RESOLUTION TO AMEND CHARTER TOWN OF KURE BEACH, NC WHEREAS, the citizens in a special election by ballot and by a majority vote held on Tuesday, May 3, 1994, voted to amend the Town Charter of Kure Beach, North Carolina, which was incorporated by the North Carolina General Assembly of the State of North Carolina; and WHEREAS, the citizens of the l'own of Kure Beach, North Carolina desire to elect the Mayor of the Town instead of being elected among the Town Council; and WHEREAS, General Statute 160A-101, allows any city to alter its form of government by adopting any one or combination of options prescribed by this statute; BE IT, THEREFORE, RESOLVED that in accordance with North Carolina General Statute 160A-102, the Town Council of the Town of Kure Beach, North Carolina hereby adopts this resolution of intent to amend its Charter and the amendment is hereinafter set out in detail: Sec. 3.4. Mayor and mayor pro tempore. The mayor shall be elected by the qualified voters of the town beginning in the municipal election of 1995 and his/her term shall be for two (2) years. In case of vacancy in the office of the mayor, the remaining members shall elect his/her successor for the unexpired term. The duties of the mayor shall be to preside at all meetings of the town council; to be the official head of the town for the service of process, for ceremonial purposes, and shall be so recognized by the governor of the state in connection with the military law; shall have power to administer oaths and take affidavits; shall sign all written contracts entered into the council by on behalf of the town and all other contracts and instruments executed by the town, which by law require the mayor's signature. The mayor shall have the same power as other members of the council to vote upon any question, or upon the appointment of officers, but he shall have no power to veto. The mayor shall exercise such powers and perform such duties as are or may be conferred upon him by the general laws of North Carolina, by this charter, and by the ordinances of the town. At its organizational meeting the council shall elect one (1) of its members, mayor pro tempore, to preside in the absence of the mayor, and to act as mayor in the absence of or during the disability of the mayor. In the event of a vacancy in the office of the mayor, the mayor pro tempore shall act as mayor until a mayor is elected by the council pursuant to this section of this article. The term of office of the mayor pro tempore shall be two (2) years. RESOLUTION Whereas, the Town of Kure Beach, North Carolina, at its regular meeting of February 15, 1994, was presented with a petition under GS 160A-104 by its citizens to initiate a referendum on the proposed charter amendment hereinafter set out; whereby the citizens may elect its own mayori and Whereas, the petition hereinabove presented purports to bear the signatures and resident addresses of a number of qualified voters of the Town of Kure Beach equal to or more than ten percent (108) of the whole number of voters who are registered to vote in the Town of Kure Beach elections; and Whereas, the T'own of Kure Beach requests that the Board of Elections verify the signatures on said petition as required by lawi and Whereas, the Town of Kure Beach upon verification of the petition hereinabove mentioned requests that said Elections Board conduct a special election on May 3, 1994, at the Town Hall of Kure Beach wherein a binding vote will be held on the following issues: (1) Should the Mayor of Kure Beach, North Carolina, be elected by the voters? - Yes (.
