A meeting of the Fayette County Board of Commissioners was scheduled for 10 a.m. on Thursday, February 20, 2025 at the meeting room of 2 West Main Street, Uniontown PA. In attendance- Commissioner Chairman Scott Dunn Commissioner Dave Lohr Commissioner Vince Vicites Chief Clerk Amy Liston County Solicitor Jack Purcell Commissioner Dunn announced that there were technical issues with the Zoom and he wouldn't start the meeting until that is fixed. He said they would start with presented the proclamations. Proclamations Commissioners Dunn, Vicites and Lohr read the proclamation for Fayette County, Pennsylvania Kick Off of America 250& Commemorating Lafayette's 200th. Muriel Nuttall, head of the Fayette Chamber of Commerce, thanked the commissioners and outlined the upcoming events for the celebration beginning this May and continuing through July 2026. Commissioner Lohr read the proclamation for International Women's Day- March 8, 2025. A representative of the Soroptimist Club attended and thanked the commissioners for the proclamation. Commissioner Vicites read the proclamation for Developmental Disabilities Awareness Month- March 2025. Two people attended to accept the proclamation. Commissioner Dunn called the meeting to order at 10:15 a.m. He asked everyone to stand for a prayer led by a pastor, which was followed by the pledge of allegiance. Public Comment on Agenda Items Prior to accepting public comment, Commissioner Dunn said although the television screens are black the Zoom is up and running. He asked people to come up to the podium and opened up to public comment on agenda items. Melanie Patterson, who described herself as a small business owner in the hospitality industry, spoke about a video on the Sheepskin Trail and promises Commissioners Dunn and Vicites made about the results of the trail development. She questioned where they got the figures of $34 million impact. Commissioner Dunn said he got his figures from a study done by the GAP Conservancy. He said the vacancy must be filled by someone with personal experience with mental illness. He said anyone interested should contact FCBHA. Commissioner Dunn said on Saturday, March 15 at 9 a.m. will be the 8th Agricultural Roundtable at the Fayette County Fairgrounds Fiddler's building. He said there will be breakfast and two guest speakers. He said they will discuss farming issues, including deer degradation. Public Comments Mark Fiano of Bullskin Township said he wanted to bring up issues with the assessment office. He said for the last four years he has been trying to get a Homestead exemption and it hasn't ever gone through. He said also after the tax sale deeds were sent out and then sent back and notarized and they must be signed in the presence of a notary sO they were done improperly. He added that the Prothonotary of the County is supposed to notarize the documents and that did not happen SO he was asking for clarification as to whether or not they are valid. He also asked about the per capita tax collection for the county. Commissioner Dunn responded to the comments, explaining that the Prothonotary is no longer a notary for the public. Solicitor Purcell said that decision came from the notary association. He said there isn't really a way to enforce per capita tax collection. Dave Smith of Nicholson Township presented multiple petitions signed by individuals opposed to solar farms. He asked what they can do to keep property in the United States, saying that one has been sold to a Japanese firm. He also said the township solicitor and one township supervisor own property where they are planning to put up a solar farm. He said that is a conflict of interest. Commissioner Dunn said the commissioners are not soliciting solar farms, the county is considered an environmental justice county due to the loss of the coal mines and tax credits are available. He said the solar ordinance is being finalized and there will be another hearing in March. He said they can't ban solar in Fayette County. Solicitor Purcell said some of the interest is because of all the existing transmission lines that are already in place. He said however that statistically only 1 in 5 of the proposed solar farms get built. Billy Dryzak of Nicholson Township said his township adopted a solar ordinance. He said they are unsightly and they pollute the landscape. He said it seems that the township is pushing it because property is owned by a solicitor and supervisor. He spoke about EMFS being transmitted by the solar farms. He said to be safe you need to live a half a mile to a mile away. The commissioners said they have to balance farmers rights, neighbors concerns, property owners rights and setback concerns. They discussed zoning issues relating to solar farms. Jon Marietta, Recorder of Deeds, said it has been a trying time with the assessment office. He asked with the new tax increase how much more money they will be 22 collecting. He said he is frustrated that the elimination of the jury commissioners is not on the agenda. He asked how often they are at the courthouse and asked if it is justified. He said eliminating jury commissioners will save $60,000 a year, which isn't insignificant. Commissioner Dunn addressed the record, saying that he did not say they were done with cuts or they were going to raise taxes a mill a year. He outlined the jury commissioners duties. He said the county is required to provide a jury pool. He said saving $60,000 and then hiring someone for $65,000 wouldn't save money. He pointed out that none of the commissioners put it on the agenda. Commissioner Lohr said if they got rid of the jury commissioners, only one person works in the office and if that person is out, they would have to hire someone to handle the job. Commissioner Lohr said they have to do it not flippantly. Commissioner Vicites said the employee that does the work has been here more than 30 years, sO she gets a lot of vacation and someone has to fill in. He said the jury commissioners have done their job. He said there is no savings. He said the law was passed in 2013 and he came back to office in 2015, and he doesn't believe it would be a savings. Solicitor Purcell said the purpose of the elected office is to have a fair and balanced way of selecting jurors.
