 herein and subject to Section III, Paragraph 7 herein. Provide the Archway Professional with access to office equipment, supplies, publications, or other educational materials necessary to the performance of the position's S duties. 6. Keep an accurate record of all funds received and disbursed under this agreement including all support documents. The UGAI Partners agree to retain such records for a period ofthree years unless an audit has begun and not been completed or if the audit findings have not been resolved at the end oft the three year period. In such cases, the records shall be retained until the audit is complete or until the resolution ofthe audit findings. The UGA Archway Partnership also agrees to retain all records relating to payments made under this agreement until the expiration of three years after final payment. 7. Report to the Executive Committee at regular intervals on the nature oft the Hart County Archway Partnership and progress being made. SECTION II The Hart County Partners shall: 1. Agree to recognize the UGA Partners as their institutional partners and provide appropriate recognition of the collaborative working relationship on all appropriate and relevant publications, materials and web sites. 2. Agree to cooperate with the UGA Partners in the implementation and administration of educational opportunities for the students of the University of Georgia. 3. Agree, when possible, to make available internship opportunities to the students of the University of Georgia and other University System of Georgia institutions in conjunction with community- identified needs and the terms of this Agreement. 4. Agree, when possible, to make available research opportunities to the faculty ofthe University of Georgia and other University System of Georgia institutions in conjunction with community- identified needs and the terms of this Agreement. 5. Agree to make available to the UGA Partners any research or study findings and results that may be realized as a result of this Agreement. Notwithstanding anything hercin to the contrary, all research or study findings and results fromi research conducted by faculty ofthe UGA Partners shall remain the property of the UGA Partners. SECTION III The Participants Mutually Agree: 1. The OVPPSO will contribute to the UGA Archway Partnership as needed in order to support the activities ofthe Archway Professional and the UGA Archway Partnership; however, this paragraph shall not be read or construed SO as to create any cost share on the part of UGA or any of the UGA Partners. 2. The Hart County Partners will pay to the UGA Archway Partnership a total FIXED FEE of$50,000 for the period beginning on July 1, 2025 through June 30, 2026 (the "FY2026 Community Fee"). Expenditures and budgetary allocations for the FY2026 Community Fee will be based on history and may vary depending on community needs. The Archway Partnership is authorized to transfer funds between various expenditure and budgetary categories and accounts without specific and separate approval by any ofthe Hart Partners. Subject to any such transfers, the expenditures and budgetary allocations for the FY2026 Community Fee are anticipated to be as follows: Operating & Project Costs 40% Personal Services 40% Travel 20% 6. The Hart County Partners and the UGA Partners agree to the creation or continuation of the Hart County Archway Partnership Executive Committee who shall perform the following functions: a. Remit or cause to be remitted the FY2026 Community Fee to the UGA Archway Partnership when due. b. Provide guidance on the appointment or hiring of the Archway Professional. The actual appointment or hiring oft the Archway Professional shall be subject to the sole approval of the UGA Partners. C. Evaluate the financial support of the Hart County Archway Partnership annually, make adjustments as necessary for continued effective support, and notify the UGA Partners of any adjustments no later than March 31, 2026. d. Agree to locate the Archway Professional's office in facilities that are adequate and appropriate for the program. 7. The Archway Professional shall remain at all times a University of Georgia employee, subject to all applicable university guidelines and policies, and shall not be an employee of any of the Community Partners while performing this service and will not be entitled to fringe benefits normally accruing for employees of any oft the Community Partners. 8. This Agreement shall take effect as of July 1, 2025. 9. The terms of this Agreement shall be from July 1, 2025 through June 30, 2026. Either the UGA Partners (acting collectively) or the Community Partners (acting collectively) may terminate this Agreement upon 90 days written notice of such intent. 10. This Agreement may be modified by mutual written agreement oft the parties hereto. 11. This agreement, along with any exhibits, appendices, addenda, schedules, and amendments attached hereto, emcompasses the entire agreement of the parties, and supersedes all previous understandings and agreements between the parties hereto, whether oral or written. 12. This Agreement may be renewed annually by mutual written agreement of all parties. There are standards of certification and or licensing required before any volunteer assisting in any county function could be covered.
