The City Council reserves the right to retire into Page 1 of 2 EST 1891 d RESOLUTION 2025-04-28-01 * RESOLUTION FOR CITY OF BARTLETT APPROVAL OF HAZARD MITIGATION ACTION PLAN UPDATE WHEREAS, natural hazards in the City of Bartlett area historically have caused significant disasters with losses of life and property and natural resources damage; and WHEREAS, the Federal Disaster Mitigation Act of 2000 and Federal Emergency Management Agency (FEMA) require communities to adopt a hazard mitigation action plan to be eligible for the full range of pre-disaster and post-disaster federal funding for mitigation purposes; and WHEREAS, FEMA requires that communities update hazard mitigation action plans every five years in order to be eligible for the full range of pre-disaster and post-disaster federal funding for mitigation purposes; and WHEREAS, the City of Bartlett has assessed the community's potential risks and hazards and is committed to planning for a sustainable community and reducing the long-term consequences of natural and man-caused hazards; and WHEREAS, the Bell County Hazard Mitigation Action Plan Update outlines a mitigation vision, goals and objectives; assesses risk from a range of hazards; and identifies risk reduction strategies and actions for hazards that threaten the community. NOW THEREFORE BE IT RESOLVED THAT: 1. The Bell County Hazard Mitigation Action Plan Update is approved in its entirety; 2. The City of Bartlett will pursue available funding opportunities for implementation of the proposals designated therein, and will, upon receipt of such funding or other necessary resources, seek to implement the actions contained in the mitigation strategies; 3. The City of Bartlett vests with the Mayor the responsibility, authority, and means to inform all parties of this action; assure that the Hazard Mitigation Action Plan Update will be reviewed at least annually; and that any needed adjustments will be presented to the City Council for consideration; and 4. EST 1891 RESOLUTION 2025-04-28-02 * * * * * * * * * A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARTLETT, TEXAS, RECOGNIZING SECTION 552.275 OF THE TEXAS GOVERNMENT CODE, RELATING TO PUBLIC INFORMATION REQUESTS REQUIRING LARGE AMOUNTS OF PERSONNEL TIME, AND PROVIDING FOR ITS IMPLEMENTATION UPON PASSAGE. WHEREAS, the Texas Public Information Act (Texas Government Code, Chapter 552) affirms the public's right to access government records and promotes transparency and accountability in public service; and WHEREAS, Section 552.275 of the Texas Government Code authorizes governmental bodies to establish reasonable time limits on the amount of personnel time devoted to responding to public information requests without charge; and WHEREAS, the City of Bartlett recognizes the need to balance transparency with the responsible and efficient use of city resources in fulfilling public information requests; and WHEREAS, the City Council finds that the adoption of Section 552.275 will ensure continued access to public information while maintaining the city's ability to perform its essential operations effectively; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BARTLETT, TEXAS: SECTION 1. The City of Bartlett hereby formally recognizes and adopts the provisions of Section 552.275 of the Texas Government Code, regarding public information requests that require large amounts of personnel time. The City of] Bartlett shall establish a cumulative limit of36 hours per requester per 12-month period for the amount of personnel time spent fulfilling public information requests without charge, as permitted under Section 552.275. SECTION 3. Upon exceeding this limit, the City shall notify the requester as required by law, and shall not be obligated to comply with additional requests unless the requester agrees to pay applicable charges or modifies the request to remain within the allowable time. SECTION 4. The City Administrator, or their designee, is authorized to implement and enforce this policy in accordance with the Texas Public Information Act and applicable legal requirements. SECTION 5. The City of Bartlett shall exercise all applicable rules and laws allowable under Section 522.275. This Resolution shall become effective immediately upon its passage.
