Background: Pursuant to the Texas Election Code, Chapter 67, Section 67.003 the governing body is required to canvass the precinct election returns for the election not earlier than the 3rd nor later than the 11th day after the May 3, 2025 election. The City ofLavon had two items on the May 3 ballot: Proposition A to reauthorize the one-half cent sales tax dedicated to city street repair and maintenance. Proposition B to create the Lavon Municipal Development District and the imposition of a sales and use tax at the rate of one-half of one percent (0.50%) for the purpose of financing development projects beneficial to the district. The unofficial results of the election are below. Proposition A For: 187 (77.92%) Against: 53 (22.08%) Proposition B For: 20 (21.51%) Against: 73 (78.49%) The unofficial election results that were provided on May 3, 2025 after the polls closed were produced directly from the Collin County Elections Office tabulation system. The Collin ABF - Canvass Sales Tax Election County Elections Administrator has provided a certified full, true, and correct tabulation, audit, and count of the votes cast. Note, pursuant to state law, two members of the City Council constitute a quorum for purposes of canvassing an election. Attachments: Proposed Ordinance Election Results CITY OF LAVON ORDINANCE NO. 2025-05-05 Canvass May 3, 2025 Election Results AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAVON, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE MAY 3, 2025; PROVIDING AN EFFECTIVE DATE; AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL THERETO. WHEREAS, the City Council ofthe City ofLavon, Texas (the "City Council") duly authorized a Special Election to be held within the City ofLavon, Texas (the "City") and the Estra Territorial Jurisdiction (ETJ) on May 3, 2025 (the "Election"), for the purpose of submitting to the qualified electors of the City and ETJ the propositions hereinafter set forth; and WHEREAS, this City Council has investigated all matters pertaining to said Election; and WHEREAS, the Election officers who held said Election have duly made the return of the results thereof, and said returns have been duly delivered to this City Council; and WHEREAS, the City Council finds and declares that the meeting at which this Ordinance is considered is open to the public as required by law, and that the public notice ofthe time, place and purpose of the meeting was given as required by Texas Government Code, Section 551.041, as amended; and WHEREAS, state law requires that the governing body of the City ofLavon canvass all City ofl Lavon municipal elections. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAVON, TEXAS: Section 1. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. Section 2. It is officially found and determined that said Election was duly ordered, that proper notice thereof was duly given, that proper Election officers were duly appointed prior to said Election, that said Election was duly and lawfully held, that due returns oft the result of said Election have been made and delivered, and that this City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said Election. Section 3. It is officially found and determined that the following votes were cast at said Election on the submitted proposition by the resident qualified electors ofthe City who voted at said Election: PROPOSITION A 187 VOTES FOR THE REAUTHORIZATION OF THE LOCAL SALES AND USE TAX IN THE CITY OF LAVON AT THE RATE OF ONE HALF OF ONE PERCENT (0.50%) TO CONTINUE PROVIDING REVENUE FOR MAINTENANCE AND REPAIR OF MUNICIPAL STREETS. THE TAX EXPIRES ON THE FOURTH ANNIVERSARY OF THE DATE OF THIS ELECTION UNLESS THE IMPOSITION OF THE TAX IS REAUTHORIZED. 53 VOTES AGAINST The number of votes by which the proposition was approved: 134 Total Votes Cast: 240 PROPOSITION B 20 VOTES FOR THE CREATION OF THE LAVON MUNICIPAL DEVELOPMENT DISTRICT AND THE IMPOSITION OF A SALES AND USE TAX AT THE RATE OF ONE-HALF OF ONE PERCENT (.50%) FOR THE PURPOSE OF FINANCING DEVELOPMENT PROJECTS BENEFICIAL TO THE DISTRICT. 73 VOTES AGAINST The number of votes by which the proposition failed was: 53 Total Votes Cast: 93 Section 4. That the City Council finds and determines that the sales and use tax proposition carried at the election, and that the City Council is accordingly authorized to levy the sales and use tax to continue providing revenue for the maintenance and repair of municipal streets in accordance with the authority granted in the proposition at the rate of one half of one percent (0.50%), to continue providing revenue for maintenance and repair of municipal streets. Section 5. That the City Council finds and determines that the Municipal Development District proposition failed at the election, and that the City Council will not create the Lavon Municipal Development District and the imposition of a sales and use tax at the rate of one-half of one percent (0.50%) for the purpose of financing development projects beneficial to the district. Section 6. That the tabulation of votes cast, attached as Exhibit "A" and incorporated herein, for the purpose of reauthorization of a local sales and use tax in the City of Lavon at the rate of one half of one percent (0.50%) to continue providing revenue for the maintenance and repair of municipal streets, in the special election held on May 3, 2025 is hereby adopted as the official tabulation of the City and is hereby ordered filed and recorded in the official records of the City ofl Lavon as the official canvass of said election. Section 7. The City Secretary is authorized and directed to send to the Texas State Comptroller of Public Accounts by United States certified or registered mail, a certified copy of this Ordinance in accordance with state law.
