MINUTES OF THE CITY COMMISSION OF THE CITY OF DUMAS, TEXAS REGULAR MEETING TUESDAY, APRIL 15, 2025 CALL TO ORDER: Mayor Brinkmann at 11:30 A.M. A motion was made by Commissioner Brooks, seconded by Mayor Pro Tem Sims, and passed unanimously to approve the 04/01/2025 Regular City Commission Meeting Minutes, as presented. A motion was made by Commissioner Barr, seconded by Commissioner Willis, and passed unanimously to approve the Consent Agenda, as presented, with the following items: Bills to be paid. Mayor Brinkmann opened the Formal Session Apartment complex owner, Ronnie DeShazo, presents a request for the Commission to reconsider the former decision to charge residential facilities with master water meters as commercial properties. He explains that his complex is an income-based complex and goes on to break down the dynamic ofthe tenants who live in the units. He continues by explaining how the commercial utility rate increase has affected his tenants. Commissioner Willis asks City Manager, Mark Hall, if the utility staff have looked into how many residential dwellings are running on master meters in town. Mr. Hall lets the Commission know that all dwellings that utilize a master meter are being charged the commercial utility rate. The Commission asks Mr. Hall to clarify what determines if a rental property will be charged commercial utility rates verses residential utility rates. He states that if the renter has the utilities under their own name, they will be charged a commercial rate. City Attorney, Bryan Guymon, requests personnel from the utility billing department to answer the Commission's questions. City Secretary, Bethanie Kemp, redirects Mr. Hall's statement by clarifying that the determining factor in which rate a tenant will be charged is based solely on if the property is running off of a single water meter for the dwelling, or if the dwelling is running off ofas shared master water meter between two or more other dwellings. There was question on how many complexes are running on master water meters, to which Mrs. Kemp states she can look into it and have that information presented as soon as possible. Mayor Brinkmann questions the billing software utilized by the city, asking if there is a way to differentiate commercial properties and apartment complexes that utilize master water meters. Mrs. Kemp lets the Commission know that the current billing software being used does have the option to bill in different rate codes, sO all that would need to be done on the back end ofthe billing portion is to create a new rate code for the apaiment complexes who have master water meters. Mr. Guymon adds that the city would need to revise the current ordinance to add a category for this change if the Commission decides to approve the reconsideration. Mr. Guymon goes on to makes the argument that he believes the city is aligned with the state norm in the way they are currently charging apartment complexes on master water meters as commerçial properties. He ençourages city staff to look into surrounding cities around the size of Dumas to see how they are charging their master meter residential customers. Mayor Brinkmann ultimately directs city staff to look into similar-sized surrounding towns and if they are billing apartment complexes on a commercial level, what the budget-impact would be should the Commission decide to make this adjustment to all apartment complexes, what steps would need to be taken in order to implement the adjustment in the billing system, and to invite public comment by making a Facebook post. Mayor Pro Tem Sims requests a mock ordinançe in the instance the Commission decides to approve the utility adjustment. No further action was taken on this item at this time. Building Official, Javier Pena, presents Ordinançe No. 1240 - Zoning Change, to the Commission. He lets the Commission know that the Zoning Board has approved it, and City Attorney, Bryan Guymon reminds the Commission that this item has been approved by them in a past meeting as well, there was never an ordinance drafted up for the zoning change and that's why it's being presented now. A motion was made by Commissioner Barr, seconded by Mayor Pro Tem Sims, and passed unanimously to approve the first reading of Ordinançe No. 1240 Zoning Change, as presented. Finance Director, Shannon Wallace, presents a contract with the county for Assessment and Collection Services which will give the county permission to collect property tax for the city. She states this is an annual contract between the city and county. A motion was made by Commissioner Brooks, seconded by Commissioner Willis, and passed unanimously to approve the Contract for Assessment and Collection Services, as presented. The Commission has decided to skip items 11 and 14 on the agenda due to logistics at this time, however, they will be heard at a future meeting. Director of Park Services, Tom Carter, presents a bid for pool slide restoration at the City of Dumas Aquatic Park. He lets the Commission know that this bid is the only bid that was received. He goes on to let the Commission know that due to the company that will be fulfilling the work on the slides not being able to get the project done before the pool season starts, they have discounted the bid $5,200.00. He states the slides are safe to use for this season, and the project will be completed by October 1, 2025. A motion was made by Commissioner Barr, seconded by Mayor Pro Tem Sims, and passed unanimously to approve the bid by Slide Guys for $64,240.00 to restore the slide surfaces, as presented. Director of Park Services, Tom Carter, presents a bid for pool filter media at the City of Dumas Aquatic Park. A motion was made by Commissioner Barr, seconded by Mayor Pro Tem Sims and passed unanimously to approve the bid by Sunbelt Pools for $55,407.20 to replace pool filter media, as presented. During the City Manager report, Mr. Hall notifies the Commission that he has coordinated a Strategic Planning Meeting, scheduled for Thursday, April 24, 2025, from 6:30 p.m. to approximately 8:00 p.m. During Items from Commissioners, Mayor Pro Tem Sims lets the rest of the Commission know that he and Public Works Director, Isidro Renteria, are still working on water wells. He states they have located five wells that they are interested in refurbishing. He goes on to say they will go through the official bid proçess to accomplish this. He states they will also be looking into going through the bid process for the above ground storage tanks as well to ensure they are up to code with TCEQ. Mayor Brinkmann makes a statement encouraging citizens to be responsible with their water usage coming into the spring and summer seasons. He requests citizens to alternate watering days, as well as watering during evening hours verses during the heat of the day.
