Welcome to the April 2, 2025 meeting of the Development Advisory Committee. My name is Crysta Draayer and I am here with the Department of Planning and Zoning. I will briefly go over the procedure for today's meeting. To begin, a presentation given by the consultant for the project. The DAC members will then give their comments on the projects. The meeting will then be opened up for anyone in attendance that may have questions or comments about the plan. There is an attendance sheet on the back table. Ifa correct email address is given, a copy of the minutes will be e-mailed to you. The minutes are recorded and will also be published to the Department of Planning and Zoning's website. We have one plan on today's agenda. That plan is Always House of Prayer, 3461 Churchville Road, Bay State Land Services. Good morning Mitch. Always House of Prayer- 3461 Churchville Road Located on the south side of Churchville Road (MD 22), west of Carsin's Run Road. Tax Map 51; Parcel 164. Third Election District. Council District E. House of Worship / 4.02 +/- acres / RR Received 03/05/2025 Always House of Prayer / Bay State Land Services Development Advisory Committee Minutes April 2, 2025 Page 2 of11 Mitch Ensor = Bay State Land Services Good morning. Thank you all for attending and for your comments to be received today. My name is Mitch Ensor with Bay State Land Services. We are located at 2012 Rock Spring Road, Forest Hill, Maryland. The plan today is for a proposed church and it is to be located at 3461 Churchville Road. It'sa 6,000 square foot building with a seating capacity of 50 parishioners. That would require 17 parking spaces which are shown on the plan. The property has approximately one and a half acres of existing forest and almost an acre of Natural Resource District. Neither the forest nor the Natural Resource District are proposed to be impacted by this plan. We do understand that we. have comments that would require some potential revisions to the plan, one from the Harford County Health Department, one from Department ofPlanning and Zoning and we would work with both of those departments to amend the plan to address those comments. Submitted along with this site plan were a Stormwater Management concept plan, a Forest Stand Delineation, a Forest Conservation Plan and a Landscape Plan. The site does access a state road which would put the comments regarding the access permit for the state road coming from the Maryland Department of Transportation State Highway Administration and we would work with the district manager on getting that access permit for this site. The location of the existing driveway is shown at the location of where there is drive access that comesi into the site. But I do believe that the comments from DPZ will require some amendments to that access point, but we will take a look at that along with State Highway as the plan progresses. And that concludes my introduction and I will stay to collect any and all comments and answer any questions. Crysta Draayer - Planning and Zoning Thank you Mitch. We will begin with the DAC comments starting with volunteer fire and EMS Bill Snyder. Bill Snyder - Volunteer Fire & EMS Thank you. Mitch the only thing I have is fire EMS is requiring a Knox Key Box and I have the information of ordering that in my notes and I will also be reading for Emergency Services for Justin Mannion. Justin Mannion - Emergency Services (read by Bill Snyder) The proposed building shall be addressed 3461 Churchville Road, as you described. The proposed building must display 10inch to 12inch address numbers and letters, the address must be clearly visible from Churchville Road and there is also in the notes a public safety wireless communications statement because you need the upgrade in the radio communications, how to go about this just upgrading that, that will be in the notes. That's all. Development Advisory Committee Minutes April 2, 2025 Page 3 of11 Clarence Cullum - Harford Soil Conservation District Thank you good morning Crysta, good morning all. The proposed construction will require an adequate sediment and erosion control plan. The erosion control plan must meet the minimum standards per the 2011 Maryland Standards and Specifications for Soil Erosion and Sediment Control. Prior to "Final Plan" submission for erosion and sediment control review, please provide our office with the district plan review fee and voucher. The sediment and erosion control plan should be integrated with the SWM strategy during the design phases. The plan appears to propose a disturbance of greater than 1 acre, I am not 100 % sure that it does, but ifit does disturb one acre or more an NDPES permit will be required. Please contact MDE at (410) 537-3019 for more information about the current NPDES permitting process. Health Department - Dustin Ferguson This plan proposes to develop a six thousand (6,000) square foot house of worship on a 4.02 acre residential lot. This property is to be served by an On-Site-Disposal System (OSDS), and a new water well has recently been drilled for drinking purposes. The site plan, as submitted by the consultant on March 7, 2025, requires additional information to allow for the comprehensive review of this proposal. In order for the HCHD to continue it's review, the following information must be submitted: 1. The site plan proposed to change the previously recorded forty-thousand (40,000) square foot Septic Reserve Area (SRA). The plan must be submitted to the Health Department as an Abbreviated Process. It is important to note that the percolation hole (C) was not approved in the perc update and will need to be outside ofthe SRA. All soil percolation test holes will need to be shown on the plan with clearly distinguishable symbols to differentiate passing and failing tests. Additional comments regarding the SRA and proposed On-Site Disposal System (OSDS) will be provided when an Abbreviated Process submittal is received. Additional soil percolation tests may be required based on what is submitted. 2. Stormwater management devices must be at least twenty-five (25) feet from the proposed SRA. The Stormwater Management Plan SWENG-000106.2025) received by this office on March 3rd, 2025 appears to adhere to this requirement, however, the site plan submitted for the Development Advisory Committee (DAC) has an SRA configuration that does not match the Stormwater Management Plan and does not comply. Development Advisory Committee Minutes April 2, 2025 Page 4 of11 3. Provide a detailed description oft the number of employees that will work in the facility. Include in each shift, the typical length of each shift, and the number of shifts per day/week. Also, indicate all planned uses of the facility such as daycare, group meetings, educational classes, etc. Include information pertaining to the frequency of any of these uses. This information is required in order to provide sizing requirements forthe proposed OSDS, as well as to determine the proper classification forthe proposed water well to serve the property. Paul Phillips- Department of Public Works Engineering We require standard Stormwater Management plans, Sediment control design standards would be: Sediment Control Required Design Standards MDE - Maryland Standards and Specifications for Soil Erosion and Sediment Control, Dec 2011, or latest edition. Required Plan Approvals A sediment control plan is required for the development ofthis site. A grading permit is required. Stormwater management must be addressed. Stormwater Management (SWM) Required Design Standards MDE-Maryland Stormwater Design Manual Volumes I & II (October 2000, Revised May 2009) or latest edition. SWM-Harford County Code Chapter 214. Required Plan Approvals (All comments must be addressed to subsequent submittals) SWM Concept Plan SWM Site Development SWM Final Plan (approval required before issuance of grading permit) Required Permits Grading (needs final SWM plan approval before issuance) Stormwater Management permit Note: Building permits require SWM permits before issuance Note: Use & Occupancy permits require SWM facilities to be constructed and inspected. Development Advisory Committee Minutes April 2, 2025 Page 5 of11 Required Easements A 20' wide access easement is required to the stormwater management facility for maintenance purposes. Outfall Investigation A suitable outfall must be provided for the stormwater management facility and shall be approved at the time of final design. Additional topo shall be shown for the outfall to ensure that the adjacent property owner will not be adversely affected by runoff: from the site. Maintenance Maintenance of the stormwater management facility is the responsibility of the lot owner and shall be stipulated in the association documents. Practices located on individual lots are the maintenance responsibility of the owner. SWM Design Comments A Stormwater Management Concept Plan has been submitted for review and must be approved before preliminary plan approval. Stormwater Management shall be provided and designed to the redevelopment criteria of the Harford County Code and the 2000 Design Manual as amended. Stormwater management practices designed for and located on individual lots shall be constructed and inspected before the issuance of use and occupancy permits. Discharge pipe locations for any stormwater management facilities must be shown on the plan. The need for an Industrial Stormwater NPDES (National Pollutant Discharge Elimination System) Permit through the Maryland Department ofthe Environment shall be investigated by the engineer. Please show proposed SWM on 2nd Series including stormdrain pipe & flow directions. Crysta Draayer- (reading comments from the Maryland Department of Transportation State Highway Administration) SHA has reviewed the site plan for Always House of Prayer and has the following comments: 1. The plan should provide the dimensions for the existing right of way and lane widths. 2. Depending on the width of the existing shoulder, the project may need to widen the existing shoulder to provide a full width shoulder improvement at the entrance in lieu of a deceleration lane. 3. SHA needs to see a sight distance evaluation/profile. This entrance sits practically in the middle of an "S"in the road and acceptable sight distance is questionable. 4. It is noted that the church has a seating capacity for 50 people. Vehicles entering from the east cannot legally use the shoulder as a bypass for queuing vehicles. Also, vehicles Development Advisory Committee Minutes April 2, 2025 Page 6 of11 entering from the west will need to use the shoulder for entry hereby requiring width and pavement depth to be compliant with SHA standards. 5. This will be a standard commercial entrance which must be a minimum of 24' wide excluding the gutter pan. If curb and gutter is not proposed, then additional width may be required to eliminate edge of pavement damage. Teresa Eller at SHA should be contacted with any additional questions. Eric Vacek - Planner, Department of Planning and Zoning Thank you. Mitch good morning. This site plan proposes to construct a 6,000 square foot house of worship and associated parking on a recorded lot. That lot is lot 3, delineated on plat 108-12. The property is zoned RR, Rural Residential, and totals 4.02 acres. It has already been noted that adequate parking spaces have been provided for, I think they are based on 1 space per 3 seats for 50 seats. A new version ofthe site plan is required, you touched upon that Mitch, for the institutional use setback from adjacent residential lots. Please note the proposed building height on the plan. Preliminary plan must be submitted to Harford County for review to revise the current recorded plat by adding and/or updating Forest Retention Area, the Natural Resource District, and any easements that are required. This property is subject to the Harford County Forest Conservation regulations. A Forest Stand Delineation was submitted and approved by the Department of Planning and Zoning. A Forest Conservation Plan was also submitted and approved by the Department of] Planning and Zoning. Appropriate buffers are required on all streams located on the site. These areas shall be labeled as Natural Resource Districts on the final plat. A Landscape Plan has been submitted and is currently under review, just make sure that we have a copy of that itemized cost estimate that is required. Harford County Historic Preservation Review is not required for this plan as the subject property is not designated adjacent to or within 500 feet ofa a Harford County Historic landmark or district. No lighting is proposed at this time. Iflighting is proposed in the future a lighting plan shall be submitted to the Department of Planning and Zoning for review and approval. The department always notes that lighting should be directed downward and away from adjacent residential lots. No signage is proposed at this time. If signage is proposed in the future it must conform to the Harford County Sign Code. Permits shall be obtained from the Department of Planning and Zoning. Do any ofthe DAC members have any additional questions or comments about the plan? No. Okay, we will now open up the meeting to anyone in attendance who has any questions or comments about the plan. Public Comments: Crysta Draayer - Planning and Zoning Your name for the record please. Cris Diaz- I am Cris Diaz. I am the adjacent, or coadjacent owner. This is my wife Terriann, also the owner of the adjacent property. And we have some questions regarding the property indicating that it is going to be a house ofworship which is nice to see that a house of worship will be built and the concerns are regarding the traffic in the area. We want to know what is going to be done to alleviate the potential for accidents as parishioners enter and exit Route 22, very congested during morning and evening traffic. As it was already indicated it will be a "T", Ir mean a "X"intersection there between Bowman and the proposed development. We have had, in the time that we have been there, many accidents already impacting our property. One in particular, in 2018, that totaled 2 vehicles on our parking pad, just to kind of annotate, in June of 2018 one of the power poles was taken down by a car departing the road. Our accident that occurred, not our accident, the accident that mainly impacted our property and home and family was in August of 2018, the car departed the highway, drove 750 feet and destroyed 2 cars in our parking area. We had another accident in uh... Terriann Diaz - 2 years later Cris Diaz - 2 years later, in August another vehicle that left the road and ended up on our property. There was another vehicle in May of2019, a driver hit and run, took the mailbox out, went through the ditch, hit the drain ditch and went off and most recently in the winter of 2022, a driver coming up the hill, spun out taking the church mailbox and ended up in the ditch. So those are just examples of amount of traffic going on in there. We entering into our own property, have experienced multiple near hits of people going around or.. Terriann Diaz = (inaudible) Cris Diaz -it'sa turn that is.. overspeed, people just overspeed in that area there and accidents occurthere on Carsin'sl Run on a regular basis. And we hear it as customers entering and leaving Bowman's.yet near hit or people just really (inaudible) honking the horn and not being prudent. So that's sj just the traffic impact and I see that the State ifN Maryland is looking for what is going Development Advisory Committee Minutes April 2, 2025 Page 8 of11 to be done, which is one of the things that we are looking for, how is the traffic going to be accommodated, uh, for having the parishioners come in and depart the uh, that property? You are having 15 parking spaces now Pastor Womack had shared with me that you were planning 100 parishioners has that now changed? Pastor James Womack - That, it has always been 50 and um we said if we could we would try to put but we locked out at our capacity at 50. Cris Diaz Okay SO you are saying now that the capacity will only be 50? Pastor James Womack - That's, that has been our planning the whole time. You had a conversation with me for my potential for what my congregation could grow to and I said I would like for it to grow to 100 but for this plan's purpose is for 50. Cris Diaz - Okay, SO you're still, the aspiration will still be to have 100 at this facility? Pastor James Womack - No sir. No sir. Planning is not aspiration for this building. Crysta Draayer - I'm sorry sir, just your name just for our record, please? Pastor James Womack = Bishop Womack, I am the pastor of Always House of Prayer, who owns the property and a resident agent for the outcome facility. Crysta Draayer - Thank you. Cris Diaz - And you are going to have 15 parking spaces for 100 parishioners? Mitch Ensor - 50 parishioners would require 17 spaces, that's what is depicted on that. Cris Diaz Right you've got 12 and the other 2... Mitch Ensor - And we'll, based on the Department ofPlanning and Zoning comments we will be amending the layout of the parking but we will require 17 spaces and we will provide 17 spaces. And then to answer your question about the access point, State Highway has offered comments on the plan and part of which was mentioned by Crysta when she read the comments was the shoulder being improved. Sometimes state highway shoulders are not uh built to the same standard as the travel way and what State Highway was saying is they want us to take a look at that shoulder and make sure it is traffic bearing height paving SO that way folks can get off of the side of the road as they are decel-ing and coming into the site. Terriann Diaz -= Well we can tell you that um, we know the state highway has come and put Development Advisory Committee Minutes April 2, 2025 Page 9 of11 gravel rock in the drainage ditch that is right off the shoulder twice in the six years we have lived there because there is a sinkhole that is um eating up the property at the drainage ditch. Mitch Ensor - Is that in front ofy your property or this property? Terriann Diaz - Yes is it running from our property to the existing driveway that is next door to us at the property 3461 Churchville. Mitch Ensor - Well all work that we do as far as access has to be reviewed and approved by State Highways and they will run it through. And trust me when I say ifthere's.. the comments that were on this plan were probably issued out to at least 20 representatives of the State Highway Administration sO everybody knows this access is being proposed. Cris Diaz -) Ifthere's uh, like you said you had to work a apron and a turning lane, there's not, it doesn't appear that there is uh, a space or have to be widened to put a left turning lane on that road. Mitch Ensor - That wasn't required by the state highway. That wasn't part of their comments. Cris Diaz - Okay, SO just for everybody's benefit this would here be the exit, basically across both entrance to Bowman's and the entrance to the house of worship, the church okay? Uh there's enough traffic issues right there with.. Terriann Diaz - Bowman S Butcher Cris Diaz - Bowman', 's Butcher, what is going to be done for the increase in access and II know it's not just Sunday worship, there's other services that the church are anticipating they will be providing SO there will be traffic during the week. Pastor James Womack = So the current plan that we propose was that we will operate on Sundays and we will have minimum hours during the week which will be Wednesdays will be 2-3 hours and Saturday 2-3 hours. So you're talking about current operation of our ministry today is less than 10 hours a week. And there is no daycare, there's no activities, there's no.. there'sjust those 3 and we been doing that for 20 years. Cris Diaz - And there is also no proposed lighting? Eric Vacek = No we don't have that, we don't have that information now. The only proposed lighting.. Mitch Ensor - The only lighting proposed is at the doorways. Eric Vacek - Right. And for most of our plans, all of our plans we say that lighting be directed downward and away. Development Advisory Committee Minutes April 2, 2025 Page 10 of 11 Cris Diaz - Just inquiring because it is where 2 of the bedrooms are for my daughters. Eric Vacek - Yes sir. Cris Diaz- - The property where my daughter resides. And the stormwater management, I notice they are proposing 3 ponds, um, what is, if anything going to be done to uh basically render those ponds childproof or safe or whatever needs to be done for that? Eric Vacek - For the children of the church? Cris Diaz - Right. Or children playing in the area. I mean my grandchildren play in, on the property. Pastor James Womack = Well... Mitch Ensor = Well one, this, it's private property SO I don't know why there would be commingling of folks on private property. But just to speak ofwhat you are calling the "ponds" they are water quality facilities and just for perspective the size of those shown generally are not any larger than the interior ofthis desk space and as far as depth they would be more shallow than the height of these tables down to the ground that you would see on the surface. So generally they're, these are probably 30 inch tall at best, 2 and a halffeet. Those facilities would likely be 2 feet deep or possibly less. And they have slopes that aren't steep SO meaning if someone were to walk down into those devices it's not SO steep that they couldn't walk back out. But for perspective this is about the size they would be (motioning toward the desks where the DAC members were sitting). Cris Diaz = Okay SO I was just envisioning them more of what some ofthe other retention ponds that I have seen like in Abingdon and other municipalities where they got this huge pond areas and I noticed that there were 3 ofthem and relatively sized that are small but didn't know whether there was anything else proposed. Mitch Ensor - It would be, they would be, you would see them but you're not going to see whatyou're, what I believe you are envisioning as this large pond that holds water after a rainfall and takes 24-48 hours for that water to go down. These are not those type of facilities. They're, they're more of a water quality type of facility and just for the record they do include landscaping. So they are not these open, barren type facilities that you see holding water. These would be, when you look at it, for conversation's sake, it looks like a small depression with landscaping in it. Cris Diaz - Okay and I heard the comment that it would need to be maintained, etc., etc. That's already been addressed. Mitch Ensor = Yeah, that's a requirement. That's incumbent on the owner of the land and it Development Advisory Committee Minutes April 2, 2025 Page 11 of 11 also gets inspected by Harford County on a periodic basis and they come out to take a look to make sure it's in proper functioning working order. Cris Diaz - Okay SO I mean I kinda had a different view of what those were going to look like SO uh, I understand. Mitch Ensor - Well that's s what we're here for to try to give a good understanding of what you are going to see. Crysta Draayer Any other questions or comments? Okay.
