121 Meeting of the Fulton County Commissioners Tuesday, October 25, 2022 8:30 a.m. at the Commissioners' Office Present: Commissioner Ulsh, Commissioner Bunch & Commissioner Shives Absent: None Others Present: Jamie Greathead, Fulton County News; Attorney Stanley Kerlin and spouse Carolyn Kerlin. Commissioner Ulsh opened the meeting with silent prayer and all recited the Pledge of Allegiance to the flag. Commissioner Ulsh opened up the floor for public comments. Jamie Greathead, Fulton County News, addressed the Commissioners on a recent lawsuit filed on Dominion Voting Systems. Attorney Stanley Kerlin spoke to Commissioners: requesting a COLA (Cost of Living Adjustment) increase in the county retirement system noting that there has not been a vote since 2017 to increase. Kerlin asked to be notified when the Retirement Board meets again, Commissioner Ulsh said it should before the end of the year. Motion by Commissioner Shives to approve the Commissioners' Minutes of the October 18, 2022 meeting. All in favor. Motion by Commissioner Bunch to approve the Accounts Payable dated October 24, 2022 in the amount of $172,116.66. All in favor. Lamb presented an audit scorecard of the proposals and stated that he would draft a letter to the awarded recipient. Lamb also stated that he spoke to Z&A, Zelenkofske Axelrod LLC, the current auditors, who assured a "smooth transition". Lamb attended via telephone. Motion by Commissioner Ulsh to award and sign the contract with RKL LLP, CPA Accounting and Business Consulting Firm, for a period of three years, 2022-2024. All in favor. 122 Commissioners continued to speak with Fiscal Admin Lisa Beatty and Mike Lamb, Wessel and Co., to review the First Draft Budget Review for 2023. Lamb presented an overview of the 2023 General Fund Budget, an ARPA Update and a Comparison oft the 2022 and 2023 Budget by Department. Lamb and Beatty will meet with the Commissioners again on November gth to review the Second Budget Draft. An approval meeting with Department Heads will occur either November 15th or the 22nd. HR Admin Deanna Park was also in attendance. Motion by Commissioner Ulsh to retitle Melissa Gordon to Chief Tax Assessor in the Tax Assessment Office, effective November 1, 2022. All in favor. A brief Salary Board meeting was held at 10:00 AM. Commissioners met with EMA/911 Director Brian Barton and HR Admin Deanna Park to discuss transferring a per diem employee to full-time. Barton stated his budget allows for five full-time employees and recommended Shawn Goshorn to be transferred to full-time. Barton also presented a Mission Critical Partners LLC Agreement and Fulton County Emergency Operations Plan Promulgation to be signed. Motion by Commissioner Shives to transfer Shawn Goshorn from Per Diem to Full-Time EMA/911 Dispatcher, effective pending current employer. Pay rate will remain the same. All in favor. Motion by Commissioner Bunch giving Commissioner Ulsh authorization to sign the Professional Services Agreement between Mission Critical Partners, LLC and County of Fulton. All in favor. Commissioners met with Elections Director and CDBG Coordinator Patti Hess to have an Environmental Review signed by Commissioner Ulsh for McConnellsburg Curb Cuts Phase II. Hess also presented an Annual Report Affirmation for voter registration statistics to be signed. In relation to the Dominion election machine investigation, Commissioner Shives asked Hess if she had knowledge of how the door became unlocked for the forensics examination where the Dominion Voting Systems equipment is stored. Hess answered that Commissioner Ulsh and Commissioner Bunch asked for the key and since it was two Commissioners asking she didn't question it. Motion by Commissioner Bunch giving Commissioner Ulsh authorization to sign the CDBG Environmental Review for the McConnellsburg Curb Cuts Phase II. All in favor. Commissioner Ulsh signed a 2022 PComp application to obtain Safety Grant funding in the amount of $6,500 to pay Keller Engineering for the Probation Steps Project. Commissioners also signed a 2022 Amended PCHIPC Pennsylvania Counties Health Insurance Purchasing Cooperative) Membership Agreement. Commissioners met with Admin Deanna Park to discuss Domestic Relations position, Domestic Relations Director. Commissioners asked Park to advertise the position internally for seven days before advertising to the public. Motion by Commissioner Ulsh to adjourn the meeting at 11:45 AM. Shives RESOLUTION NO. 8 of 2022 WHEREAS, the County of Fulton, Pennsylvania, is an Eight-Class County; and WHEREAS, the County of Fulton has the authority by law to impose certain real estate taxes as more particularly provided by various statutes; and WHEREAS, said real estate taxes are collected by duly elected and/or appointed tax collectors; the Fulton County Tax Claim Bureau and other individual and/or entities authorized by law to collect taxes on behalf of Fulton County; and WHEREAS, the Commonwealth of Pennsylvania enacted Act 57 of 2022 on July 11, 2022, hereinafter referred to as "said Act"; and WHEREAS, said Act provides that taxing districts are required to adopt by ordinance or resolution the provisions of said Act requiring tax collectors acting on behalf of the County of Fulton to waive additional charges for real estate taxes under the circumstances more particularly set forth in said Act; and WHEREAS, it is the intention of the Board of Commissioners of Fulton County to comply with the provisions of said Act by enacting the within Resolution. NOW, THEREFORE, the Board ofCommissioners of Fulton County, Pennsylvania, does hereby enact the provisions of Act 57 of 2022 requiring all tax collectors acting on behalf oft the County of Fulton to waive additional charges for real estate taxes provided the taxpayer complies with all ofthe requirements set forth in said Act and all other provisions of said Act have been met. Shives Jim Stein, Solicitor RESOLUTION 9 of 2022 A RESOLUTION OF THE COUNTY OF FULTON RECOMMENDING THE OFFICIAL IDENTIFICATION AND NAMING OF AN UNNAMED STREAM IN WELLS TOWNSHIP FULTON COUNTY. WHEREAS, the Fulton County Board of Commissioners and citizens of Fulton County have an interest in maintaining uniform and geographic identification information for management of public lands in the County of Fulton; and WHEREAS, the Fulton County Board of Commissioners has been informed of a 2.8 long stream located in Wells Township, Fulton County which flows into a tributary of the Laurel Fork Creek which runs into Sideling Hill Creek has not been identified with a formal and approved name for the stream; and WHEREAS, Public Law 80-242 passed in 1947 created the U.S. Board on Geographic Names (BGN) which is tasked with approving the names of geographic features through an application process; and WHEREAS, a resident of Wells Tannery, Gerald Wright, submitted a proposal to the BGN, to name the stream "Wishart Mine Run"; WHEREAS, the Fulton County Board of Commissioners, does not have any objection to such proposal to the BGN and support such proposal; NOW, THEREFORE, BE IT RESOLVED, the Fulton County Board of Commissioners do hereby support the application of the Fulton County resident which is currently before the BGN and make a recommendation to name such identified but unnamed stream, Wishart Mine Run.
