The purpose of 5 our meeting will be to go through some 6 department heads. We'17 see if they have 7 anything for the agenda or the upcoming 8 meeting. We'17 hear from our council 9 members, mayor, our borough manager, our 10 solicitor. 11 If any members of the public would 12 like to address us we'11 give you a few 13 moments at the end of the meeting. The 14 chief of police has a sign-in sheet. 15 With that said, our first department 16 head is DPW manager, Joseph Lenceski. Joe, 17 good evening. Anything for tonight or for 18 the upcoming agenda? 19 MR. LENCESKI: Nothing. 20 MR. RUSSELL RINALDI: Any members 21 have any questions for Joe? 22 MR. LETTIERI: Joe, the assisted 23 living down on George Street, that tree 24 hanging over, is there anything you can do 25 with that? I've been getting a lot of calls 3 1 from people that it's hanging over the road. 2 If that's our property, if that's something 3 we can do? 4 MR. LENCESKI: It's not our 5 property. 6 MR. LETTIERI: So that has to go to 7 Mike? 8 MR. LENCESKI: I'17 get over there 9 and cut it. We should notify the owner of 10 the property, but because it's overhanging 11 the street I can take the bucket truck and 12 cut it down with the line of the trees. 13 MR. LETTIERI: Thank you. 14 MR. In the zoning 2 things does it say something about damaged 3 houses in our zoning ordinance? 4 MR. SOKOLOWSKI: As far as what? 5 MR. BUTLER: Is condemned a damaged 6 house? 7 ATTY. RINALDI: There's probably a 8 definition under the international property 9 maintenance code. It covers what happens if 10 the house 11 MR. SOKOLOWSKI: What type of 12 damage? 13 MR. BUTLER: I understand the house 14 on Oak Street, that's being litigated in 15 court? 16 MR. SOKOLOWSKI: Yes. 17 MR. BUTLER: Is it possible that 18 somebody could live in half of this house 19 and the other half is burned? 20 MR. SOKOLOWSKI: No, there's nobody 21 living there. 22 MR. BUTLER: There's nobody in the 23 house at all? 24 MR. SOKOLOWSKI: There's no 25 utilities to it. 5 1 MR. BUTLER: Then I don't understand 2 what the problem is there. The insurance 3 company doesn't want to pay? 4 MR. SOKOLOWSKI: They don't want to 5 pay. I just spoke with him two weeks ago. 6 Actually, their lawyer. I spoke to him 7 also. It's supposedly coming up again this 8 month. 9 MR. BUTLER: Can we find out if a 10 condemned house is considered damaged? 11 Because we have that one on South Main 12 Street. 13 MR. SOKOLOWSKI: Yes. 14 MR. BUTLER: And the one on Sussex 15 Street is condemned? 16 MR. SOKOLOWSKI: Yes, but someone 17 bought it. Actually, they came in for 18 permits. They're going to fix it, repair it 19 and put it back. 20 MR. BUTLER: Okay. 21 MR. RUSSELL RINALDI: Any other 22 members have any questions for Mike? Thank 23 you, Mike. 24 Engineer, Dave Lopatka. I know that actually I got, 4 yesterday, the contract documents back for 5 Pagnotti Park from Linde with their bond and 6 everything that they needed. So they're 7 going to get me a schedule and they should 8 be starting within the next week or two, 9 probably. 10 Same with the senior center. I know 11 the contractors were here today. They just 12 kind of start figuring stuff out. I think 13 they're waiting for some final documents 14 that they have to get from the county before 15 they can actually start. That should be 16 starting soon as well. 17 MR. RUSSELL RINALDI: Anything else? 18 MR. LOPATKA: No. 19 MR. RUSSELL RINALDI: Any update on 20 the guardrail on Howard? 21 MR. LOPATKA: I did talk to a 22 contractor. I sent him a sketch and I 23 should have a price back by the end of the 24 week. 25 MR. RUSSELL RINALDI: Any members 7 1 have any questions for Dave? 2 MR. BUTLER: When are they going to 3 put sod on the field down at Pagnotti? 4 MR. LOPATKA: We're going to bid 5 that in March, I oelleve. We talked about bidding - well, that work can't start until 7 after they get out of school, which is June. 8 So it likely will be sometime in June or 9 July. We're going to bid it, you're talking 10 end of March. 11 MR. BUTLER: Is that going in with 12 that easement for the water? 13 MR. LOPATKA: No, that's the 14 contract for Linde that's already been 15 approved. They're going to be starting. 16 They're going to put the water line in, put 17 the electric up to the building. That 18 building that's next to the first base side. 19 That's their contract, bring the utilities 20 in. Then the second phase is to do the 21 irrigation and then grade and sod the field. 22 MR. HOOVER: Dave, a lady called me, 23 Corrine, regarding Lackawanna storm water. 24 Where do we stand with it, that storm water 25 program? She wants to come and meet us 8 1 again. Do you want to do it in executive 2 session next month or at our next meeting? 3 MR. LOPATKA: Sure. 4 MR. HOOVER: We'17 sit and talk with 5 her about this 01d Forge storm water program 6 they want to do. We didn't say we were 7 going to be members of it yet. 8 MR. LOPATKA: Right. That's the 9 group that they're trying to put together. 10 MS. BARTOLETTI: That's the one with 11 the city of Scranton. 12 MR. HOOVER: Maybe I'11 call her and 13 tell her to come for an executive session at 14 our next meeting. 15 MR. RUSSELL RINALDI: Any other 16 questions for David? 17 MR. KOMENSKY: Dave, I know 18 Councilman Hoover asked you about looking at 19 the DPW garage. Did you ever look at that? 20 Or could we get together? 21 MR. LOPATKA: We can get together. 22 I didn't look at it. 23 MR. HOOVER: Looking at adding on 24 getting a grant and adding on to the back of 25 it because our DPW is getting bigger and we 9 1 have a lot of machines. I don't want to be 2 spending $100,000, $300,000 for the leaf 3 truck and have it sit outside. I think I we 4 can do some work on the back of the DPW and 5 extend it. 6 MR. LOPATKA: If you guys want to 7 call me and set up a time. 8 MR. RUSSELL RINALDI: Any other 9 questions for Dave? Thank you, David. 10 Chief Dubernas, good evening. 11 Anything for the meeting tonight or the 12 upcoming agenda? 13 CHIEF DUBERNAS: Two things. First, 14 I've passed out the drawing of the side of 15 the building from Thornton for the two 16 different designs he made up. One has a 17 five and a half by seven foot patch and the 18 other one is a three by four patch and a 19 color switch. 20 Then second for the agenda, we 21 already use NEPA Towing as our heavy-duty 22 tower. I'17 have it in all the packets 23 their insurance, all pictures of their 24 vehicles. They just want to be added on to 25 the regular towing, too, now, because 10 1 they're going to be stationed in Taylor, on 2 Oak Street. 3 MR. RUSSELL RINALDI: So it would be 4 added on with the other two we currently 5 have? 6 CHIEF DUBERNAS: Yes. I'17 give you 7 a copy of their insurance and everything 8 else. We already use them for our 9 heavy-duty stuff. 10 MR. RUSSELL RINALDI: Anything else, 11 Chief? 12 CHIEF DUBERNAS: That's it. 13 MR. RUSSELL RINALDI: Any members 14 have any questions for the chief? 15 MAYOR LEGG: Is Billy going to still 16 be able to tow? 17 CHIEF DUBERNAS: I'm not sure what's 18 going on. I know Morrell is covering him 19 right now. 20 MR. RUSSELL RINALDI: Any members 21 have any questions for the chief? Chief, I 22 have two. It's about the sign. First of 23 all, thank you for getting this back to us 24 sO fast. 25 Second, what one would you 11 1 recommend? 2 CHIEF DUBERNAS: The smaller one. 3 That first one is monstrous. I think I'11 4 have him move it down a little bit. Same 5 area, just drop it a little bit. 6 MR. RUSSELL RINALDI: You're 7 satisfied as far as the design and 8 everything? Just before council considers 9 which one. Like I said, I'd like to hear 10 your recommendation, too, before we discuss 11 it. So this is the one you recommend. 12 MR. HOOVER: Is that area lit up at 13 night? 14 CHIEF DUBERNAS: Long story. It is 15 now. We shut the timers off on the lights. 16 When the timers went off everything on the 17 building went black. 18 MR. RUSSELL RINALDI: We had to have 19 the company come back. 20 CHIEF DUBERNAS: We shut the timers 21 off sO we can have lights. 22 MR. RUSSELL RINALDI: We had the 23 company come back about a month and a half 24 ago and set all the timers the right way. 25 CHIEF DUBERNAS: They didn't set 12 1 them the right way. It was a mess. 2 MR. RUSSELL RINALDI: Everything's 3 in order now? 4 CHIEF DUBERNAS: For now. We just 5 shut them off. At 9:00 at night the lights 6 would go out and come back on 5:00 in the 7 morning. 8 MR. RUSSELL RINALDI: As long as 9 it's taken care of. Anything else? 10 CHIEF DUBERNAS: That's it. 11 MR. RUSSEL RINALDI: Anyone else 12 have anything for the chief? Thank you, 13 Chief. 14 Attorney Rinaldi, anything for the 15 meeting tonight or for the upcoming agenda? 16 ATTY. RINALDI: So Marylynn's going 17 to put in an ad. I just want to make sure. 18 It's going to be an advertisement to fill 19 the vacancy on council to, be voted on on 20 February 18th at the regular meeting. 21 Resumes should be in by the 18th at 3:00. 22 Since we already have interviews for the 23 vacancy board at 6:00 we can make these at 24 6:30, if everybody's okay. Then I'17 have a 25 draft resolution for the appointment of that 13 1 council seat. 2 Also, the resolution for the vacancy 3 board, that's advertised for that 4 appointment. 5 I believe there's a subdivision that 5 has to be approved. 7 MR. SOKOLOWSKI: Yes. 8 ATTY. RINALDI: And an extension of 9 the preliminary plan for Holly Ridge, that 10 was approved. 11 And lastly, pave cut ordinance, 12 anything on that one? 13 MR. HOOVER: I'm just about 14 finishing it up. 15 ATTY. RINALDI: So we're just going 16 to do a draft. The nuisance vehicles, I can 17 get you some kind of a draft. We're not 18 going to be passing that on the 18th. 19 That's it. 20 MR. RUSSELL RINALDI: Any members 21 have any questions for the solicitor? The first one, I guess, is more 3 towards Jimmy. The loan for paving, have 4 you given any thought to that? Are we going 5 to attempt to do the PIB loan for this 6 upcoming year? It's starting to get late, 7 sO I'd like to try to get that in. 8 MR. HOOVER: Well, that's up to 9 everybody. Right now I have $1.7 million 10 that Dave has estimated SO far for me, and 11 it's about five more streets that I've 12 added. 13 MS. BARTOLETTI: So maybe we'17 put 14 it on the agenda in two weeks. 15 MR. HOOVER: We have a lot of 16 streets. It's, like, $2 million worth of 17 streets that we have to do. I'd like to do 18 it, yes. 19 MS. BARTOLETTI: Okay. Then just 20 the other thing is at our last meeting we 21 spoke a little bit about the grant that the 22 little league has, and we discussed changing 23 it to the borough and changing the scope of 24 the work. Is this something that all of you 25 are into? Is it something that I should go 15 1 forward with? 2 MS. SHOTWELL: Yes. 3 MR. BUTLER: Yes. 4 MR. HOOVER: Yes. Do we have to 5 change the name? 6 MS. BARTOLETTI: We'11 get all that 7 done. I'11 start to get the preliminary 8 paperwork done, and then what we're going to 9 have to do is finalize a plan. Dave and I 10 spoke about it. We have a couple ideas that 11 I'd like to talk about maybe in a recreation 12 committee meeting. That's all. 13 MR. I'd like 22 to hear what we're looking at, what we're 23 applying for. 24 MR. RUSSELL RINALDI: The last time 25 I spoke with Mr. Barrett was probably about 17 1 two months ago. He said whenever we want 2 him to come in. 3 MS. SHOTWELL: So if somebody can 4 reach out to him. 5 MS. BARTOLETTI: I'm in touch with 6 him quite often. We'11 see what we can set 7 up. 8 MR. RUSSELL RINALDI: Should we 9 bring him in for the next work session a 10 month from now? 11 MS. BARTOLETTI: I think a month 12 from now because we have SO much going on. 13 MS. Council had an 14 executive session on January 3rd regarding a 15 personnel matter. So I wanted to address 16 the public on the record and let them know 17 that. 18 Second, I was contacted today by our 19 chairman of our planing commission, Vince 20 Piccolini. He brought it to my attention 21 that the original anvil that was in the 22 forge a couple hundred years ago, where 23 Popil Coal is now, he said he has 24 information from the historical society 25 that's where the original forge was and the 19 1 original anvil that was in there is. It's 2 at the museum at McDade Park. He said he 3 spoke to some of the historical society 4 members. 5 MS. BARTOLETTI: I've spoken to them a several times. It's actually at the 7 Lackawanna Historical Society, in their 8 building. They had a couple people contact 9 them from different organizations from the 10 borough asking to - that the borough wants 11 it back. They are not willing to give it 12 back until they know where the permanent 13 home would be and that it passes all of 14 their inspections and all that. They've 15 been asked to loan it for a coupe months and 16 then they would give it back. They're not 17 willing to do anything like that until they 18 know where, when, what's the spot. They 19 have to check it out to make sure that the 20 historical piece would be protected. 21 If the borough is interested, 22 because the oorough would have to drive it. 23 It wouldn't be just anybody saying we want 24 it. It would have to come from the borough 25 and we would have to provide all the 20 1 information on exactly where it would be, 2 how it would be maintained. 3 Most recently, I was in contact with 4 them just a couple months ago when we were 5 trying to plan our anniversary celebration, a thinking that we would be able to bring it 7 here for that. But right now I'm 8 comfortable where it is, I'm sure everybody 9 else is comfortable where it is. 10 MR. RUSSELL RINALDI: So there's 11 more to it than - = because what he was told 12 was - and he could have been misinformed. 13 They said that council needed to send them a 14 letter with a resolution saying that we 15 approved that we want it back and that we 16 could put it - - obviously, we could put it 17 wherever we want. I figured we'd put it in 18 the borough building. Correct? 19 MS. BARTOLETTI: It takes a lot to 20 move it. It's hundreds of pounds. They 21 need a guarantee that it's going to be taken 22 care of, that it's going to be in a place 23 that's going to be here for a long time and 24 it's going to be taken care of. They won't 25 just let you put it in a park or a temporary 21 1 building or anything like that or put it on 2 display someplace outside, you know, as we 3 said, for our celebration or whatever. It 4 has to be in a permanent location. If it's 5 something council still wants to do we can 5 work on it. 7 MR. RUSSELL RINALDI: First time I 8 heard of it, SO I figured I'd bring it to 9 your attention. 10 MR. KOMENSKY: Maybe we can go look 11 at it. 12 MR. RUSSELL RINALDI: I wanted to 13 bring it to everybody's attention. I have 14 nothing else. 15 Mr. Stull, assistant fire chief, I 16 skipped over you. Do you have anything for 17 the meeting tonight or the upcoming agenda? 18 MR. STULL: Going back to the 19 building that burned down over on Oak 20 Street, I know it's in with the lawyers and 21 everything like that. On the borough side, 22 isn't there anything that we can keep fining 23 it for even though it's in litigation? 24 ATTY. RINALDI: Actually, is it the 25 insurance, that they don't want to pay? 22 1 MS. SHOTWELL: There's, like, a 2 subrogation. 3 MS. BARTOLETTI: The insurance is 4 saying that there's two buildings and they 5 feel that the insurance was on one building 6 but not the second building, and that's why 7 it's in litigation. Mike's been in touch 8 with them quite a bit and doesn't seem to be 9 getting anywhere because it's being bounced 10 around in the courts. 11 MS. SHOTWELL: There was supposed to 12 be a hearing in front of Judge Gibbons on 13 the 31st of January. 14 MR. SOKOLOWSKI: I talked to them 15 two weeks ago and I didn't hear anything 16 after that. 17 MR. KOMENSKY: Bill, can we find out 18 what happened? If not, we'17 get the book 19 out through public safety. I will meet with 20 Mike and Bill and see what we can do. The 21 international property code or something. 22 MS. BARTOLETTI: Usually when 23 there's a fire the insurance company sends 24 the check to the borough in escrow until the 25 building is brought to where it needs to be, 23 1 but pecause the insurance is fighting it 2 there's no check. So it threw the whole 3 system off. 4 MR. KOMENSKY: Maybe we need to 5 start getting together, get the book out. 6 MR. RUSSELL RINALDI: I have no 7 other items.
