Background: In July 1997 the City of Lancaster entered into an Agreement for Construction, Maintenance and Operation of Continuous Highway Lighting Systems within a Municipality with the Texas Department of Transportation. This agreement requires the City to maintain the median lighting from south of Pleasant Run Road to the southern city limits. The City subsequently amended the agreement in 2004 and 2006. Operational Considerations: The City received numerous complaints regarding the lights along North Interstate Highway 35 not being operational within the City of Lancaster. The Texas Department of Transportation coordinated with staff to evaluate the concern and ensure compliance with the maintenance agreement. While the operation of the lights is a maintenance requirement of the City of Lancaster, the light fixtures provide illumination to the cities of Lancaster, DeSoto and Glenn Heights. Legal Considerations: Highway Intelligent Traffic Solutions in an authorized vendor to perform work within the Texas Department of Transportation rights-of-way. Operational Considerations: Approval of this purchase will increase efficiencies and operations in the Wastewater Department and also assist us with complying with (Texas Commission of Environmental Quality (TCEQ) mainline inspections. The improved technologies for the mainline camera will allow us to inspect sewer mains up to 12 inches to allow crews and the foremen to determine if repairs are needed and to assist with stopping inflow and infiltration (I & I). The development aligns with the character of the surrounding area. Availability of utilities and access: Water is available through Rockett. City sewer is not available, and a septic system will be required. Dallas County is the authority to process and permit septic systems. Site conditions such as vegetation, topography and floodplain: The subject property is currently vacant. Upon construction of this site, factors such as vegetation and topography will be addressed through the permitting process. There is no floodplain on the site. These codes are administered for construction and serve to establish minimum standards that protect lives and ensure safety. Every three years, the International Code Council (ICC) prepares a series of new code updates for municipalities to consider adopting as their minimum construction and maintenance standards. The State of Texas also recommends the update of the National Electrical Code every three years as the minimum standard for life safety. The ICC model codes are administered throughout Texas and many municipalities within the nation as their minimum construction standard. To ensure further consistency in the building code standards throughout the region, the North Central Texas Council of Governments (NCTCOG) also proposes local amendments to the model codes. To enhance the City's current construction and maintenance safety standards, the 2023 National Electrical Code and the following 2021 International Code Council (ICC) Model Codes are proposed for update consideration with local amendments. Background: As prescribed in the City Council Rules and Procedures, Section D. City Council Agenda Process, Subsection 1.b, as amended September 9, 2024, Councilmember Strain-Burk requested that an item be placed on the City Council work session for the purpose of discussing the Historic Landmark Preservation Committee's role in designating Historic Landmarks within the City. During its February 2025 work session meeting, the City Council discussed HLPC responsibilities in designating historic landmarks. City Council directed staff to bring an agenda item for consideration of establishing an application for landmark designation. Operational Considerations: In accordance with the Lancaster Development Code (LDC) Section 2.12(d), a Historic Landmark is defined as an individual site, building, object or structure, designated by ordinance of the City Council, that is worth rehabilitation, restoration and/or preservation for its historical, cultural and/or architectural significance to the City of Lancaster. The process for designating a historic landmark is identified in the Lancaster Development Code Section 2.12 (d)(2) A-H. It begins with a nomination by the property owner, City Council, or recognized historic preservation organization. The six (6) criteria for considering eligibility for designation is: 1. Significance in history, architecture, archeology and/or culture; 2. Association with events that have made a significant contribution to the broad patterns of local, regional, state or national history 3. Association with the lives of persons significant in our past; 4. Embodiment of the distinctive characteristics of a type, period or method of construction; 5. Representative work of a master designer, builder or craftsman; and/or 6. An established and familiar visual feature of the City. The HLPC shall review the application, along with, receiving comments from the nominating property owner and interested parties. Their recommendation is then forwarded to the Planning and Zoning Commission (P&Z) for a public hearing and final recommendation to the City Council. After holding a public hearing, the City may make the following determination: 1. Designate by ordinance historic landmark status for all, or some of the building(s), site(s) or feature(s) specified or, 2. Remand the nomination to P&Z or HLPC for additional consideration or, 3. Reject the nomination of the historic landmark in its entirety.
