MINUTES - REGULAR SESSION TOM BEAN CITY COUNCIL 201 S. Britton St., Tom Bean, TX 75489 6:00 p.m. Monday, March 10, 2025 tpp.ombantge On Monday, March 10, 2025, the Tom Bean City Council met in a Regular Session. 1. CALL TO ORDER Mayor Thomas called the meeting to order at 6:00 p.m. 2. INVOCATION - Invocation by Fire Chief Jason Lankford. 3. PLEDGE OF ALLEGIANCE 4. Citizen Comments: This item is available for citizens to speak for up to five (5) minutes on any subject of which the City of Tom Bean has authority. However, no discussion or action, by law, may be taken on the topic unless and until properly posted on a future agenda. The council may direct the mayor to resolve or request the matter to be placed on a future agenda. Completed speaker's request forms must be submitted to the City Secretary at the beginning of the Council meeting. REGULAR AGENDA - (NON - CONSENT) 6. Presentation of Community Achievement Award to David and Lisa Harrison from Mayor Ricky Thomas. REPORTS = (DISCUSSION ONLY) 7. Report from Fire Department- Chief Jason Lankford 37 calls for February, 105 calls for the year. Closed out grant used to purchase new air pack. Working on getting a generator for the fire station. 8. Report from Police Department- Chief Zach Smith Officer Cauffiel is close to completing training. 166 traffic contacts were made in February. The 2021 Silverado is being outfitted for patrol and should be completed by the end of March. 1Page 9. Report from Public Works-. Acting Director Jarrett Tate Monthly water flushing is complete totaling 27,500 gallons at 16 locations. All monthly reports and water samples were submitted and passed. A small leak was located in the chlorine room at the North well and was repaired. 6 water leaks were repaired around the city. As severe thunderstorm on March 4 knocked the power out at all four sewer lift stations and at two water wells. Whitemound well did not lose power and was able to keep water flowing. A generator at the North well kept water flowing until power was restored at 11:15 a.m. Since power was out at all four sewer lift stations, it was necessary to hire a pump truck to assist in removing sewage until power was restored. A new weir trough was installed on the west clarifier. Two motors and shafts went down, one each on the east and west tracks. Both were repaired. 10. Report from City Secretary- Sarah Dusenberry Account balances, account reconciliations, and bank statements were provided to Council for review. 11. Report from Court/Permit Clerk- Tammy Phillips 105 total collections and 83 citations closed. 172 outstanding warrants with 2 warrants cleared. 27 daily appearance letters mailed. Court was held with one prosecutors conference, a bench trial continuation, and one juvenile case. One new home permit and one irrigation permit were issued. 12. Report from the Mayor- Ricky Thomas Mayor Thomas praised the Public Works department team for reacting quickly to repair a hydrant that was hit by a freight liner in town. Public Works employees worked for 8 hours straight to repair the damaged hydrant and water line and restore water service to homes in the area. CONSENT AGENDA (All consent agenda items are considered routine by City Council and will be enacted by one motion. There will bei no separate discussion oft these items unless a Councilmember requests an item be removed and considered separately.) 14. To approve the Minutes of the Regular Session meeting held February 10, 2025. Motion: Upon a motion made by Ellis and seconded by Melton, the council voted four (4) and none (0) opposed to approve the Minutes of the Regular Session meeting held February 10, 2025. The motion carried. NEW BUSINESS 15. Discuss and take action, if any, on certifying candidate Michael Upchurch as unopposed for election to office for the Special Election scheduled to be held on May 3, 2025. 2IPage Motion: Upon a motion made by Melton and seconded by Marshall, the council voted three (3) and one (1) abstained and (0) none opposed to certify candidate Michael Upchurch as unopposed for election to office for the Special Election scheduled to be held on May 3, 2025. The motion carried. 16. Discuss and take action, if any, on approving the Order of Cancellation canceling the Special Election scheduled to be held on May 3, 2025 and declaring certified unopposed candidate Michael Upchurch as elected to an unexpired 1-year term on the City ofTom Bean City Council. Motion: Upon a motion made by Marshall and seconded by Ellis, the council voted three (3) and one (1) abstained and none (0) opposed to approve the Order of Cancellation canceling the Special Election to be held on May 3, 2025 and declaring certified unopposed candidate Michael Upchurch as elected to an unexpired 1-year term on the City ofTom Bean City Council. The motion carried. 17. Discuss and take action, ifa any, on Resolution 2025-01 designating Ricky Thomas and Sarah Dusenberry authorized signatories for the 2023 Texas CDBG Program, grant agreement no. CDV23-0381. Motion: Upon a motion made by Ellis and seconded by Upchurch, the council voted four (4) and none (0) opposed to approve Resolution 2025-01 designating Ricky Thomas and Sarah Dusenberry authorized signatories for the 2023 Texas CDBG Program, grant agreement no. CDV23-0381. The motion carried. 18. Discuss and take action, ifany, on approving Resolution 2025-02 to adopt CDBG Civil Rights policies. Motion: Upon a motion made by Marshall and seconded by Upchurch, the council voted four (4) and none (0) opposed to approve Resolution 2025-02 to adopt CDBG Civil Rights policies. The motion carried. 19. Discuss and take action, if any, on the award ofthe Whispering Oaks Force Main contract to Hayes Construction LLC based on the recommendation of Hayter Engineering. Motion: Upon a motion made by Ellis and seconded by Marshall, the council voted four (4) and none (0) opposed to award the Whispering Oaks Force Main contract to Hayes Construction LLC based on the recommendation ofHayter Engineering. The motion carried. 20. Mayor and Council Closing Comments- Mayor Thomas reminded everyone in attendance about the Easter egg hunt on Saturday, April 12 from 11 a.m.-2 p.m. The tree line was cleared behind City Hall to avoid potential damage during storm season. Picnic tables have been ordered and will be installed under the pavilion at Ice B. Reeves park.
