City Attorney, Jay Garrett, read: RESOLUTION #01-05-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COOPER, TEXAS, CANVASSING THE GENERAL ELECTION RETURNS, INCLUDING THE RETURNS OF EARLY VOTING BALLOTS CAST IN CONNECTION THEREWITH, AND DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON MAY 6, 2023, FOR THE PURPOSE OF ELECTING (1) MAYOR AND (2) CITY COUNCIL MEMBERS FOR (2) YEAR TERMS; AUTHORIZING THE SSUANCE OF A CANVASS OF GENERAL MUNICIPAL ELECTION; AND AN EFFECTIVE DATE. Diane Stegall made the motion to approve Resolution #01-05-23 verifying the canvassed totals of the May 6, 2023 election as presented. Josh Hoskison seconded. Scotty Deatherage and Linda Barnes abstained. Vote to approve Resolution #01-05-23 carried. AGENDA ITEM #4 City Attorney, Jay Garrett gave the statement of officer to the newly elected officers. AGENDA ITEM #5 The certificate of election was mentioned. AGENDA ITEM #6 City Attorney, Jay Garrett, gave the oath of office to Mayor Darren Braddy, City Council Scotty Deatherage, City Council Linda Barnes. AGENDA ITEM #7 Mayor Darren Braddy stated that a Mayor Pro-Tem appointment was at hand. It was the consensus of the council to appoint Josh Hoskison as Mayor Pro-Tem. This appointment will remove David Phillips from the signatory status of all City of Cooper bank accounts and instate Josh Hoskison as the new signatory for all City of Cooper bank accounts and retaining Mayor Darren Braddy and City Secretary Emily Howse as signatories for all City of Cooper bank accounts. Diane Stegall made the motion to appoint Josh Hoskison as Mayor Pro-Tem. Linda Barnes seconded. Vote unanimous. AGENDA ITEM #8 Diane Stegall made the motion to approve the April 10, 2023 public hearing and regular minutes as written. Josh Hoskison seconded. Scotty Deatherage and Linda Barnes abstained. Vote to approve April 10, 2023 minutes carried. AGENDA ITEM #9 Mayor Darren Braddy asked for public comments on agenda items. No comments were made. GENDA ITEM #10 Mayor Darren Braddy presented that the Cotton Harvest Festival was requesting date changes for the event. Linda Barnes made the motion to read Resolution #02-05-23 setting dates for road closure for the Cotton Harvest Festival for five years by caption. Diane Stegall seconded. Vote unanimous. City Attorney, Jay Garrett, read: 2 RESOLUTION #02-05-23 " A RESOLUTION AUTHORIZING ENTRY INTO AN AGREEMENT BETWEEN THE CITY OF COOPER, TEXAS, AND THE STATE OF TEXAS FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY; AND PROVIDING AN EFFECTIVE DATE." Below is the full resolution stating the dates and times which was not read out loud. WHEREAS, the City has determined a need for the temporary closure of the state right-of-way located at West Dallas Avenue from S.W. Second to S.E. Second and S.W. First from West Fort Worth to West Cooper for the purpose of Cotton Harvest Festival, which festival serves a public purpose, and which will be held on the following date: Saturday October 14, 2023 from 7:00 am to 10:00 pm, Saturday October 12, 2024 from 7:00 am to 10:00 pm, Saturday October 11, 2025 from 7:00 am to 10:00 pm, Saturday October 10, 2026 from 7:00 am to 10:00 pm, Saturday October 09, 2027 from 7:00 am to 10:00 pm. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COOPER, TEXAS: SECTION 1. That "Cotton Harvest Festival" serves a public purpose for the City of Cooper and the surrounding communities. SECTION 2. That the Agreement for the Temporary Closure of State Right-of-Way attached hereto as Exhibit "A" is hereby approved and the Mayor is hereby authorized to sign the Agreement with the State of Texas on behalf of the City. SECTION 3. This Resolution shall be in full force and effect immediately. PASSED AND APPROVED this the 15th day of May, 2023 Josh Hoskison made the motion to approve Resolution #02-05-23 changing the dates on the street closure for the Cotton Harvest Festival for five years. Diane Stegall seconded. Vote unanimous. AGENDA ITEM #11 Mayor Darren Braddy presented to the council that the previously approved TA Set Aside Sidewalk Grant project was on the table for discussion. Mayor Braddy stated that this grant had been in the works for several years. During this time the state officials changed and the new criteria was implemented therefore all of the work that was done for the benefit of the city, by Hayter Engineering was void due to the fact that the Hayter Engineering no longer met the criteria for services, according to the state. Mayor Braddy also stated that at the initial time of application, that the city did not fall into the economically disadvantaged category, therefore the Cooper Independent School District was willing to pay the match portion of this grant. Mayor 3 Braddy stated if the city withdrew the application now, then the city could re-apply in a year and then would be qualified as economically disadvantaged and the match portion would be considerably less cost. Josh Hoskison made the motion to withdraw the application for the TA. Set Aside Sidewalk Grant. Linda Barnes seconded. Vote unanimous. AGENDA ITEM #12 Mayor Darren Braddy presented to the council the desire to have the early voting and election day voting at the same location. Mayor Braddy stated that, in his and Emily's opinion, that it would help with the confusion of election locations and save moving the bulky voting machines from one location to another. All counting must be done at the central counting station, which is Cooper ISD. It was the consensus of the council to approve this action. Scotty Deatherage made the motion to approve to set the entire election location to CISD's new Administration Building located at 759 FM 1528. Josh Hoskison seconded. Vote unanimous. AGENDA ITEM #13 Mayor Darren Braddy updated the council that he was still waiting for quotes for the Frankie McKinney house repairs. No request for funds were presented. AGENDA ITEM #14 Mayor Darren Braddy updated the council on street paving, upcoming street grant, and pot hole repairs. AGENDA ITEM #15 Monthly budget reports were reviewed. AGENDA ITEM #16 Accounts payable were reviewed. AGENDA ITEM #17 Diane Stegall made the motion to adjourn. Linda Barnes seconded. Vote unanimous.
