NEWVILLE BOROUGH COUNCIL WORK SESSION. / REGULAR MONTHLY MEETING FEBRUARY 25, 2025 AT 6:00 PM The work session meeting of the Newville Borough Council was held on Tuesday, February 25, 2025 at 6:00 PM in the Newville Borough Office Meeting Room, 103 South High Street, Newville PA 17241 with the regular monthly meeting to follow at 7:00 PM. The meeting was called to order by Council Vice President, Edward Sinkovitz. The invocation was given by Solicitor Marcus McKnight, followed by the Pledge ofAllegiance. On roll call, the following members were present: Mr. Jack Ericksen, Mr. Charles Heberlig, Pastor Joseph Kindon, Mr. Robert Darius and Mr. Edward Sinkovitz. Also in attendance: Borough Solicitor Marcus McKnight, Borough Manager Robert Sabatini, Borough Secretary Jody Hoffman, Rental/Codes Inspector Jeffrey Line, PFM representatives Gordon Mann and Lauren Sukovich, DCED representative Troy Keiser, Sentinel Reporter Maddie Seiler, Nicki Kunkle, Rebecca Walker, Meg Enslin, Sam Stine, George Spangler, Martina White, Elizabeth Knouse, Caroline Cooker, Gabe Rader, and Jim Burkholder. Executive Session: The work session ofthe Newville Borough Council began with immediately entering into an Executive Session to discuss personnel and financial matter at 6:03 PM. A motion to return to Regular Session at 7:05 PM was made by Pastor Kindon, seconded by Mr. Ericksen. Mr. McKnight stated that no actions were taken during Executive Session. REGULAR SESSION Citizen Comments: Rebecca Walker oft the Fountain Festival Foundation distributed maps of the areas to be utilized for the Fountain Festival on June 20 and 21, 2025. She explained that alternating sides of the streets will be used for the vendors in order to allow emergency vehicles access if needed. She stated that the layout is very similar to the previous year. Transporting between the fairgrounds and borough are still being discussed. She reported that there will be four restrooms placed among the festival areas. Concerns oft traffic and barricades were discussed as well as a parade route. Mrs. Walker is requesting a resolution to allow a waiver of the open contain law in the designated area as marked on the map. Liz Knouse spoke on behalf of the Newville Historical Society. A letter was submitted to council requesting a pause on the conversion of single-family dwellings into multi-family units. Jim Burkholder with WEMA voiced his concern of vendors on both sides of the streets. He reiterated Mrs. Walker's plan of vendors on every other side ofthe street blocks for safety and emergency vehicle access. He stated that if the new layout is not supported, WEMA will not participate in the Fountain Festival. He also requested that LEMC will need to submit an Event Emergency Plan to the county. Vicki Witter voiced her support ofthe Newville Historical Society's letter of not allowing any future conversation of single-family homes into multi-unit rentals. Borough Council Reorganization: Page 1 of 3 a. A motion was made by Mr. Ericksen, seconded by Pastor Kindon to appoint Mr. Edward Sinkovitz as President of Newville Borough Council. All were in favor. Motion carried 5-0. b. A motion was made by Mr. Sinkovitz, seconded Mr. Ericksen to appoint Pastor Kindon as Vice-President of Newville Borough Council. All were in favor. Motion carried 5-0. C. Mr. Sinkovitz asked Mr. Heberlig to be. Assistant Secretary Treasurer. Mr. Heberlig declined the request due to time restraints. Pastor Kindon asked for clarification of the duties that are required ofthe Assistant Secretary Treasurer. Mr. Sabatini responded that the. Assistant Secretary Treasurer would sign the minutes in the absence of the Borough Secretary Treasurer. A staff member would record the minutes. Pastor Kindon made a motion, seconded by Mr. Heberlig to appoint Mr. Ericksen as Assistant Secreatary Treasurer. All were in favor. Motion carried 5-0. Consent Agenda: A motion was made by Pastor Kindon, seconded by Mr. Ericksen to accept the Consent Agenda as presented. All were in favor. Motion carried 5-0. Manager's Report: Mr. Sabatini stated that he was notified by PennDOT that the paving of North and South High Street project has been divided into two parts. Curbs and handicap cutouts will be done this summer, with the milling and paving to be done the summer of 2027. He reported that all radios have been ordered by the deadline. Legal Matters: Mr. McKnight reported that the warehouse design has now been handed to DEP by the county. It is waiting for DEP's decision. Old Business: A motion was made by Mr. Ericksen, seconded by Pastor Kindon to approve Resolution 2025-03, "The suspension ofthe Open Drinking Ordinance number 58 dated. August 5, 1980j for the Fountain Festival, June 20 and 21, 2025 in the designated area' " New Business: a. Mr. Ericksen made a motion that all Borough Council consultant contracts be based on a "not to exceed" cost basis, and that any additional expenditures be approved by Council or two Council representatives prior to them being incurred. He also requests that a Council member be appointed as the Council liaison with any consultant retained by the Borough. The motion was seconded by Mr. Darius. All were in favor. Motion carried 5-0. b. A: motion was made by Pastor Kindon, seconded by Mr. Ericksen to appoint Ms. Vicki Witter as chair ofthe Vacancy Board. All were in favor. Motion carried 5-0. C. Mr. Sabatini explained the Municipalities Authorities Act (section 5610 - b1) for the eligibility of members to include township residents to which the. Authority services. He explained there is one member from North Newton Township and one member from West Pennsboro Township. The remaining three members are residents of Newville Borough. He explained the definition of a resident per the Act is that a person lives in the Borough, a person operates a business in the Borough or they are a tax payer of the Borough. A motion was made by Mr. Ericksen, seconded by Pastor Kindon to appoint Mr. John Eppley to the Newville Water and Sewer Authority. A motion was made by Mr. Ericksen, seconded by Mr. Darius to approve the appointment ofLiz Knouse to the Planning Commission. All were in favor. Motion carried 5-0. e. A motion was made by Pastor Kindon, seconded by Mr. Ericksen to add the second Tuesday of the month for meetings of the Newville Borough Council. All were in favor. Motion carried 5-0. f. Ai motion was made by Mr. Ericksen, seconded by Pastor Kindon of confirmation of request for public hearing by Senator Rothman regarding the Big Spring. All were in favor. Motion carried 5-0. g. A motion was made by Pastor Kindon, seconded by Mr. Ericksen authorizing the use ofthe park by Big Spring Heights Church of God for an Egg Hunt on April 13, 2025, Summer Faith and Fun Days tentatively starting June 6 through August 1 on Fridays and Back to School Bash on August 3. All were in favor. Motion carried 5-0. h. Ai motion was made by Mr. Ericksen, seconded by Pastor Kindon authorizing the enhanced financial monitoring agreement with Hamilton and Musser.
