Filling vacant seat on the Town Council: Motion Shaul, second Zeughauser to appoint Dudley Fowlkes, Falstone, to fulfill the remaining term of former Council Member, Cathy Pickar. Motion passed 4-0. Council Member Fowlkes was sworn into office. Closed Session: Motion Shaul, second Peale, to enter into closed session in accordance with Section 3-305 oft the Maryland Code to discuss a matter of potential legal liability to the Town of Somerset with legal counsel. Closed session lasted from 7:30 pm to 8:15 pm. Motion Shaul, second Zeughauser to exit closed session. Motion passed 5-0. Council Member Zeughauser as alternate check signer on the Town Council 4. Resolution honoring Cathy Pickar for her years of service on the Town Council 5. Confirmation approval of the Mayor's re-nomination of Patty Friedman to serve on the Town Parks and Natural Resources Committee for a term ending December 31, 2018. 6. Confirmation approval of the Mayor's re-nomination of Steve Surko to serve on the Town Parks and Natural Resources Committee for a term ending December 31, 2018. 7. Confirmation approval of the Mayor's re-nomination of Kathleen Kenyon to serve on the Town Parks and Natural Resources Committee for a term ending December 31, 2018. 8. Confirmation approval of the Mayor's re-nomination of Matt Fink to serve on the Town Tennis Committee for a term ending December 31, 2018. Setting the Election date for 2016: Election date will be April 5, 2016 from 6 pm to 9 pm in the Town Hall. Motion Zeughauser, second Shaul. Motion passed 5-0. 11. 4715 Cumberland Avenue building permit application: Motion Shaul, second Zeughauser to approve the following building permit items and to include the Town Inspector and Town Arborist reports: Construct a 2.5 story addition in the rear ofthe house Restore and extend the deck in the rear oft the house Restore the existing garage in the rear yard Replace the existing driveway flare with a parking pad Construct a stucco retaining wall along the new parking pad Relocate the HVAC units Motion passed 5-0. 12. Local Advisory Panel Recommendation to the Historic Preservation Commission for 4817 Dorset Avenue: Motion Shaul, second Zeughauser to recommend to the Historic Preservation Commission the following: Construct new steps in the rear yard adjacent to the new accessory building addition Rebuild two retaining walls adjacent to the narrower steps New limestone paving that will border a new gravel driveway A new exposed gravel concrete parking area at the end ofthe gravel driveway 13. Consider approval to amend Section 4-103 ofthe Town Code in relation to snow/ice removal on Town sidewalks: Following much discussion and comments from the public on the removal of snow from sidewalks policy, it was determined this matter would be deferred to the January Council meeting once more information was obtained. Motion Shaul, second Zeughauser, motion passed 5-0. 14. Consider approval to amend Section 9-301 ofthe Town Code in relation to sled-riding on Cumberland Avenue: Following many comments from the public on the sledding hill both pro and con, the following motion was made: Motion Shaul, second Zeughauser to eliminate the section sentence in Section 9-301a which will eliminate sledding for greater than 24 hours after a snow storm. Motion passed 4-1 with Council Member Peale against. 15. River Road traffic control options near Greystone Street: Dave Murnan, representative of the State Highway Administration for Montgomery County, was in attendance at the meeting to discuss the latest traffic control design for this intersection. Motion Fowlkes, second Peale to support the design presented by SHA. Motion passed 4-1 with Council Member Zeughauser against. The design will be placed on the home page ofi the Town website if anyone wants to see it. 16. Bids to replace Town Hall emergency generator: Larry Plummer, Town Inspector, presented the bids received to replace the emergency generator with a newer model. A FEMA grant is to cover 75 percent of the cost. Motion Shaul, second Zeughauser to approve the bid of JBI Services in the amount of$11,153.82 contingent upon FEMA approving the bid. Motion passed 5-0. 17. Larry Plummer Exit Report to the Council and Mayor: Final report appended to these minutès 18. Project Management Proposal by John Chadwick ofthe OGC Company, LLC for pool construction bidding work and construction work proposed in calendar year 2016 at a cost of $3,000.00: Motion Condos, second Zeughauser. Motion passed 5-0. 19. Pool Management proposals for 2016: Motion Condos, second Zeughauser to approve the pool management proposal submitted by Community Pools for calendar year 2016 contingent upon a final contract being finalized. Motion passed 5-0. 20. Comcast Cable Franchise Ordinance Ordinance was introduced for the cable franchise agreement which will be managed by Montgomery County. 21. General Code Update: Ongoing workshop dates have been set and are being publicized via electronic communications. 22. Mayor's Report: Mayor Slavin provided his report to the Council and had copies available in the room if anyone wanted to review it. 23. Adjourn at 10:40 pm
