Notice hereby given that the City Council of the City of Cumby, Texas will conduct a Regular Meeting on MAY 13th, 2025 I 6:00PM I 100 E Main St, Cumby, TX. 75433. " If you wish to speak, you must follow these guidelines Presentation by Citizens Guidelines: The Mayor will recognize those citizens who have signed up prior to the start of the meeting. Pursuant to Resolution No. 2020-12 Citizens are given three minutes (3:00) to speak during "Presentation by Citizens. " Members of the public may only speak once and cannot pass the individual's time allotment to someone else. Direct your comments to the entire Council, not to an individual member. Show the Council members the same respect and courtesy that you expect to be shown to you. The Mayor will rule any disruptive behavior, including shouting or derogatory statements or comments, out of order. Continuation of this type of behavior could result in a request by the Mayor that the individual leave the meeting, and if refused, an order of removal. CITY COUNCIL COMMENTS Pursuant to TEX. GOV'T CODE 551.0415, the Mayor, a City Council member and Staff may report on the following items of community interest:(1) expression of thanks, congratulations or condolences (2) information about holiday schedules (3) recognition of individuals (4) reminders about upcoming events organized or sponsored by the City Council (5) Information about community events and (6) announcements involving imminent threat to public health and safety. CONSENT AGENDA & DEPARTMENT REPORTS All matters listed under this item are considered routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired by any Alderman on any item, that item will be removed from the consent agenda and will be considered separately. 6.1. Approval - Fire Department Activity Report 6.8. Approval = Building Permit Report 7. NEW BUSINESS 7.1. Discussion/Action: Canvass of May 3rd Election Results Allocation 1.5% Sales and Use Tax In accordance with Texas Election Code S 67.003, the governing body of the political subdivision shall canvass the results of the election not earlier than the 3rd day or later than the 11th day after election day. The City Council is required to officially canvass the results oft the May 3rd, 2025 election regarding Allocation of 1.5% Sales and Use Tax, which proposed the adoption of a local sales and use tax at a rate of one-fourth of one percent (0.25%) Election Results: Votes in Favor: 21 Votes Against: 24 7.2. Discussion/Action: Discussion and possible adoption of Ordinance 2025-05-01, establishing Line/Denton St. as a one-way northbound from Green St to Mill St. Proper signage and public notification would be required prior to implementation. This was a recommendation from 2 of the 3 contractors that we met with regarding the repair of city streets. (Mayor, Amber Hardy & City Secretary, Miranda Randle) 7.3. Discussion/Action: Review bids from paving contractors for street repair. This will be a budget item in the upcoming FY Budget meetings and will need to go out for official RFP. However, we have been meeting with contractors over the last several weeks to have an idea of what street repairs will look cost-wise as we can begin to make preparations. Discussion/Action: Resolution 2025-05, a resolution authorizing the imposition of a $10.00 monthly Street Maintenance Fee to be collected through the City's water utility billing system, with funds deposited into a dedicated Street Maintenance Fund for the purpose of maintaining and improving public streets. City residents have brought to the Council's attention the deteriorating condition of many local streets and expressed concerns regarding safety, drivability, and long-term infrastructure stability. The City Council recognizes the need for dedicated funding to address these issues. This resolution would authorize a $10.00 monthly fee per active water account. The fee will be collected through the utility billing process and allocated solely to a Street Maintenance Fund, which will be used only for street repair, maintenance, and improvement projects. Discussion/Action: UPDATE on Amending Ordinance 0-2023-003 Water Schedule of Services and Rates including adding rate for 2" & 4" water meters. The Public Utility Commission of Texas is conducting a rate study. (Phyllis Brown, PUC) 8.2. Discussion/Action: Update on possible purchase of Cumby United Methodist Church. The City offered $150,000 for the church and they counter offered at $175,000 (Mayor Pro-Tem, Alderman 1, Brandon Phipps) 8.3. Discussion/Action: Codification of City of Cumby Ordinances & Resolutions - The City of Cumby is considering an agreement with enCodePlus to codify its ordinances and resolutions. The total cost for this project is $3750.00, with a 10-day turnaround time. This package will include Site Design and Build, a website designed for easy navigation, easing transparency as well as ongoing support for the site. Discussion/Action: Update on various grants and other potential funding requests by City of Cumby (Alderman 5, Rosina Duckworth, and Miranda Randle, City Secretary) 9.
