Commissioner Ulsh opened up the floor for Public Comment Period. Sandra Barton addressed the Commissioners on the ongoing litigation matters with the Dominion Voting Machines. Commissioner Ulsh commented that going forward Public Comment Period would be for matters related to the agenda and that anything else would require to be placed on the agenda. Motion by Commissioner Shives to approve the Commissioners Minutes of the October 10, 2023 meeting. All in favor. Motion by Commissioner Bunch to approve the Accounts Payables dated October 9, 2023 in the amount of $74,233.23. All in favor. Motion by Commissioner Shives to exit Executive Session at 8:55 a.m. All in favor. 266 Motion by Commissioner Bunch to hire Keith Stains as a Per Diem Deputy Sheriff, effective January 1, 2024. All in favor. Motion by Commissioner Ulsh to approve the P&W Excavating Inc. invoice as a Capital Project in the amount of $8,000.00 for excavating and paving at 119 North Second Street, McConnellsburg, PA, to be ADA Compliant. All in favor. Commissioners met with Chief Probation Officer Dan Miller to review and approve Adult and Juvenile Grants. Motion by Commissioner Ulsh to approve a Pennsylvania Juvenile Court Judges' Commission letter addressed to Mr. Robert J. Tomassini to confirm compliance in accordance with subsection 200.1003 (2) of Title 37 of the Pennsylvania Code. All in favor. Motion by Commissioner Bunch to approve the Juvenile Probation Services Grant Agreement to award grant funding in the amount of $37,496.00. All in favor. Motion by Commissioner Bunch to approve the FY 2022-2023 Financial Statement showing funds expended under Juvenile Probation Services Grant for Budget Period July 1, 2022 to June 30, 2023. All in favor. Commissioners met with EMA/911 Director Brian Barton who requested approval to hire a Per Diem Dispatcher. Motion by Commissioner Shives to hire Austen Jumper as a Per Diem EMA/911 Dispatcher, effective immediately. All in favor. Commissioners met with Sue Cubbage, Fulton County Food Basket, to review the FY 2022-2023 State Food Purchase Program Expense and Data Report. Motion by Commissioner Shives to approve Commissioner Ulsh's signature for the State Food Purchase Program Expense and Data Report for Fiscal Year 2022-2023. All in favor. Motion by Commissioner Shives to approve the Purchase of Service Agreement between Fulton County Commissioners for Fulton County Services for Children and Community Specialist Corporation- New Outlook Academy, effective July 1, 2023 through June 30, 2024. All in favor. commissioners met with HR Administrator Mary Huston to discuss vacant county positions. Motion by Commissioner Shives to hire Rebecca Carowick as an Office Deputy 1 for the Prothontary's Office, effective October 23, 2023. All in favor. Commissioners met with Coroner Berley Souders and HR Administrator Mary Huston to discuss Deputy Coroner positions. Motion by Commissioner Bunch to hire all current and future Deputy Coroners as Per Diem Deputy Coroners, effective January 1, 2024. All in favor. 263 A brief Salary Board Meeting was held to set the wages for the new hires. Separate minutes are on file. Commissioners met with Denny Koons with Raymond James for a Retirement Board Meeting. Separate minutes are on file. Commissioner Ulsh reopened the floor for Public Comment Period for resident Carolyn Kerlin who entered the meeting. Kerlin read a comment that she stated she was putting in the Fulton County Newspaper. Commissioner Shives stated that what she read about Attorney Stephanie Lambert made her feel that she is somebody that the county should not be associated with and questioned why Attorney Tom Carrol would request a court hearing and try to get a stay eight times. Motion by Commissioner Shives that Special Counsel be dismissed for the reasons already stated and that she didn't think it was in the county's best interest and also stated that she feels there is a hidden agenda that is also not in the county's best interest. Commissioner Ulsh-Opposed; Commissioner Bunch-Opposed. Motion failed on a 1-2 vote. Commissioner Bunch said he would like to make a statement on why he opposed saying, "Without election integrity, we have nothing and I want to keep the attorneys we have due to further litigation and I will answer for this to God someday and I know I did the right thing". Commissioner Ulsh said he would also like to make a statement on why he opposed saying, "Elections is the biggest part of freedom and if we lose elections, we lose freedom. d don't care if you are Democrat or Republican".
