Approval of May 1, 2017 Council Meeting Minutes 2. Approval of June 5, 2017 Council Meeting Minutes 3. Approval of June 23, 2017 Council Meeting Minutes June 5, 2017 Council Meeting Minutes were not acted on because they were not complete yet. Motion Shaul, second Peale to approve the May 1 and June 23 minutes, motion passed 4-0. Non-Consent Agenda 4. Town Manager Charnovich presented the June 2017 Financial Report 5. 4818 Cumberland Avenue plan amendment: The applicants were requesting to amend the plan by replacing the shed dormer in the roof ofthe living room with a gable style roof with two windows, and reforest the site with additional trees by amending the landscape plan. The Town Attorney and plan reviewer identified some proposed changes that were not outlined clearly in the application materials. Motion Peale, to approve the amendment application to reflect changes to the side chimney, side windows, garage "Where People and Trees Have Deep Roots and Grow Strong" door, guest house roof, amendment to tree plan to include 5 total canopy trees and all trees in the Town Arborist report. Second Shaul. Motion failed 3-1-1, with Council Members Condos, Zeughauser, and Shaul voting against. Council Member Fowlkes abstained because he was not at the meeting yet for the discussion. It was then determined that the applicant would need to come back with the updated site plan and County approved plan, outlining in specific detail the amendments they would like to make. The item would be reconsidered at either the August Council Meeting or during a special meeting sometime in July. 6. 4707 Cumberland Avenue Historic Preservation Application: The applicants requested to replace a fence in the right side and rear yard, and construction of a flagstone patio and seat wall in the rear yard. Motion Zeughauser, second Shaul, to recommend the plan to the Historic Preservation Commission. Motion passed 5-0. 7. 4704 Essex Avenue HVAC unit application: Motion Shaul, second Zeughauser, to approve the application for a replacement HVAC unit contingent upon it passing the required sound test. Motion passed 5-0. 8. 4718 Cumberland Avenue HVAC unit application: Motion Zeughauser, second Shaul, to approve the application for an HVAC unit to be installed on the east side ofthe property. James Regan, a neighbor of the applicant, commented on the application to make sure it was being installed on the east side. Motion passed 5-0. 9. Removal ofthe following Town trees as recommended by the Town Arborist: Elm, 24" dbh at 5001 River Road (being removed on an emergency basis), Elm, 10" dbh at Capello Park, Tulip Poplar, 30" dbh at 4520 Dorset Avenue. Motion Shaul, second Zeughauser, motion passed 5-0. 10. Resolution concerning LED Lighting: Motion Shaul, second Zeughauser, to adopt a Resolution of the Town of Somerset, committing to exploring converting streetlights to energy efficient bulbs. Motion passed 5-0. 11. Ordinance 1-2017 concerning parking restrictions on Dorset Avenue: Motion Shaul, second Condos to approve a technical correction to previously adopted Ordinance 1 of 2017 related to parking restrictions on Dorset Avenue from Wisconsin Avenue approximately 414 west to the eastern edge oft the fire hydrant zone. Motion passed 5-0. 12. Amendment to Pool Rules: Motion Condos, second Peale, to amend the Pool Rules, section VIII, recommending removing the words "full time/contracted" to make it SO all nannies, au pairs, babysitters, and caregivers would be exempt from the guest fee when attending with the resident they take care of as recommended by the Pool Committee. Motion passed 5-0. 13. Automatic vacuum cleaner for the Town Pool, proposal from Community Pools for $6,700.00: Motion Peale, second Condos to authorize the Town Manager to work on purchasing an automate cleaner for the Town Pool at a cost not to exceed $3,000.00. Motion passed 5-0. 14. Dry Dek four square proposal from Community Pools for $2,000.00: Motion Zeughauser, second Shaul, to install a Dry Dek four square court at the pool at a cost not to exceed $2,500.00 contingent upon receipt ofinformation from Community Pools with the cost breakdown, pictures of successful installations, maintenance info, and warranty information. Motion passed 4-1, with Council Member Condos against. 15. Gift of cell phone holders by FONBOOTH for the Town Pool: The item was discussed, and no motion was made to accept the gift to place cell phone holders in the bathrooms at the Town Pool. 16. Replacement ofwater heater at the Town Hall: Motion Peale, second Fowlkes to replace the water heater in the Town Hall kitchen with a tankless water heater at a cost not to exceed $3,800.00. Motion passed 5-0. 17. Bethesda Plan Zoning Text Amendment: Motion Shaul, second Zeughauser, to send a letter to the Montgomery County Council on the Bethesda Downtown Plan and its possible effects on Somerset Elementary School. Motion passed 5-0. 18. Montgomery County Bicycle Master Plan preliminary recommendations: Motion Shaul, second Condos, to approve starting the conversation with the County by inviting them to look at our roadways once the school year has started. Motion passed 5-0. 19. Montgomery County Council legislation, Bill 21-17, pertaining to dog parks: Motion Zeughauser, second Condos to send a letter to the Montgomery County Council related to dog park management within individual municipalities. Motion passed 5-0. 20. Town Attorney Ron Bolt went over pertinent legislation at the County and State level that may potentially affect the Town of Somerset. No action was taken. 21. General Code update: A number of Town Charter proposed amendment resolutions would be introduced in August. The public would have the opportunity to comment on them at both the September and October Council meetings, before any action would be taken. The proposed resolutions will be placed on the Town website and are available in the Town Hall for review by the public. 22. Mayor Slavin had his report available at the meeting if anyone wanted to review it. It will also be placed on the weekly email blast notice. 23. Adjournment at 10:18 pm
