We 4 began about 18, 19 minutes late. We held 5 interviews for two vacancies. We have the 6 vacancy chairman. We had interviews at 7 6:00. Then we had a borough council vacancy 8 which began at 6:30. Council had an 9 executive session in oetween both to discuss 10 the interviews, SO that's why we ran late. 11 Once again, we apologize. 12 The purpose of tonight's meeting is 13 we're going to go through a few housekeeping 14 motions. We have a public sign-in sheet 15 that the chief has if the public would like 16 to address us. Then we'11 go down our 17 department heads. We'11 eventually hear 18 from our borough council members, our mayor, 19 our solicitor and borough manager. 20 Before we begin the meeting with our 21 regular housekeeping we're going to skip 22 forward to our first two items under new 23 business because we have to appoint these 24 two seats or make a motion to appoint them, 25 and if they do Mr. Seig has to swear them in 4 1 and we're going to adjourn the meeting. 2 So just to give you a brief 3 description, the first item is going to be a 4 resolution to appoint a member as the 5 chairman to the vacancy board. Council 6 legally advertised and we accepted 7 applications until last Friday at 3 p.m. to 8 the borough manager. We had one applicant. 9 That applicant is in the audience. We 10 interviewed her at 6 p.m. this evening. 11 So at this time the chair is going 12 to entertain a motion - - and this is just to 13 open up nominations. 14 MS. We ran a legal 15 ad and applications were due back by this 16 afternoon at 3 p.m. We had three 17 applicants. One person called up and pulled 18 their application out, sO we had two. We 19 had interviewed those applicants at 6:30. 20 At this time the chair would now 21 entertain a motion just to open up 22 nominations for the borough vacancy seat. 23 This is just to open up nominations. 24 MS. BARTOLETTI: There are some that 22 are in the processes of being run, but 23 they're there for a reason. 24 MR. BROWN: There is one down on 25 Sussex Street. There's two different ticket 20 1 numbers but they don't seem to be of 2 priority. 3 MAYOR LEGG: Thanks, Chief. 4 MR. I know we asked 7 you to get some price quotes and some 8 measurements for the sign for the police 9 station. 10 CHIEF DUBERNAS: I gave them to you 11 the last meeting. 12 MS. SHOTWELL: I thought prices were 13 on there. 14 CHIEF DUBERNAS: I changed to the 15 smaller one. I talked to Mike about it. We 16 just told them we wanted the sign because 17 Mike said they can probably do the 18 electrical hookup. They have a light there 19 they can just tap right into. 20 MR. RUSSELL RINALDI: So we're just 21 waiting to get the price 22 CHIEF DUBERNAS: Confirmation from 23 him. 24 MR. RUSSELL RINALDI: on the 25 smaller one. The one that you recommended. 21 1 Anything else? 2 CHIEF DUBERNAS: No. 3 MR. RUSSELL RINALDI: Bill Stull, 4 assistant fire chief. Good evening. 5 Anything for the meeting? MR. STULL: Two things. First of 7 all - and this is for Dave. Did you hear 8 anything back from PennDOT? a MR. LOPATKA: Yeah, we had 10 discussions with PennDOT. I talked to the 11 borough. PennDOT doesn't require a traffic 12 study for that type of signal. What needs 13 to happen is the borough needs to contact 14 them. There's a couple things. One is you 15 want flashing lights somewhere, sO to do 16 that we would have to submit something to 17 PennDOT. Not a traffic study. They don't 18 need that. But it would need some kind of 19 actuary SO it's not blinking all the time 20 and only blinks when you're going to be 21 pulling out. 22 I know there was a cost associated 23 with that. A pretty stiff cost. I think I 24 talked to you about it. So the borough has 25 to make the final decision as to whether or 22 1 not you want to move forward with that. But 2 I did talk to them. That was probably after 3 last month's meeting. 4 MR. KOMENSKY: They will only let us 5 put the one that doesn't blink all the time? 6 MR. LOPATKA: Yes, to answer your 7 question. They would prefer to see one that 8 only comes on when - - sO there has to be 9 something that kicks it on, whether it's you 10 guys get a call or whatever the case may be. 11 But it would actually turn the light on and 12 starting to blink, an actuary at that point. 13 So that was kind of what the discussion that 14 I had was. 15 MS. BARTOLETTI: Dave, could you 16 e-mail that to me, the information? 17 MR. LOPATKA: Sure. 18 MR. STULL: Second thing is April 19 5th and 6th, it's on a Saturday and a 20 Sunday, the Pennsylvania State Fire 21 Academy's On the Road program, we have them 22 coming over to our station. They're going 23 to do a flashover simulator. So what that 24 is, they actually do a live fire inside one 25 of their trailers that they will bring up. 23 1 So my question - - and I know I have 2 to submit for a DEP permit because it is 3 live fire and smoke. But what's the 4 borough's thing on notifying the residents 5 around there? Do I send out letters to a them? 7 MR. RUSSELL RINALDI: If we don't 8 have anything like that on the books, and 9 I'm not aware that we do, I would say we 10 should send something out to them just sO 11 they're aware that it's a controlled 12 simulation. 13 MR. STULL: People over on Reese 14 Street, Grace Street and right there on West 15 Oak Street that are behind our property. 16 MR. KOMENSKY: You're going to do it 17 at your property? 18 MR. STULL: Yes. We need a pretty 19 big area to do it. 20 MR. KOMENSKY: Maybe Jay could put 21 the signs up in the parking lot the week 22 before to at least say live burn. 23 CHIEF DUBERNAS: We can put the 24 signs out a week before. 25 MR. HOOVER: Put it on the website, 24 1 too, a couple days before, let people know, 2 because everybody's going to see the smoke. 3 MR. RUSSELL RINALDI: Obviously put 4 it on your Facebook page and we'11 put it on 5 our website, too, and if we can get some letters out. 7 MR. STULL: We'11 definitely do 8 that. 9 MR. I think we have 25 1 the plans here for Bernie Andrione, which is 2 a pretty straightforward subdivision. Did 3 we get anything from Emlaw? 4 MR. SOKOLOWSKI: No. 5 ATTY. RINALDI: We addressed it in 13 the new zoning ordinance, which I thought we 14 would have passed by now. 15 MR. KOMENSKY: In absence of that 16 could we - 17 ATTY. RINALDI: I guess we can peel 18 that section out and try to amend the zoning 19 ordinance. 20 MR. HOOVER: He wants it done not 21 soon, but it's almost a year now. 22 ATTY. HOOVER: The skilled games, the 25 machines, we were going to - there's an 26 1 awful lot on this list that Billy has that 2 we just keep adding to it but we're not 3 removing them. 4 ATTY. RINALDI: Supposedly there's a 5 case that came out of Philadelphia and I 6 cannot find it anywhere published. There 7 was some sort of a decision on whether the 8 ordinances are good or bad. At our 6 last meeting we said it was going to be 7 starting, but if anyone wants to take a peek 8 in there and see how much has been done. 9 We had a sewer committee meeting 10 last weak. It was a very brief meeting to 11 discuss the software and to come up to a 12 decision on that. 13 And just to let you know an update 14 on the tax collector. So he's been here 15 basically every day. He's up and running. 16 His e-mail is working, his phone is working. 17 Bank accounts have been changed, and the 18 bills are already here and they're in the 19 process of getting them in the envelopes and 20 getting them mailed out. So it's working 21 very, very well. Just SO you know. That's 22 really all I have for tonight. 23 MR. KOMENSKY: I would just like to 24 say Mare, thanks a lot. I know the tax 25 collector takes a lot of time out of your 29 1 days and weeks and months. So I would just 2 like to thank you for sticking with it and 3 I'm glad John's doing really well. 4 MS. Before we go into new business 17 we'11 go into public comment. 18 CHIEF DUBERNAS: One name, Mr. Mark 19 Kania. 20 MR. RUSSELL RINALDI: Mr. Kania, how 21 are you? 22 MR. KANIA: Thank you for hearing 23 me. I actually have two questions to pose 24 to council this evening. First one is what 25 is considered an acceptable time for raw 31 1 sewage to run on my walkway and continue 2 down? 3 MR. RUSSELL RINALDI: First my 4 question back to you would be I don't think 5 there's any acceptable time for raw sewage 6 to be anywhere other than in sewers. Where 7 is it coming from? 8 MR. KANIA: Well, first of all I've 9 been in touch with Mike and Joe Lenceski, 10 and to their credit they've been great. 11 They've been making phone calls. There has 12 been raw sewage running down my walkway 13 alongside my house, which would be the 14 continuation of Stewart Street. 15 MR. RUSSELL RINALDI: Where the dead 16 end is, goes up to the top 17 MR. KANIA: Apparently he has a 18 broken sewer line. Now, back - and this is 19 going on for three months now. 20 MR. RUSSELL RINALDI: If I can stop 21 you there. Mike and Joe, did we look at it? 22 Did the sewer line come from the house or 23 from one or our sewer lines? 24 MR. SOKOLOWSKI: No, from the house. 25 MR. KANIA: It's the person. First 32 1 I thought it was just water. I had no idea 2 what it was or where it was coming from. 3 There was no smell. To the point where I 4 know I had to call the borough when the 5 intersection froze. There was enough water 6 in the street that it froze over. 7 So I finally called the water 8 company, and it was a Sunday. The guy came 9 down, he said I got bad news for you. It's 10 not a water line, it's the sewer line up 11 above. So I got a hold of Joe and Mike 12 and again, to their credit they contacted 13 the homeowner and everything was apparently 14 cordial. However, there was no action being 15 taken on the homeowner's part. 16 My problem with all of this, which 17 is why I am in front of council, I just wish 18 that the property had been condemned earlier 19 sO that - 20 MR. RUSSELL RINALDI: There's 21 somebody living there? 22 MR. KANIA: Yes. The big issue is, 23 for any council members who aren't familiar 24 with the area I'm talking about, it is a 25 major walkway to and from the school 33 1 district. I've got kids walking through 2 MS. SHOTWELL: Where are we talking 3 about? 4 MR. KANIA: I'm at the corner of 5 Powell and Steward. You turn across from 6 Turkey Hill. Powell and Steward, come to 7 the stop sign. That hill going up. Kids 8 are walking through that raw sewage, taking it to the school, they're taking it home and 10 everything else. So that was my only feat. 11 So Mike and Joe were on the homeowner and 12 finally they got some sort of an agreement. 13 There's a machine sitting up on top of the 14 hill now for the last couple days. So it's 15 a nice lawn ornament. 16 MR. SOKOLOWSKI: He's supposed to 17 start. He said the ground is frozen. It 18 hasn't been flowing for a while. But like I 19 said, we tried to divert it about three, 20 four weeks ago when Joe and I got there. 21 First, second week of January. Like I said, 22 we went down to look, we didn't see exactly 23 what it was at first until we saw that it 24 was a sewer line. 25 MR. KANIA: The guys from the 34 1 borough came up and put sandbags up, put 2 horses across to block the sidewalk. 3 MR. SOKOLOWSKI: So nobody would 4 walk through it. 5 MR. KANIA: Again, to their credit 6 they did a great thing. My only gripe is 7 that the building wasn't condemned for 8 occupancy sO that it was stopped. 9 So having said that I have a second 10 question, and part of what Mr. Hoover said 11 earlier about a hole being dug in the 12 street. When someone causes damage to 13 property and they're told to stop and they 14 stop they're still responsible to repair it. 15 Is that correct? In other words, if 16 somebody's driving across the lawn here 17 ATTY. RINALDI: On your property? 18 MR. KANIA: My property, the 19 borough's property, whoever, and say look, 20 he can't drive across the lawn anymore. 21 Okay, great, but the lawn's all torn to 22 pieces. He's responsible to repair it, is 23 he not? 24 ATTY. RINALDI: If he's driving on 25 your property, yes, you have an action you 35 1 can take. 2 MR. KANIA: That leads into my next 3 statement. Years ago the borough had 4 diverted water at the top of the hill, near 5 the oroperty that we're talking about. It 6 cascaded for years down my sidewalk. I've 7 presented a photo of it and video of it. 8 MR. RUSSELL RINALDI: This is where 9 it damaged your wall. 10 MR. KANIA: My wall and my sidewalk. 11 MR. RUSSELL RINALDI: I remember. 12 MR. KANIA: Now, back to my previous 13 situation. A11 that solidified sewage is 14 hanging up where the sidewalks are uneven. 15 So is the borough going to do anything to 16 repair the damage that was caused by their 17 action years ago? I mean, I realize there 18 wasn't a soul on this board right now that 19 was involved about 30 years ago that this 20 took place and I've been after this borough 21 council for all those years. 22 MR. RUSSELL RINALDI: Mr. Kania, on 23 the second question where the water was 24 coming down, not the sewage, was that just 25 water running off the top, down the road? 36 1 MR. KANIA: Yes. 2 MR. RUSSELL RINALDI: So it was 3 coming from the top of the borough road, 4 through another borough road 5 MR. KANIA: The reason it came down 6 at such velocity is that the borough had 7 done something up at the top to divert the 8 water and it came down. In fact, Mike, you 9 can attest to the condition of the walkway 10 above the property. It looks ungodly. 11 There are potholes two feet deep, the entire 12 sections of sidewalk are gone, and more than 13 once I had to have the borough come up to 14 clean the intersection out oecause of all 15 the debris, and it cleaned out - I had 16 decorative stone alongside my wall. I would 17 go out with the snow shovel and wheelbarrow 18 and collect the stone to put it back. 19 Dave came up quite a few times and 20 the oorough did rectify the problem with the 21 water coming down but the damage was done, 22 which was my question with Mr. Rinaldi. So 23 the damage was done and it was caused by 24 borough actions. 25 MR. HOOVER: The street on the top 37 1 is Corcoran? 2 MR. KANIA: Yes. 3 MR. HOOVER: I remember you coming 4 here with a water problem. 5 MR. KANIA: I've sent certified 6 letters to the borough, I came in here with 7 pictures upon pictures upon oictures. 8 MR. HOOVER: Mr. Carey came, too. 9 MR. RUSSELL RINALDI: Mr. Kania, 10 this is what I would suggest. First of all, 11 I would suggest we send the engineer up 12 there and have him look at the road and see 13 exactly how we can fix the problem. Do we 14 need an inlet, do we need 15 MR. KANIA: The water's no longer an 16 issue. They put a catch basin up top, 17 rerouted it. The water's no longer an 18 issue. I'm very grateful for that. It 19 caused the damage. The damage was already 20 done. 21 MR. RUSSELL RINALDI: Did you have 22 the property fixed? 23 MR. KANIA: I have not had the 24 property fixed. 25 MR. RUSSELL RINALDI: So my second 38 1 thing would be that if that was our water 2 that you're saying coming down the road and 3 we have Dave look at it or Joe, I would say 4 that you should get an estimate, fix your 5 property and bill the borough. That's me. 6 So if it was our road and we didn't maintain 7 it properly, we didn't drain the water 8 properly, we didn't flow the water properly 9 and it went onto your property and damaged 10 it you should get an estimate from your 11 insurance company, an estimate to fix it, a 12 price, and I would say bring it to us. I 13 personally would vote to pay for that if we 14 were the ones responsible for it. Sounds 15 like we are. 16 MR. HOOVER: That's a borough road. 17 The water main went up sO far. 18 MR. KANIA: The water shutoffs are 19 right behind where I park my car. Probably 20 50 feet off the intersection with Powell 21 there are two shutoffs. 22 MR. HOOVER: There's a water main 23 that comes up there. 24 MR. KANIA: We were always told that 25 Carey's and ours were dead end. 39 1 MR. HOOVER: That section was paved. 2 The section above that is a mess now. I'17 3 get a machine up there and clean it up a 4 little bit. 5 MR. KANIA: Fortunately now I'm very 6 grateful. 7 MR. HOOVER: Is that a borough road 8 all the way to the top? 9 MR. SOKOLOWSKI: It's a right - 10 MR. HOOVER: If you get a backhoe up 11 there, back blade it, throw some modified 12 down there and cleaned up a little bit. 13 Especially with the sewer now being a 14 problem. 15 MR. SOKOLOWSKI: Part of it's going 16 to be dug up. 17 MR. KANIA: They may have to go 18 through that right-of-way just to get - 19 MR. SOKOLOWSKI: It comes out in 20 back of the house. The main sewer runs 21 right up Stewart Street right to Corcoran. 22 It comes out the house oehind the house and 23 goes in. 24 MR. KOMENSKY: In that right-of-way. 25 MS. SHOTWELL: What exactly is the 40 1 damage to the property? Have the sidewalks 2 caved? 3 MR. KANIA: The sidewalks are all 4 heaving. Between the sidewalk and the curb 5 there are areas that are gapped that much. 6 The sidewalk is this much below the curb. I 7 don't know if they're still on record but 8 there are a whole host of photos. Sidewalk 9 and retaining wall. Fortunately there was 10 no damage to my home. 11 MR. RUSSELL RINALDI: If you can get 12 that for us and submit it to the borough 13 manager, bring it to the office. 14 MR. KANIA: Thank you very much. 15 MR. SOKOLOWSKI: I did talk to that 16 guy again. The machine, he had to change 17 the teeth on the bucket for frost to dig. 18 It's still frozen, sO it's not flowing. 19 MR. RUSSELL RINALDI: Chief, no 20 names? 21 CHIEF DUBERNAS: No. 22 MR. A17 we 8 have intentions of is making sure, number 9 one, that the zoning officer gets the house 10 on the corner to fix their sewer pipe sO the 11 raw sewage isn't coming down, and also 12 Mr. Kania, we asked him to get us an 13 estimate for the damage to his property that 14 the water caused. But to open the road 15 right now, I don't think council has any 16 intentions of that, do we? No. 17 MR. LOPATKA: That has a serious 18 slope on it. 19 MS. SHOTWELL: I understand the 20 ground is frozen, but shouldn't they also be 21 responsible for some sort of environmental 22 cleanup? We can't have raw sewage - - is 23 that not something we should arrange and 24 they should pay for? 25 MR. SOKOLOWSKI: Joe talked to DEP 42 1 about that. I'm not sure exactly what they 2 came up with. I'11 give Joe a call 3 tomorrow. 4 MR. KANIA: I spoke with DEP also 5 and I was told that, A, it is not a state 6 issue, it is a municipal issue. B, their 7 recommendation on anything on surface would 8 be to spread lime on it because it brings 9 the PH that the pacteria can't survive in 10 it. I asked about all of the sewage that 11 had drained down below my sidewalks, and he 12 said that basically became its own sewer 13 pipe. It's filtered through and it 14 basically decontaminates itself. 15 MS. SHOTWELL: Can we spread lime? 16 MR. SOKOLOWSKI: Sure we can. 17 ATTY. RINALDI: It's his property. 18 He's got to spread the lime. 19 MR. SOKOLOWSKI: It's in the 20 right-of-way. 21 MR. LOPATKA: : I think it's more all 22 vegetated up through there. 23 MR. SOKOLOWSKI: It's soil. It's 24 just going to seep through. Once he gets 25 done excavating to put the new sewer line in 43 1 it's going to be gone. 2 MR. RUSSELL RINALDI: Is it running 3 right now or is it frozen? 4 MR. SOKOLOWSKI: It's frozen. It's 5 going to be gone once he starts digging it. 6 MS.
