The effects are not only immediate, but can lead to long term psychological, emotional, and physical effects with lasting consequences. Child abuse prevention programs in our community are important and necessary to promote the well-being of children and families in a safe, stable, and nurturing environment. ATTACHMENTS Child Abuse Prevention Month Proclamation -1- Child Abuse Prevention Month Proclamation WHEREAS, over 286,000 children in Texas are reported as abused or neglected every year; and WHEREAS, over 125 cases of child abuse and neglect were reported and investigated in Fayette County in 2024. We know that 43 of our children fell victim to neglect and abuse and know that many more suffer in silence; and WHEREAS, child abuse and neglect are a serious problem affecting every segment of our community, and finding solutions requires input and action from everyone; and WHEREAS, our children are our most valuable resources and will shape the future of Fayette County; and WHEREAS, child abuse and neglect are not only felt immediately, but may lead to long-term psychological, emotional, and physical effects that have lasting consequences for victims of abuse; and WHEREAS, protective factors are conditions that reduce or eliminate risk and promote the social, emotional, and developmental well-being of children; and WHEREAS, effective child abuse prevention programs succeed because of partnerships among individuals, governmental agencies, schools, religious organizations, law enforcement personnel, and the business community; and WHEREAS, we acknowledge that we must work together as a community to increase awareness about child abuse and to promote the social and well-being of children and families in a safe, stable, and nurturing environment. REGULAR AGENDA The first item was to discuss and/or consider the establishment oft the La Grange Arts & Culture Fund to be known as the La Grange Arts Council. City staff were looking for City Council approval to establish the La Grange Arts & Culture Fund in partnership with the Greater Fayette Community Foundation (GFCF). This fund is designed to support charitable organizations that promote arts, culture, and community-engaged design as key components of community development. The agreement ensures that the fund will be administered by the Foundation while allowing for structured distributions to support local creative initiatives. The Fund will operate as a Quasi-Endowed Fund, meaning it allows for annual distributions up to 5% ofthe fund's value while also permitting extraordinary distributions with approval. The La Grange Arts Council will play a crucial role in guiding the fund's impact. The Council will be composed of nine (9) members, ensuring a diverse representation of artistic disciplines, cultural backgrounds, and community stakeholders. The council took No Action. The second item was to discuss and/or consider approval of a Lease Agreement between the National Multiple Sclerosis Society, South Central Region, and the City ofLa Grange, TX, for the VFW Hall during the annual BPMS150 bike ride. Lil" Einstein Daycare has taken over at 901 Mode Lane and is beginning demo and construction at the facility. The EDC Board has authorized a Commercial Lease Agreement with La Grange Brewing Company at 256 W. Colorado Street. The City Manager and EDC Manager are meeting with interested parties - future restaurant, retail, etc. at the 226 N. Main Street location. Citizen Participation Under Citizen Participation, Ken Edwards and Teresa von Rosenberg spoke. Items of Community Interest City Secretary Janet Bayer reminded council ofthe Texas Healey Roundup 44 car show on Saturday, April 5th around the square with cars available for viewing at 9am. Councilmember Ken Taylor invited everyone to the Queen oft the Holy Rosary picnic on Sunday, May 4th. SUMMARY The City ofLa Grange, Texas, operates under a Home Rule Charter, which establishes the structure and governance of the City Council. Article III of the Charter governs the City Council, and Section 3.02 outlines the qualifications and responsibilities ofi its members, including attendance expectations. Council Member Ms. Gross has requested an excused absence from regular meetings ofthe City Council due to a family illness and obligations. Council Member Mr. Kerr has also requested an excused absence from regular meetings due to work obligations. In accordance with the Home Rule Charter and longstanding Council practice, absences may be formally excused by a majority vote of the Council to maintain compliance with Charter expectations regarding attendance. FINANCIAL IMPACT N/A ATTACHMENTS Article III of City Charter - Information regarding council qualifications -6- La Grange Code ofOrdinances assessments levied against the property abutting thereon and the owners thereof, and such assessments may be levied in any amounts and under any procedure now or hereafter permitted by State law. The City Council shall have the power to assess a special tax on railways for improvement of area occupied by said railways in accordance with governing State law. As an alternate and cumulative method of developing, improving, and paving any and all public streets, sidewalks, alleys, highways, and other public ways within the corporate limits, the City shall have the power and authority to proceed in accordance with governing State laws. The City shall likewise have the power to make any such development, improvement or paving with its own forces if, in the opinion of the City Council, the work can be done more expeditiously or economically, and in such event the City shall have the power to reimburse itself for the cost of such improvement in the same amount and in the same manner as if the work had been performed by a successful bidding contractor. ARTICLE III. THE CITY COUNCIL Section 3.01. Number, selection, powers and term. The legislative and governing bodies of the City shall consist of a Mayor and eight (8) council members and shall be known as the City Council of the City of La Grange, Texas. The Mayor shall be elected at large by the qualified voters of the City. Two (2) council members shall be elected from each of the four (4) wards of the City. The term for the Mayor and council members shall be for two (2) years. Each member of the City Council shall serve until his/her successor is elected and qualified. The terms of the council members shall be staggered SO that the council member from each ward in the second year of his/her term in office shall stand for election. The Mayor shall be elected in odd numbered years. (Amnd. at an election held 5/1/21) Section 3.02. Qualifications. The Mayor and each member of the City Council shall be a resident citizen of the City of La Grange and shall be a qualified voter of the State of Texas, shall have been such resident citizen of the City of La Grange for a period of not less then [than] twelve (12) months immediately preceding the election; provided, however, that any person with the above qualifications, except as to residence, who shall have been a resident for a period of not less then [than] twelve (12) months immediately preceding the election of any of the territory not formerly within the corporate limits of said City, but which is annexed under the provisions of this Charter, shall be eligible for said office. If any council member fails to maintain the foregoing qualifications, the City Council must at its next regular meeting declare a vacancy to exist and shall fill said vacancy as set forth in Section 3.07 of this Charter. If any council member shall be absent from three (3) consecutive meetings without valid excuse, the City Council may declare a vacancy to exist and fill said vacancy as set forth in Section 3.07 of this Charter. The current fees, last set in May 2020, no longer reflect the actual cost ofl labor, equipment, and administrative services. Current Fees (2020 Rates): Mowing/Shredding: $50.00/hour Weed Eating: $20.00/hour per staff Brush/Trash Pick-Up: $25.00 (30-minute minimum) Backhoe/Dump Truck (Condemned Properties): $45.00/hour F-350 Dump Bed (Condemned Properties): $35.00/hour Administrative Fee (paperwork and certified mailing): $25.00 Proposed Updated Fees (2025 Rates): Mowing/Weed Eating: $85.00/hour (minimum) C This rate reflects the combination oft the previous separate charges for mowing ($50/hour) and weed eating ($20/hour), as well as an adjustment for inflation and increased service costs. Health and Sanitation ARTICLE 6.02. ACCUMULATIONS OF WEEDS, BRUSH, RUBBISH, ETC. & > 6.02.004. Grass, weeds or brush. (a) Growth restrictions. (1) It shall be unlawful for any person or entity owning or having supervision or control of any lot, tract, parcel of land or portion thereof, occupied or unoccupied, improved or unimproved, developed or undeveloped, within the corporate limits of the city, to permit uncultivated grass, weeds or brush to grow to a height greater than twelve inches (12") on any lot, tract or parcel of land within the corporate limits of the city. (2) It shall be unlawful for any person or entity owning or having supervision or control of any lot, tract, parcel of land or portion thereof, occupied or unoccupied, improved or unimproved, developed or undeveloped, within the corporate limits of the city, to permit grass, weeds or any plant to grow in, upon or across the sidewalk or street adjacent to the lot or property in the area. Cultivated vegetation may be adjacent to the sidewalk when not in violation of other city ordinances. Special concern must be afforded corner lots to prevent violation of other city ordinances regarding obstruction of line of sight. (3) The fact that a person is a present occupant of the premises shall be prima facie evidence that the person has supervision and control of the property. If the premises are unoccupied, the fact that a person is listed by the current tax roll as the owner shall be prima facie evidence that the person is the owner and has supervision and control of the lot. (b) Defenses. The following shall be affirmative defenses to any charge of permitting grass, weeds or brush to grow in violation of subsection (a) of this section: (1) The grass, weeds or brush islare located on land that is being used as a pasture for the grazing of livestock. (2) The grass, weeds or brush islare located on public property owned by the state or any of its subdivisions, and such governmental entity has determined that it is in the public interest that such property should remain in its natural, undisturbed condition and the vegetation on such property is in its native biome and the condition of such property does not present a danger or hazard to adjacent properties. (3) The city manager or his designee has determined that there is just cause to permit grass, weeds or brush to grow to a height greater than twelve inches (12") on a lot, tract or parcel of land within the corporate limits of the city. Just cause shall exist if one or more of the following factors apply to the lot, tract or parcel of land in question: (A) Areas determined to be areas designated for wild grasses or flower sanctuaries; (B) The topography of the land makes compliance with subsection (a) (growth restrictions) of this section impractical or impossit'j2- (C) The density of the brush makes compliance with subsection (a) (growth restrictions) of this section impractical or impossible; (D) Some act of the city makes compliance with subsection (a) (growth restrictions) of this section impractical or impossible; and (E) The land does not otherwise present a danger or hazard to adjacent properties. (Ordinance 05-18, sec. 2, adopted 11/14/05) $ 6.02.009. Remediation required. It shall be the duty of any person owning or having supervision or control of any lot, tract, parcel of land or portion thereof, whether occupied or unoccupied, improved or unimproved, developed or undeveloped, to: (1) remove all vegetation, trimmings, garbage and refuse; (2) cut or cause to be cut all grass, weeds and brush; (3) remove or cause to be removed any and all junk or unsightly matter; or (4) fill, drain, repair, remove or clean any condition on such lot, tract, parcel of land or portion thereof that is in violation of this article, or take any and all other action necessary to comply with this article, as often as may be necessary. (Ordinance 05-18, sec. 2, adopted 11/14/05) S 6.02.010. Notice of violation; annual notice. (a) Notice required. In the event that the person owning or having supervision or control of any lot, tract, parcel of land or portion thereof, whether occupied or unoccupied, improved or unimproved, developed or undeveloped, shall fail to comply with the requirements of section 6.02.009 of this article, notice of such violation shall be given prior to exercising the authority granted in section 6.02.011 of this article. (b) Method of service. Such notice shall be given: (1) Personally by hand delivery to the person owning or having supervision or control of any lot, tract, parcel of land or portion thereof in writing; (2) Personally by letter addressed to the owner at the owner's address as recorded in the county appraisal district's most recent tax roll records as provided to the city; (3) Personally by letter addressed to the person having supervision or control as recorded in official utility billing records as an active utility account; or (4) If personal service cannot be obtained as hereinabove set forth, notice may be given by: (A) Publication at least once in the city's official newspaper; (B) Posting the notice on or near the front door of each building on the property to which the violation relates; or (C) Posting the notice on a placard attached to a stake driven into the ground on the property to which the violation relates, if the property contains no buildings. If the city mails a notice to a person owning or having supervision or control of any lot, tract, parcel of land or portion thereof in accordance with subsection (b), and the United States Postal Service returns the notice as "refused" or "unclaimed, the validity of the notice is not af- fected, and the notice is considered as delivered. (c) Annual notice. After a person owning or having supervision or control of any lot, tract, parcel of land or portion thereof has been given one (1) notice of violation, annual notice may be given to the -13- person owning or having supervision or control of any lot, tract, parcel of land or portion thereof. Annual notice must be mailed to the person owning or having supervision or control of any lot, tract, parcel of land or portion thereof and posted on the property. Once the city has given such annual notice, no further notice shall be required prior to abatement by the city for that lot, tract or parcel of land for the year the notice was posted. If the city receives notice of a change of ownership of the property during the one-year period, notice of a violation must be sent in compliance with subsection (b) above. If the city does not receive notice of a change in ownership, the city may abate any nuisance contained on the property covered by this article without further notice and assess expenses to the property owner. (d) Contents. The notice of violation shall at a minimum contain the following: (1) The name of the owner, if known, or person having supervision or control of the premises proposed to be entered upon by the city; (2) The address or legal description of the premises proposed to be entered upon by the city; (3) The offending conditions existing on the lot, tract or parcel of land; (4) A statement that the recipient has seven (7) days from the date of notice to correct the violation, that if he/she fails to do sO, the city will enter upon the premises and remedy the same, and that the city is entitled to attach a lien to the property to secure payment for the services rendered; and (5) A: statement that the recipient is entitled to a hearing. (e) Additional contents of annual notice. If an annual notice is given, it shall state, in addition to the foregoing, that the city may enter upon the premises to remedy any violation at thirty-day intervals during the year. (f) Owner-requested work. In the event the owner or person having supervision or control of any such property requests that the city do such work as is necessary in order to abate or prevent a violation of this article, then such request will constitute a waiver of the requirement for notification of violation by the city, thereby relieving the city of such requirements, and the city will have the same remedies as hereinbefore and/or hereinafter set forth. (g) Exception. Notwithstanding the foregoing provisions, city may abate, without prior notice, any weeds that have grown to a height of 48 inches or are an immediate danger to the health, life or safety of any person. In the event that city abates weeds pursuant to this article, the requirements set forth in the Texas Health and Safety Code for such abatement shall govern. (Ordinance 05-18, sec. 2, adopted 11/14/05) S 6.02.011. Abatement by city; assessment of city's expenses; lien. (a) Abatement: authorized. If the person owning or having supervision or control of any lot, tract, parcel of land or portion thereof does not comply with the provisions of this article within seven (7) days of receipt of notice of violation, the city or its agents may: (1) Enter upon such premises and do such work as necessary, or cause the same to be done, in order that the premises may comply with the requirements set forth in this article; and (2) Pay for the work or improvements made and charge the expenses to the owner of the property. The city shall collect an administrative fee from the owner or person entitled to possession of each parcel on which improvements are made or grass and weeds are cut or mowed. Such fee is in ad- dition to the actual cost of cutting the grass or making the improvements. -14- (b) Assessment of expenses; lien. (1) The city manager may assess expenses incurred by the city in exercising the authority granted in this section. The city attorney, or an assigned representative, may file a statement with the county clerk of such expenses including administrative, filing and publication costs incurred in abating the unsanitary condition on said premises. The lien statement must state the name of the owner, if known, and a legal description of the property. The city shall have a privileged lien on such lot, tract or parcel of land, second only to tax liens and liens for street improvements, for the expenses incurred, together with interest at the rate of ten percent (10%) per year on the amount due from the date the city paid or incurred such expenses. For any such expenditures and interest, suit may be instituted and recovery and foreclosure had in the name of the city, and the statement of expenses, or a certified copy thereof, shall be prima facie proof of the amount expended in any such work performed by the city. The city may also foreclose a lien on property under this article in a proceeding relating to the property brought under the Texas Tax Code. (2) The city secretary shall execute and file a release of lien for the subject property with the county clerk within a reasonable time after payment of the amount due on the property including interest through the date of payment. (c) Hearing. Any person or entity receiving an abatement notice under this article shall have the right to meet with the city manager or his designee within ten (10) days of receipt of such notice to assert any legal defense as to why the city should not proceed with abatement and attachment of a lien as provided in this article. (Ordinance 05-18, sec. 2, adopted 11/14/05) S 6.02.012. Issuance of citations. For the purpose of enforcing this article, the city building inspector, fire inspector, or code enforcement officer shall be empowered to issue citations to any person who is found in violation of any of the provisions of this article. (Ordinance 05-18, sec. 2, adopted 11/14/05) -15- City of Schulenburg, TX $ 6.02.002. Abatement required; abatement by city; lien for city's costs. (a) The city does hereby require the filling up, drainage, and regulating ofany lot or lots, grounds or yards, or any other places in the city which shall be unwholesome or have stagnant water therein, or from any other cause be in such condition as to be liable to produce disease, and [is authorized to] cause all premises to be inspected and to impose fines on the owners of houses under which stagnant water may be found, or upon whose premises such stagnant water may be found, and require the filling up, altering, or repairing of all sinks and privies, and the cleaning and disinfecting of the same and the cleansing of any house, building, establishment, lot, yard or ground from filth, carrion, or any other impure or unwholesome matter of any kind. (b) The owner of any lot within the city shall keep the premises free from weeds and grass in excess oftwelve (12) inches in height, rubbish, brush and any other objectionable, unsightly, or unsanitary matter of whatever nature. If such owner fails or refuses to do so, within ten (10) days after notice as provided in section 6.02.003, the city may do such work or may cause the same to be done and may pay therefor and charge the expenses incurred in doing or having such work done or improvements made to the owner of such property as herein provided. (c) The city may cause any of the improvements above mentioned to be done at the expense of the city on account of the owners, and cause the expense thereof to be assessed on the real estate or lot upon which such expense is incurred. On filing with the county clerk a statement by the mayor, city health officer, or other city official designated by the mayor of such expenses, the city shall have a privileged lien thereon, second only to tax liens and liens for street improvements, to secure the expenditure SO made and ten (10) percent interest on the amount from the date of such payment. For any such expenditures, and interest, as aforesaid, suit may be instituted and foreclosured [foreclosure had] in the name of the city; and the statement so made, as aforesaid, or a certified copy thereof, shall be prima facie proof of the amount expended in any such work or improvements.
