John Alvarez, a resident of Farmersville, expressed interest in seeing the Transit Center utilized as a school resource office or a substation for the Police Department. Provides an opportunity for members of the public to address the City Council on items of interest to the public within the Council's jurisdiction and which are not already on the agenda this evening. It is the policy of the Council not to answer questions impromptu. Concerns or complaints will be referred to the City Manager's office. Presentations: Introduction and Swearing in of New City Manager = Police Chief Jay Brock introduced the new City Manager Daymon Qualls and the City Clerk gave him the oath of office. 7. General Business A. Transit Center- Discussion Item Discussion took place Councilmember Boyer expressed support for the City Manager's outreach to potential transit providers for the Transit Center. He suggested the center could also serve as a resource center for the Farmersville Unified School District, offering students and parents access to important information. Additionally, he supported the idea of establishing a police substation at the center, noting that residents might feel more comfortable filing reports there than at City Hall. Councimember Gomez emphasized that the facility is primarily a Transit Center and should remain focused on that purpose. He expressed appreciation that the City has already reached out to TCRTA and encouraged continued discussions with Visalia Transit as well. He also acknowledged that Councilmember Boyer presented some strong ideas that deserve further consideration. Additionally, he noted the importance of reviewing the usage and hours of availability for the center. Lastly, he reminded the Council that the second floor of the Community Center is available for use, but an elevator would need to be installed and for ADA compliance. Mayor Pro Tem Ochoa expressed her interest in transforming the Transit Center into a Community Resource Center. While she supports collaboration with outside agencies, she emphasized the importance of having resources readily available within Farmersville to better serve local residents. She also suggested appointing a community member to serve as a liaison, helping to connect residents with services and resources. Additionally, she proposed holding a Town Hall or Open House meeting to gather input from the community on what they would like to see offered at the Transit Center. She also mentioned the possibilities of using the land in between the Transit Center and Fire Station for a Police Department Sub Station. Councilmember Hinojosa believes that the Community does need a Resource Center as well as using the facility as a Transit Center. He also suggested that the possibility of closing off a wall where the benches are to make more room for more resources. He would like a sign out front with a phone number SO residents know who to contact to get rides. Mayor Hernandez voiced her support for utilizing the Transit Center as a space for Veterans' services. She noted that Public Works Director Steven Thompson has already laid the groundwork due to discussions from previous Council meetings to have the Veterans Legion housed at that location. She also expressed interest in establishing a Police Substation at the Transit Center, as well as exploring the potential for a Visitor Center to support the needs of Farmersville's growing community. However, Mayor Hernandez raised concerns about the proposal to use the Transit Center for school-related resources. To her knowledge, the City previously sold the old Fire Station to the School District, and she suggested that location would be more appropriate for school resource services. She requested that the City Manager reach out to the School District to discuss this matter further. Additionally, Mayor Hernandez shared concerns that expanding services at the Transit Center could potentially attract homelessness to the area, which may impact the surrounding residents. Police Chief Jay Brock informed the Council that, based on previous conversations with the School District, the plan was to offer a wide range of services at the old Fire Station. The understanding was that the School District intended to utilize that location for their various programs and needs. Public Comment Ruben Macareno, a resident of Farmersville agrees with having a Town Hall meeting. He also suggested the possibility of a Chamber of Commerce. Frank Alvarez, a resident of Farmersville and a member of the Farmersville School Board would like to see School Resources at the Transit Center. The Council motioned to have a Town Hall meeting regarding the Transit Center Council Action: It was moved by Mayor Pro Tem Ochoa, seconded by Councilmember Gomez, and unanimously approved with a 5-0 vote. 9. Council Reports A. City Council Updates and Committee Reports Councilmember Hinojosa would like to know if the. Town Hall meeting is going to be at Transit Center. Councimember Boyer thanked Public Works for fixing the potholes on the east side of town at Brundage and how good the parks look. He also thanked Fire and the Police for assisting in the minor accident in front of his house. He also attended the Greater Kaweah Ground Water Sustainability meeting. Councimember Gomez requested an update on the traffic lights at Walnut Avenue and Farmersville Boulevard. Public Works Director Steven Thompson informed the Council that the City needs to contact AC Electric to inspect the sensors in the control box that operates the traffic signal. Councimember Gomez also asked about the condition and placement of stop signs throughout the City. Mr. Thompson stated that he has not yet been able to address this issue but plans to reach out to 4Creeks for their input once he begins gathering the necessary information. Additionally, Councilmember Gomez inquired about the lighting at Highway 198. Mr. Thompson confirmed that all associated fees have been paid, and the lights are expected to be operational within the next 30 days. Mayor Pro Tem Ochoa requested an update on the Housing Element and the Gardenia Apartments project. She also expressed her appreciation to Mr. Alvarez for attending the Council meeting and shared her desire to strengthen the relationship between the City and the School District. Additionally, she suggested that when the City applies for future RFPs, such as Summer Night Lights, there should be coordination with the Police Department to enhance planning and mplementation. Mayor Hernandez requested that staff reach out to the City's grant writers to inquire about potential funding opportunities for a digital sign. She also asked for an update on the drinking fountain and the chimes. Public Works Director Steven Thompson responded that the speakers for the chimes still need to be installed, and he is currently waiting on a quote. He added that the drinking fountain is scheduled to be installed this week. Mayor Hemandez thanked the Public Works Department for laying gravel at the Church Museum. Lastly, she raised concerns about the number of loose dogs in the community and requested that the City Manager review the current ordinance related to dogs. Police Chief Jay Brock informed the Council that Visalia Animal Control has been contacted. 10. Staff Communications: City Manager Daymon Qualls informed the Council that he, along with Mayor Hernandez and Councilmember Boyer, attended the Blueprint Awards, where the City was recognized for its work on the Transit Center and the Los Arroyos Development. Mr. Qualls also expressed his appreciation to City staff for their support and assistance during his onboarding process. City Engineer informed the Council that the street improvements will be starting this summer. Public Works Director Steven Thompson updated the Council, reporting that recent work has been done on the baseball fields at Veterans Park, the lights at Freedom Field, and the removal of weeds and debris from Los Arroyos. Fire Chief Thomas informed the Council that the new patrol vehicle is expected to arrive this Sunday or Monday. He also reported that the new Fire Station is on schedule and should be completed by the end of June. Additionally, Code Enforcement is currently focused on weed abatement efforts. 11. The program was continued in the six-year Federal Highway Act, TEA-21 (with extensions), SAFETEA-LU, and now MAP-21. Through the program, TCAG receives funds for surface transportation improvements in Tulare County. In the past, TCAG has chosen to exchange its annual RSTP allocation for State Highway Account funds ("State Cash"). State Highway Account Funds have fewer restrictions, shorter environmental processes, and no local match requirements when compared to federal funds. The exchange is allowable under law due to the rural classification of Tulare County. As a result of the 2010 Census, Visalia, Tulare, Exeter, FarmersVille and surrounding unincorporated communities were combined into the Visalia/Tulare Urbanized Area (Visalia UZA). Since the area encompassed by the Visalia UZA boundary exceeded the 200,000-population threshold, the Visalia UZA was also designated as a Transportation Management Area (TMA). This designation resulted in additional planning requirements for TCAG and eliminated the ability for member agencies encompassed by the Visalia UZA to exchange RSTP funds for state cash. RSTP funds designated for these agencies remained federalized and were governed by the federal project selection and obligation process. Member agencies whose boundaries were not encompassed by the Visalia UZA were able to continue exchanging RSTP funds for state cash. As a result of the change of how urbanized areas were determined for the 2020 Census, the Visalia UZA is no longer designated as a TMA. In addition, beginning Fiscal Year 2024/25, all member agencies in the County are now able to exchange RSTP funds for state cash. The Tulare County Association of Governments' 2024/25 estimated RSTP apportionment is $7,577,705. From this amount, the County of Tulare is designated a State required rural set aside of $887,784, leaving a total of $6,689,921 to be apportioned to the incorporated cities and the County based upon population. FISCAL IMPACT The estimated RSTP fund amount available to TCAG is $6,689,921 for the 2024/2025 fiscal year of which $66,477.61 is available to the City of Farmersville for the 2024/2025 fiscal year for ongoing road maintenance and other transportation related projects. The program was continued in the six-year Federal Highway Act, TEA-21 (with extensions), SAFETEA-LU, MAP-21, and now IIJA. Through the program, TCAG receives funds for surface transportation improvements in Tulare County. Prior to 2010, TCAG chose to exchange its annual RSTP allocation for State Highway Account funds ("State Cash"). State Highway Account Funds have fewer restrictions, shorter environmental processes, and no local match requirements when compared to federal funds. As a result of the 2010 Census, Visalia, Tulare, Exeter, Farmersville and surrounding unincorporated communities were combined into the Visalia/Tulare Urbanized Area (Visalia UZA). Since the area encompassed by the Visalia UZA boundary exceeded the 200,000-population threshold, the Visalia UZA was also designated as a Transportation Management Area (TMA) or a Tier 2 MPO.. This designation resulted in additional planning requirements for TCAG and eliminated the ability for member agency areas encompassed by the Visalia UZA to exchange STBGP funds for state cash. STBGP funds designated for these agencies remained federalized and were governed by the federal project selection and obligation process. Member agencies whose boundaries were not encompassed by the Visalia UZA were able to continue exchanging STBGP funds for state cash. As a result of the change of how urbanized areas were determined for the 2020 Census, the Visalia UZA was divided or split. This resulted in two Urbanized areas: Visalia and Tulare. This is similar to pre 2010 adjustment. In addition, TCAG was reclassified to a Tier 1 MPO. Asa result, TCAG is no longer designated as a TMA. The additional results in, all member agency areas in the County are again able to exchange STBGP funds for state cash. DISCUSSION: The Tulare County Association of Governments' estimated 2024/25 STBGP apportionment is $7,577,705. From this amount, the County of Tulare is designated a State required rural set aside1 of $887,784, leaving a total of $6,689,921 to be apportioned to the incorporated cities and the County based upon population. The $887,784 County amount is rural set aside as established in 1990 and required in the California Streets and Highway Code (Article 5-182.6). The amount has remained the same since 1990. There are currently four projects STBGP state exchange funding commitments programmed in the FTIP. The projects are programmed through fiscal year 2026/27 (see Table 1). Ifthere is an emergency or is inclement weather that requires the cancellation of lighting for the event, the User shall immediately contact Farmersville City Hall at 559-747-0458 to shut off lights for that period. Thè User shall be financially responsible for all City employee overtime expenses incurred by 3:00pm, Monday through Friday or at any time on weekends or holidays for change request. CONFLICTS & COMPLAINTS Any conflicts, altercations, or disputes while upon City property is strictly prohibited. Individuals engaging in such.action must be expelled from City property. The Authorized Representative shall contact Farmersville Police Department for assistance for uncooperative or hostile persons. All complaints regarding the park or facility shall be submitted in writing to the Farmersville Department of Public Works. No applicant, entity, agency, or group shall circumvent the complaint process. The City shall maintain the Parks scheduling. If a request Is submitted to reserve a Park and there is,a scheduling conflict between two or more parties, the party who first submitted the Athletic Fields Reservation application shall have priority. PARK ACCESS (VEHICLES) The Authorized Representative shall prevent all vehicles (cars, trucks, etc...) from driving or parking upon any Parks turf or landscape. The Authorized Representative may forfeit use of the park if unauthorized vehicles are found upon the parks turf or landscape. Access to the park for maintenance shall be permitted ift the Authorized Representative utilizes an All-Terrain Vehicle (ATV) with a maximum weight of 648lbs. Authorized vehicles approved by the City are exempt. SPECIAL CROWD CONTROL The, Authorized Representative understands the application for Special Crowd Control utilizing off duty or reserve uniformed police personnel are reviewed by the Chief of Police or his/her designee and their decision is final. Fees for Special Crowd Control shall be accrued at the police officer's-hourly rate of pay for the time scheduled on the application. FEES Any expenseincurred by the City to remove refuse, litter, or graffiti; to make any repairs or replacement to any equipment or facilities caused by damage or vandalism that occurs during the reserved period shall be the responsibility of the Authorized Representative. A fee of $25.00 per half hour needed for cleanup and the cost of material shal! be billed to the Authorized Representative. All deposits, fees and charges shall be paid in full at City Hall prior to permit issuance. There shall be no extensions or payment plans. ATTORNEY FEES In any action or proceeding involving a dispute between the City and the Authorized Representative arising out ofthis Agreement, the prevailing party will be entitled to reasonable attorneys' feès and any costs incurred. BACKGROUND ANALYSIS The Military Service Banner program will be established to honor both current and past military personnel for their service to the nation and community. The banner will act as a public expression of gratitude that pays tribute to the courage, commitment, and heroism displayed by individuals who have served in the United States Armed Forces. Loved ones may nominate a military hero to be honored with a banner that will show the individual's name, photo and branch of service. Individuals may also self-nominate. The banners will be displayed on Farmersville Blvd with any overflow shown on Visalia Road and Walnut. They will be raised for the year every Memorial Day. FISCAL IMPACT Other than minimal staff time for installation and takedown, there is no fiscal impact associated with this action. All costs will be incurred by the residents. Military Service Banner Program and Requirements Reviewed/Approved CITYOF FARMERSVILLE City of Farmersville - Military Banner Program Policy PURPOSE It is the purpose of this policy to establish regulations under which the City of Farmersville will permit the use of streetlight poles to display Military Banners. The display of the Military Banners will contribute to the community's quality of life, which lend a special character to the city. The Military Banner Program is to be used for the benefit of recognizing those who are currently serving or who have served in the United States Armed Forces. ELIGIBILITY To qualify: The Honoree must be a current or past member of the United States Armed Forces. The Honoree must be a current or past resident within the Farmersville area as defined by the boundaries of the Farmersville Unified School District. The honoree's discharge from military service must be honorable. APPLICATIONS The city will begin taking applications on December 1st. Completed applications, photos and payment must be received no later than 5:30 p.m. on February 1st to allow adequate time for banner production. The banner application may be obtained by the following methods: (1) Online: htps/www.tilyofiamrsvll-ca.gov, (2) In- person: Farmersville City Hall, 909 W. Once a banner is on a pole it will not be moved unless determined by the City of Farmersville. Once banners are installed by the city, they will be displayed until the banner starts to show deterioration, or the applicant requests to have it taken down. When the banner loses its integrity, city staff will contact the applicant by phone, email, and/or by certified mail if necessary, to arrange for pick up from the Public Works Department located at 873 S. Farmersville Blvd within a reasonable time of the banner being taken down. BACKGROUND ANALYSIS While Kaweah Pump was performing routine maintenance on Well 8A, located at 1685 N Matthew, it was noted that the main motor for the well had burned out and failed. Additionally, the Goulds Bowl was missing, having broken off, and both the bowl and shaft coupling were found sheared off and resting at the bottom of the well. Kaweah Pump notified the Public Works Director of the damage and the need for immediate repairs. In November of 2024, the Acting City Manager and Finance Director were informed and subsequently authorized Public Works to take all necessary steps to restore Well 8A through emergency repairs. Kaweah Pump completed the replacement of a new motor, bowl, and shaft coupling, removed all debris from the well, and replaced all worn parts in the pump after a thorough inspection was completed. Staff are optimistic that the new equipment, combined with the recent well rehab work on the well, will improve overall operating efficiency and well production for many more years. Well 8A is now fully functional and all required water quality testing has been completed with all results falling within normal limits. Well 8A is officially back online and is actively providing water to the city. FISCAL IMPACT Kaweah Pump invoice for Emergency Repair of Well 8A is $150,288.59. Adopt Resolution No. 2025-09 adopting a Mitigated Negative Declaration as the environmental finding for the project 2. Adopt Resolution No. 2025-10 approving a General Plan land use amendment for the project site 3. Introduce Ordinance No. 528 amending the existing zoning designations for the site 4. Adopt Resolution No. 2025-11 approving Tentative Subdivision Map No. 2022-01. 5. Resolution 2025-012 initiating Reorganization (annexation) of the parcel. BACKGROUND - - ANALYSIS The application is a series of planning approvals for the development of a single-family residential subdivision on a 22-acre site located south of West Walnut Avenue, between Road 156 to the west and North Ventura Avenue to the east. Attachment "A" is a location map and Attachment "B" is an aerial photo of the site. The project includes a 96-lot single family residential subdivision, one 0.8-acre neighborhood park centrally located, one 0.5-acre neighborhood park located on the south side of the development and one 0.7-acre storm water basin that will service the development. Associated actions include a General Plan land use amendment, zone change, Tentative Subdivision Map and annexation. Existing Zoning Land Uses and Proposed Amendments The site is currently in agricultural use with additional agricultural uses surrounding the site to the west and south. There are existing residential neighborhoods to the east. The proposed project currently lies outside of the city limits but within the city's Sphere of Influence. Approval and development of the project will require annexation into the city. This process requires a resolution by the City Council to proceed and an application to the Tulare County Local Area Formation Committee (LAFCo), typically done following city approvals. The bulk of the site has a land use designation of Medium Density Residential" with a small portion on the south side being designated as Agriculture/Urban Reserve". The project proposes to utilize the Medium Density Residential for a majority of the development, consistent with the 96-lot request. A General Plan Amendment will be required to change the area currently designated Agriculture/Urban Reserve" to Medium Density Residential" and to incorporate an "Open Space" designation for the neighborhood parks and storm drain basin being proposed for the development (Attachment "C"). In addition, the site as a whole will require adequate zoning for the proposed development. The current site, as shown in Attachment "D", is zoned under Tulare County jurisdiction as Agriculture (A-1). The applicant is proposing a zoning that is consistent with the general plan land use designations, including "R-1" (Single Family Residential) for residential lots and "P/QP" Public/Quasi Public) zoning for those areas that will be developed with neighborhood parks and storm drain basin areas (Attachment "E"). Project Design Attachment "F" shows the proposed subdivision design. The subdivision proposes 96 single family residential lots. The primary access to the site will come from Walnut Avenue to the north of the development. From there, the project includes a series of interconnecting local roads specifically intended to provide access to residents of the development. A second local street will connect to Garrett Avenue, originally established as part of the Walnut Grove Phase 3 Subdivision. This road was not originally planned as part of the original proposal. However, a secondary access is required as part of the development and the applicant has revised the map to include this portion of the subdivision, thus providing the necessary secondary access for residents. This secondary access will be a viable option for ingresslegress in case of an emergency or future road closure near Walnut Avenue. As part of the development, the applicant has proposed one neighborhood park/storm water detention basin centrally located and one 0.49-acre neighborhood park located on the south side of the development. The park/storm basin will function as both a recreational open space and a collector for storm water generated by the subdivision. It is expected that, most of the time, the facility will be dry. Both parks are expected to be landscaped with a combination of turf, shrubs, and shade trees. Circulation As noted above, the project will be served by Walnut Avenue. Walnut Avenue is identified as a Collector Road in the 2025 Farmersville General Plan. As defined in the Farmersville General Plan. A Collector Road can traverse residential neighborhoods. It is this type of roadway that "drains" traffic from a neighborhood and conveys it towards other collector or arterial roadways. Ultimate buildout of Walnut Avenue includes a Class 1 cycling corridor. This is required by standards contained in the Circulation Element of the Farmersville General Plan. The intersection of Walnut Avenue and Ventura Road will eventually need to be signalized; the traffic impact study that was prepared for the project estimates that a traffic signal will not be warranted for more than ten years and that the project should contribute 47.45% of the cost of this signal. The remainder of the traffic "impact" on this intersection will result from city- and area-wide traffic growth along Walnut Road. It should be noted that the subdivision project will also be paying the City's newly adopted traffic impact fees at $760 per lot. Planning Commission Hearing The Farmersville Planning Commission conducted a public hearing to consider the project on November 20, 2024. Following discussion, the Commission voted unanimously to recommend approval of the project. Consistency with adopted Policies, Goals, Plans and other Programs The proposed project is consistent with city policies and standards, including the 2025 Farmersville General Plan (as amended), Farmersville Zoning Ordinance, Farmersville Subdivision Ordinance and Farmersville Improvement Standards Manual. Chapter 16.28 of the Farmersville Municipal Code provides the construction and design standards necessary for the development of a subdivision Utilities The project will be required to extend and connect to City utility lines, including water, sewer, and storm drain. There are currently utility lines along the north side of the site (sewer, water, and storm drain) along Walnut Avenue north of the site and within Garrett Avenue (sewer, water, and storm drain) on the east side of the site. The Public Works and Engineering Departments report there is adequate capacity in all systems to accommodate the project. The project will retain storm drainage on site in the proposed park/ponding basin. In order to conserve water, all landscaping on the site will be required to meet the City's water-efficient landscape ordinance. ENVIRONMENTAL REVIEW As required by law, the City had a consulting firm (Crawford and Bowen) prepared an analysis of potential impacts that may result from the project. The study was advertised and circulated for 30 days for public review and comment. At the close of the comment period one letter had been submitted. This letter was from the Air District and had no significant comments. The environmental study determined the project would not have significant impacts to the environment provided that mitigation measures are incorporated into the project design and construction. These include: Air Quality. The developer will be required to devise and submit measures for reducing air quality impacts, particularly as it relates to equipment used during construction of the project including the reduction of potential dust emissions through pre-soakingwatering of undeveloped and natural areas such as dirt roads and undisturbed soils prior to construction. Biological resources. Project construction should occur outside the bird nesting season but if conducted during nesting season a biologist must survey the site and if nests are discovered, construction in that area must be avoided. Cultural Resources. Construction crews should be trained to be observant for buried human remains or cultural artifacts and if these are encountered during construction then a preservation protocol must be implemented. Greenhouse Gas Emissions. The developer will be required to prohibit the use of natural gas connections and appliances for consistency with the 2022 Scoping Plan for greenhouse gas reduction. Traffic/Circulation. The project will be required to pay fair share amounts toward future signalization at the following intersections: Ventura Avenue & Walnut Avenue: 47.45% Farmersville Boulevard & Front Street: 18.85% To mitigate crçuationgreennouse gas impacts of the project, the study identified that the project be required to install/upgrade ADA-compliant pedestrian curb ramps at the following nearby intersections: Garrett Avenue & Virgina Avenue (2 ramps) FISCAL IMPACT Each lot that is developed in the subdivision will be required to pay the City's Development Impact Fees. All traffic signs and street name signs shall be installed in accordance with City standards and the latest edition of the California Manual on Uniform Traffic Control Devices (CA MUTCD). A striping and signage plan shall be included with the construction plans and submitted for review and approval by the City Engineer. g. The developer shall submit a copy of the prepared Stormwater Pollution Prevention Plan along with the State Water Board issued Waste Discharge Identification Number (WDID) prior to the start of construction and City issuance of a grading permit. b. Plans for these requirements shall be included in the construction plan set and shall be submitted to and approved by the City Engineer. 4. SANITARY SEWER AND WATER IMPROVEMENTS: a. The developer's engineer shall be responsible for verifying size, location, and elevations of existing sanitary sewers, storm drainage, and water improvements. b. The developer shall install a City standard water service with backflow prevention device, size as necessary for the development in accordance with City standards. Any existing fire hydrants are to be raised to finish grade. 5. ELECTRICAL, GAS, CABLE TELEVISION, AND TELEPHONE SERVICES: a. All services (electric, cable television, and telephone) to newly constructed buildings shall be installed underground and placed per the utility providers specifications. The developer is responsible for all utility coordination and should coordinate directly with the utility providers. b. The developer shall comply with all the requirements ofthe local utility (gas and electric), telephone, cable, and other communication companies. It shall be the responsibility of the developer to notify the local utility, telephone, cable, and other communication companies to remove or relocate utility poles where necessary. The City will not accept first submittal ofi improvement plans without proof that the developer has provided the improvement plans and documents showing all proposed work to the utility, telephone, cable, and other communication companies. 6. BOND OR DEPOSIT: a. An engineer's estimate shall be submitted for all public works improvements. The developer shall make provisions for a bond, deposit, or instrument of credit on all required improvements as follows: 1. 100% faithful performance 2. 100% labor and materials 7. FEES: a. The developer shall pay to the City all applicable fees prior to Issuance of a building permit. 8. ADDITIONAL ENGINEERING REQUIREMENTS: a. Provide the City with improvement plans that have been prepared by a licensed Civil Engineer. b. Mailbox facilities shall be installed per USPS guidelines and regulations. C. A digital copy of the improvement plans shall be provided to the City upon final approval. Any free-standing fencing should be treated with climbing vines for beautification and graffiti prevention. e. Dedicate landscape lots to the City that are to be maintained by the Landscape & Lighting District. f. Show locations of all utilities that are to be relocated (i.e., service poles, meters, etc.). g. The developer is required to notify the City inspector of all phases of construction, which includes but is not limited to the installation of any underground utilities, streets etc. and obtain approvals by the City inspector at the time of construction. h. It shall be the responsibility oft the developer to remove all existing structures, trees, shrubs, etc., that are within or encroaching on existing or proposed rights- of-way or easements. Existing street improvements shall be preserved, at the discretion of the City Engineer. i. Within five days after the final setting of all monuments has been completed, the engineer or surveyor shall give written notice to the City Engineer that the final monuments have been set. Upon payment to the engineer or surveyor for setting the final monuments, the developer shall present to the City Engineer evidence of the payment and receipt thereof by the engineer or surveyor. j. Aj preconstruction meeting is required prior to the start of any construction. A. PLANNING 1. Front facades ofhomes shall be reviewed and approved by the City Planner. 2. All traffic control sign posts shall be painted gloss black. 3. Improvement plans (including landscaping) for the open space corridors and park/ponding basin shall be submitted and reviewed and approved by the City Planner, City Engineer, and Public Works Director. Designs for the waterway open space corridors shall comply with the Farmersville Waterway/rails Master Plan. Landscaping for the park shall include turf, shrubs, shade trees, benches and other amenities determined by the City Manager. B. ENVIRONMENTAL The project shall implement all mitigation measures identified in the Initial Environmental Study prepared by Crawford & Bowen Planning Consultants, including: AIR-1: Page 9 of 14 Farmersville City Council Resolution 2025-11 Tentative Subdivision Map for Fagundes Residential Project) Consistent with San Joaquin Valley Air Pollution Control District (SJVAPCD) Regulation VIII (Fugitive PM10 Prohibitions), the following controls are required to be included as specifications for the proposed project and implemented at the construction site: 1. All disturbed areas, including storage piles, which are not being actively utilized for construction purposes, shall be effectively stabilized of dust emissions using water or chemical stabilizer'suppressant or covered with a tarp or other suitable cover or vegetative ground cover. 2. All on-site unpaved roads and off-site unpaved access roads shall be effectively stabilized of dust emissions using water or chemical stablizer'suppressan, 3. All land clearing, grubbing, scraping, excavation, land leveling, grading, cut and fill, and demolition activities shall be effectively controlled of fugitive dust emissions utilizing application of water or by presoaking. 4. When materials are transported off site, all material shall be covered, or effectively wetted to limit visible dust emissions, and at least 6 inches of freeboard space from the top of the container shall be maintained. 5. All operations shall limit or expeditiously remove the accumulation of mud or dirt from adjacent public streets at the end of each workday. (The use of dry rotary brushes is expressly prohibited except where preceded or accompanied by sufficient wetting to limit the visible dust emissions. Use of blower devices is expressly forbidden.) 6. Following the addition of materials to, or the removal of materials from, the surface of outdoor storage piles, said piles shall be effectively stabilized of fugitive dust emissions utilizing sufficient water or chemical stabilizer/ suppressant. A pre-construction survey shall be conducted no more than 14 days prior to the initiation of construction activities. During this survey, the qualified biologist shall inspect all potential nest substrates in and immediately adjacent to the impact areas. If an active nest is found close enough to the construction area to be disturbed by these activities, the qualified biologist shall determine the extent of a construction-free buffer to be established around the nest. Ifwork cannot proceed without disturbing the nesting birds, work may need to be halted or redirected to other areas until nesting and fledging are completed or the nest has otherwise failed for non- construction related reasons. BIO-2: Compensate for loss of Swainson's hawk foraging habitat. 1. Compensate for loss of Swainson' S hawk foraging habitat (i.e., the fallow fields on the Project site) in accordance with the CDFW Staff Report Regarding Mitigation for Impacts to Swainson's Hawks (Buteo swainsoni) in the Central Valley of California (Appendix E of Appendix B). The CDFW requires that projects adversely affecting Swainson' s hawk foraging habitat provide Habitat Management (HM) lands to the department. Projects within 1 mile of an active nest shall provide one acre ofHM lands for each acre of development authorized (1:1 ratio). Projects within five miles of an active nest but greater than one mile from the nest shall provide 0.75 acres ofHM lands for each acre of urban development authorized (0.75:1 ratio). And projects within 10 miles of an active nest but greater than 5 miles from an active nest shall provide 0.5 acres of HM lands for each acre of urban development authorized (0.5:1 ratio). No compensation is required if an active nest is not found within ten miles ofthe Project site. The nearest nest is determined using methods identified in Mitigation Measure BIO-1 during the nesting season before or during construction. CUL-1: The following measures shall be implemented: 1. The archaeologist shall determine whether the item requires further study. If, after the qualified archaeologist conducts appropriate technical analyses, the item is determined to be significant under California Environmental Quality Act, the archaeologist shall recommend feasible mitigation measures, which may include avoidance, preservation in place or other appropriate measure, as outlined in Public Resources Code section 21083.2. In order to meet the consistency requirements of the 2022 Scoping Plan for Greenhouse gas (GHG) reduction and equity prioritization goals, the proposed project shall prohibit the use of natural gas connections and appliances as part ofthe proposed project. Farley, Interim City Attorney AGENDA TITLE: Transit Center Discussion ACTION & RECOMMENDATION Discussion. Staff does not recommend a JPA as more fully discussed nereafter. BACKGROUND - ANALYSIS Discussion regarding use of the Transit Center and possible affiliation with the School District. In order to enter into a mutual relationship with another public entity (School District), the City would probably need to enter into what is commonly referred to as a Joint Powers Agreement (JPA). This Agreement would set forth the rights and obligations of each entity. The JPA would have to have members sitting as a Board. Generally, two members from the City, two members from the other public entity, and a fifth member usually being the City Manager or, if it were the School District, a principal or vice principal. The fifth position would alternate every six months or so. JPAS are subject to the Brown Act. ENVIRONMENTAL REVIEW N/A FISCAL IMPACT The City would have costs associated with a JPA involving staff time, supplies, and personnel (who would be in charge of cleaning, maintenance, putting together the agenda, etc.). The City would have to advise its Risk Management to make sure they had liability coverage. Given the current issues facing the City, it is my recommendation that a JPA not be entered into at this time. ATTACHMENTS N/A Review/Approve
