Tuesday, April 1, 2025 7:00 P.M, Municipal Building = 4000 Main Present: Mayor Pro Tem Winget, Deputy Mayor Pro Tem Shinder, Councilmember Reaves, Councilmember Bowers, Councilmember Britton and Councilmember Schupp 1. CALL TO ORDER Mayor Pro Tem Winget called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION 2A. The City Council sha!l convene into Executive Session pursuant to the Texas Government Code, $551.074 (Personnel) to deliberate the appointment, employment, evaluation, duties, discipline, or dismissal of a public officer or employee, to wit: Presiding/Chief Judge of the Rowlett Municipal Court. (To be held after Regular meeting.) Mayor Pro Tem Winget adjourned the meeting into Executive Session at 7:59 pm. 3. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY OR APPROPRIATE ACTION ON CLOSEDIEXECUTIVE SESSION MATTERS Mayor Pro Tem Winget reconvened the meeting at 10:10 pm. No action was taken. 4. PRESENTATIONS 4A. Presentation of Rowlett Centurion Recognition and Proclamation for Mrs. Maria Brookshire Davis. Councimember Britton presented the Proclamation for Mrs. Maria Brookshire Davis. 4B. Presentation of Proclamation recognizing March 29, 2025, as Vietnam War Veterans Day. Deputy Mayor Pro Tem Shinder presented the Proclamation recognizing March 29, 2025, as Vietnam War Veterans Day. 4C. Presentation of Proclamation recognizing National Library Week. April 6 - 12, 2025. Councimember Bowers presented the Proclamation recognizing National Library Week. April 6 - 12, 2025. City of Rowlett 10801 4D. Presentation of Proclamation recognizing the month of April as Autism Acceptance Month and a request to light the downtown water tower in blue. 1 Mayor Pro Tem Winget presented the Proclamation recognizing the month of April as Autism Acceptance Month. The downtown water tower will be lit in blue on April 2, 2025. 4E. Presentation of Proclamation recognizing the month of April as National Child Abuse Prevention Month. Councimember Reaves presented the Proclamation recognizing the month of April as National Child Abuse Prevention Month. 4F. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Councimember Bowers provided the following announcements: CITY SECRETARY'S OFFICE - Are you ready for the May 3d General and Special Elections? The last day to register to vote or make changes to your voter registration is Thursday, April 3. Early voting will begin on Tuesday, April 22 and will run through Tuesday, April 29. Election Day is Saturday, May 3. ECONOMIC & COMMUNITY ENGAGEMENT - Mark your calendars for the Rowlett Easter Eggstravaganza on Saturday, April 12 from 10 - 1 p.m. at Pecan Grove Park. We'll have multiple egg hunts for different age groups with the first egg hunt starting at 10:15 a.m. The City of Rowlett is partnering with Keep Rowlett Beautiful on the Great American Clean- Up/Texas Trash Off on Saturday, April 5 from 9 a.m. - noon. The program supports efforts to clear Texas roadsides and public areas of trash. Keep Rowlett Beautiful will supply trash bags, grabbers, gloves and more while supplies last. For a list of upcoming titles, visit Rowlet.coml_ibraty, The Rowlett Arts and Humanities Commission invites all young artists to participate in their annual art contest - The Young Artist Exhibit. This contest is open to children in Kindergarten through 12th grade, enrolled in public or private or home school. There are multiple age divisions along with a special needs division. Councimember Reaves introduced the Featured Pet, Ghost, is ready to share his smile and toys with a forever home. To meet Ghost or one of his companions, please contact Animal Services at 972-412-6219 or come by the Shelter at 4402 Industrial St. from 10 am to 5 pm, Tuesday through City of Rowlett 10802 Saturday. The animal shelter is currently at code red. This means that the kennels are full. All adoptions are $25 and include spay/neuter, microchip, and up-to-date vaccinations. Mayor Pro Tem Winget stated the Great American Clean-Up/Texas Trash Off scheduled for Saturday, April 5 has been cancelled due to inclement weather. Deputy Mayor Pro Tem Shinder stated Earth Dayis Saturday, April 19, at 11 am on the Green in downtown. Mayor Pro Tem Winget requested citizens sign up for the Smart911 program to receive text updates. 5. CITIZENS INPUT No Online Input Forms were received. There were no citizens input. 6. CONSENT AGENDA 6B was removed from the Consent Agenda to be considered individually. 6A. Consider action approving the minutes. Consider action to approve minutes from the following City Council meeting(s): March 17, 2025, City Council Work Session, and March 18, 2025, City Council Meeting. This item was approved on the Consent Agenda. 6B. Consider action approving an ordinance regarding Short-Term Rentals. Consider action to approve an ordinance repealing in its entirety Division 4 "Short-Term Rentals" of Article XI "Rental Housing" of Chapter 10 "Businesses" of the Code of Ordinances and Adding A New Division 7"Short-Term Rentals" To Article XI "Rental Housing" Of Chapter 10 "Businesses" in The Code Of Ordinances Of The City Of Rowlett, Texas. Deputy Mayor Pro Tem Shinder stated she conferred with the city attorney regarding this ordinance. She would like to have the word "may" changed to "shall" in Section 10.477 on page 10 of the ordinance. This protects staff from having to use discretion and gives the ordinance more of a bite. A motion was made by Deputy Mayor Pro Tem Shinder, seconded by Councilmember Britton, to approve the ordinance regarding Short-Term Rentals with the amendment of changing may" to "shall" in Section 10.477. Motion passed 6-0. This item was approved on the Consent Agenda as ORD-012-25. 6C. Consider action approving supplemental authorization for the design of the Hwy 66 East Sewer Line Improvements Project Phase 2. Consider action to approve resolution approving and authorizing the City Manager to execute a supplemental Task. Authorization #Y21-NS-01-SUPPOT to PO#22100297 with Neel-Schaffer, Inc. for the engineering design of the SH 66 East Sewer Line improvements Project Phase 2 (SS1134) in the amount not to exceed $119,900.00. This item was approved on the Consent Agenda as RES-042-25. City of Rowlett 10803 6D. Consider action approving a contract for alley reconstruction. Consider action to approve a resolution authorizing the award of a contract for Project No. 2025- 88-B CDBG Alley Reconstruction - Dana Drive (from Paul Place to Carla Ln), to Onyx Paving & Utility, LLC, for a price not to exceed $199,442.17 ($181,311.06, with a ten percent (10%) contingency amount of $18,131.11); authorizing the City Manager or his designee to execute the contract and all necessary and related documents; and providing an effective date. This item was approved on the Consent Agenda as RES-043-25. 6E. Consider action approving the acquisition of right-of-way for Cheisa Road Widening Project. Consider action to approve a resolution authorizing the negotiated acquisition of 0.0038 acres of real property located at 2012 Chiesa Road by special warranty deed and 0.1437 acres of real property located at 1929 Chiesa Road by special warranty deed, as necessary for the Chiesa Road Widening Project from Dalrock Road to Miller Road (ST2134), for compensation of $5,326.50 and $65,401.50, respectively; authorizing the Mayor or his designee to execute all necessary documents to effectuate said purchases. This item was approved on the Consent Agenda as RES-044-25 6F. Consider action approving supplemental authorization for the design of the Merritt Road Interconnector Phase 2. Consider action to approve a resolution authorizing the City Manager to execute a supplemental Task Authorization Y2016FNIO1-SUPPOZ for the design of the Merritt Rd Interconnector Phase 2 (ST2110) with Freese and Nichols, Inc., for compensation in the amount not to exceed $1,433,310.00. This item was approved on the Consent Agenda as RES-045-25. 6G. Consider action rejecting the single bid for the Martin Drive Pedestrian Crossing Signal Project. Consider action to approve a resolution rejecting the single bid received in response to Request for Bids, Bid No. 2025-89-B Martin Drive Pedestrian Crossing Signal Project and providing direction to staff to manage this project in-house, acting as the general contractor. This item was approved on the Consent Agenda as RES-046-25 6H. Consider action rejecting the single bid for the Rowlett Road Pump Station Upper Pressure Plane Additions. Consider action to approve a resolution rejecting the single bid received in response to Request for Bids, No. 2025-87-B Rowlett Road Pump Station Upper Pressure Plane Additions. City of Rowlett 10804 This item was approved on the Consent Agenda as RES-047-25. 61. Consider action approving a contract for the purchase and installation of traffic control hardware. Consider action to approve a resolution authorizing the purchase and installation of traffic control hardware from Consolidated Traffic Controls, Inc., through a HGACBuy cooperative contract, for a total price not to exceed $4,025,329.00, authorizing the City Manager or his designee to negotiate and the Mayor to execute the purchase contract and the City Manager to further execute any other necessary and related documents. This item was approved on the Consent Agenda as RES-048-25. A motion was made by Councilmember Britton, seconded by Deputy Mayor Pro Tem Shinder, to include all the preceding items marked as having been approved on the Consent Agenda. The motion passed 6-0. 7. INDIMDUAL CONSIDERATION 7A. Consider: authorizing the issuance of a building permit for a non-conforming structure under Section 77-908 of City Code for the residence at 6602 Warwick Drive. Kristoff Bauer, Deputy City Manager, presented this item. City Council made an amendment to the non-conforming structures, a few weeks ago. This is the first application received based on that ordinance. The ordinance allows you to permit or authorize a building permit for a non-conforming structure, as long as the only non-conformance is that it is in a side yard setback. You will need to find that there is an appropriate hardship to grant the building permit. A motion was made by Councilmember Britton, seconded by Deputy Mayor Pro Tem Shinder, to authorize the issuance of a building permit for a non-conforming structure under Section 77-908 of City Code for the residence at 6602 Warwick Drive. Motion passed 4-2, with Councilmember Bowers and Councilmember Schupp voting against. 8. MEMBERS OF THE CITY COUNCIL MAY REQUEST TOPICS TO BE PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING. ANY DELIBERATION OR DECISION SHALL BE LIMITED TO A PROPOSAL TO PLACE TOPIC ON THE AGENDA FOR A SUBSEQUENT MEETING. There were no requests. 9.
