MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, March 4, 2025, at 5:00 p.m., in Council Chambers. Council Member Rhodes led the invocation and the Pledge of Allegiance was recited. PUBLIC COMMENT (Exhibit A) David Heimbecker, owner/operator of the Family Grounds Coffee Shop (133 Wicker Street, Sanford), expressed frustration with the Historical Preservation Committee's denial ofhis request to paint the exterior ofhis property. He requested permission to paint the exterior and suggested the committee be dissolved. APPROVAL OF AGENDA Council Member Rhodes made a motion to approve the agenda. AGENDA Saleof Vacant Lot on Hooker Street to Cora McIver and Approval of Restrictive Covenants and Purchase Agreement with City of Sanford - Redevelopment Land (Exhibit E) Community Development Administrator Karen Kennedy reminded Council that she presented an offer on January 21 from Cora McIver to purchase property described on the attached Exhibit E. She confirmed this offer was advertised as required by law and no upset bids were received. Council Member Rhodes made a motion to approve the Sale of the Vacant Lot on Hooker Street to Cora McIver, as well as the Restrictive Covenants and Purchase Agreement with the City of Sanford - Redevelopment Land. Seconded by Council Member Dabbs, the motion carried unanimously. NEW BUSINESS Resolution in Support of the Temporary Closure ofal Portion of Third Street for the Bee City USA Field Day (Exhibit F) Parks Administrator Caroline Jeffries explained that the Appearance Commission is requesting a portion of Third Street (between City Hall and the Service Center) be closed temporarily (from 6:00 a.m. through 1:00 p.m.) for the Bee City Field Day on May 3. Council Member Dabbs made a motion to approve the Resolution in Support of the Temporary Closure of a Portion of Third Street for the Bee City USA Field Day. Seconded by Council Member Ferguson, the motion carried unanimously. Capitall Project Ordinance Amendmenti to Closel Moncure] Megasite Phase II Wastewater S2101 (Exhibit G) Assistant City Manager Beth Kelly explained that this amendment would close the project and transfer funds back to the Utility Fund. Council Member Buckels made a motion to approve the Capital Project Ordinance Amendment to Close Moncure Megasite Phase II Wastewater Project S2101. Seconded by Council Member Rhodes, the motion carried unanimously. Capital Project Ordinance Amendment to Close Project Forge = Site Prep/Roadway G2002 (Exhibit H) Assistant City Manager Beth Kelly explained that this amendment would close the project and transfer funds back to the General Fund. Council Member Rhodes made a motion to approve the Capital Project Ordinance Amendment to Close Project Forge Site Prep/Roadway Project G2002. Seconded by Council Member Dabbs, the motion carried unanimously. Ordinance Amending Annual Operating Budget - Various Departments (Exhibit I) Assistant City Manager Beth Kelly explained that this budget amendment is the typical mid-year clean-up amendment appropriating funds to various departments from the General and Utility Funds. 2 City Council Meeting March 4, 2025 Council Member Dabbs made a motion to approve the Ordinance Amending the Annual Operating Budget = Various Departments. Seconded by Council Member Rhodes, the motion carried unanimously. Pittsboro Chatham Commons Lease for Triiver Customer Service (Exhibit J) Nick Fortune, TriRiver Water Director of Business Management, explained that this three-year lease would provide customer service space in Pittsboro, where staff hopes to be operational by July 1 to serve new clients from the utility system merger with Chatham County and Siler City. Council Member Ferguson made a motion to approve the Pittsboro Chatham Common Lease for TriRiver Customer Service. Seconded by Council Member Taylor, the motion carried unanimously. Voluntary Contiguous Annexation Petition of18.736 +/- Acres Owned by Harkey Road Developers. LLC Long-Range Planning Administrator David Montgomery reminded everyone that Council approved a townhome project last year for this property which is located in the ETJ (extra-territorial jurisdiction) and the applicant is now requesting that the property be annexed into the City limits. Since two properties owned by the City are adjacent to this property, staff requested they be included in this petition. Ifapproved, the public hearing would be held March 18, 2025, at 6:00 p.m. in Council chambers Resolution Directing the Clerk to Investigate a Petition for Contiguous Annexation (Exhibit K) Council Member Dabbs made a motion to approve the Resolution Directing the Clerk to Investigate a Petition for Contiguous Annexation. Seconded by Council Member Rhodes, the motion carried unanimously. Receive the Certificate of Sufficiency for Voluntary Contiguous Annexation (Exhibit L) City Clerk Bonnie Bryant confirmed that the petition was sufficient. Resolution Fixing Date of Public Hearing on Ouestion of Annexation Pursuant to G.S. 160A- 31 (Exhibit M) Council Member Rhodes made a motion to approve the Resolution Fixing the Date of Public Hearing on the Question of Annexation Pursuant to G.S. 160A-31. Seconded by Council Member Dabbs, the motion carried unanimously. Voluntary Non-Contiguous Annexation Petition of 10.086 +/- Acres Owned by DRB Group North Carolina, LLC Long-Range Planning Administrator David Montgomery reminded everyone that this property is located in the ETJ (extra-territorial jurisdiction) and Council has already approved R-6 zoning. The owners are now requesting that the property be annexed into the City limits in order to access sewer service. If approved, the public hearing would be held March 18, 2025, at 6:00 p.m. in Council Chambers. Receive the Certificate of Sufficiency for Voluntary Contiguous Annexation (Exhibit O) City Clerk Bonnie Bryant confirmed that the petition was sufficient. 3 City Council Meeting March 4, 2025 Resolution Fixing Date of Public Hearing on Question of Annexation Pursuant to G.S. 160A- 31 (Exhibit P) Council Member Rhodes made a motion to approve the Resolution Fixing the Date of Public Hearing on the Question of Annexation Pursuant to G.S. 160A-31. Seconded by Council Member Dabbs, the motion carried unanimously. DECISIONS ON PUBLIC: HEARING Application by Otter Creek Properties, LLC. to rezone six parcels totaling 4.5 acres +/- with frontage on Palomino Drive and Dogwood Acres Drive from Suburban Neighborhood-Low, (SN-12) to the Palomino Townhomes Conditional Zoning District to allow the development of a 34-lot townhome residential subdivision via the site plan/subdivision plan conditional zoning process. The subject property is identified as Lee County Tax Parcels 9631-47-8940-00. 9631-57-3905-00. 9631 1-57-3608-00. 9631-57-0997-00, 9631-58-0192-00., and 9631-48-8041-00: as depicted on Tax Map 9631 - 1.02. (Exhibit Q) Senior Planner Amy McNeill reminded Council that the Planning Board met on February 18, 2025, after the public hearing was held on this application and unanimously recommended that Council approve this request to rezone the property from SN-12 to the Palomino Townhomes Conditional Zoning District. The recommendation included a condition that the entire loop ofPalomino Drive, from the end of the new pavement to the existing pavement, be maintained by the City of Sanford. Vote to Approve a Statement on Long-Range Land Use Plan Consistency as it] Relates to this Zoning Map Amendment (Exhibit R) Council Member Rhodes made a motion that the proposed zoning map amendment is consistent with the PlanSanLee designation of Suburban Neighborhood, which encourages development oflarge-scale residential neighborhoods on the outskirts of a core urbanized area. Seconded by Council Member Dabbs, the motion carried unanimously. Ordinance Amending the Official Zoning Mapofthe City ofSanford, North Carolina (Exhibit S) Council Member Dabbs made a motion to approve the proposed zoning map amendment from SN-12 to the Palomino Conditional Zoning District because it would allow development of attached single-family dwellings in an area that adjoins multi-family development, a residential subdivision, and commercial development fronting Westover Drive on land that was planned for residential single-family home development in the 1960s, that has access to public water and sewer, is in close proximity to a major thoroughfare, and is in the corporate city limits. Seconded by Council Member Ferguson, the motion carried by a vote of five to one, with Council Member Taylor casting the dissenting vote. Application by Rollingdale Investment, LLC, to rezone 20.44 acres +l-offo fofCarthage Street from Urban Neighborhood (UN-6) to Multi-Family (MF-12) to allow the development of a multi-family apartment community. The subject property is identified as portions ofLee County Tax Parcels 9642-11-6991-00: and 9642-11-2504-00 (1509 Carthage Street) as depicted on Tax Map 9642.03. (Exhibit T) Senior Planner Amy McNeill reminded Council that the Planning Board met on February 18, 2025, after the public hearing was held on this application and unanimously recommended that Council approve this rezoning request to allow development of a multi-family apartment community. Vote to Approve a Statement on Long-Range Land Use Plan Consistency as it Relates to this Zoning Map Amendment (Exhibit U) Council Member Buckels made a motion that the proposed zoning map amendment is consistent with the PlanSanLee designation of Urban Neighborhood because multi-family dwellings are an encouraged residential use with a development density of 10 to 16 units per 4 City Council Meeting March 4, 2025 acre, and MF-12 is listed as a current district with Multi-Family Residential as a proposed district. Seconded by Council Member Ferguson, the motion carried unanimously. Ordinance. Amendingthe Official Zoning] Mapofthe CityofSanford. North Carolina (Exhibit V) Council Member Rhodes made a motion to approve the proposed zoning map amendment from Urban Neighborhood (UN-6) to Multi-Family (MF-12) because it is reasonable and in the public interest since the location is off of a major thoroughfare between US Highway 1 and downtown Sanford and it would allow multi-family dwellings in an area with public water and sewer. Seconded by Council Member Buckels, the motion carried unanimously. CLOSED SESSION Council Member Rhodes made a motion to go into closed session in accordance with N.C.G.S. 143-318.11(a)(), to prevent the disclosure ofi information that is privileged or confidential pursuant to the law ofthe State or the United States. Secondedby Council Memberl Dabbs, thei motion carried unanimously. RETURN TO REGULAR SESSION Council returned to regular session at 6:00 p.m. CASES FOR PUBLIC HEARING (held at 6:00 D.m.) Public Hearing on Adams Village Development Downstream Sewer Developer's Agreement (Exhibit W) Mayor Salmon opened the public hearing. Nick Fortune, TriRiver Water Director of Business Management, explained that this agreement, if approved, would provide off-site sewer improvements to increase capacity in the Gasters Creek sub-basin, for property described in Exhibit W located between Highway 87 and Lee Avenue, off Wilson Road. Plans call for development of211 single-family home lots and 84 townhome lots in two phases. Phase One calls for 106 units to be complete by the end of 2026, and Phase Two calls for 189 units to be complete by mid- July 2027. An estimated 82,200 gallons of sewer would be discharged daily at completion and the developer would pay $247,422 for their share of sewer capacity improvements under this agreement. With no other speakers, Mayor Salmon closed the public hearing. Adoption of] Development Agreement (Exhibit X) Council Member Dabbs made a motion to adopt the Development Agreement. Seconded by Council Member Rhodes, the motion carried unanimously. Public Hearing on Broadwell Development Downstream Sewer Developer's Agreement (Exhibit X) Mayor Salmon opened the public hearing. Nick Fortune, TriRiver Water Director of Business Management, explained that this agreement, if approved, would provide off-site sewer improvements to increase capacity in the Gasters Creek sub-basin, for property described in Exhibit Y located offHighway 87 and Commerce Drive. A preliminary map has been approved for 270 single-family homes and 210 townhomes to be developed in four phases. Mr. Fortune noted that Phase 1 is commercial and is not included in the development agreement. Phase Two, projected for completion by the end of 2026, calls for 210 units; Phase Three, projected for completion in 2028, calls for 189 units; and Phase Four, projected for completion in 2030, calls for 84 units. At full buildout, the development would produce 128,250 gallons of sewer capacity daily and under terms of the agreement, the developer would pay $386,032 for their share oft the sewer capacity improvements. With no other speakers, Mayor Salmon closed the public hearing. 5 City Council Meeting March 4, 2025 Adoption of] Development Agreement (Exhibit Y) Council Member Dabbs made a motion to adopt the Development Agreement. Seconded by Council Member Ferguson, the motion carried unanimously. OTHER BUSINESS Council Member Ferguson stated that he recently attended the Salvation Appreciation luncheon, along with Council Member Rhodes, and encouraged everyone to support and volunteer not only during the Red Kettle Christmas campaign, but throughout the year. Council Member Dabbs announced that a new chapter of the "Sleep in Heavenly Peace" organization is being formed in Lee County to provide beds to children in our area. She was surprised to learn that children in our area have been served by chapters in nearby Southern Pines and Fuquay-Varina, and 200 requests have been made for beds in Lee County. She encouraged everyone to learn more about the organization online and noted they are not affiliated with any particular religious organization. Council Member Rhodes echoed Council Member Ferguson' 's comments about attending the recent Salvation Army luncheon, noting that last year's Sanford's Red Kettle campaign raised almost $60,000, with almost all remaining in our community. She and Council Member Buckels attended SAGA's public policy luncheon with a great program by the Lee County Library. She also noted that Council welcomes public comments but suggested it should not be used to disparage staff or committee members serving our community and apologized on behalf of the City for derogatory comments directed at them earlier in the meeting. Mayor Salmon commented on the Temple Theatre's 100th anniversary celebration this past weekend and encouraged everyone to support other anniversary celebrations in our community. The City recently held the final commemorative coin search and she thanked Public Information Officer Kelly Miller for organizing events and sharing information about the City for our 150th anniversary celebrations.
