MIINUTES OF MIEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, March 18, 2025, at 5:00 p.m., in Council Chambers. Council Member Ferguson led the invocation and the Pledge of Allegiance was recited. APPROVAL OF AGENDA Mayor Salmon requested that an item be added to the New Business agenda as Item 8-G, "Resolution Setting the Meeting Schedule for the City Council of the City of Sanford." Council Member Rhodes made a motion to approve the agenda as amended. Seconded by Council Member Ferguson, the motion carried unanimously. NEW BUSINESS Resolution in Support of the Temporary Closure of Several Streets for the 2025 Sanford Block Party (Exhibit E) Council Member Rhodes made a motion to approve the Resolution in Support of the Temporary Closure of Several Streets for the 2025 Sanford Block Party. Seconded by Council Member Dabbs, the motion carried unanimously. Resolution in Support of the Temporary Closure of the Carthage Street Parking Lot for the April Downtown Alive Concert (Exhibit F) Council Member Ferguson made a motion to approve the Resolution in Support of the Temporary Closure of Carthage Street Parking Lot for the April Downtown Alive Concert as described in the submitted document, contingent upon a valid Certificate of Insurance. Seconded by Council Member Rhodes, the motion carried unanimously. Resolutionins Supportofthe' Temporary Closure of Steele Street for Strawberry Jammin' 2025 (Exhibit G) Council Member Dabbs made a motion to approve the Resolution in Support of the Temporary Closure of Steele Street as described in the submitted document, for the Strawberry Jammin' event, contingent upon receiving a valid Certificate of Insurance. Seconded by Council Member Buckels, the motion carried unanimously. Resolution in Support of the Temporary Closure of the Carthage Street Parking Lot for the September Downtown Alive Concert (Exhibit H) Mayor Pro Tem Akinosho made a motion to approve the Resolution in Support of the Temporary Closure ofthe Carthage Street Parking Lot for the Downtown Alive Concert as described in the: submitted document, contingent upon receiving a valid Certificate of Insurance. Seconded by Council Member Rhodes, the motion carried unanimously. Appointment to Friends of Sanford, Inc. (Term Expires June 30, 2025) - (Exhibit D) City Attorney Susan Patterson explained that this board of directors follows a different appointment schedule, with many serving by virtue of their positions. Council needs to re-appoint the members of Friends of Sanford, Inc., and appoint a citizen to fill the vacant at-large position. Council Member Rhodes nominated Chet Mann to serve the citizen-at-large position and re- appoint the members serving by virtue of position. Mayor Pro Tem Akinosho made a motion to close nominations and appoint Chet Mann by acclamation to serve the citizen-at-large position and re-appoint 2 City Council Meeting March 18, 2025 the members serving by virtue of position. Seconded by Council Member Buckels, the motion carried unanimously. Appointment to Joint Environmental Affairs Board (Term Expires June 30. 2027) = (Exhibit J) City Attorney Susan Patterson explained that there is a vacancy on the board since a former member has moved out of the city limits. Council Member Dabbs nominated Kelsey Crowley to serve the vacant position. Council Member Rhodes made a motion to close nominations and appoint Ms. Crowley by acclamation. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Resolution Setting the Meeting Schedule for the City Council of the City of Sanford (Exhibit K) City Attorney Susan Patterson explained that Council wants to add a second work session on the fourth Tuesday of each month at 1:00 p.m., effective April 1, 2025, and shall continue thereafter unless otherwise changed by resolution or motion ofrecord. Council Member Rhodes made a motion to approve the Resolution Setting the Meeting Schedule for the City Council of the City of Sanford. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. CLOSED SESSION Council Member Dabbs made a motion to go into closed session in accordance with N.C.G.S. 143- 318.11(a)(1), to prevent the disclosure ofinformation that is privileged or confidential pursuant to the law of the State or the United States; and (3), to consult with an attorney employed or retained by the public body to preserve the attorney-client privilege. RETURN TO REGULAR SESSION Council returned to regular session at 6:00 p.m. CASES FOR PUBLICI HEARING (held jointly with the Planning Board at 6 P.M.) Rezoning Public Hearings Application by Tim Althaus to rezone vacant land adjoining Hydro Tube Enterprises at 2645 Mt. Pisgah Church Road from Rural Neighborhood (RN-20) to Light Industrial (LI) to allow expansion oft the existing business. The subject property isa2.3a acre +- portion ofa 3.6 acre +/- tract of land identified as Lee County Tax Parcel 9661-88-2884-00 as depicted on Tax Map 9661.02. (Exhibit L) Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill reviewed the documentation submitted for this request. Staff is supportive oft this request because it aligns with the Maker District designation for the Plan SanLee Long Range Plan. Samantha Cardone, Human Resource Manager for Hydro Tube Enterprises, spoke in favor of the rezoning request. Kirk Smith (3108 Avents Ferry Road, Sanford) spoke in favor ofthe rezoning request. Crystal Gaddy (228 Lakeview Drive, Sanford) spoke on behalf of Sanford Area Growth Alliance (SAGA), in support ofthe rezoning request. 3 City Council Meeting March 18, 2025 With no other speakers, Mayor Salmon closed the public hearing. Application by Nicholas Jakel to rezone 18.34 acres +/- of] land, comprised of two adjoining parcels with frontage on Center Church Road, from Residential Agricultural (RA) to Tramway Towns Conditional Zoning District to allow the development ofal 144-unit townhome community via the site plan/subdivision plan conditional zoning process. The subject property is located on the north side of Center Church Road, between the Pine Reserve Apartments (under construction) and Tramway Elementary School. One parcel was formerly developed with a house addressed as 264 Center Church Road and the other parcel is vacant. The subject property is owned by RDUSA, LLC and is identified as Lee County Tax Parcels 9631-34- 3479-00 and 9631-34-6613-00: as depicted on Tax Maps 9631.01 and 9631.03. (Exhibit M) Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill explained that the original request for this rezoning was withdrawn by the applicant, due to sewer service issues, which have been resolved. Ms. McNeill reviewed the project details as described in the submitted documentation. Executive Director ofUtilities Paul Weeks confirmed that the sewer issues have been resolved; the developer is installing a lift station, which will be turned over to the City ofSanford, with easements to cross their parcel to other parcels that could be served. Nicholas Jakel (152 Land Ridge, Sanford) spoke in favor oft the reasoning request. With no other speakers, Mayor Salmon closed the public hearing. The Planning Board retired to the West End Conference Room. Annexation Public Hearings Voluntary Contiguous Annexation Petition of 18.736 +I- Acres Owned by Harkey Road Developers. LLC (Exhibit N) Mayor Salmon opened the public hearing. Long-Range Planning Administrator David Montgomery reminded Council that this project was approved for rezoning last year. The area is located within the Extra Territorial Jurisdiction (ETJ) and includes two additional properties owned by the City. The purpose of the annexation request is to have access to sewer. Ifapproved, staff recommends assigning the property to Electoral Ward #4. Petitioner representative Ron Bailey (1611 Jones Franklin Road, Raleigh, North Carolina) spoke in favor oft the request. With no other speakers, Mayor Salmon closed the public hearing. Ordinance to Extend the Corporate Limits ofthe City ofs Sanford, North Carolina (Exhibit 0) Council Member Rhodes made a motion to approve the Ordinance to Extend the Corporate Limits oft the City ofs Sanford, North Carolina, as shown on the attached documentation, and to assign it to Electoral Ward #4. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Voluntary Non-Contiguous Annexation Petition of 10.086 +/- Acres Owned by DRB Group North Carolina, LLC (Exhibit P) Mayor Salmon opened the public hearing. Long-Range Planning Administrator David Montgomery reminded Council that this property was 4 City Council Meeting March 18, 2025 rezoned, and is located within the City's ETJ. The purpose of the annexation request is to connect to sewer service. Ifapproved Mr. Montgomery recommends assigning it to Electoral Ward #4. With no other speakers, Mayor Salmon closed the public hearing. Ordinance to Extend the Corporate Limits of the City of Sanford, North Carolina (Exhibit 0) Council Member Rhodes made a motion to approve the Ordinance to Extend the Corporate Limits of the City of Sanford, North Carolina, as shown on the documentation submitted, and to assign it to Electoral Ward #4. Seconded by Council Member Dabbs, the motion carried unanimously. DECISIONS ON PUBLIC HEARINGS There were no decisions on public hearings. OTHER BUSINESS There was no other business.
