December 5. 2011 Regular Council Meeting Minutes Motion, Council Member Zeughauser, Second Vice President Shaul. Motion passed 4-0. Council Member Proctor abstained. 2. Town Manager's January Financial Report Manager Charnovich presented his January Financial Report in two parts. (Attached). He also asked Council Member Proctor to present to the Council a revised financial report template that can possibly be used for meetings going forward. 3. Town Residents/Agenda Items None. 4. Town Residents/Non Agenda Items Wendy Louttit, Trent asked ifthere was a possibility that Contractors working on homes could park in the pool parking lot during the offseason. 5. Pool House Construction Update Lou Balodemas discussed his report with the Council and the remaining items on the punch list needing completed. Vice President Shaul expressed concern over the timing of the design and construction of the new entrance sign. Mr. Balodemas stated he would check with McInturff Architects to seeif the process could get finalized in the next couple weeks. An operating manual for the pool house was also discussed that Mr. Balodemas stated he could put together in conjunction with Manager Charnovich. 6. PCO 80 in the amount of $251.75 Motion Council Member Farley, Second Council Member Pickar. Motion passed 5-0 to approve. 7. Invoice by Balodemas Architects in the amount of $5,940.00 Motion Vice President Shaul, Second Council Member Zeughauser. Motion passed 5-0 to approve. 8. 5529 Surrey Street, Replacement HVAC unit Mayor Slavin asked Inspector Plummer to provide his report to the Council. Mr. Plummer stated that the HVAC Unit met the requirements and recommended approval. Motion Council Member Pickar, Second Vice President Shaul. Motion passed 5-0. The Council stated that it would begin to work on Amendment to the Town Code concerning the emergency installation of HVAC Units. 9. 4909 Essex Avenue application, increase deck size Mayor Slavin asked Inspector Plummer to provide his report. Mr. Plummer stated that he reviewed the application in conformance with the Town Code. Manager Charnovich stated that the neighbors in the vicinity of the property had been notified about the application for the increase in the deck size. Motion Vice President Shaul, Second Council Member Pickar. Motion passed 5-0. 10. 4712 Cumberland Avenue, Historic Preservation Local Advisory Panel Mayor Slavin asked Inspector Plummer to provide the report on the property. Kevin with Paramount construction was present on behalf of the applicant. Kevin explained the process by which the applicant submitted this design. Norm Schneider, Greystone, was at the meeting on behalf ofhis mother, Zola, who lives on Cumberland. Mr. Schneider was interested in the approval process for this submittal, Lucy Freeman, Dorset, commented on when the original house at this property was constructed in 1955. Motion Council Member Zeughauser, Second Council Member Pickar, to recommend to the Historic Preservation Commission as Local Advisory Panel number 2 on the Paramount Letter of September 1, 2011 but not to recommend number 1 on the letter. (Attached) The Council stated that they were concerned about stormwater management issues as well as tree protection issues with this particular plan that was presented. 11. Council Member Zeughauser's Curb Cub Ordinance Amendment Mayor Slavin asked Barbara to present her amendment for the curb cut ordinance amendment. Motion Council Member Zeughauser, to approve an Ordinance to amend the Town of Somerset Code, Chapter 3, Streets and Sidewalks, Sections 3-103, 3-105, 3- 106; and 3-111, and to renumber Sections 3-107, 3-108, 3-109, and 3-110. The Section 3-111 waiver clause Ai is to eliminate the words "Parking and". Second Vice President Shaul. Motion passed 5-0. 12. Memorandum of Understanding Robin Wilder, 5535 Warwick Place Mayor Slavin provided his recommendation to the Council for the Town pay to move the fence onto private property. He stated that documentation must be established for future Boards and Officials. Motion Counçil Member Proctor, Second Vice President Shaul to authorize the Mayor to negotiate a Memorandum of Understanding that would include the options of moving the central portion of fence onto the Wilder' s Property at the Town's cost. This is contingent upon the rare tree not being affected and the fence being easily moved based on its condition. Ifthe current property owner were to move or the fence rots, the fence is to be removed completely. Motion passed 5-0. 13. Approval of the Mayor's re-nomination of Phyllis Wiesenfelder to the Board of Supervisors of Elections to 12/31/13 Motion Council Member Farley, Second Council Member Proctor. Motion passed 5-0. 14. Approval of the Mayor's nomination of Sherry Bindeman Kahn to the Board of Supervisors of Elections to 12/31/14 Motion Council Member Pickar, Second Council Member Zeughauser. Motion passed 5- 0. 15. Approval of the Mayor's re-nomination of Bill Marmon to the Board of Supervisors of Elections to 12/31/14 Motion Council Member Zeughauser, Second Vice President Shaul. Motion passed 5-0. 16. Introduction Amendment to the Town Code to set standards for utility pole attachments in public rights of way Mayor Slavin asked Council Member Proctor to go over the proposed amendment. The Mayor and Staff will contact the affected utility companies and share the code amendment with them SO they can provide comments if they wish. 18. Council Member Proctor's update on an effort to add cost effective options to Pepco's tariffs for LED street lights. Council Member Proctor provided an update regarding his efforts on this topic as well as a brief article from the Wall Street Journal. 19. Mayors Report Mayor Slavin commented on the following 5 topics ofinterest: 1. He asked Council Member Proctor to work on Purple Line issues to discuss further at the March meeting. 2. He mentioned that a code amendment was going to be worked on concerning the 7 day notice requirement for the Town Journal. This would amend the code to permit for 7 day notice electronically. 3 The Personnel Committee would be discussing in the near future possible changes in the Town's Ethics Code, gifts and campaign finance. 4. The Mayor and Vice President Shaul would be meeting with Drummond officials to discuss Warwick Lane. 5. The Town would work on an amendment to the Code in the near to immediate future concerning construction hours on certain federal holidays. 20. Adjourn at 9:55 pm.
