A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LEONARD, TEXAS, APPROVING THE INTERLOCAL AGREEMENT FOR THE PURPOSE OF HOLDING A JOINT ELECTION WITH THE LEONARD INDEPENDENT SCHOOL DISTRICT ON SATURDAY, MAY: 3, 2025. WHEREAS, it is necessary to hold an election in the City of Leonard, Texas for the reauthorization oft the local sales and use tax in The City ofLeonard at the rate of 1/4% to continue providing revenue for maintenance and repair of municipal streets; and WHEREAS, per Tax Code Section 327.007, the tax will expire in four years unless reauthorized; and WHEREAS, the City will hold an election on May 3, 2025, on the reauthorization ofthe tax, to elect persons to fill three at large positions on the City Council of the City of Leonard, Texas, and to elect persons to fill four at large positions on the Board of Trustees of the Leonard Independent School District; and WHEREAS, Section 271.002 of the Texas Election Code authorizes more than one political subdivision to hold joint elections; and WHEREAS, the City Council oft the City ofLeonard and the Leonard Independent School District deem it to be in the best interest of their respective subdivisions and in the interest oft the voters who reside within their respective jurisdictions to hold such elections jointly. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Leonard, Texas, that: Section 1. That the City Council hereby approves the Interlocal Agreement for participation in the joint elections. Section 2. That the City Council of the City of Leonard hereby authorizes the Mayor to sign and the City Secretary to attest the Interlocal Agreement referred to above. Section 3. That this resolution shall take effect immediately from and after its passage. APPROVED: Michael Pye, Mayor ATTEST: of Leons lissa C Melissa Vérde, City Secretary EONARB 9 ounty Resolution Interlocal Agreement, LISD for 2025 Joint Election Page 12 CITYOF - EONARD INTERLOCAL GOVERNMENT AGREEMENT BETWEEN CITY OF LEONARD AND LEONARD INDEPENDENT SCHOOL DISTRICT FOR A JOINT ELECTION This Interlocal Agreement ("Agreement") is made between the City of Leonard, a Texas Type A general law municipality located in Fannin County, Texas, (the "City") and the Leonard Independent School District, a Texas public school district ("Leonard ISD"), both political subdivisions of the State of Texas, acting by and through their respective signatories. The City and Leonard ISD may be referred to in this Agreement individually as a "Party" and collectively as the "Parties." Pursuant to and under the authority of the Texas Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended, and Chapter 271 of the Texas Local Government Code, as amended, for the purpose of participating in cooperative purchasing. RECITALS WHEREAS, it is necessary to hold an election in the City for the reauthorization of the local sales and use tax in the City at the rate of 1/4% to continue providing revenue for maintenance and repair of municipal streets. The tax expires on the fourth anniversary ofthe date of this election unless the imposition oft the tax is reauthorized; and WHEREAS, per Tax Code Section 327.007, the tax will expire in four years unless reauthorized; and WHEREAS, the City will hold an election on May 3, 2025, on the reauthorization of the tax, to elect persons to fill three at large positions on the City Council of the City, and to elect persons to fill four at large positions on the Board of Trustees ofthe Leonard ISD; and WHEREAS, Section 271.002 of the Texas Election Code authorizes more than one political subdivision to hold joint elections; and WHEREAS, the City, acting through the Mayor, and in accordance with the Election Contract with Fannin County Elections Clerk, will provide for the administration of the Election; and WHEREAS, the City Council of the City and the Board of Trustees of the Leonard ISD deem it to be in the best interest of their respective jurisdictions to hold such elections jointly. NOW, THEREFORE, IT IS AGREED that a joint election will be held by the City and the Leonard ISD under the following terms and conditions, and the parties hereto agree with said Page 1 Interlocal. Agreement, the City & LISD 2025 Joint Election conditions: TERMS OF THE AGREEMENT Section 1. The statements contained in the preamble of this Order are true and correct and adopted as findings of fact and operative provisions hereof. Section 2. That joint elections be, and the same are hereby ordered to be held, within the jurisdictions of the City and the Leonard ISD, on the 3rd day of May, 2025, pursuant to the laws ofthe State ofTexas. Such elections shall be held for the following purposes: A. The reauthorization oft the local sales and use tax in the City ofl Leonard at the rate of 1/4% to continue providing revenue for maintenance and repair of municipal streets. The tax expires on the fourth anniversary of the date of this election unless the imposition oft the tax is reauthorized. B. To fill the three at large positions on the Leonard City Council. C. To fill the four at large positions on the Board of Trustees of the Leonard Independent School District. Section 3. That a runoff election is hereby ordered and be held on June 7th, 2025, if necessary, to determine the election of one or more candidates for School Board positions in the City, or one or more positions on the Leonard City Council. Section 4. That there shall be one ballot that contains all appropriate races and propositions available for qualified voters oft the Parties. Section 5. That said election shall be held in accordance with the Constitution and laws of the State of Texas, and all duly qualified voters of the City and Leonard ISD shall be entitled to vote; provided, however, that no voter shall be given a ballot containing any office or proposition on which the voter is ineligible to vote. Section 6. That the election forms and records shall be individual in a manner convenient and adequate to record and report the results of the election of the City and Leonard ISD. The individual tabulation of the election results shall be in a manner to facilitate the independent canvass of returns for the City. Section 7. That the implementation and management of said elections shall be by the City Secretary, City of Leonard. The City Secretary is hereby designated as the Chief Election Official and Early Voting Clerk for the election to be held on May 3, 2025, from 7:00 a.m. to 7:00 p.m., and a runoff election, if necessary. The implementation, conduct and management of the elections shall include, but not be limited to: A. The securing of qualified individuals to serve as election judge, alternate judge, and clerk for the polling place. B. The securing ofl locations and façilities where the election is to be conducted. C. The securing of election materials and supplies, requisite to the proper administration of the elections, and the programming and preparation of Direct Recording voting equipment to be used in the election. D. The securing of an election services contract with Fannin County Elections Clerk for election services and supplies. E. The City shall be responsible for conducting early voting for the election. Page 2 Interlocal Agreement, the City & LISD 2025 Joint Election F. The City shall serve as general custodian of the election records in the joint election. Section 8. It is in the best interest of the Parties for election expenses incurred in the May 3, 2025, election be apportioned as follows: A. The City will fund the full cost of the election with the exception of the Judge, Alternate Judge and Clerk. B. The City will fund all costs in full for the Election Clerk for early voting. C. The City will fund all costs in full for Election Judge, Alternate Judge and Clerk on election day. D. Each Party will respectiully honor each individual contract with Fannin County Clerk's office for election services and supplies. Section 9. As stated in the order of election for the City, said elections shall be held in the following location: City Hall, Council Chamber 111 W. Collin Street Leonard, Texas 75452 Section 10. Early voting shall be conducted by personal appearance and by mail. As stated in the order of election for the City, the period for early voting for the general election shall be April 22 through April 29, 2025. Paper ballots shall be used for early voting by mail and direct recording electronic voting machines shall be used for early voting by personal appearance. The Early Voting Clerk for said elections shall be the City Secretary for the City. Jointly each Party shall appoint additional assistance by qualified individuals of the community to assist at the early voting polling place. The early voting place, by personal appearance, as stated in the order ofelection for the City will be: Early Voting Location: City Hall, Council Chamber 111 W. Collin Street Leonard, Texas 75452 Early Voting Time: April 22 - April 29 8:00 a.m. = 5:00 p.m. (Tuesday - Tuesday) Extended Hours: April 24 7:00 a.m. - 7:00 p.m. (Thursday) April 29 7:00 a.m. = 7:00 p.m. (Tuesday) Tuesday, April 22, 2025, is the last day for the City Secretary and/or Administrative Secretary to receive an application for ballot by mail. The City Mayor, or his designee, is hereby authorized to negotiate and execute an election service contract with Fannin County for services in connection with the joint election oetween the City and Leonard ISD. Section 12. There shall be one set of voting equipment to be used at the common polling places for the general election and runoff election, if necessary. Section 13. That this Agreement shall be preserved for the period for preserving the precinct election records. Section 14. That either party may terminate this Agreement in its entirety for convenience by giving the other written notice ofintent to terminate. This Agreement terminates ninety (90) days after a Party received notice of termination. Section 15.
