A Public Hearing to Consider Approval of A Resolution of the City Council of the City of Arvin Approving A Plan of Finance for the Acquisition and Rehabilitation of the Monte Vista, Parkview Apartments, and Haciendas Del Sol (Collectively Known as Arvin Rental Assistance Demonstration (RAD), Including the Issuance by the Housing Authority of the County of Kern of Multifamily Housing Revenue Bonds not to Exceed $24,000,000.00. A Public Hearing to Consider Introduction of An Ordinance of the City Council of the City of Arvin Adopting Zoning Code Amendment 2025 Amends Title 17 Zoning - Chapter 17.055 Multiple Family Residential Design Review Ministerial Permits. Staff recommends the City Council consider introducing the Ordinance to be read by title only, open the hearing, allow for public testimony, close the hearing, waive first reading of the Ordinance, and approve the introduction of the Ordinance. Motion to waive first reading of the Ordinance to be read by title only and approve the introduction of the Ordinance. Motion CM Perez Second MPT Reyes Vote 4-0 C. A Public Hearing to Consider Approval of Conditional Use Permit 2024-Solar Array and Site Development Permit 2024-Arvin CSD Solar Array Subject to Conditions of Approval. Staff recommends to open the hearing, allow for public testimony, close the hearing, and adopt the Resolution approving the project subject to Conditions of Approval. Hearing opened. Alan Peak, Attorney for Arvin Community Services District (ACSD) provided comments regarding conditions for the Celestial Way street improvements and concerns regarding ongoing maintenance for landscaping and lighting requirements and requirements to improve what appears to be % of the street versus % of the street. The ACSD's compromise is to improve % of the street when the City improves the northern portion of the street. No testimony received from the public. Hearing closed. Motion to adopt the Resolution approving the project subject to Conditions of Approval as provided by City staff. Consideration and Approval of Amendment No. 1 to Master Services Agreement Number 2023-31 Dated December 4, 2023, Between Veolia Sustainable Buildings USA West, Inc., Formerly Known As Enovity, Inc. and the City of Arvin for A Contingency Budget in the amount of $615,153.00 for Payment for PG&E Utility Upgrades and Other Scope Items for the City of Arvin's Wastewater Treatment Plant Solar Renewable Energy Project, and Related Budget Adjustments. Staff recommends approval of Amendment No. 1 to Master Services Agreement 2023-31. Motion to approve Option 2: Approving the Amendment No. 1 to Master Services Agreement Number 2023-31 Dated December 4, 2023, Between Veolia Sustainable Buildings USA West, Inc. and the City of Arvin to include upgrade costs in the extended payment terms with Veolia until all funding is secured with California Energy Commission and Federal Government Investment Tax Credit Direct Pay and not to exceed total project cost of $4,285,714.00 per approved funding budget.
