Call to Order A meeting of the City ofWestminster Board of Zoning Appeals was held at City Hall, 1838 Emerald Hill Lane, Westminster, MD 21157 and broadcasted live on the City YouTube Channel, on Tuesday, January 7, 2025 at 6:02 pm. II. Introductions Chair Scott Graf, Vice Chair Brenda Frazier and BZA Member Richard Huss were present. Also in attendance were Board Attorney Karen Ruff, Attorney Elissa Levan, and City staff member, Mark Depo - Director of Planning and Community Planning and Joe Adkins - City Planner. III. Approval of Meeting Summaries On a motion by Vice Chair Frazier and seconded by Chair Graf, the Board voted 3-0 to approve the meeting summaries ofMay 7, 2024, July 2, 2024, October 1, 2024, and the November 5, 2024 meeting summaries. IV. Approval of Final Decision Letter BZA 24-07 Vice Chair Frazier made the motion to approve the Final Decision Letter BZA 24-07. Mr. Huss seconded the motion which passed 3-0. V. Public Hearings BZA CASE NO: 24-05, Appeal of the Zoning Administrator Determination An appeal of the Zoning Administrator's determination dated June 11, 2024 regarding Sections 164-3 and 164-45.8 ofthe Zoning Ordinance for the property at 301 East Main Street in the City of Westminster (SDAT #07-053096). BZA CASE NO: 24-08 Appeal of the Zoning Administrator Notice of Violation An appeal of the Zoning Administrator's Notice of Violation dated September 27, 2024 for the unapproved operation of a retail sales establishment, the installation of an unproved sign, and the illegal use of City sidewalk fori the property at 279 East Main Street in the City of Westminster (SDAT #07-070217). Attorney Matt Hurff requested a continuance based of the fact that the City of Westminster is now considering a text amendment to define vape shops, the signage has been removed, the obstructions on the sidewalks has been removed, and the property owner is working in good faith to complete the simplified site plan. Director Depo objected and stated that the text amendment and site plan does not impact the Notice of Violation (NOV) that has been issued. The NOV is for the sign, the obstructions, and that the business opened illegally without any City approvals. The property owner was notified a year ago and chose not to respond. Attorney Kelly Miller, representing the property augured that the Mayor and Common Council will determine if the use if permitted and is asking for a continuance until that occurs. She believes that the Mayor and Common Council will permit the use, and that the City will work with the property owner through the site plan process. Attorney Elissa Levan representing the City argued that the NOV should be resolved not matter what the action of the Mayor and Common Council takes. Chair Graf made a motion to continue BZA 24-08 until the February 4, 2025 meeting. Mr. Huss seconded the motion which passed 2-1 with Vice Chair Frazier voting against the motion. Adjournment Vice Chair Frazier, hearing no objection, made the motion to adjourn the Board of Zoning Appeals meeting of February 4, 2025. The motion was seconded by Mr. Huss.
