TOWN OF HAH T GAFTONSVILNE 1892 Meeting Minutes ofTown Council on April 1, 2025 As reviewed, approved, and accepted by the Town Council on May 6, 2025 There being a quorum, Mayor Charles Hendricks called the regular meeting ofthe Town Council to order at 7:58 p.m. The meeting was held using video conferencing. Council Members Charles Bradsher, Tom Burke, Amy Koval, and Christina Pellegrino were present. Town Treasurer Angela Hoffman, Town Clerk Mary Burke, Assistant Clerk James Schneider, Historic District Commission Chair Jennifer Sizemore, and approximately 21 residents or guests were also present. Declare Decision on Whether to leave the Record Open or Close the Record on the above stated proposed Zoning Ordinance Text Amendment Mayor Hendricks recommended that the record remain open. He noted that the Planning Commission needs to review this proposed Zoning Ordinance Text Amendment. Council Member Pellegrino agreed and made a motion to keep the record open. Council Member Koval seconded the motion. Unanimously approved. Approval of Minutes The minutes of the Town Council Meeting held March 4, 2025, were approved as submitted. Treasurer's Report Treasurer Hoffman reported that from February 2025 Balance Sheet, ARPA Funds have been moved to the General Fund. From the Profit & Loss Sheet, the two major forms ofincome for the month of February were interest income of $8,071 and income tax receipts of $56,542, which, with the other smaller income, brings our total income to $65,125. The main expenses were the waste collection of $6,515 and payroll of $4,635. We did have some furnace repairs of $3,284. Our total town expenses for the month $23,597, which leaves us a net income of $51,866 for the month of February. Council Member Bradsher made a motion to approve the Treasurer's report subject to audit. Council Member Koval seconded the motion. Unanimously approved. www.laytonsvile-mdus Post Office Box 5158 e Laytonsville, Maryland 20882 e Office 301-869-0042 1 Town Hall e 21607 Laytonsville Road e Laytonsville, Maryland Historic District Commission Report Jennifer Sizemore Historic District Commission (HDC) Chair, reported the Laytonsville HDC is authorized to accept and approve Historic Preservation Tax Credit Applications, and have received two applications as of today's deadline, We actually put together a web page that was added to the town website which explains who can qualify for the tax credit, and how to go about applying for it. We're using the Montgomery County application for now. Planning Commission Report Planning Commission Member Brian Kline, reported that the Planning Commission met several times last month and will meet again on April gth to work on the Comprehensive Plan. Mayor Hendricks stated that he hopes the Planning Commission also reviews the proposed Zoning Ordinance Text Amendment. Unfinished Business Discussion of draft Ordinance 01-25 Mayor Hendricks offered an amendment to draft Ordinance 01-25, which he had circulated to Council members before the meeting. He explained that the amendment makes mostly technical corrections. The key substantive change to the original draft would increase to six feet from five feet the height of fences allowed in non-historic residential zones without a special exception. Council Member Koval seconded the proposed amendment. Mayor Hendricks invited the public to comment on the proposed amendment when the public hearing on the draft ordinance resumes. He said that the draft ordinance with the proposed amendment would be posted on the web. New Business Discussion and possible approval of a proposal from Scates Corporation to install a new TPO- surface roof above the porch on Town Hall Mayor Hendricks explained what was previously proposed and discussed compared to what is now being proposed. The main change is the material to be used (a color sample was given to Town Hall) and the price slightly more ($6,750). Council Member Burke stated that this material appears to be a good fit for this project. Council Member Pellegrino agreed. Council Member Koval made a motion to approve the proposed estimate from Scates Corporation and submit it to the HDC. Council Member Burke seconded the motion. Onanimously approved. 2 Appointment of Election Judges Mayor Hendricks explained the annual terms of election judges for the town. He proposed Ms. Joy Jackson, Mr. Michael Mauer, and Mr. Christopher Bresnan as this year's S election judges. Council Member Pellegrino made a motion to confirm those individuals as election judges. Council Member Burke seconded the motion. Unanimously approved. Announcement of Candidate Filings Town Clerk Burke reported that the next town election is on Monday, May 5, 2025. Charles Hendricks is the only candidate for Mayor. The only candidates for the two Council Member seats are Amy Koval and Tom Burke. Approval ofLindsey and Associates as town auditor for the current fiscal year Mayor Hendricks reported that Lindsey and Associates have been the Town Auditor for about twelve years. This firm is asking for a 3% increase to do the audit. Discussion ensued. The new cost is $10,850, $350 more than last year. Council Member Burke stated that the new proposal was as comprehensive as usual. Council Member Koval agreed. Council Member Pellegrino made a motion to approve Lindsey and Associates as Town Auditor for the next fiscal year. Council Member Bradsher seconded the motion. Unanimously approved. Request from the Laytonsville Lions Club Foundation for a sponsorship to help fund a community center in Laytonsville Mayor Hendricks explained that there is an annual Golf Outing to raise funds for a community center in Laytonsville and what was done by the Town Council towards this last year. Council Member Koval mentioned the Community Survey showed support for a community center. Council Member Pellegrino agreed, stating that the Lions Club does a lot to support the town. Mayor Hendricks suggested a $1,000 donation towards this cause. Council Member Burke made a motion to approve a $1,000 donation towards a sponsorship for the annual Golf Outing by Laytonsville Lions Club. Council Member Koval seconded the motion. Unanimously approved. 2025 First Quarter Safety Inspection Council Member Koval reported that there was a large white plastic envelope in the firepit on Town Hall property. She stated that there were three areas of raised sidewalks: Dwyer Court, across from Stadler parking lot, and a manhole cover askew at Higgins Road. The streets in all areas have some cracking and wider cracks were found in the asphalt on the walking path at Jones Farm Pond. Significant cracking was found at the end of Cracklin Road near the sod farm, and all cul de sacs areas seem to have more cracking than the roadways. There were two significant potholes: on the Higgins Road side of the Firehouse, and in the middle of Warfield Road. 3 Council Member Pellegrino stated that the county 311 line has been very effective for reporting issues with county roads. Mayor Hendricks stated that sealing cracks on asphalt paved trails and roads is needed. The Second Quarter Safety Inspection is to be completed by Christina Pellegrino. Bulk Trash Pick Up Town Clerk Burke reported that Tuesday, April 22nd, > which is Earth Day is Bulk Trash Pick Up Day. She read the requirements for residents. This is posted on the town website. Resident's) Forum Mr. Dave Stadler mentioned that the asphalt at the end of Rolling Ridge Lane is in disrepair. Mayor Hendricks replied that there is a common driveway that serves several lots in Rolling Ridge. He explained that property easements govern the division of responsibility for the maintenance of this common driveway, assigning different responsibilities to the various lot owners it serves and to the area homeowners' association. The mayor stated that he is examining whether the town bears any responsibility for the deterioration of this common driveway. Mr. Lu Romano requested any updates on the Barberry and Birdie Lane trails. Mayor Hendricks stated that the Parks & Trails Taskforce has had several discussions on this. We have been very concerned regarding changes within ARRO Consulting, and we have been looking for other consultants to help with this. Mr. Chris Bresnan described a possible surface material called Turfstone that can be used on these trails. Mayor Hendricks is looking into using this material for the Birdie Lane trail. Ms. Jill Ruspi stated that there are several components impacting these trail projects, and it is a very complex situation. Council Member Koval asked ifthe lattice material is similar to what was being considered for the Miller Park-Barberry Lane trail. She asked about fulfilling the ARRO contract. Mayor Hendricks stated that yes, we have a contract, but it appears that neither ARRO nor the town is eager to move forward with this contract. Mr. Eric Wenger asked about the sidewalk along the shopping center. Mayor Hendricks explained that the public right of way is not as large as was anticipated. This is not a very easy thing to work out. He asked about putting together a task force to bring a desirable idea to the shopping center owner. Mr. Wenger stated that such a project would benefit the shopping center with safe access to the shops. He asked about contacting the state for assistance with this project. Mayor Hendricks confirmed that the engineering work has been completed showing what area is public right of way and what area is shopping center property. This would be a challenging engineering design effort. 4 Mr. Brian Kline agreed with Mr. Wenger's comments and mentioned how such a project would make Laytonsville become more walkable.
