Public Comment Lea Lashley, 500 Sawgrass - stated that a neighboring property located at 501 Sawgrass was cleared for development but has since been ignored as ifa abandoned. She would like to see an ordinance passed that would not allow developers to abandon property. 3.a Receive Report Regarding the March 25, 2025 City Council Meetings and discussion of same. Chairman Tunnell acknowledged receipt of the March 25, 2025 Council Meeting regarding P&Z items covered at the March 4, 2025 Planning and Zoning meeting. 3.b Discussion and Action Regarding the Minutes ofthe January 7, 2025 and March 4, 2025 Regular Meetings and the March 12, 2025 Work Session. MOTION MADE: GORDON SECONDED: RUSZKIEWICZ APPROVED: PASSED UNANIMOUSLY BY THOSE PRESENT ABSENT: HEINKELE 3.C ZA-2025-01: Hold a public hearing and consider a request from Grant Keller, on behalf ofthe owner Beth Jackson, for a change in zoning from (AG) Agricultural District to (PD-LR) Planned Development District and for approval of a concept plan for (LR) Local Retail land uses, being an 11.057-acre tract ofland, situated in the E. Teal Survey, Abstract No. 207, City of Heath, Rockwall County, Texas. (RCAD PID 12818) Director of Economic Development David Gonzales stated that the required public notice was published, posted, and mailed to 27 properties within 500 feet on March 13, 2025. No notices returned in opposition or in favor of the zoning request were received. The applicant is requesting to change the zoning from (AG) Agricultural District to (PD-LR) Planned Development District for Local Retail District land uses on an 11.057-acre vacant parcel of land. The purpose ofthe zoning change is to facilitate the development of eight non-residential sites that will include four medical offices, a daycare center, a bank, and two lots whose use will be determined later. The development of the site will be completed in two phases. Phase one will include a proposed PNC Bank with a drive-through on Lot 1 and a medical office on Lot 2. Phase two will contain three medical offices on Lots 3, 5, & 6, with a daycare center located on Lot 4. All of the lots are greater than one acre in size and meet the density and dimensional Planning & Zoning Minutes - April 1, 2025 Page 1 of3 requirements of Section 159.27, Local Retail District Regulations. The proposed PNC Bank will require approval of a Conditional Use Permit (CUP) to allow for a drive-through facility. This will be included as a condition ofa approval of the Planned Development District and will require a separate public hearing. The medical office, bank, and daycare center are a mix of land uses that could be considered appropriate fort this area;however, a change to the zoning ofthe subject property and a zoning map amendment is a discretionary decision for the City Council pending a recommendation from the Commission. Applicant Grant Keller, Vaquero Ventures, 2627 Tillar Street Suite111, Fort Worth, TX, was present to answer anyo questions. Project Coordinator Consultant, Keenan Young, was also present to clarify the lot and the proposed uses. HEARING to receive comments regarding the request. Chairman James Tunnell opened the public hearing at 7:13 p.m. Mike McClard, 217 Blue Heron, stated the Concept Plan should be taken into account when matching the proposed buildings with the Towne Center Overlay. The daycare does not seem like a good idea with the school and added traffic. Tunnell closed the public hearing at 7:16 p.m. Discussion and action regarding the request. Michael Rizzolo, Bannister Engineering, 240 N. Mitchell Rd, Mansfield, TX, was also present to answer questions and stated that they will work with the staff to make this work. After the Commissioners discussed the proposed uses, the consensus was to table the item and allow the applicant to consider amending their plans to meet the Towne Center Overlay standards for building design, decrease the amount of impervious coverage of the lots, address the potential use(s) for lot 7, and review the proposed draft ordinance for this development. MOTION MADE: GORDON SECONDED: BISHOP APPROVED: PASSED FIVE TO ONE For: BISHOP, GORDON, RASK, SHAW, TUNNELL Against: RUSKIEWICZ ABSENT: HEINKELE Commissioner Ruskiewicz stated that he opposed and was in favor of approving the base zoning that is consistent with the Comprehensive Plan. 3.d PP-2025-01: Discuss and consider a request from Carroll Consulting Group, Inc., on behalf ofthe owner 3-Gen-Contractors, LLC, for the approval of a Preliminary Plat for aj proposed residential development containing ten (10) single-family lots, and being a 14.614-acre tract ofland, situated in the Antonio Rodriguez Survey, Abstract No. 231, City of Heath, Rockwall County, Texas, and zoned for (PD-SF) Planned Development District land uses, located on the southeast side of S. FM- 549 and across from Bison Meadow Lane. (RCAD PID 109143) Director of Economic Development David Gonzales stated that the applicant, Carroll Consulting Group, Inc., has requested approval of a preliminary plat for a 14.614-acre tract of land located at the southeast side of S. FM-549 and across from Bison Meadow Lane for the purpose of constructing 10 single-family residential lots and two common areas as open space and drainage easements. The open space and drainage easements will be maintained by the HOA. The lots within this subdivision exceed the minimum one-acre developable net of right- of-way, floodplain, and water bodies. A: 10-foot-wide trail system will be constructed adjacent to thel lots within the subdivision, and meandering through Lot 11X open space, crossing Tenth Avenue, and connecting to Lot 3 on the opposite side oft the roadway. The applicant provided a tree survey that is consistent with the approved concept plan in terms of placement. This results in a total deficit of 99 inches due for mitigation. The applicant has noted on the treescape plan that the additional trees will be planted at the time of construction ofthe. home sites.
