CITY OF COOPER CITY COUNCIL MEETING - SPECIAL MEETING/BUDGET WORK SHOP AUGUST 29, 2022 = 5:00 PM MEMBERS PRESENT: DARREN BRADDY; MAYOR, DAVID PHILLIPS, ALLEN FOSTER, AMANDA L'ESPERANCE, DIANE STEGALL AND JOSH HOSKISON CITY ATTORNEY: JAY GARRETT OTHERS PRESENT: EMILY HOWSE, KEVIN CARTER, LISA CARTER, JOE ADAMS, ZYA L'ESPERANCE, KASEY BRITTON AND LINDA BARNES AGENDA ITEM #1 Mayor Darren Braddy called the meeting to order and Darren also voiced the prayer. AGENDA ITEM #2 Mayor Braddy presented to the council that Kevin and Lisa Carter were present to ask the council to pass an off-premise billboard sign ordinance. Mayor Baddy turned the meeting over to Kevin Carter. Kevin thanked the council for allowing him to speak. Kevin stated that it was his desire to install a digital LED billboard sign, of which anyone could place an advertisement on for a fee, which is an "Off Premise" sign. Kevin said that the state has strict rules governing billboard signs. First and foremost, the city has to have an ordinance that allows the placement of such signs. Kevin stated that his sign had 16 spaces for advertisement, eight on each side. It was the consensus of the council to allow the action of an "Off Premise" billboard sign with the ordinance presented. David Phillips made the motion for City Attorney, Jay Garrett, to read Ordinance #01-08-22 by caption. Diane Stegall seconded. Vote unanimous. City Attorney, Jay Garrett, read: ORDINANCE #01-08-22 AN ORDINANCE REGULATING OFF-PREMISE SIGNS AND BILLBOARDS; PROVIDING FOR DEFINITIONS; PROVIDING FOR THE SCOPE AND ENFORCEMENT OF THE ORDINANCE; IDENTIFYING PROHIBITED SIGNS AND EXEMPT SIGNS; ESTABLISHING REGULATIONS FOR NONCONFORMING SIGNS AND BILLBOARDS; PERMITTING OFF-PREMISE SIGNS AND BILLBOARDS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Allen Foster made the motion to approve Ordinance #01-08-22 as read by caption. Josh Hoskison seconded. Vote unanimous. AGENDA ITEM #3 Mayor Braddy presented to the council that the previously approved interlocal agreement forj joint election equipment purchase was again on the table. Mayor Braddy stated that CISD stated their desire to, in their opinion, to more clearly state the method of delivery of documents. The original document only stated "delivery" or US Mail, or Certified or Registered US Mail. CISD desired the document to state "hand delivered" or US Mail or Certified or Registered US Mail. Amanda L'Esperance made the motion to approve the updated change on the interlocal agreement for the election equipment joint purchase. Allen Foster seconded. Vote unanimous. AGENDA ITEM #4 Mayor Darren Braddy presented to the council that Sanitation Solutions has presented the annual 3% CPI (Consumer Price Index) rate increase for the upcoming year. City Secretary, Emily Howse, stated that the some of the current rates that the city is charging customers is barely above the charges of Sanitation Solutions. Diane Stegall asked why the city charged more that Sanitation Solutions. Emily Howse stated that the city was not trying to make money on garbage charges, but a buffer was the intent of the upcharge. Diane Stegall made the motion to absorb the 3% CPI rate increase and not pass it through to the residents. David Phillips seconded. Vote unanimous. AGEDNA ITEM #5 Mayor Darren Braddy presented to the council the balanced proposed budget which was figured on the effective rate (No New Revenue Rate) that was presented by Dawn Moody, Delta County Tax Assessor Collector. To clarify, the effective rate is the rate that will produce the same amount of revenue as the previous year. The city designates a portion of the taxes to go directly to pay on bond payments i.e.: I & Srate. So, Dawn Moody, Tax Assessor Collector for the City of Cooper, figures the rate using the system worksheet. The total No New Revenue Rate, as presented by Dawn is 0.723916. Oft that rate, subtract the I & S rate of 0.027702 which leaves 0.69214 for the M & O Maintenance and Operation) rate. The balanced budget was figured on the rate of 0.69214. The proposed budget was thoroughly discussed. Amanda L'Esperance firmly stated her desire was to go lower: than the effective. Allen Foster made the motion to table the budget discussion. Amanda L'Esperance seconded. Vote unanimous. AGENDA ITEM #6 Mayor Darren Braddy presented to the council that a proposed tax rate had to be approved tonight but the budget could be further discussed and changed if needed. Diane Stegall made the motion to approve the No New Revenue rate of 0.723916 (M&O 0.69214 1&5 0.027702) to prepare the upcoming 2022-2023 budget. Allen Foster seconded. Aye votes: David Phillips, Allen Foster, Diane Stegall and Josh Hoskison. Nay votes: Amanda L'Esperance. AGENDA ITEM #7 Allen Foster made the motion to adjourn. Amanda L'Esperance seconded.
