The following waivers have been determined to be necessary by the Town in order for the applicants to retain recently-constructed portions of the house:-8:20 A. a 6.55-foot waiver for the 2nd and 3rd floor balconies which project into the required "nearby house" front setback along Dorset Avenue. The applicant contends no waiver is needed, because the County does not require an "established building line" front setback for the project. B. a 5-foot waiver for the triangular architectural feature at the corner of the house which projects into the required "nearby house" front setback along Dorset Avenue. The applicant contends no waiver is needed, because the County does not require an "established building line" front setback for the project. C. a 1.5-foot waiver for a wraparound balcony feature along the Deal Place setback. The applicant contends no waiver is needed, based on a County exception for a balcony that encroaches into a required setback. D. a 0.9-foot waiver for the 2-story ornamental panel projections along Deal Place. The applicant contends no waiver is needed, based on a County exception provided for ornamental features that encroach into a required front setback. E. a 2.1-foot waiver for the I-Beam that projects into the side-yard along Deal Place.
