PRESENTATION 2023/2024 Audit - Brendan McKitrick Mr. McKitrick explained the financials of the Town for 2023/2024. The town has no issues with long term capital debt. The town had two comments on the agenda with the first comment being very typical with small towns. The second comment should be rectified by the next audit. The financial highlights the biggest would be the CDBG grant being included in the audit. The FGOA benchmark is to have a minimum of two months' income. Councilman Swanson asked about the Better Place Fund and the Fuel Tax. Councilman Swanson asked about the threshold value. Mayor Cuevas questioned about the description of the Significant Matters and Mr. McKitrick, explained that the description is misleading. It's not as bad as it sounds. It is the language of the state. PUBLIC HEARING ITEMS Smoking Ordinance 2025-01 ORDINANCE NO. 2025-01 Town Clerk read Ordinance No- 2025-01 by title only, AN ORDINANCE OF THE TOWN OF POMONA PARK, FLORIDA, AMENDING ARTICLE Il, CHAPTER 34 OF THE CODE OF ORDINANCES ADDING A NEW SECTION 34-9 PROHIBITING SMOKING OR V APING, IN MUNICIPAL PARKS OR MUNICIPALLY CONTROLLED BEACHES AND BEACH PARKS; PROVIDING SEVERABILITY, REPEAL, CODIFICATION AND AN EFFECTIVE DATE Councilwoman Evans motioned to adopt Ordinance No-2025-01 and Councilwoman Mead 2nd the motion. Councilwoman Cooney asked that we do a proclamation for the parks that we include that the parks are healthy and include the no smoking in the parks. Attorney Holmes explained to change the Chapter 2022-213 and change it to Statue 386.209. The fine also must be determined. Along with the enforcement method. 2 - Councilman Swanson stated that signage will help with the deterrents. Town Attorney stated the Ordinance needs to state what the Town would like to happen if the ordinance is broken. Councilwoman Mead stated that the law enforcement may stop showing up to the parks if they get continued calls about smoking in the parks. Mayor Tony stated that the hopes are to get the process started somewhere. Town Attorney Holmes stated that there should be some authority to tell them to not smoke in the parks. You just need to determine the punishment for the smoking in the parks. Councilman Swanson suggested tabling the issue. Town Attorney Holmes explained that all the amendments should be made with the first reading. A motion to amend the ordinance would be needed. Councilwoman Cooney stated that smoking is not illegal in Florida, and she understands that the law says that we can make this. A further discussion was had with the Council. Councilwoman Kuleski stated that she feels like we need this ordinance to back up the enforcement. Mr. Carol stated that as a grandparent of a teenager, he would not like his grandchild to pick upi the vaping. Because this leads to the health of our youth and the cleanliness of the parks. Most people are respectful and will follow the rules. Respect the property and kids of the town. Larry Flaman stated that he thinks it's a good idea. When it comes to enforcement will need to contact the sheriff and a prosecutor. Doris Carol the sign is a sign to parents to not smoke, more parents are more likely to quit smoking when they see the sign. Along with kids are less likely to start smoking if they see the signs. Councilwoman Evans motions to Table the Smoking Ordinance and Councilman Swanson 2nd. The vote was unanimous. Larry Flaman asked about all town properties. Town Attorney Holmes read the bill and explained that the bill does not allow the restrictions of other lands. Larry Flaman asked about the Community Center. Councilwoman Cooney motioned to adopt Resolution 2025-02 and Councilwoman Kuleski 2nd the motion. A discussion was had about protection for the staff. RESOLUTION 2025-03 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF POMONA PARK ADOPTING THE TOWN OF POMONA PARK CODE OF ETHICS AND CONDUCT FOR ELECTED AND APPOINTED OFFICIALS, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. Councilwoman Kuleski motioned to adopt Resolution 2025-03 and Counciwoman Evans 2nd the motion. Town Attorney explained that when it comes to committees that it is hard in a small town to avoid having conflict. His suggestion is to combine the two paragraphs on page 6 of A and B and remove starting at However and start back at B. Further discussion was had. Councilman Swanson motioned to table the motion. Councilwoman Evans 2nd the motion. Town Attorney explained that the three paragraphs do not apply to councilmembers. Further discussion was had. The vote to motion to table was tied 3-3. Does not pass. Councilwoman Kuleski amended her motion to for Resolution 2025-03 page 6 to combine Subparagraphs A&B and correct the grammatic. Along with removing the lines starting with, however. Councilwoman Evans asked about two payments made. Beautification Report - Martha Mann 4 Beautification Chair Martha reviewed breakfast 99, food sales of $911 the highest amount ever earned. New bulbs for outside the Town Hall. Upcoming events at Dunns Creek State Park 1-1:30 22"d and April 12. The mural will be painted on Wednesday. A special thanks to Luke Taft for assisting with this project. Upcoming projects a senior computer class, computer training for seniors April 5th after the breakfast. Along with a plant sale. All sales to benefit the garden. April 19th Easter Egg Hunt at the ball field at 10am. Councilwoman asked about the Dunns Creek Park projects, Bird watching. Tree Committee - Councilwoman Mead Councilwoman Mead opened the Tree Board meeting. The last meeting was in January and this our 35th We just completed the 34th year of Tree City. The beautification committee planted trees as gifts. What being a tree city means, sets our city up to be an environmental city tomorrow. Next meeting will be in June. NEW BUSINESS Aquatic Management Quote-Mayor Cuevas explained that the Town received a quote for the removal of the weeds at the beach of $1500. That is currently not in the budget. A solution was offered for this spring and having a volunteer clean-up day. Charles Behm asked about using the Scouts for help or community service hours. Mayor Cuevas asked for any volunteers. Martha Mann asked about the budget. Larry Flaman asked about the quote. C&S Under Groundwater Unlimited Invoice for Damaged Hydrant $4,056. Mayor Cuevas explained the incident that occurred to the damage. A workshop needs to be had about approving emergency repairs. Our insurance covers everything but the $500. Councilwoman Evans to approve payment of $4056.21 to C&S Underground Water, and Councilwoman Cooney 2nd the motion. The motion passes unanimously. James Moore Audit Invoice $5,500 Counciwoman Evans motioned to approve the $5,500 and Councilwoman Cooney 2nd the motion. Motion passed unanimously. Committee Approval for Seat on Blue Ways and Trails Mayor Cuevas asked Mr. Flaman to continue to represent Pomona Park and Councilman Swanson 2nd the motion. The motion passes unanimously. 5 Committee Appointment for River2Sea Loop Mayor Cuevas explained his concerns on the Trail. He feels that the proposed path is adequate for the Town. Andrea Almeida Grant Consultant Jeffrey Winters Mike Tibble and John Petrohovich with Mittauer and Associates 3. Purpose ofWorkshop The purpose of the workshop was to discuss and review the Town's eligibility, priorities, and project proposals related to the upcoming application for the Community Development Block Grant (CDBG). 4. Presentation from Mittauer and Associates- 1 John explained that this is a follow up to a workshop that was held almost a year ago. He explained that some changes in legislation that will change some of the projects planned for the future of the town. John reviewed the past successful projects. John reviewed the water system improvements are the most current infrastructure needs of the town. You must have a water system before you can have a septic to sewer project. The second application for the SCOP grants has been submitted for the town. John reviewed the Basin Management Action Plan and the new house bills that will affect the towns projects. The Town sits inside the lower St. Johns River Main Stem B Map. In the future it is estimated that the Town will have a limit on the nutrients. House Bill 1379 makes it for any lots on 1 acre or less will require an enhanced nutrient reducing on-site sewage treatment and disposal system. John explained the process since the last workshop ofworking with FGUA to discuss purchasing the system. Over 50 % of the Town is served by FGUA and is not the best service. Ittook almost a year to be in contact with them. FGUA is actively working on a cost estimate to purchase the plant. Mittauer is willing to continue working with the Town to assist with the acquisition of the plant. This is still a way out. The funding opportunities are available depending on what phase the project is at will depend on the cost to the Town. It would be the design phase then some time before the construction phase. Councilman Swanson asked about the cost when a person sells a piece of property it's going to cost them $15,000-$50,000. Councilman Swanson asked about ARPA funds and Town Clerk Andrea explained that funds have already been used on Town projects. Martha Mann stated that with the property tax reduction the Town should look very closely at these projects. Councilwoman Kuleski asked about comparable to recoup the cost of the water plant. A discussion was had about the quality of water. Along with other concerns from the residents. Grant Consultant The grant consultant, Jeff Winters provided an overview of the CDBG program, including eligible activities, application deadlines, and the maximum funding amount available. Topics covered: 2023-2024 CDBG program A draft application has been prepared. This cycle a waiver has been issued and the funding has been doubled. $40 million is available. This project is completely separate from the FGUA water project. If1 the council would like to proceed with this CDBG application. Jeff is willing to prepare the application at no cost to the town. AlL that he ask is that when we open the RFQ to take his company into consideration. A CATF would need to be created to allow for more points. The Town would be wise to look at every possible process to earn 2 more points for this grant because of every city being able to apply. A leverage commitment would be best of $25,000 to earn 25 more points. This funding could be used on engineering or a project. Readiness to proceed, will earn more points, this means having the plans ready to go out to bid, this will earn us 50 more points. The data is based on a survey that was created just under 5 years ago and we are maximizing points. Councilman Swanson asked about the point system. Suggested to pass a resolution to commit the funding if awarded. Total is 1000 points right now the town is sitting around 612. The $25,000 could be in kind services. Permit applications submitted by May 2. Mike from Mittauer explained how the last CDBG had multiple projects in the plans that were not constructed. Exercise trail with 6 equipment, picnic shelter, bathrooms community center, sidewalk Broward, beach oathrooms. Martha Mann asked if all plans had to be submitted at one time you can't add projects without plans. Larry Flaman asked about the bathrooms at the beach. Counciwoman Kuleski asked about cost estimates. Planning purposes for the next steps- submit first hearing notice and CATF notice, April 5 notice. The meeting will be the 10th and the 11tht the next hearing notice. The next meetings will be 21-24. WHEREAS, the Town of Pomona Park is eligible to apply for funding through the Florida Small Cities Community Development Block Grant (CDBG) Program for the 2025 grant cycle; and WHEREAS, the Town seeks professional assistance to ensure the preparation and timely submission of a competitive CDBG application that meets all program requirements and guidelines; and WHEREAS, Winter Consulting Group LLC has demonstrated experience and expertise in providing such grant writing and technical assistance services for local governments; and WHEREAS, the Town Council has determined that it is in the best interest of the Town to authorize Winter Consulting Group LLC to assist in the preparation and submission of the Town's 2025 CDBG grant application. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF POMONA PARK, FLORIDA: Section 1. Authorization. The Town Council hereby authorizes Winter Consulting Group LLC to assist the Town of Pomona Park in the preparation and submission of the 2025 Community Development Block Grant (CDBG) application. - Section 2. Execution. The Mayor, Town Clerk, and other appropriate Town officials are hereby authorized to take all actions and execute any documents necessary to carry out the intent of this Resolution. Section 3. Conflicts. AlL resolutions or parts of resolutions in conflict with this Resolution are hereby repealed to the extent of such conflict. Section 4. Severability. If any section, subsection, clause, or provision of this Resolution is held to be invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions hereof.
