A quorum was established, and all members were present. 2) REGULAR AGENDA a) Presentation/Discussion on proposed Ordinance #2025-0- 015 No Heavy Trucks on Side Streets in Main Street/Downtown Area - prohibiting heavy trucks from deviating off of Main Street or Hwy 1869 onto side streets in downtown area. (J. Herrera, M. Banks) This issue was last discussed at the December 11, 2024, City Council meeting. This Ordinance may be considered during the Regular Called Meeting at 6 PM. City Council Workshop Meeting March 26, 2025 Page 1 of 2 Erin Higginbotham, via telephone, presented city legal counsel report on this proposed Ordinance. The City Council was working from the version called Version #4 3:35 PM, on 3.26.2025. This is the most updated version. (See Exhibit A') Interim Public Works Director James Herrera disseminated a large (tabloid size page) map of the downtown area to the City Council members for reference. This map will not be attached to the final Ordinance. There was a brief discussion of why this workshop/this Ordinance had been requested, that is, the high number oflarge heavy trucks driving on side streets in the downtown area that were not constructed to carry large trucks. Damage was being done to these smaller streets. It was noted that there are still a few corrections that need to be made to Version #4', such as some additional spelling corrections for some ofthe street names. Also, Interim Director Herrera will make a few more updates on the map. There were a few small tweaks discussed, such as removing the private parking lot of One Chapel, it is not a street. The Ordinance will then be ready for approval. City Attorney Marianne Banks explained that she was updating the proposed Ordinance Version #4' with the changes being requested, and she would email the final version to the City Secretary, and it will be known as Version 5'. During the Regular Called meeting tonight, the City Council will consider passage ofversion 5 ofthis proposed Ordinance (No. 2025-0-015) and the Ordinance caption will be read into the record. 3. ADJOURNMENT Given there were no further agenda items and hearing no objections from the Council, Mayor Mancilla adjourned the meeting at 5:43 PM. Streets in the Downtown Area AN ORDINANCE OF THE CITY OF LIBERTY HILL, TEXAS, AMENDING CHAPTER 11, ARTICLE 11.02, DIVISION 1, ADDING SECTION 11.02.004, TRUCK TRAFFIC, CODE OF ORDINANCES, CITY OF LIBERTY HILL, TEXAS, REGARDING REGULATIONS FOR TRUCK TRAFFIC PROHIBITED ON CERTAIN STREETS; PROVIDING FOR SEVERABILITY AND REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY;AND PROVIDING FOR PUBLICATION, ANDAN EFFECTIVE DATE. WHEREAS, the City of Liberty Hill, Texas (the "City"), is a home rule municipality located in Williamson County, Texas, created under the provisions ofChapter 9 ofthe Texas Local Government Code and operating according to the enabling legislation of the State ofTexas; and WHEREAS, pursuant to Texas Local Government Code Chapter 51, the City has general authority to adopt ordinances and regulations that are for the good govemment, peace, or order of the City and that are necessary or proper for carrying out a power granted by law to the City; and WHEREAS, the City has exclusive control over the highways, streets, and alleys of the City, including authority to regulate city streets as provided for in Chapter 311, Texas Transportation Code, and other law; and WHEREAS, the City Council finds that truck traffic pose a danger to persons and properties, including city streets, and result in increased traffic congestion impeding the safe flow of traffic for the general public when traveling in certain areas; and WHEREAS, the City Council finds that it is in the best interest of the City and in the interest of the health, safety, and welfare of its citizens to prohibit truck traffic on certain streets within the City; and WHEREAS, the City of Liberty Hill deems it necessary to adopt certain amendments to the Code of Ordinances to serve these public interests; and WHEREAS, the City finds that this Ordinance was passed and approved at a meeting of theCity Council ofthe City ofLiberty Hilll held in strict compliance with the Texas Open Meetings Act at which a quorum of the City Council Members was present and voting. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LIBERTY HILL, TEXAS, THAT: City of Liberty Hill Ordinance 2025-0-015 No Thru Truck' Traffic (4) Page 1 of4 Section 1: The facts and recitations set forth in the preamble of this Ordinance are hereby found tol be true and correct. Section 2: Chapter 11, Article 11.02, Section 11.02.004, Code of Ordinances, City of Liberty Hill, Texas, is hereby amended to read as follows in Exhibit "A," attached hereto and incorporated by reference herein. Section 3: Severability. Ifany clause or provision oft this Ordinance shall be deemed to be unenforceable for any reason, such unenforceable clause or provision shall be severed from the remaining portion of the Ordinance, which shall continue to have full force and effect. Section 4: Repeal. This Ordinance shall be and is hereby cumulative of all other ordinances of the City of Liberty Hill, Texas, and this Ordinance shall not operate to repeal or affect any of such other ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this Ordinance, in which event such conflicting provisions, ifany, in such other Ordinances arel hereby repealed. Section 5: Penalty. Penalties for a violation of this Ordinance shall be as provided for in the attached Exhibit "A" and by the Code of Ordinances generally. Section 6: Effective Date. Truck Traffic. (a) Purpose. The purpose of this article is to establish general regulations controlling through heavy truck traffic for certain trucks driving or operating on streets, roadways or rights-of- way, or any segment thereof, within the corporate limits of the city. (b) Applicability, The provisions of this article prohibiting the driving or operation of heavy trucks shall apply at all times or at those times herein specified or as indicated by official signs or in compliance with the directions of a police officer or official traffic-control device. (c) Definitions. The terms recited herein shall have the following meanings: (1) Types of vehicles named shall have the meanings ascribed to them in the Texas Transportation Code, section 502.001, and as hereafter amended. (2) For purposes of this article, "heavy truck" means any truck or tractor-trailer combination that has dual wheels or tandem rear axles, and which has a rated capacity of12,000 pounds gross vehicle weight (GVW). (d) Operation on certain streets is prohibited. It shall be unlawful for any person to drive or operate any prohibited heavy truck on any street, roadway, or right-of-way or segment of such street, roadway, or right-of-way within the city limits when such prohibition is visible on: a sign or signs prohibiting through truck traffic; provided, however, that this prohibition shall not apply to trucks being used to make deliveries or pickups from a residence or business located on said street or street segment. When signs are erected giving notice thereof, through heavy truck traffic shall be prohibited upon those streets or portions of streets as follows: (I) On Barton Lane from RR 1869 Entrance to Aynsworth Street CR 279 Entrance. No person shall cause, allow, or permit any truck owned by him/her or registered in his/her name or operated by him/her to drive or operate in violation of fany provision of this article or state law. Proof that a vehicle found so driven or operated was registered inaj person' 's name shall constitute prima facie evidence that such person caused, allowed, suffered or permitted the vehicle to be driven or operated at the place where such violation occurred. (1) Except as provided in subsection (2) below, the registered owner and the operator ofa vehicle, when not the same, shall both be in violation ofthis provision, unless the owner can prove that the vehicle was operated without his/her express or implied consent. (2) A vehicle owner who is engaged in the business of renting or leasing vehicles under written rental or leasing agreements shall not be in violation of this provision on a rented or leased vehicle if, within thirty (30) days after receiving written notice of as violation under this article, the owner provides a sworn affidavit that includes the true name, address, driver's license number and state of issuance of the person in possession of the vehicle at the time the citation was issued, or a true copy of the lease or rental agreement in effect at the time the citation was issued. () Enforcement It shall be the duty of the chief of police or any other police officer having jurisdiction within the corporate limits of the city to enforce the provisions of this article. The City Manager, or designee, is authorized to erect signs consistent with this section. (g) Criminal Offense. A person commits an offense if the person operates a heavy truck, or causes, allows, or permits a heavy truck to operate, on any street, roadway, orright-of-way or segment of such street, roadway, or right-of-way within the city limits where operation ofheavy truck is prohibited. (1) It is an affirmative defense to prosecution of an offense under this section that the operation of the heavy truck on the particular roadway was required to makea delivery or pickup from a residence or business located on said street or street segment. (h) Penalty. Any person, firm or corporation violating any ofthe provisions of this article shall be deemed guilty ofa misdemeanor and, upon conviction in the municipal court of the city ori in any other court of proper jurisdiction, shall be subject to a fine in accordance with the general penalty in section 1.01.009 of this code for each offense.
