AM City of Margate Page 2 Regular City Commission Meeting Meeting Minutes March 5, 2025 MARGATE RESIDENT, DONNA L. FELLOWS, thanked the Margate Police Department pertaining to an incident that occurred in her neighborhood. MAYOR SCHWARTZ made comment. MARGATE RESIDENT (LAKEWOOD CIRCLE), RICHARD ZUCCHINI, commented that when a member of the public questioned the City Commission for a response, they were looking for a conversation. He repeated a past request for the City to look into rumble strips as part of their repertoire which he believed was a valuable asset. He would like to hear a CONSENSUS from the City Commission against the rezoning of Palm Lakes Golf Course to residential. MARGATE RESIDENT, JONATHAN KRALJIC, read a statement pertaining to Vice Mayor Arserio's comments at the last City Commission meeting referencing fluoride in the water. MARGATE RESIDENT, TRACY VAN WINKLE, said that her husband worked as a Water Operator for the City for 30 years where she indicated that the extra fluoride in water was unnecessary. She agreed with Margate resident, Mr. Zucchini's comments on the public being able to respond to the City Commission and referenced the last City Commission meeting pertaining to the City Manager. She alleged that Mayor Schwartz was the only City Commissioner who read the back-up relating to a $25,000 drop in price for the forthcoming Fair. She also alleged that there was a high turnover of City employees and discussed the same. COMMISSIONER RUZZANO responded to Ms. Van Winkle and that he would also discuss this issue under Commission Comments. Discussion ensued. MARGATE RESIDENT, ELSA J. SANCHEZ, expressed her appreciation to Chief of Police Palma and Police Major Druzbik pertaining to a missing sign at their clubhouse. PARKLAND RESIDENT, MARGARET J. BREZINA, explained that at the next City Commission meeting, Margate was one of three cities that her board would discuss for consideration at their next Community Giveback event and sought their opinion on whether the City would do it again this year. COMMISSIONER RUZZANO explained that he did not have a problem with Margate doing the Community Giveback event again this year. COMMISSIONER, ANTHONY N. CAGGIANO, echoed Commissioner Ruzzano's comments and explained why it was an awesome event. COMMISSIONER, JOANNE SIMONE, said that she had no issues with it. VICE MAYOR, ANTONIO V.. ARSERIO, had no problem reviewing this when it was brought to his attention. CITY MANAGER, CALE CURTIS, explained that for last year's Community Giveback event, there was nothing that necessarily came before the City Commission as it was CONSENSUS from the board as Margate ultimately hosted this event and Ms. Brezina's organization provided all the volunteers. Discussion ensued. 3) COMMISSION COMMENTS COMMISSIONER RUZZANO explained that Margate Sports Complex had an incredible grand opening for the City last Saturday. He anticipated that Calypso Cove would re-open by the end of this month and referenced tickets for sale for their party. He informed that the soccer field at Southeast Park was being replaced and suggested incorporating shade areas at that vicinity. He referenced the Department of Environmental and Engineering Services (DEES) and the Building Department's respective Office Managers, O'Connor and Buddie, where they reduced the cost of a survey for a Homeowners Association (HOA). He advised that the BC Commission approved the height and extended the garbage at Mount Trashmore (Monarch Hill Renewable Energy Park) and explained the history pertaining to the Alpha 250 project which he was against. He heard that the Town of Davie did a Community Redevelopment Agency (CRA) extension which BC. He said that if Margate's 's CRA expired next year, the City would receive a loss of $5,000,000. He met with a developer this week about Cocogate pertaining to a eight story apartment complex on the corner of Coconut Creek Parkway and 441 and he also discussed the apparatus with the Fire Department. Discussion ensued on the proposed construction. COMMISSIONER RUZZANO highlighted that Margate' 's Ace Hardware was selling Tillman's Barbecue Sauce. He asked the City Manager ifr residents had first priority for pickleball courts in Firefighters' Park. He said that he received two calls on tiny homes in Margate and asked if they could be incorporated. CITY MANAGER CURTIS advised that the pickleball courts were on a first come, first served basis, unless they were permitted out. COMMISSIONER CAGGIANO took a picture of a tiny home which he said was stunning and continued to discuss the same. He also highlighted that it was Women's History Month and hoped that everyone had a good Valentine's Day. COMMISSIONER SIMONE thanked Development Services Permit Specialist II, Gonzalez, pertaining to her assistance with a resident and praised Margate's employees for the tremendous job that they did. COMMISSIONER CAGGIANO agreed with Commissioner Simone pertaining to the City's staff and also praised the Building Department for being helpful to residents. VICE MAYOR ARSERIO referenced previously selecting the Building Department's Office Manager, Buddie, as his Employee of the Year and said that it was good that she continued to do great work and highlighted a forthcoming meeting with a shopping complex pertaining to Code issues. He previously spoke with the developer which Commissioner Ruzzano discussed and referenced out parcels. He said that he may not be available at the next City Commission meeting as his wife was expecting a baby in the near future and questioned whether the date for the City Commission Workshop would need to be adjusted. She highlighted this Saturday's Doc Reno's 2nd Annual Meatball Mania Italian Festival and Spring Clean up and Garage Sale and shared Happy St Patrick's Day greetings. CITY ATTORNEY TOLCES reminded everyone that the legislative session had commenced in Tallahassee and that he would do his best to keep the City abreast of developments. 4) CITY MANAGER'S REPORT CITY MANAGER CURTIS repeated that the Town of Davie was successful in getting their CRA extended until 2039 and asked for CONSENSUS to send County Administrator, Cepero, a letter detailing the City's intent to extend Margate's board to 2039 as well. VICE MAYOR, ARSERIO, clarified that BC was not contributing but the City would be running it which he said would be beneficial to Margate sO he was fine with it. He confirmed that he agreed to CONSENSUS. Discussion ensued on affordable housing. MAYOR SCHWARTZ believed that BC still owed the City a year but said yes. COMMISSIONER SIMONE explained that recently, she had frequently visited that area and received feedback from regulars who attend the Dog Park and therefore, she would like to volunteer her services to work with City Manager Curtis and Parks and Recreation Director Jones to get these improvements underway. CITY MANAGER CURTIS advised that in the back-up, they have added some concept ideas as per Commissioner Simone's comments of the improvements to make for the dog park users. He explained that they would utilize the $50,000 grant and in excess of that amount, the increased budget that the City Commission were providing. VICE MAYOR ARSERIO thought that this was great and explained the history of this Item. MARGATE RESIDENT, ANNE BLATT, informed that she was a frequent user of the Dog Park and praised Parks and Recreation Director Jones, for obtaining the grant. She advised that they definitely needed some shade at that park and provided suggestions on the same. ID: 2025-060 A RESOLUTION OF THE CITY OF MARGATE, FLORIDA, APPROVING WITH CONDITIONS A TEMPORARY USE PERMIT FOR HILDEBRAND AMUSEMENT RIDES, INC., FOR PERMISSION TO HOLD MARGATE SPRING FLING' ALSO KNOWN AS 'A SPRING FAIR' AT 1000 NORTH STATE ROAD 7,1 FROM MARCH 14TH - 30TH, 2025; PROVIDING FOR AN EFFECTIVE DATE. A motion was made by Commissioner Caggiano, seconded by Vice Mayor Arserio, that this Resolution, be approved. COMMISSIONER RUZZANO referenced the last City Commission meeting about the possibility of a pedestrian bridge from Winfield Boulevard to the Park and questioned the position of an aerial crossing. CITY MANAGER CURTIS advised that the aerial crossing was being designed with the intention ofi installing the bridge. He suggested that if the crane was already going to be there for the pipes for the aerial crossing, he thought that the City could ask the contractor for a change order into what it would cost to install the bridge. DEES DIRECTOR, CURT KEYSER, informed that the crossing was subaqueous and not aerial. MAYOR SCHWARTZ advised that this discussion had nothing to do with this Agenda Item. Discussion ensued. JOSHUA D. RYDELL LAW OFFICE, JOSHUA RYDELL, 111 SW6TH ST, FORT LAUDERDALE, ON BEHALF OF HILDEBRAND AMUSEMENT RIDES provided updates from the last CRA meeting and advised that all outstanding fees had been paid. He also advised that for this current event, if they received any additional funds in respect of overtime from the Police or Fire Departments, his client would pay this within 30 days. He confirmed that there would be no animals associated with any event on the City's CRA property including the forthcoming circus. MAYOR SCHWARTZ referenced a housekeeping issue and explained that the application for the length of the fair stated 16 days but it was, in fact, 17. Discussion ensued. MR. RYDELL explained that it was a scrivener's error. Discussion ensued. MAYOR SCHWARTZ sought agreement that if there was another event, since it said 90 days in advance for the temporary use permit, they did not have to call for a Special Meeting. MR. RYDELL confirmed that the City would not have to do that again. Discussion ensued. MAYOR SCHWARTZ suggested that there would be a $200,000 bond posted to avoid a future conversation. MR. RYDELL believed that his client had paid all his bills. Discussion ensued on when the balance of the outstanding fees were paid and parking on the west side of State Road 7. COMMISSIONER SIMONE thanked Messrs. Rydell and Bast for valuing Margate in regard to their event for not featuring animals which she greatly appreciated. She requested if animal pictures could be removed from the margatefair. com website and also, referenced the back of the flyer. She thanked People for the Ethical Treatment of Animals (PETA), Animal Rights Views (ARV) and all the animal rights advocates and organizations who helped stop the animals being part of the fair and circus coming to Margate. MR. RYDELL pertained to the comments made about the website and indicated a change would only be possible if it was something that they could control. He explained that his client was very committed and was trying to build a fruitful relationship with the City. He requested City Manager Curtis to email the information to him. MAYOR SCHWARTZ continued to ask questions pertaining to the Fair and Carnival. CITY MANAGER CURTIS confirmed that all the staff comments would need to be resolved before the Fair could open. MR. RYDELL addressed Mayor Schwartz's questions and concerns. MS. FELLOWS voiced her concerns about noise and the operational times and compared it to the Dade County Fair. MS. VAN WINKLE referenced a Fair she attended in Palm Beach County on Southern Boulevard and questioned why they could not stop at 10:00pm. She also hoped that the applicant pays on time in future. ROB REINER, 110 EAST PALM DRIVE, questioned whether the owner would be willing to offer Margate resident generous discounts. COMMISSIONER RUZZANO hoped that the applicant would continue to do something for the homeless, as well as continuing to grant passes for the City's Athletes of the Month and Students of the Month and questioned if there was anything the applicant could do 8 Printed on: 3/24/2025 9:15, AM City of Margate Page Regular City Commission Meeting Meeting Minutes March 5, 2025 for Margate residents. He also requested if they could give some passes to School Resource Officer (SRO) Careccia. MR. RYDELL confirmed that his applicant was always committed to the Students and that they could pick a Margate Day' with a buy one get one free (BOGO). He explained that the applicant had moved away from issuing paper tickets which were now digitalized. MS. SANCHEZ indicated that most of her concerns had been addressed. She questioned why they allowed one person to break all the codes and referenced times, more dates or less money. MS. BREZINA thanked Mr. Bass and Mr. Rydell for providing tickets for homeless children at the last Fair. She expressed that the applicant should be shown some grace as he did a lot for the community. COMMISSIONER CAGGIANO highlighted that the applicant provided over $8,000 worth of tickets to the homeless which did not include the Students or other complimentary tickets and thought what he did was tremendous for the community. He also did not have a problem with the extra hour and questioned the Chief of Police Palma and Fire Chief Lorenzo ofh how many incidents occurred in the last two Carnivals where the Police or Fire Departments were involved. CHIEF OF POLICE, MICHAEL PALMA, was unable to provide a definitive number but did not believe there were many serious incidents. FIRE CHIEF, ROBERTO LORENZO, did not have the data to hand and said that he would have! been notified of any serious incidents but there was no major increase in call volume. MR. KRALJIC read a statement pertaining to the fair. ANIMAL RIGHTS FOUNDATION OF FLORIDA, FORT LAUDERDALE, JAMES WILDMAN, thanked City Commissioner Simone for her stance against the use of animals and hoped that in future, the City would do their due diligence of who they brought in. FORT LAUDERDALE RESIDENT, ANA CAMPOS, discussed the use of animals in past Margate events. She requested that the City consider the two Ordinances of 625 and 6241 to protect animals in Margate for future events. She thanked City Commissioner Simone for speaking up and also, Mayor Schwartz, Mr. Rydell and other participants. MARGATE RESIDENT, RICH ALIANIELLO, indicated that they should try and sort out all the issues concerning the Fair at this meeting. MAYOR SCHWARTZ responded to Mr. Alianiello's comments. MARGATE RESIDENT, LAUREN BERACHA, questioned if any incident more than zero was way too many? She sought an update pertaining to a bond which Vice Mayor Arserio discussed at a previous City Commission meeting. HALLANDALE BEACH, CITY COMMISSIONER, MICHELE LAZAROW, thanked Mayor Schwartz's vote against the animals for coming to Margate and appreciated her putting some safeguards into ensuring that nothing got ushered through. She also thanked Commissioner Simone, who she said, genuinely cared about the welfare of animals. She thanked Mr. Rydell for always having a spirited conversation. COMMISSIONER CAGGIANO concurred with Commissioner Ruzzano's response pertaining to Commissioner Lazarow's comments. MAYOR SCHWARTZ questioned if Mr. Rydell could elaborate on a "Margate Day." MR. RYDELL had spoken to his client to do BOGO for the first Monday as a "Margate Day" for all City residents regardless of age but they would need to provide proof of address. COMMISSIONER SIMONE questioned if the Noise Ordinance would be in effect with no loud speakers after 10:00pm. CITY ATTORNEY TOLCES informed that their Ordinance was always in effect and he was not aware of any specific waivers being granted. Discussion ensued. MR. RYDELL said traditionally by the property and the hours, his understanding was that the Noise Ordinance would not apply but Mr. Bast was being a 'good neighbor' who had always shut down the music and amplifying devices or things of that nature whilst the Fair was still operating. Discussion ensued on the Noise Ordinance and the days when the Fair operated late hours. CITY ATTORNEY TOLCES repeated that he was not aware of a waiver of any Noise Ordinance provisions as a result of Mr. Rydell's approval of a temporary use permit and explained that nor could the CRA board waive any provision of the same. He believed that the City would still be within its rights to enforce provisions of the Noise Ordinance and he would work with the applicant to ensure that they were in compliance. He asked for an amendment to be made for the "Margate Monday." Discussion ensued on whether a bond should be posted. A motion to amend was made by Commissioner Simone, seconded by Mayor Schwartz, to add Margate Monday "Buy One Get One Free (BOGO)" and to provide for a $200,000 bond. COMMISSIONER RUZZANO questioned if they wanted to do the bond next time. Discussion ensued on the bond.
