Belton City Council Meeting March 25, 2025 - 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor David K. Leigh, Mayor Pro Tem John R. Holmes, Sr., Councilmembers Wayne Carpenter, Craig Pearson, Daniel Bucher, Stephanie O'Banion and Dave Covington. Staff present included Sam Listi, John Messer, Mike Rodgers, Amy Casey, Chris Brown, Larry Berg, Daniel Aguirre, Jon Fontenot, Bob van Til, Megan Odiorne, James Grant, Cynthia Hernandez, Scott Hodde, Tina Moore and Joe Dyer. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Daniel Bucher. The Pledge of Allegiance to the Texas Flag was led by Director of Finance Mike Rodgers. The Invocation was given by Mayor David K. Leigh. 1. Call to order. Mayor Leigh called the meeting to order at 5:31 p.m. 2. Public Comments. (Audio 1:33) Adam Wagner, 202 Shine Street, said that his property taxes continue to rise. He requested that the Council not approve the zoning changes related to the Imagine Belton Plan due to the effect on property values. Clinton Bailey, 445 Bella Rose, brought a concern about the Hubbard Branch neighborhood not having sidewalks or a playground for the children of the neighborhood. Woody Durbin, 308 E. 20th Avenue, said that his property taxes have increased each year. He asked what the Council intended to do to maintain the existing conditions and to quit chasing growth. There were no other public comments. Consent Agenda Items 3-11 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councimember, and it will be considered separately. (Audio 8:10) 3. Consider a resolution of support for the transition of the Central Texas Council of Governments to a Regional 9-1-1 Emergency Communications District. 5. Consider authorizing the City Manager to exécute a contract with Paragon Sports Constructors LLC for the installation of a multi-purpose field in the Heritage Park Expansion through the BuyBoard Purchasing Cooperative. Belton City Council Meeting March 25, 2025 - Page 2 6. P-25-04 = Consider a final plat for Capitol Way Industrial Park comprising 40.0986 acres, located on Capitol Way and Grove Road. 7. Consider a resolution authorizing the City Manager to execute an agreement regarding a Water Service Area (CCN) Transfer with the Armstrong Water Supply Corporation for water service to the Seefried Capitol Way Industrial Park Project. 8. Consider authorizing the City Manager to execute a License Agreement with Dominica Garza for use of an existing City sign frame as a wayfinding sign for businesses located on Pearl Street. 9. Consider a resolution authorizing the release of approximately 110.04 acres from the City of Belton's ETJ, owned by JT Carothers Holdings LLC, consisting of two tracts of land, generally located west of Lark Lane, north of FM 2484 and east of FM 1670, more specifically described as: A. Tract 1 = a 40.317-acre tract of land situated in the Young Williams Survey, Abstract No. 861, Bell County, Texas, being a portion of a called 160.152- acre tract of land conveyed to Darin Chick and Debby Chick; and B. Tract 2 - a 69.72-acre tract of land situated in the Young Williams Survey, Abstract No. 861, Bell County, Texas, embracing all of a called 7.456-acre tract of land conveyed to Darin Chick and Debby Chick, and a portion of the remainder of a called 160.152-acre tract of land conveyed to Darin Chick and Debby Chick. 10.Consider a resolution confirming consent for a proposed bond issue by the Bell County Municipal Utility District (MUD) No. 1, as provided for in the Development Agreement between the City, the MUD, and W&B Development Il, LLC, in the amount of $3,540,000 for additional public improvements. 11.Consider a revised General Development Plan for the proposed River Farm Development, located east of IH-35, between Shanklin and the Lampasas River, north of Elmer King Road and east of Toll Bridge Road, and containing approximately 480 acres. Items 6 and 7 were pulled for a separate vote. RESOLUTION NO. 2025-12-R A RESOLUTION OF THE CITY OF BELTON, TEXAS, PROVIDING CONSENT FOR A PROPOSED BOND ISSUE BY THE BELL COUNTY MUNICIPAL UTILITY DISTRICT NO. 1 IN THE AMOUNT OF $3.54 MILLION IN BONDS. RESOLUTION NO. 2025-14-R A RESOLUTION OF THE CITY OF BELTON, TEXAS, AUTHORIZING AN AGREEMENT REGARDING A WATER SERVICE AREA TRANSFER WITH THE ARMSTRONG WATER SUPPLY CORPORATION FOR WATER SERVICE TO THE SEEFRIED CAPITOL WAY INDUSTRIAL PARK PROJECT; AND ESTABLISHING AN EFFECTIVE DATE. Upon a motion by Councilmember Covington and a second by Mayor Pro Tem Holmes, Consent Agenda Items 6 and 7, were approved upon a vote of 6-0-1 Councimember Pearson abstaining). Planning and Zoning 12.Z-25-09 = Hold a public hearing and consider a zoning change from Commercial-2 and Planned Development MullfamlyCemmercialz to Commercial-1 on approximately 16.07 acres located at the southwest corner of IH-14 and S. Upon a motion by Councimember Bucher, and a second by Councilmember Carpenter, the following captioned ordinance was unanimously approved upon a vote of 7-0 with the following conditions: The development must conform to all applicable standards of the Commercial Highway Zoning District. Approval of the "Skyview Belton Addition" plat, currently under review. Construction plans that meet applicable standards must be submitted and approved before construction begins. Belton City Council Meeting March 25, 2025 - Page 4 ORDINANCE NO. 2025-19 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM COMMERCIAL-2, PLANNED DEVELOPMENT MULTI-FAMILYICOMMERCIAL, TO COMMERCIAL -1 ON APPROXIMATELY 16.07 ACRES LOCATED AT THE SOUTHWEST CORNER OF INTERSTATE 14 AND S. LOOP 121. 13. Z-25-10 = Hold a public hearing and consider a zoning change from Planned Development-30 with a Specific Use Permit for Used Car Sales, Drive-In Restaurant and Retail Zoning to Amended Planned Development Retail with a Specific Use Permit for an Automatic Carwash on approximately 1.59 acres located at 111 Sparta Road. Drew Donosky, applicant's engineer, is available to answer questions. Clinton Bailey, 445 Bella Rose, asked what the water demand would be for this car wash and if the system recycles the water. Assistant City Manager Matt Bates discussed the Drought Contingency Plan as it relates to car washes. No one else spoke for or against the item. Upon a motion by Councimember Bucher, and a second by Councimember O'Banion, the following captioned ordinance was approved upon a vote of 5-2 (Councimember Carpenter and Mayor Pro Tem Holmes dissenting) with the following conditions: The development must conform to all applicable standards of the Retail District and Planned Development 30. An automatic carwash is a permitted use. A subdivision plat in compliance with adopted Subdivision Ordinance is required. Civil site plan and building plans in compliance with adopted standards are required. An 8' tall masonry fence and solid hedges a minimum of 6' in height at the time of planting are required. Hours of operation shall be no earlier than 7:30 a.m. and no later than 8:00 p.m. ORDINANCE NO. 2025-20 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM PLANNED DEVELOPMENT 30 AND RETAIL TO AMENDED PLANNED DEVELOPMENT RETAIL WITH A SPECIFIC USE PERMIT FOR AN AUTOMATIC CARWASH ON APPROXIMATELY 1.59 ACRES LOCATED AT 111 SPARTA ROAD. 14.Z-25-12 - Hold a public hearing and consider the repeal of Ordinance 2025-14 and a zoning change from Retail to Retail with a Specific Use Permit for a Package Store located at 2150 N. MAIN STREET AND AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM RETAIL TO RETAIL WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 0.073 ACRES LOCATED AT 2150 N. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Covington, the following captioned ordinance was unanimously approved upon a vote of 7-0. ORDINANCE NO. 2025-23 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM CENTRAL BUSINESS DISTRICT, LIGHT INDUSTRIAL, RETAIL, COMMERCIAL-1, VARIOUS SPECIFIC USE PERMITS, AND VARIOUS PLANNED DEVELOPMENT DISTRICTS TO CENTRAL DOWNTOWN ZONE GENERALLY LOCATED WEST OF IH-35, NORTH AND EAST OF NOLAN CREEK AND SOUTH OF SECOND AVENUE. 16.Hold a public hearing and consider a resolution adopting an amendment to the 2030 Comprehensive Plan related to the updated Future Land Use Map/Plan for the City of Belton.
