Melissa Cortez, Board Member- Asked if they are going to connect to city sewer? Monica Rodriguez, Planner I- Stated they will be installing septic tanks. Melissa Cortez, Board Member- She asked if they will be getting city service. Monica Rodriguez, Planner I- Stated they will only be getting city water since sewer is not available for this property at this time. Velma De Los Santos, Chairperson- Asked how far away is the city sewer? Johanna Maldonado, Planning Director- They can extend the sewer line, but it won't be something we would accept due to elevations. It may not work since it is a decent distance. Melissa Cortez, Board Member- Made a motion to approve, with the conditions that they provide the letter of authorization from the lien holder, remove signature blocks on the preliminary plat it will not be recorded, preliminary and final plats shall reflect all changes and redlines requested by C.C.D.D. #3 and C.C.I.D. #2. An Approval Letter will also be required, preliminary and final plats, per City Ordinance 10.02, 10.02.007, (d), (4), (B), 10.02.009, (a), (3) in addition to the various requirements for the Preliminary Plat, the Final Plat shall also include the following: natural ground and proposed ground elevations including detention easements with dimensions and detention ponds with bleed pipes, label each detention pond with a callout stating the following: Detention Pond (Typ.) Public hearing opened 6:01p.m. Lucio Chapa spoke before the board, he mentioned he lives on the corner lot behind this property. He stated that other residents including himself are against this property being rezoned. He mentioned it is residential area and it would cause too much chaos for the back of their area. They have not seen what they are proposing. Johanna Maldonado, Planning Director- Said before moving forward she wants to remind the board that they cannot take into consideration what they say is going to be built. The question is will the proposed zoning fit for that area. Abraham Villagran, Stonespring Investments LLC- Mentioned they are proposing to by the property for commercial purposes. They will comply with the City requirements to build a commercial building for retail space along the frontage of the property which is 600 plus feet that will not interfere with at the rear of the property they are interested in building closer to the frontage off Sam Houston which is generally known as a commercial corridor. He feels that it will be very useful to the city to have commercial retail spaces there. Velma De Los Santos-Chairperson - Closed Public Hearing. Johanna Maldonado, Planning Director- This area might be in included in the new study because we feel the entire Sam Houston Area should be rezoned for commercial. Adam Abrego, Board Member- If the property across the street is the only property zoned commercial in this area. Johanna Maldonado, Planning Director- Stated yes. Adam Abrego, Board Member- Asked after this meeting what happens? Johanna Maldonado, Planning Director- After this meeting it will go before City Commission with the recommendation of this board. Adam Abrego, Board Member- We won't know what happens with it, it can be any type of commercial. Johanna Maldonado, Planning Director- Stated that is something they need to look at, is that property more commercial, industrial or single family. Does it fit the request? One owner may have it and say they will do one thing and if it switches hands the new owner may do something else. Adam Abrego, Board Member- Maybe eventually it will be commercial. Velma De Los Santos, Chairperson- Asked if this is in the master plan Johanna Maldonado, Planning Director- That is what they are looking into it has already been brought up for a property further south. At one point we were going to do an entire rezone as a city but this company who is doing the studies will handle it. Adam Abrego, Board Member- Will it be better to wait for the master plan to come in. Johanna Maldonado, Planning Director- That will be up to the board. Velma De Los Santos, Chairperson- Explained that this board makes recommendations, whatever they decide will go before City Commission. They can agree with the recommendation or overturn it. Planning & Zoning does have the final say. Luciano Chapa- Stated most of the property along Sam Houston is mostly residential. The only two commercial properties is the Home Health and the Church. Everything on the opposite side of the street is residential. Dr. Garza owns the property on the side of this property. Velma De Los Santos, Chairperson- Said she's sorry but she's not supposed to let him speak but she didn't want him to think she was cutting him off. Johanna Maldonado, Planning Director- Stated it will be required for the commercial property to put a wall between commercial and residential.
