MINUTES OF THE TOWN OF ARGYLE PLANNING AND ZONING COMMISSION REGULAR MEETING WEDNESDAY, APRIL 2, 2025 A regular meeting of the Argyle Planning and Zoning Commission was held on Wednesday, April 2, 2025, at 6:00 PM. This was an OPEN MEETING, open to the public, subject to the open meeting laws of the State of Texas and, as required by law, was hereby posted on March 28, 2025 at 5:00 PM, at Argyle Town Hall, giving notice of time, date, place, and agenda thereof. PLANNING AND ZONING COMMISSION MEMBERS PRESENT: Paul Kula, Chairman David Snell, Vice-Chair Matt Nelson Martin Brading Marilyn Lewis Mike Udovic PLANNING AND ZONING COMMISSION MEMBERS ABSENT: Courtney Mitchell STAFF PRESENT: Brenda McDonald, Town Attorney Harrison Wicks, Director of Community Development REGULAR MEETING AGENDA CALL TO ORDER - Chairman The regular meeting was called to order at 6:06 PM by Chairman Kula noting a quorum was present. PLEDGE OF ALLEGIANCE - American Flag PLEDGE OF ALLEGIANCE = Texas Flag "Honor the Texas Flag; I pledge allegiance to thee Texas, one state, under God, one and indivisible". OPEN FORUM: Pursuant to Section 551.007 of the Texas Government Code, any member of the public has the opportunity to address the Planning and Zoning Commission concerning any matter of public business or any posted agenda item; however, the Act prohibits the Planning and Zoning Commission from deliberating any issues not on the public agenda and such non-agenda issues may be referred to Town staff for research and any future action; all persons addressing are limited to five (5) minutes and subject to council adopted rules and limitations permitted by law. Chairman Kula opened the meeting to public comment. With no speakers, Chairman Kula closed the open forum at 6:07 PM. CONSENT AGENDA 1. Consider approval of the minutes of the Regular Planning and Zoning Commission Meeting of March 5, 2025. Minutes of the April 2, 2025 Argyle Planning & Zoning Commission Page 2 of 4 Commissioner Udovic motioned to approve the minutes of the Planning and Zoning Commission Regular Meeting of March 5, 2025, as presented. Commissioner Lewis seconded the motion. The motion carried unanimously by a vote of six (6) in favor to none (0) opposed. ACTION ITEM 2. Discuss, consider and make recommendation on a Final Plat application (FP-25-003) for High Plains Trail Lots 3X, 4X, 5X, Block 15, being 7.66 acres in the FW Thornton Survey, Abstract No. 1244, Town of Argyle ETJ, Denton County, Texas. Director of Community Development Harrison Wicks provided a presentation on the item. Applicant Jason Weaver with GM Civil Engineering and Surveying answered questions related to the plat application. Commissioner Brading motioned to recommend approval to Town Council for Final Plat application (FP-25-003), as presented. Commissioner Nelson seconded the motion. The motion carried unanimously by a vote of six (6) in favor to none (0) opposed. PUBLIC HEARING TEMS 3. Hold a public hearing, consider and make recommendation on a Site Plan Request (SP-25- 001) with proposed variances to the Single Family Residential Estate = (SF-2.5) zoning district standards, for the proposed Tribes Church on a tract of land, known as Lots 15 and 16, Block A, Woods of Argyle, in the F.W. Thorton Survey, Abstract 1244, located at 809 FM 407 W, Town of Argyle, Denton County, Texas. Director of Community Development Harrison Wicks provided a presentation on the item. Applicant Matthew Holtman answered questions related to the site plans for the Tribes Church. The Commission discussed the item and considered the site plan request. Chairman Kula opened the public hearing at 7:19 PM. With no speakers, Chairman Kula closed the public hearing at 7:20 PM. Commissioner Brading motioned to table the Site Plan Request (SP-25-001), for the proposed Tribes Church, to the Planning and Zoning Commission meeting on May 7, 2025. Commissioner Lewis seconded the motion. The motion carried unanimously by a vote of six (6) in favor to none (0) opposed. 4. Hold a public hearing, consider and make recommendation on a Site Plan Request (SP-25- 002) with proposed variances to the Agricultural (A) zoning district standards, for the proposed Argyle Independent School District's Elementary School on a tract of land known as Argyle Middle School No. 1, Lot 1, Block A, in the Patrick Rock Survey, Abstract 1063, located at 750 FM 407 W, Town of Argyle, Denton County, Texas. Director of Community Development Harrison Wicks provided a presentation on the item. The Commission discussed the item and considered the site plan request. Applicant Jeff Koehn with AISD answered questions related to the site plan for the elementary school. Chairman Kula opened the public hearing at 7:59 PM. With no speakers, Chairman Kula closed the public hearing at 7:59 PM. Commissioner Nelson seconded the motion. The motion failed by a vote of three (3) in favor to three (3) opposed. Vice-Chair Snell and Commissioners Udovic and Brading dissented. Vice-Chair Snell motioned to recommend approval to Town Council for site plan request (SP-25- 002), with the following condition: That the applicant provide three (3) additional 3" caliper inch trees and three (3) additional 4" caliper inch trees within the perimeter of the playground area of the elementary school. Commissioner Udovic seconded the motion. The motion carried by a vote of four (4) in favor to two (2) opposed. Chairman Kula and Commissioner Lewis dissented. 5. Hold a public hearing, consider and make recommendation on an ordinance amendment (TDS-25-002) to Article III, Zoning, of the Town of Argyle Town Development Standards regarding amendments to Section 14.3.53 = Form Based Zoning Districts and other related provisions in the Town Development Standards. Director of Community Development Harrison Wicks provided a presentation on the item. The Commission discussed the item and considered the ordinance amendment request. Applicant Ryan Kagay answered questions related to the amendment. Chairman Kula opened the public hearing at 8:43 PM. With no speakers, Chairman Kula closed the public hearing at 8:43 PM. Vice-Chair Snell motioned to recommend approval to Town Council for ordinance amendment request (TDS-25-002), with the following condition: That the Food Service Use definition be amended to delete Cafeteria and Snack Bar terms and add Limited-Service Use and Counter Service Use terms. Commissioner Lewis seconded the motion. The motion carried unanimously by a vote of six (6) in favor to none (0) opposed. FUTURE AGENDA AND ITEMS OF INTEREST 6. Active Development Project List Town staff provided the commission with recent development project updates and gave an overview of upcoming projects. ADJOURNMENT Commissioner Nelson moved to adjourn the meeting. Chairman Kula seconded the motion. The motion carried unanimously by a vote of six (6) in favor to none (0) opposed at 8:54 PM.
