Public Comment Period: Shane Green, Uppingham, had questions about the tree being planted at 5514 Uppingham Street. Consent Agenda 2, 3, 4. Motion Shaul to approve the consent agenda including the July 7, 2014 Council Meeting Minutes and August 4, 2014 and remove the July 22, 2014 (Number 3) minutes because they were approved previously. Non-Consent Agenda 5. Town Manager Charnovich provided the August Financial Report. 6. 4820 Cumberland Avenue Consideration of an 11.6 foot variance to construct a bay window along the left, front elevation. Motion Peale, to approve the variance citing Section 6-312 e2 oft the Town Code in relation to Waivers. The criteria from this Section were met. Second Shaul. Motion passed 4-0. A Montgomery County, Maryland Municipality 7. 4820 Cumberland Avenue - Consideration of a building permit application to construct a bay window on the left front elevation, dumpster permit, and replace an existing wooden fence along the east property line. Motion Shaul, second Peale and to include the reports by Larry Plummer and Dr. Feather. Motion passed 4-0. 8. 4905 Falstone Avenue Consideration of a 2.65 foot variance from the front yard setback requirement to construct a second story addition above the garage. Motion Shaul, second Peale to approve the variance based on the criteria being met in Section 6- 312 e2 ofthe Town Code. Motion passed 4-0. 9. 4905 Falstone Avenue - Cosideration of a building permit application to construct a second story addition and convert the existing garage into mudroom and storage space. Motion Peale, second Pickar and including the requirements in the reports by Larry Plummer and Dr. Feather. Motion passed 4-0. 10. WSSC Permit Extension Consideration of a Permit extension request from WSSC until September 30 to complete work taking place on Cumberland Avenue. Motion Pickar, second Shaul. Motion passed 4-0. 11. WSSC Environmentally Sensitive Areas Representatives from WSSC and its consultant, O'Brien and Gere were at the meeting to make a presentation on projects that are proposed on Town Parkland. Various comments and questions were posed by Town residents concerning the proposed project. It was determined a separate public information session would take place this fall to explain the details of the project(s) and the Town administration would begin working on a Conditions Agreement with WSSC with the Town Attorney's office. 12. Fall tree plantings Plantings were considered at the following locations for fall tree plantings: 4700 Essex, I Sugar Maple (Transplant existing Willow Oak) 4731 Essex, 3 Yellowwoods 4807 Essex, 2 Yellowwoods 5407 Uppingham, 1 Red Maple 5811 Warwick Place, 1 Willlow Oak (transplanted from 4700 Essex) 5501 Trent Street, 1 Red Maple Motion Pickar, second Shaul. Motion passed 4-0. It was determined the Blackgum tree at 5514 Uppingham would be tabled until further notice. 13. 4515 Cumberland Avenue Tree 15 - Motion Pickar, second Condos to approve the removal of the Red Maple contingent upon Pepco removing the tree at its cost. Motion passed 4-0. 14. Memorial/Donation Policy - Item was tabled until further notice. 15. Dog Waste Disposal Unit Donation by Mayor Slavin Item tabled until the Gift/Donation policy is finalized. 16. Memorial Gift Donation of a single tree in memory of Bonnie Lewin - Tree is to be planted at the Town Hall in between the Town Hall and Town Garage. Motion Shaul, second Peale. Motion passed 4-0 to accept donation of the tree and plaque. 17. Resolution for Road Closures for Somerset Race - Motion Shaul, second Peale to adopt a Resolution confirming the closure of Wisconsin Avenue and River Road entrances on Sunday, October 12, 2014 from 8 am to 11 am for the annual race sponsored by the Somerset Elementary School PTA. Motion passed 3-0. Council Member Condos exited the room for a brief period. 18. Confirmation of3 invoices from Therrien Waddell = Invoices are in relation to the Town Hall interior renovation project for a total amount of $4,665.00 (Invoice 1,$ $1,000: Invoice 2, $2,697.00, Invoice 3, $968.00) Motion Peale, second Shaul. Motion passed 3- 0. 19. 2 Invoices from Balodemas Architects for Town Hall interior renovation project - Motion Shaul, second Pickar to approve 2 invoices in the amount of $2,837.50 (Invoice 1, $1,897.50: Invoice 2, $940.00). Motion passed 4-0. Council Member Condos re- entered the meeting room. 20. Letter endorsing Meredith Wellington for a position on the Montgomery County Planning Board - Motion Shaul, second Pickar to approve the Mayor to send a letter in support of Meredith Wellington for a seat on the Montgomery County Planning Board. Motion passed 4-0. 21. Mayor's Report - Mayor Slavin providing his report to the Council and made it available for anyone in the audience. 22. Adjourn - 10:10 pm
