FORNEY MINUTES PLANNING AND ZONING COMMISSION Thursday, March 6, 2025 6:30 p.m. - Regular Meeting (Immediately following the Capital Improvements Advisory Committee Meeting) Forney City Hall Annex 101 East Main Street, Forney, Texas 75126 I. CALL TO ORDER Chair Ann Lemons called the meeting to order at 6:47 p.m. Commission members present were Chair Ann Lemons, Vice Chair LaPortia Hurse, Daphne King, Ryan Childress, Larry Frazier and Lawrence McCall. City staff present were Director of Community Development Peter Morgan, Senior Planner Alex Dixon, City Attorney Jon Thatcher, City Engineer John Casey and Commission Secretary Kylee Goodson. II. INVOCATION Commissioner Daphne King gave the invocation. III. CONSENT ITEMS 1. Consider approval of the January 2, 2025 Planning and Zoning Commission meeting minutes. Commissioner Childress made a motion to approve the minutes. Vice-Chair Hurse seconded the motion. The motion passed by a vote of 6 ayes and 0 nays. IV. PUBLIC HEARING ITEMS 1. Hold a public hearing and discuss and consider approval of an Ordinance rezoning 9.308 acres of property by amending Planned Development District Ordinance 1072 to establish regulations to allow single-family attached (townhomes) as an approved use. The property is located east of Kaufman Street and Park Creek Avenue. Mr. Morgan introduced the item. 49 townhome lots were proposed for the planned development rezone request. The Commission discussed several development standards, including vehicle parking, setbacks, crime, and traffic. Dan Hatten, speaking as the applicant, spoke to the Commission about the concerns. Mr. Hatten mentioned possibly gating the community to cut down on crime and stated a preference for a one car garage. Mr. Hatten agreed to bring additional information for the Commission to consider at the next meeting. Chair Lemons opened the public hearing at 7:09 p.m. No one from the public spoke, and public hearing was closed at 7:09 p.m. Vice Chair Hurse made a motion to table this item until the April 3 meeting. Hold a public hearing and discuss and consider approval of an Ordinance amending the City of Forney Comprehensive Zoning Ordinance by adding a definition and regulations for a "Cigar Lounge" and related uses. Mr. Morgan introduced the item. Staff has been approached recently by several people interested in operating a cigar lounge or a hookah lounge in Forney. The Zoning Ordinance does not currently define or provide regulations for these uses. The proposed amendments require approval of a conditional use permit in order to operate a cigar lounge or a hookah lounge. Chair Lemons opened public hearing at 7:21 p.m. and no one spoke. Chair Lemons closed public hearing at 7:21 p.m. Vice Chair Hurse made a motion to approve the item with one change: the uses shall not be permitted in the Light Industrial zoning district. Commissioner Childress seconded the motion. The motion passed by a vote of6 ayes and 0 nays. V. ACTION ITEMS 1. Discuss and consider approval of a final plat for Forney Fire Station No. 2, located at 980 Reeder Lane. Senior Planner Alex Dixon introduced the item. The purpose ofthe request is to establish the boundary and easements necessary for an expansion of the fire station facility. Staff recommended approval of the request. Commissioner Frazier made a motion to approve the item. Commissioner King seconded the motion. The motion passed by a vote of6 ayes and 0 nays. 2. Discuss and consider approval of a site plan for Burger King, located north of the South F.M. 548 and F.M. 741 intersection. Mr. Dixon introduced the item. Staff recommended approval of the request. Commissioner Childress made a motion to approve the item. Commissioner Frazier seconded the motion. The motion passed by a vote of 6 ayes and 0 nays. 3. Discuss and consider approval of a final plat for Costco Forney, located north ofU.S. Highway 80 and east ofF.M.460. Mr. Dixon introduced the item. Staff recommended approval of the request. Commissioner King made a motion to approve the item. Commissioner Childress seconded the motion. The motion passed by a vote of 6 ayes and 0 nays. VI.
