COMMITTEE REPORTS: Community Partnerships Committee: Mrs. Marshall, Chairman, reported that Committee recommends legislation be prepared expressing the intent of the City of Troy to negotiate jointly with other cities in the region on one price schedule under which street lighting services shall be provided. The current ten-year street lighting contract expires at year end. The Miami Valley Communications Council (MVCC) negotiated the expiring contract and is willing to negotiate the next contract on behalf of the participating communities. Report submitted by Severt, Twiss and Marshall. Discussion. Mr. Schilling asked if the new contract could lead to a reduced cost for the new metal poles that will be installed along part of the West Main Street improvement Project. Mr. Titterington indicated that the cost of those poles was based on the pricing in the current expiring ten-year contract and that pricing under a new contract would likely be more costly based on inflation over the past ten years. Recreation & Parks Committee: Mr. Whidden reported that Committee recommends legislation be prepared authorizing the Board of Park Commissioners to advertise for bids and enter into a contract for a replacement bucket truck for the Park Department in an amount not to exceed $185,000. ORDINANCE ADOPTED ORDINANCE NO. 0-15-2025 AN ORDINANCE CHANGING THE ZONING OF PARCEL ID. NO. COMMENTS OF THE MAYOR: Mayor Oda commented that she was glad to see the pavement grinding on W. Main Street as that is an indication that the West Main Street Improvement Project is nearing completion. COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington noted: -There had been a number of social media posts regarding the annual Spring Cleanup at Riverside and Rosehill Cemeteries with some citizens expressing displeasure regarding how this was handled, including statements that the City had not strictly enforced the cleanup in the past and that items were taken from grave sites that had been left in prior years. Mr. Titterington commented that for at least 20 years the City has scheduled a spring cleanup (3- 15 through 4-14) and a fall cleanup (10-1 through 10-31)when Cemetery Department employees remove items from the gravesites to allow for maintenance and advance notice is provided that citizens should remove items from the gravesite prior to the start of the cleanup period and that citizens may return permitted items to gravesite after the cleanup; this notice is provided well ahead of the cleanup to citizens by permanent posted signage, news releases, social media postings, and the cleanup period is stated within the rules and regulations available at Riverside Cemetery and which are given to persons when lots are purchased; the rules and regulations are specific as to what can and cannot be placed at 20,400 gravesites to show respect for the gravesites and to discourage vandalism, graffiti and theft and to allow for the maintenance of cemetery grounds; the rules and regulations allow for approved landscaped areas for the placement of allowed items; the removal of items is not disrespectful; some years weather and workloads for burial preparations may not allow for staff to be as diligent in enforcing the rules and regulations as they have been this year; and the enforcement does follow the rules and regulations and timeframe that has been in place for several years. -Effective 6-2-2025, City Hall hours are changing to be open Monday - Thursday 7:30 a.m.-5:30 p.m. and Friday 7:30 a.m. noon. The change is intended to provide citizens with additional access to City Hall offices and services during the additional open hours. -Council authorized accepting the donation of a new ambulance from the UVMC Foundation and contracting to provide primary EMS services to the UVMC Campus. The ambulance has been received and is scheduled to be placed in service May 1 provided all additional equipment is received. COMMENTS OF MEMBERS OF COUNCIL: -Councilmembers noted that the past week included some fires, including one where some firefighters suffered minor injuries, and first responders responding to a death tragedy. Councilmembers stated they are thankful for the response to these items and that there were not more severe injuries. It was also noted that donations are being accepted for the fire victims. -Mrs. Snee commented that the change in City Hall hours may be helpful to some citizens. CITIZEN COMMENTS: -Branden Meyer, 249 Chapel Court, presented a petition to stop the connection of New Castle Drive in the Reserve at Washington development to New Castle Drive in the Fox Harbor Subdivision. The petition noted concerns of increased traffic and safety hazards, preservation of the neighborhood character, potential decline in property values, and lack of current community support. Mr. Meyer also commented that non-residents may use the connection as a cut-through to do vandalism in the neighborhood. Mr. Titterington noted that the connection is a part of the approved developments, and stated staff will review the petition. April 21, 2025 Page Three -Several citizens spoke regarding the Cemetery Spring Cleanup, commenting that rules have not been evenly enforced; that they have photos of gravesites where items were left that are similar to items removed from their gravesites; that items that have been allowed to remain at gravesites for several years were thrown away; that the cleanup went beyond general maintenance and was more of a disregard" for those buried and their families; childrens' toys were removed from the stone of a child; that flags were disrespectfully thrown in a dumpster; that the City Administration was not listening to the residents' concerns; and had questions regarding having solar lights, landscaped areas, and who is permitted to work on a gravesite. Those who spoke were: Brad Boehringer, 105 Crestwood Drive; Chad Morgan, 1114 Long Street; Ken Miller, 510 Michigan Avenue; Laura Schide, 1142 Bunker Hill Drive; and Julie Anderson, 74 Tamworth Drive. Mr. Morgan stated that he had contacted the Ohio State office in charge of cemeteries. In response, it was noted that the rules and regulations are always in place and items placed that do not follow those regulations may be removed at any time; it is during the two annual cleanups that there is a concerted effort to remove non-permitted items. It was suggested that citizens always consult with the Cemetery Foreman/Department prior to placing items in the cemeteries. Regarding the flags, it was stated that those in the dumpster were not placed there by City employees, but care was taken that the flags did not touch the ground. It was also commented that items may be placed on a gravestone base that is larger than the stone or a landscaped area defined in the rules and regulations. There was discussion that the City does not place the small flags in the veteran flag stands and is it usually youth groups that remove and replace those flags. It was noted that the City does not have records on the heirs for many of the gravesites as there are over 20,000 gravesites, many dating back years, sO it is not possible to individually reach out to the current person responsible for the sites. It was also noted that only the owner of a gravesite is to maintain it. Mr. Twiss commented that he was sorry items were removed from gravesites that citizens may have wanted to keep, and indicated he did not believe items were intentionally removed and that the best effort is being made to maintain the cemeteries. This project includes replacing the chlorine process from gas to solids; lime slaker 4; and three meters. This will reduce the negative impact of a chlorine leak, rupture or failure. The current estimate including contingency funds is $2,275,000, which exceeds the budgeted amount by $100,000. However, the additional funds are available within the fund balance of the Water Fund. RECOMMENDATION: (to be read at Council meeting) Iti is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for the Chlorine Gas Conversion Project at the Water Treatment Plant at a total cost not to exceed $2,275,000. Pierce, Chairman Buildings & Utilities Committee DETAILED REPORT: This Committee met April 28, 2025, regarding bidding the Chlorine Gas Conversion Project at the Water Treatment Plant (WTP). Also attending the meeting were Mayor Oda, Council President Rozell, Council Member Whidden, thel Director of Public Service and Safety, citizens, and members of the City staff. The consulting firm of Jones & Henry Engineers, LTD was authorized to design this project. The project will decrease the risk while increasing the resiliency of the WTP by replacing chlorine gas with sodium hypochlorite as determined to be more cost effective over onsite generation. A chlorine leak rupture or failure could have a negative impact on residents and result in extended down time of the WTP. This project also includes the replacement of lime slaker 4 and replacement of the WTP backwash flow meter, the WTP high zone flow meter and the WTP low zone flow meter. Replacement of the lime slaker will result in more efficiency and replacement of the meters will allow the documentation of accurate recording of flow as required by OEPA. It was discussed that while there may be some increase in operational costs, no additional staff is required, and the primary benefit is the safety for the community. A draft agreement was authorized by Council in May of 2024 but was not executed by the County or West Milton. A new: 20-year agreement would gradually reduce their surcharge from the current 10% to 2.5% over the life of the agreement. If West Milton declines to sign the agreement, that community would continue to have a 10% surcharge, or other options would be explored. RECOMMENDATION: (to be read at Council meeting) Itis the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety to enter into a Master Water Service Agreement with the Board of Commissioners of Miami County and the Municipality of West Milton, with provisions retroactive to January 1, 2024. Pierce, Chairman Buildings & Utilities Committee DETAILED REPORT: This Committee met April 28, 2025, to again consider a Water Agreement between the City, the Board of County Commissioners of Miami County, Ohio, andi the Municipality of West Milton, Ohio. Also attending the meeting were Mayor Oda, Council President Rozell, Council Member Whidden, the Director of Public Service and Safety, citizens, and members of the Citystaff. Troy has been providing water to areas of Miami County since 1977. The last twenty-year agreement expired in December of 2023. In May of 2024, Council authorized a new agreement that remained relatively unchanged with a 10% surcharge, increased flow rate from one million gallons per day (MGD) to 1.1 MGD and switched from a twenty- year agreement to a five-year agreement that can auto renew up to four times. This agreement was presented to but never signed by' West Milton or Miami County, as Miami County proposed other discussion items. Staff has now negotiated an agreement with Miami County that would gradually reduce their surcharge from 10% to 2.5% over the life of a twenty-year agreement, as shown on the attachment. Modified rate terms are in return for various language clarifications and timeframes. The contract would be retroactive to January 1, 2024. The City may elect to acquire County-owned water utility assets that are part of an annexation plat at no cost unless there is outstanding debt on the system. IfWest Milton chooses not to sign this new agreement, Troy would continue to sell them water at the existing 10% surcharge rate, or other options would be explored. City staff recently requested proposals from qualified insurance providers for a program that would offer benefits fully paid by the employee. Staff recommended that an agreement be authorized with the American Fidelity Assurance Company. That company will provide all the lines of insurance requested, provide additional services to assist employees in making insurance decisions, and assist staff with the administration and payroll deduction processes for the voluntary coverages. Offering these voluntary benefits is at no cost to the City. Council consideration is required as the benefit premiums would be paid through payroll deduction. RECOMMENDATION: (to be read at Council meeting) It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety to execute a Master Employer Services Agreement and any related documents with American Fidelity Assurance Company for voluntary insurance benefits for full-time employees. Snee, Chairman Personnel Committee DETAILED REPORT: This Committee met April 28, 2025, regarding authorizing a company to offer voluntary insurance benefits for full-time employees. Also attending the meeting werel Mayor Oda, Council President Rozell, Council Member Whidden, the Director of Public Service and Safety, citizens, and members of the Citys staff. The City recently requested proposals from insurance providers for rates and information regarding voluntary employee benefit programs provided by the provider. As a result of the process, City staff recommended that the City contract with the American Fidelity Assurance Company for such a program. That company provides all the lines of insurance the City requested, which include accident, cancer, critical illness, disability, hospital indemnity, life insurance, and flexible spending accounts for those on a PPO plan. Employees have the option of selecting any, all or none of these voluntary options. These plans are optional, are totally paid by the employee through payroll deduction, and all riski is the responsibility of the insurance company. The provider will offer individual meetings with employees regarding the City's group health insurance options as well as the new optional voluntary benefits in an effort to assist employees in selecting his or her best options. Services also include assisting staff with benefit administration and payroll deduction processes. Council consideration is required as the benefit premiums would be paid through payroll deduction. The property is located on Commerce Center Boulevard north of McKaig Road. The land is currently vacant. County zoning of R-1AAA, One Family Residential is present to the south. The property is bounded by interstate 75 to the east. It is important to note that the property has multiple zoning districts on the same lot. The majority of the lot is currently zoned M-2 Light Industrial District. See Exhibit A Zoning Map. DISCUSSION: The Zoning Code describes the proposed M-2 Light Industrial District as "Purpose. The "M-2" Light Industrial District is designed to provide for industrial uses, which can be operated in such a manner as to conform to the applicable performance standards specified in the district. These performance standards regulate such uses in order to prohibit congestion and for the protection of adjacent residential and business activities. The Comprehensive Plan's Future Land Use Map displays this property as future light industrial land. In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to base decisions. Staff analysis can be found in Red below: (A) Whether the change in classification would be consistent with the intent and purpose of this Zoning Code. Section 1131.02(0) & (r) state the purposes of the Zoning Code are to preserve and enhance property value, and direct particular land uses to the parcel of land best suited for them. The proposed rezoning request achieves these purposes. PUBLIC HEARING: Due to the straight forward nature ofi the rezoning request, the compliance with the City of Troy Comprehensive Plan, and the fact that City Council is required to hold a public hearing if the request proceeds on, staff does not feel that a public hearing before the Planning Commission is warranted. RECOMMENDATION: It is staff's opinion that the proposed rezoning will achieve the desired M-2 Light Industrial District as identified in the City of Troy's Comprehensive Plan. The temporary maintenance of traffic will continue through the winter. Turning left into and out of McDonalds along West Main Street is prohibited. Street lighting has been ordered and will be installed by Miami Valley Lighting but will be delayed for several months due to delivery and contractor schedule coordination. Crews are milling and final asphalting the south side of West Main Street. Once this is complete, traffic will be switched to compete the north side with final course asphalt. This should all occur in the next two weeks. 0 WWTP Expansion - Phase 1 of the project is complete. Phase 2 additional CIP items are progressing, and the total construction will be under the initial authorization. Recreation Update: o Dayton Feis Irish Dancing event was held at Hobart Arena Saturday, April 26. There were approximately 520 competitors from the Midwest competing. Items of Interest Engineering Department May 2, 2025 PROJ # PROJECT TITLE PROJECT STATUS PUBLIC WORKS AND CITY FACILITY PROJECTS Council authorized Strand Associates, Inc. to design improvements along West Main Street from Market Street (i.e. Public Square) to I-75. Both project phases have been awarded federal funding totaling $5,508,383, ODOT Urban Paving Program for $860,000 and OPWC grant for $600,000 (Phase 2 only). Phase 1: Council granted authorization for Phase 1 of 99,000,000. The contract was awarded to Double Jay Construction, Inc. of Englewood, Ohio. The contactor has completed Phase 1 construction. Phase 2: Council authorized the Phase 2 project to bid at a cost not to exceed $8,000,000. The project was West Main Street (SR 41) Corridor awarded to Milcon Concrete, Inc., in the amount of $6,789,958.48. Turning left into and out of McDonalds along improvements (PID 108662 and West Main is prohibited. Street lighting has been ordered and will be installed by Miami Valley Lighting but will be 110253) delayed for several months due to delivery and contractor schedule coordination. Crews are milling and final asphalting the south side of West Main Street. Once this is complete, traffic will be switched to complete the north side with final course asphalt. This should all occur in the next 2 weeks. All questions for the West Main Street improvements can be directed to mainstimprovements@primeeng.com. We appreciate your patience during this complex street improvement project! 2018-12 The project was awarded federal grant fund of $2,578,867 in Spring 2024. Project construction is anticipated to West Main Street and Experiment Farm being in the Summer of 2028 (SFY 2029). Council authorized the consultant to provide the ODOT requested Road/South Stanfield Road Intersection Feasibility Study for the intersection sO that design can be finalized. American Structurepoint is completing this Improvements (PID 121678) 2018-014 phase of the project. Council approved an agreement with Strand Associates, Inc. for the following items: FEMA submission of new flood plain boundaries, design of ditch improvements, especially around bridges, negotiations of easements with residents for staff to enter the ditch for maintenance, and public education information to provide to residents along ditches in the City. With onsite construction complete, staff is working with Strand to revise the flood plain along Kidder Ditch Modeling & Rehabilitation Kidder Ditch and submit it to FEMA. Door hangers were placed along the ditch to remind residents of their obligation to maintain their portion of the ditch since the project has been completed. Staff along with Strand is evaluating the possibility of assisting residents currently in the flood plain to apply for a Letter of Map Amendment (LOMA's). 2018-015 The project is located along South Stanfield between West Stanfield and the Meijer entrance. LJB designed the South Stanfield Road improvements construction project and RB Jergens was awarded the of the project at a cost of $1,750,906.56. Construction is set Phase 2 2019-015 to begin the week of May 5, 2025 and continue through November 2025. Council authorized an agreement addendum with Hazen & Sawyer to provide design services for the plant expansion to increase capacity. Council authorized $14,000,000 for the construction project. The contract was WWTP Aeration Blower Replacement awarded to Peterson Construction in the amount of $10,777,000. Phase 1 of the project is complete. The Phase 2 Expansion additional CIP items are progressing. Phase 2 portion of the project has been value engineered, and the total construction will be under the initial authorization. Contractor is expected to remobilize in June 2025. 2020-003 1 of 3 Items of Interest Engineering Department May 2, 2025 PROJ # PROJECT TITLE PROJECT STATUS Council approved an agreement with Miami County in June 2022 related to the design of the waterline extension to Casstown. Troy will own the portion of the waterline along Staunton Road (SR 55) between Stonyridge Avenue and Casstown Waterline Extension Sayers Road. The County awarded the construction project to Tom's Construction Inc of St. Henry, Ohio in the amount of $5,421,198. Council authorized the final agreement between the city and Miami County on this project. 2022-002 Construction will begin in May 2025. Choice One Engineering is completing the ODOT requirements for the resurfacing grant dollars. Stage 1 plans will Experiment Farm Road Resurfacing submitted 2022-011 be to ODOT in November 2025. Council authorized $225,000 for LJB Inc. for the conceptual design/study phase of the Downtown Safety, Streetscape, and Utilities Improvement Project. City staff and the design team have hosted two public meetings for feedback from the public. The team received comments and is finalizing a path forward as well as finalizing the design scope. Council authorized the Phase 2 design at a cost of $617,370. Design continues; a public meeting will be forthcoming in the Spring of 2025. A presentation to Council as a Committee of the Whole regarding possible Downtown Safety, Streetscape, and Prouty Plaza landscape designs was held February 24, 2025; and a presentation to Council as a Committee of the Utilities Improvement Project Whole regarding the Downtown Safety, Streetscape, and Utilities improvement Project was held March 10. Comments were analyzed for final design and the final design is progressing. Routine design updates and other information will be sent out via sretscape@toypnogow Information can also be found at wiopegpetscape 2023-003 Council awarded the Design/Build contract to Brumbaugh Construction, Inc of Arcanum, Ohio at a cost not to Park Maintenance Building 2023-010 exceed $1,825,000. The building was delivered last week to Duke Park. The Low Head Dam Removal project has over $7.5 million in funding for the completion of the dam removal, shelf and rec trail. Staff continues to apply for additional grant funding to maximize City funding for the project. Staff sent Low Head Dam Removal RFPS for design of the dam and river improvements to qualified consultants. After reviewing the submissions and interviews, Council approved a professional services agreement with Burgess & Niple for the project design. Design for the project continues with data collection and processing. Environmental permitting has started. 2023-011 Council approved an agreement with American Structurepoint of Columbus, Ohio for the design of the intersection. A stakeholder meeting with nearby businesses, facilities, and schools was held earlier in the year. A public open Adams Street & Riverside Drive- house occurred on February 26, with feedback to be reviewed and the design phase to continue. Utility companies Staunton Road Roundabout have been contacted for the movement of a couple of poles. Staff will be requesting Council to approve 2024-007 authorization to bid in the coming month. Phase 16 of the sidewalk program encompasses Carriage Crossing Subdivision and locations of missing gap Sidewalk Program 2024 (Phase 16) sidewalks along West Main Street. Staff is finalizing design for the missing gap sidewalks program. On November Carriage Crossing and Missing Gap 4, Council approved the Resolution of Necessity in order to send letters to the affected property owners. Letters along West Main Street were sent to the affected property owners who had until mid-February to obtain permits to complete the work on their own. Plans are being prepared for bid. Council authorized bidding of the repair/missing gap program. SUBDIVISION PROJECTS The preliminary plan for The Reserves at Cliff Oaks (previously the Swank Farm along Fenner Rd.) was approved by the Planning Commission on March 13, 2024. The final plat for Phase One was approved by City Council. The Reserves at Cliff Oaks Construction continues with pipe testing and culvert installation along Fenner Road. The contractor continues to 2024-005 work to install sanitary sewer along the eastern side of the Edgewater Subdivision. Phase 2 of the planned development is along N. Market Street across from Nottingham Subdivision/Loxley Lane. Halifax Villas & Patio Homes PD Houses are being built in Phase 2. 2024-001 This property is located west of the intersection of West Market Street and Nashville Road. At Council's December 4, 2023 meeting, the rezoning to PD-R and the General Plan were approved. Final Development Plan was 2023-015, Somerset Reserve PD-R approved by Council on October 4, 2024. Earth moving and pipe installation of sanitary sewer and water continues. 2025-004 Phase 2 is submitted to staff for review. 2022-013; Section 6 received final acceptance from Council, and construction continues. Council authorized Section 7's final Halifax 2023-012 plat and construction began. The preliminary plan, final record plat and construction drawings were reviewed; comments were sent back to the 2022-014 Fern Way developer and the developer's engineer. Staff is awaiting resubmittal by the developer. 2021-02; Section 8 public improvements are complete and under the M&G period. Section 9 houses are being approved for 2022-009, Fox Harbor construction. Phase 10 final record plat was approved by Planning Commission March 21, 2024. Council approved 2023-009 Phase 10 on June 3, 2024. Phase 10 housing construction has begun. The preliminary plan for Liberty Meadows was presented to the Planning Commission and approved. Staff is 2021-11 Liberty Meadows working with the developer to review construction plans for Phase 1. This property is located along North Dorset Road/Lytle Road.
