PRESENTATION PRESENTATION ON THE PROGRESS OF THE COLONY AT COLE SPRINGS DEVELOPMENT PROJECT Page 124 Minutes Volume 151 March 25, 2025 Development Services Director / City Engineer Angela Kennedy provided a brief overview of the project and introduced Royce Rippy of M/I Homes. Mr. Rippy presented background information. A copy of the presentation is part of the supplemental record. General discussion was held on the project sediment release into Onion Creek and mitigation, erosion control, and construction truck traffic. Mr. Rippy informed the contact information will be readily available at the site. Responding to a question by Council, City Manager Micah Grau informed he and former Councilmember Ray Bryant met with Mrs. Nelson of the Antioch Church to discuss options to connect to the City's infrastructure. But as oft today, staff have not heard back from Ms. Nelson. Alicia Ramirez presented background information and noted, at the recommendation of the City Attorney, that the Council consider adopting the item via Ordinance versus a Resolution. City Attorney Borjorquez further noted the agenda language is sufficient to allow the Council to consider the item as an ordinance and, as such, should be under the Election Code. Mayor Urbanovsky closed the public comment period at 7:54 p.m. General discussion was held on the recommended zone change and future zone change, the impact to the neighborhood, and acknowledging the action as procedural to correct the discrepancy. TABLED ORDINANCE REGARDING A REQUEST BY TEJAS REAL ESTATE DEVELOPMENT, LLC FOR A ZONING MAP AMENDMENT TO CHANGE THE EXISTING ZONING OF INTERSTATE 35 BUSINESS (B-3) TO LIGHT INDUSTRIAL (LI) FOR A +/- 43.818 ACRE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF SUFFIELD DRIVE AND DACY LANE (Z 24-03) Development Services Director / City Engineer Angela Kennedy suggested tabling the item until April 15. APPROVAL OF THE FISCAL YEAR 2024 ANNUAL COMPREHENSIVE FINANCIAL REPORT AND SINGLE AUDIT Assistant Finance Director Angela Verduzco provided a brief overview of the audit and introduced Rebecca Darling of Weaver and Tidwell, L.L.P. UPDATE AND POSSIBLE ACTION ON THE TEXAS 89TH REGULAR LEGISLATIVE SESSION City Manager Micah Grau provided a brief overview and introduced Jeff Heckler of The Schlueter Group. Mr. Heckler presented background information. City Manager Micah Grau informed Representative Erin Zwiener requested Buda's support on specific legislation she has filed. He noted the Council may direct staff to prepare Resolutions of Support for these items for adoption at an upcoming Council meeting. HB 1256 Exempt water conservation systems from taxes. HB 2608 - Strengthens requirement for package WWTP to have higher discharge standards and to encourage regionalization. HJR 88 Exempt rainwater harvesting and graywater systems from taxes. HB 2015 - Makes it tougher to create a MUD through TCEQ and would require developers to include a water conservation plan when creating a MUD. HB 2346 - Grants a county the authority to enact a water conservation program in unincorporated areas. HB 2347 - Another way to grant a county the authority to enact water conservation measures in unincorporated areas. HB 3139 Grants a county the ability to approve or deny the creation of a municipal utility district that is located outside of a city. HB 1003 Adds an identification card issued by an institution of higher education as an acceptable form of voter ID. The Council suggested staff provide a list of the various bills. Smith presented background information. She noted that staff will bring the other boards' nominations at the April 15th meeting. She informed the Committee would consist of nine (9) members appointed by the City Council, with two (2) members from each of the following boards: 1. City Council: Councimember Smith nominated Councilmembers Davidson and Bowles 2. Historic Preservation Commission 3. Buda Economic Development Corporation 4. Main Street Advisory Board 5. One (1) member will be a resident, property owner, or business operator within the historic downtown district. 6. City and EDC: staff, including the City Manager, ACM - Development, Historic Preservation Officer, and Economic Development Chief Executive Officer, will serve in ex-officio roles. City Manager Micah Grau suggested the Council consider a member of the public to fill the #5 slot. ADOPTION OF ORDINANCE #2025-22 ON FIRST AND FINAL READING AMENDING THE PRIMA FACIE SPEED LIMIT ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF THE TRANSPORTATION CODE, V.T.C.A. ON THE THOROUGHFARE KNOWN AS RANCH-TO-MARKET HIGHWAY 967 WITHIN THE BOUNDARIES OF THE CORPORATE LIMITS OF THE CITY OF BUDA AND TO ESTABLISH A MAXIMUM CONSTRUCTION ZONE SPEED Development Services Director / City Engineer Angela Kennedy presented background information. General discussion was held on lowering the speed limit from the proposed 45 mph to 35 mph. Ms. Kennedy stated staff will visit with TxDOT Representatives. She noted further consideration will be given after the construction is completed to finalize the designated speed limit for the proposed roundabout.
