I have attached this as a supplement to the Monthly Report PowerPoint for informational purposes. Slide one: Calls for service Monthly calls for service have decreased by 41 from 485 to 454. Overall, the police department responded to an average of 16.21 calls for service each day of February 2025. We responded to less calls for service overall, but the CFS per day increased slightly due to February having only 28 days. Slide Two & Three: Calls for service by day of the week and time of the day Calls for Service increased on Sundays and Tuesdays. The remaining days of the week were consistent with January's call volume. We saw an increase in calls for service during the 10:00am time frame. Most calls for service remained during the 3:00pm - 8:00pm time frame. The personnel schedule continues to be a living document with officers being assigned during peak times. Slide Four: Reports generated 9 arrests were made during the month of February. One hundred and eleven (111) traffic stops were conducted resulting in forty (60) citations being issued (enforcement rate of 54%). Fifty-one (51) warnings were also issued. The department completed 31 incident reports and 42 supplemental reports. Traffic crashes have decreased to twenty-four (24) and we have continued to reçeive a high volume of reckless driver calls for service. Officers were not required to appear before the Grand Jury. Notable C.F.S. are as follows: Public Intoxication = 02/06/2025: Assault - 02/07/2025: Officers were dispatched to McDonalds in reference to an assault in progress. Investigation revealed the subject became involved in a physical altercation with a manager, causing bodily injury. The subject was released to EMS for an unrelated medical issue. A warrant was sought and later served. Incident cleared by arrest. D.W.I. I Unlawful Carrying a Weapon - 02/08/2025: Officer was dispatched to a reckless driver on IH-35 northbound. Subject vehicle was located and observed traveling 40mph in a 75mph zone. A traffic stop was initiated at which time the officer observed several signs of intoxication. S.F.S.T.'s were conducted and the subject was subsequently arrested for Driving While Intoxicated. During a pre impoundment inventory of the vehicle, officers found a loaded revolver pistol. The subject was also charged with Unlawful Carrying a Weapon. Incident cleared by arrest. Possession of Controlled Substance = 02/11/2025: Officer observed the subject walking in the middle of the roadway on IH-35 service road near Exit 284. The subject advised he was walking to his residence located off FM 2843. Officer offered to give the subject a ride to his residence, which the subject agreed to. The officer observed that the subject was in possession of a pocketknife and asked to hold onto the item until the courtesy ride was completed. The subject agreed. While removing the knife from the subject's pocket, a small plastic baggie containing a white crystalline substance came out with the knife. The subject admitted the substance was methamphetamine. The subject was subsequently arrested without incident. Incident cleared by arrest. D.W.I/ Possession of a Dangerous Drug - 02/16/2025: Officer observed a minor traffic violation and initiated a traffic stop on the subject vehicle. Multiple signs of intoxication were observed and S.F.S.T.'s were conducted. The subject was subsequently arrested for Driving While Intoxicated. During a pre impoundment inventory of the vehicle, officers located several items of drug paraphernalia and 13 prescription methocarbamol tablets that did not belong to the subject. The subject was also charged with Possession of a Dangerous Drug. Incident cleared by arrest. Driving While Intoxicated - 02/25/2025: Officer observed the subject operating a golf cart northbound on Main Street, making a right turn into Pace Park Road. At that point, the golf cart left the roadway and drove over the elevated curb and onto the sidewalk. Officer initiated a traffic stop for suspicion of D.W.I. Upon contact with the subject, multiple signs of intoxication were observed. S.F.S.T.'s were conducted and the subject was subsequently arrested for Driving While Intoxicated. Incident cleared by arrest. 2 Slide Five: Response Times Response times remained consistent with those of January 2025. Nine plates were retained for investigative purposes and the system was accessed one time for administrative purposes. Slide Eight: Purge Report 184,968 plates read in January were deleted from the system. This is an automatic setting purging the previous months captured data. On February 3rd, we hosted our second roundtable with Media2Social, bringing together hotels and local businesses to explore ways to enhance their online presence and optimize their profiles on the website. The discussion sparked valuable insights and collaboration among attendees. Businesses and hotels had the opportunity to connect, exchange ideas, and learn from one another. Some of our hotels have already put their knowledge into action, doing an excellent job creating content and tagging Visit Salado as a premier travel destination. On February 18th, the tourism office hosted the Brazos Trail Region Board meeting at the Salado Museum, welcoming representatives from 11 other cities. The mayor greeted attendees and offered a warm welcome before they started the program which included a tour of the museum and College Park, followed by lunch, and then the board meeting took place in the afternoon. The Village of Salado Tourism Department was honored with a certificate of appreciation. On February 21, twenty gift bags were made up and given to June at the Salado Winery, where she hosted a military FRG group who booked a tasting her winery. In this Agreement, the Village and Developer are sometimes individually referred to as a "Party" and collectively referred to as the "Parties. 99 RECITALS Developer owns approximately 33.217 acres of land located within the Village municipal limits and the extraterritorial limits ("*ETJ") of the Village. The 33.217 acre tract is located northwest ofthe intersection ofFM 2484 and IH3 35 and described by metes and bounds on Exhibit A attached hereto (the "Land"), and also known as Phase I and Phase II of the Salado Center development. Developer and the Village desire that the Land be governed by this Agreement. Developer intends to develop the Land as a master-planned, mixed-use community to serve the residents and property owners ofthe community, as well as the other residents ofthe Village, the Village's ETJ, and the County. The development may also include facilities that will serve tourists and visitors to the area. In this Agreement, the Land, as it will be developed, is sometimes referred to as the "Salado Center Project." The Village has established a Future Land Use Plan ("Future Plan") to guide the Village in planning for future growth and development. The Village has determined agreements with developers of mixed-use communities such as the Salado Center Project will benefit the Village by establishing land use controls, providing for the construction of appropriate and necessary utility and roadway infrastructure, encouraging economic growth, and promoting the welfare of all present and future citizens ofthe Village. Therefore, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, including the agreements set forth below, the Village and Developer agree as follows: ARTICLE 1 DEFINITIONS 1.1 Agreement: This development agreement is between the Village of Salado, Texas, and Celts International LLC. 1.2 Applicable Rules. The Village rules, regulations, fee schedule, and official policies in effect as of the date of this Agreement, will be applicable to the development of the Land, as modified by this Agreement. 01341938;1 1.3 Board of Aldermen. The Board of Aldermen of the Village of Salado, Texas. 1.4 County. Bell County, Texas. 1.5 Developer. Celts International LLC 1.6 Initial Term. The 14.031 acre portion of the Salado Center development depicted in the Final Plat for Salado Center Phase II as depicted in Exhibit A, including utilities and easements as described therein. 1.10 Planning and Zoning Commission. The Planning and Zoning Commission oft the Village. 1.11 Public Infrastructure. Includes Salado Center Loop Road, Salado Center Drive, and Celts Drive, and their related drainage, streetlights, and sidewalks. 1.12 Salado Center Project. The Land, as it will be developed under this Agreement. 1.13 Village. The Village of Salado, Texas, a Texas general law municipality. ARTICLE 2 PUBLIC BENEFITS, INFRASTRUCTURE, AND AMENITIES 2.1 Orderly Growth. The Agreement will ensure development ofthe Land occurs in an orderly manner in order to protect the health, safety, and welfare of its present and future citizens, protect property values and provide for the growth of the Village's tax base. This Agreement will benefit the Village by facilitating the development of a mixed-used community within the Village, which will allow for thoughtful and high-quality planning, the development of necessary roadways and utility facilities, the provision of required fire protection services, and the development of a balanced community that includes commercial, residential, and civic uses. 2.2 Economic Growth. The development of the Salado Center Project as a master-planned, mixed-use community will benefit the Village by providing new employers and an expanded job market for the residents of the Village and its ETJ, furthering the development of an expanded commercial tax base and making increased services available to residents of the Village and its extraterritorial jurisdiction. 01341938;1 ARTICLE3 PARTIES' DUTIES 3.1 Developer shall: 3.1.1 Developer shall provide a Performance Bond for the Salado Center Loop Road located within Phase II of the Salado Center project with fiscal security in an amount to be specified by the Village, and which shall be issued for a one year period in which construction must be completed. 3.1.2 Salado Center Loop Road must be constructed in accordance with the Village's ordinances and will be inspected by the Village's engineer prior to acceptance by the Village. 3.1.3 Developer shall install public sidewalks in Phase I and Phase II ofthe Salado Center development in accordance with applicable Village ordinançes by each property owner during site development. 3.1.4 Developer shall install streetlights in Phase I and Phase II of the Salado Center development within the public right of way in accordance with the design criteria attached as Exhibit B, and shall be installed during the term ofthe Performance Bond issued for Salado Center Loop road. 3.1.5 The Performance Bond will be provided by Developer to the Village via letters of credit, which shall be approved by the Village Administrator and Village Attorney. At the completion and acceptance of the public infrastructure, the Performance Bond may be converted to a Warranty Bond for Phase I and Phase II. 3.2 Village shall: 3.2.1 If Salado Center Loop is constructed in accordance with the Village's ordinances pursuant to inspection and approval by the Village's engineer, the Village shall take necessary action to accept Salado Center Loop and its related improvements. 3.2.2 Salado acknowledges that Salado Center Drive in Phase I and Phase II, and Celts Drive in Phase I were not inspected by the Village during the construction of these roadways. The Village has approved an Acceptance Agreement for Salado Center Drive in phase II. At the conclusion of the Performance Bond period for Salado Center Loop Road, including any extension of that Performance bond period approved by the Village, upon the Village's acceptance of the public infrastructure (which includes Salado Center Loop Road, Salado Center Drive, and Celts Drive, and their related drainage, streetlights, and sidewalks) a two year warranty bond in an amount to be determined by the Village shall be provided to the Village for both Phase I and Phase II. 3.2.3 Phase I and Phase II of Salado Center are subject to the Village's Franchise Ordinance for the Development applicable to public sewer lines within the Salado Center development that are within the public right-of-way. 01341938;1 ARTICLE 4 PROPERTY DEVELOPMENT 4.1 Governing Regulations. Except as otherwise provided in this Agreement, the Village rules, regulations, and official policies applicable to the development of the Land (the "Applicable Rules") during the term of this Agreement will be those Village ordinances, regulations, fees, and official policies (collectively, "Village Rules") in force and as interpreted by the Village by policy or practice on Effective Date of this Agreement, which the Parties agree is also the date on which Developer filed its first application with the Village for development ofthe Salado Center Project. 4.1.2 For the term of this Agreement, the development and use of the Land will be controlled by the terms ofthis Agreement and the Applicable Rules. Iftherei is any conflict between the Applicable Rules and the terms of this Agreement, the terms ofthis Agreement will control. 4.2 Salado Center Project Approvals and Entitlements. 4.2.1 Salado Center Project Approvals: The Developer has and shall continue to submit improvement plans to the Village and acquire any required permits from the Village prior to construction of any planned improvements. Such improvements shall comply with the Applicable Rules, unless otherwise waived or excepted to by this Agreement or by the subsequent agreement ofthe parties, as well as federal, state, and local laws. The Village agrees to not delay in granting such permits to the Developer upon Developer's proper request and application. 4.2.2 Signage. Signage may be permitted pursuant to applicable Village ordinances. 4.2.3 Marketing. The Village agrees to include the Salado Center Project in its marketing efforts for the Village. 4.4 Amendments. The parties agree and acknowledge that due to the fact that the Salado Center Project will encompass and affect a significant amount of Land for which the development will occur over a number of years, modifications to Developer's Conceptual Plan may be required. 4.5 Addition of Land. Should the Developer, in the future, desire to acquire and/or add additional land to the Salado Center Project and make it subject to this Agreement, which additional land has a shared boundary with the Land, or land that may be acquired that is on the north or south side of FM 2484, such acquisition must occur within the initial term of this Agreement, or by the end of any extensions ofthis Agreement, unless otherwise approved by the Village. Developer must give written notice to the Village of the acquisition, which will include a description of the property that has been acquired and a proposed conceptual plan for that property. The Village's approval of the addition of property will be processed in accordance with the Applicable Rules, and will not be unreasonably delayed. 4.6 The Parties agree that any verbal or written communication, agreement, or understanding is not valid and final until action is taken by the Salado Board of Aldermen as well as the applicable decisionmaker for Developer. 01341938;1 ARTICLE 5 TERM, AUTHORITY, AND VESTING OF RIGHTS 5.1 Term. 5.1.1 Initial Term. The term of this Agreement will commence on the Effective Date and continue for ten (10) years thereafter ("Initial Term"), unless sooner terminated under this Agreement. 5.1.2 After the Initial Term, the Agreement may be extended for up to an additional 5 (five) years by mutual agreement ofthe Parties. Factors to be assessed by the Village in exercising its discretion whether to extend the Agreement will include, but not be limited to, determining whether Developer has made significant progress on the development project. 5.1.3 Thereafter, any further extension(s) of the term of this Agreement will be subject to the mutual agreement of the Village and the Developer. 5.1.4 Extensions. In order to request extension ofthe term oft this Agreement beyond the Initial Term, the Developer must notify the Village in writing at least 60 (sixty) days prior to the last day ofthe then-current term that it wishes to extend the term of this Agreement. Any extension ofthe term of this Agreement after the 10-year term will be subject to the mutual agreement ofthe Village and the Developer as set forth in 5.1.1. 5.1.5 Expiration. Except as otherwise provided herein, after the Initial Term and any Extension Period(s), this Agreement will be of no further force and effect, except that termination will not affect any right or obligation arising from Salado Center Project Approvals previously granted for portions of the development actually constructed. 5.1.6 Termination or Amendment. This Agreement may be terminated or amended as to all of the Land at any time by mutual written consent of the Village and the Developer or may be terminated or amended only as to a portion ofthe Land by the mutual written consent ofthe Village and the owners of only the portion ofthe Land affected by the amendment or termination. 5.2 Authority. This Agreement is entered into, in part, under the statutory authority of Section 42.044 and Chapter 380 of the Texas Local Government Code, which authorize the Village to make written contracts with the owners of land within an area in which tourist-related businesses and facilities will be located, establishing lawful terms and considerations that the Parties agree to be reasonable, appropriate, and not unduly restrictive ofbusiness activities. The Parties intend that this Agreement guarantee the annexation of the Land as provided in this Agreement; authorize certain land uses and development of the Land; provide exceptions to certain ordinances; and provide other terms and consideration, including the continuation of land uses and zoning upon annexation of any portion of the Land to the Village. 5.3 Equivalent Substitute Obligation. If either Party is unable to meet an obligation under this Agreement due to a court order invalidating all or a portion of this Agreement, preemptive state or federal law, an imminent and bona fide threat to public safety that prevents performance or requires different performance, changed circumstances, or subsequent conditions that would legally excuse 01341938;1 performance under this Agreement, or any other reason beyond the Party's reasonable and practical control, the Parties will cooperate, to an extent reasonable, to revise this Agreement to provide for an equivalent substitute right or obligation as similar in terms to the illegal, invalid, or unenforceable provision as is possible and as is legal, valid and enforceable, or other additional or modified rights or obligations that will most nearly preserve each Party's overall contractual benefit under this Agreement. ARTICLE 6 GENERAL PROVISIONS 6.1 Assignment; Binding Effect. This Agreement and the rights and obligations of Developer hereunder, may be assigned by Developer to a subsequent purchaser of all or a portion of the undeveloped property within the Salado Center Project provided that the assignee assumes all of the obligations that are assigned. The Village must approve any assignment of the Agreement and the rights and obligations of Developer hereunder, which approval shall not be unreasonably withheld. Any assignment shall be in writing, shall specifically describe the property in question, shall set forth the assigned rights and obligations and be executed by the proposed assignee. A copy of the assignment document must be delivered to the Village. Upon any such assignment, Developer will be released ofany further obligations under this Agreement as to the property sold and obligations assigned and those obligations shall transfer to the approved assignee. The provisions of this Agreement shall be binding upon and inure to the benefit oft the Parties and their respective successors and assigns. 6.2 Severability. If any provision of this Agreement is determined to be illegal, invalid, or unenforceable, under present or future laws, it is the intention of the Parties that the remainder of this Agreement not be affected, and, in lieu of each illegal, invalid, or unenforceable provision, that a provision be added to this Agreement which is legal, valid, and unenforçeable and is as similar in terms to the illegal, invalid, or enforceable provision as is possible. 6.3 Applicable Law and Venue. The interpretation, performance, enforcement, and validity of this Agreement is governed by the laws of the State of Texas. Venue will be in a court of appropriate jurisdiction in Bell County, Teas. 6.4 No Third-Party Beneficiary. This Agreement is not intended, nor will it be construed, to create any third-party beneficiary rights in any person or entity who is not a Party, unless expressly otherwise provided. 6.5 Default. If either Party defaults in its obligations under this Agreement, the other Party must, prior to exercising a remedy available to that Party due to the default, give written notice to the defaulting Party, specifying the nature of the alleged default and the manner in which it can be satisfactorily cured, and extend to the defaulting Party at least thirty (30) days from receipt ofthe notice to cure the default. If the nature of the default is such that it cannot reasonably be cured within the thirty (30) day period, the commencement of the cure within the thirty (30) day period and the diligent prosecution ofthe cure to completion will be deemed a cure within the cure period. The Village may issue Stop Work Orders for violations arising under this Agreement or the regulations applied herein and those shall be resolved through the Village's normal processes. 01341938;1 6.6 Remedies for Default. If either Party defaults under this Agreement and fails to cure the default within the applicable period, the non-defaulting Party will have all rights and remedies available under this Agreement or applicable law, including the right to institute legal action to cure any default, to enjoin any threatened or attempted violation of this Agreement or to enforce the defaulting Party's obligations under this Agreement by specific performance or writ of mandamus, or to terminate this Agreement. All remedies available to a Party will be cumulative and the pursuit of one remedy will not constitute an election of remedies or a waiver of the right to pursue any other available remedy. Each of the parties acknowledge that a failure by it to perform its obligations under this Agreement in the time and manner required herein could result in significant damages to the other party and could preclude, on a temporary or permanent basis, that party's ability to develop its properties. If litigation is commenced as a result of a default hereunder, the prevailing party will be entitled to recover its reasonable costs and attorneys' fees incurred in enforcing its rights hereunder. The parties agree they will each make reasonable efforts to settle any claim or controversy arising out of this Agreement through communication and negotiation with each other. If such efforts should fail, then the involved dispute shall be submitted to a mutually acceptable mediator. Neither party shall unreasonably withhold acceptance of a mediator, and selection ofthe mediator shall be made within fifteen (15) days after written notice by one of the parties to the other that mediation is desired. The cost of such mediation, and of any other subsequent alternative dispute resolution procedures agreed to by the parties, shall be shared equally. The parties agree to appear before the mediator and to engage in mediation in good faith. 6.7 Reservation of Rights. To the extent not inconsistent with this Agreement, each Party reserves all rights, privileges, and immunities under applicable laws. 6.8 Attorney's Fees. The prevailing Party in any dispute under this Agreement will be entitled to recover from the non-prevailing Party its reasonable attorney's fees, expenses, and court costs in connection with any original action, any appeals, and any post-judgment proceedings to collect or enforce a judgment. 6.9 Waiver. Any failure by a Party to insist upon strict performance by the other Party of any provision of this Agreement will not, regardless of the length of time during which that failure continues, be deemed a waiver of that Party's right insist upon strict compliance with all terms of this Agreement. In order to be effective as to a Party, any waiver of default under this Agreement must be in writing, and a written waiver will only be effective as to the specific default and as to the specific period of time set forth in the written waiver. A written waiver will not constitute a waiver of any subsequent default, or of the right to require performance of the same or any other provision of this Agreement in the future. 6.10 Entire Agreement. This Agreement contains the entire agreement ofthe Parties, and there are no other agreements or promises, oral or written, between the Parties regarding the subject matter of this Agreement. This Agreement may be amended only by written agreement signed by the Parties with proper authority to enter into an amendment. This Agreement supersedes any and 01341938;1 all prior agreements, both verbal and written, and the Parties waive any claims or causes of action arising under such prior agreements. 6.11. Exhibits, headings, Construction & Counterparts. All exhibits attached to this Agreement are incorporated into and made a part of this Agreement for all purposes. The paragraph headings contained in this Agreement are for convenience only and do not enlarge or limit the scope or meaning of the paragraphs. Wherever appropriate, words of the masculine gender may include the feminine or neuter, and the singular may include the plural, and vice-versa. Each ofthe Parties has been actively and equally involved in the negotiation ofthis Agreement. Accordingly, the rule of construction that any ambiguities are to be resolved against the drafting Party will not be employed in interpreting this Agreement or its exhibits. This Agreement may be executed in any number of counterparts, each of which will be deemed to be an original, and all of which will together constitute the same instrument. This Agreement will become effective only when one or more counterparts, individually or taken together, bear the signatures of all of the Parties. 6.12. Time. Time is of the essence of this Agreement. In computing the number of days for purposes of this Agreement, all days will be counted, including Saturdays, Sundays and legal holidays; however, ifthe final day of any time period falls on a Saturday, Sunday or legal holiday, then the final day will be deemed to be the next day that is not a Saturday, Sunday or legal holiday. 6.13. Authority for Execution. The Village certifies, represents, and warrants that the execution of this Agreement has been duly authorized and that this Agreement has been approved in conformity with Village ordinances and other applicable legal requirements. Developer certifies, represents, and warrants that the execution ofthis Agreement is duly authorized in conformity with their authority. 6.14. Property Rights. Owners expressly and unconditionally waive and release the Village from any obligation to perform a takings impact assessment under the Texas Private Real Property Rights Act, Texas Government Code Chapter 2007, as it may apply to this Agreement, the Property, and the Salado Center Project. 6.15. Notices. SCOPE. These criteria shall be adhered to for the design of all street lighting systems to be installed in the public street right-of-way. Continuous street lighting systems shall consist of one or more service enclosures, distribution systems, poles, luminaires, and other appurtenances required to provide a complete, operable lighting system. The City Engineer shall be responsible for determining the scope of a street lighting system. B. LOCAL STREET LIGHTING. City policy is not to continuously light local streets, therefore lighting along local streets does not provide specific maintained light averages and uniformity ratios. The purpose of local street lighting is to provide enough light on the street to enhance the safety ofthe street users but to avoid over lighting the area. All streetlights on local streets will be installed in conformance with the following basic guidelines. At Intersections: In order to provide lighting within the intersection area oft two local streets, a light pole will be installed on one corner of an intersection or opposite the intersection in the case of a T-intersection. Within Cul-de-Sac Bulbs: A light pole will be installed within the cul-de-sac bulb when the cul-de-sac street is longer than 200 feet measured from the intersection of the intersecting streets to the center ofthe cul-de-sac bulb. Mid-block Streetlights: A minimum number of mid-block streetlights will be installed in order to achieve a desired pole spacing ofa approximately 250 feet. The maximum spacing between lights should not exceed 300 feet and the minimum spacing between lights should not be less than 200 feet unless otherwise approved by the City Engineer. Lights should desirably be located on or near a property line and not in front of residences, if avoidable. At this time, lighting on local streets is installed and maintained by the electrical utility company. For all new developments, the developer shall indicate the location of streetlights on the roadway plans for all local streets. The City Engineer will review the location of streetlights and authorize the electrical utility company to install the streetlights when the street is constructed and accepted for maintenance. C. CONTINUOUS LIGHTING DESIGN. These criteria are established to provide uniform procedures to aid the Design Engineer in preparing improvement plans. These criteria are not to be a rigid set of rules that would restrict the Design Engineer from utilizing creative or original design; however these criteria may be modified only with prior authorization by the City Engineer. The AASHTO Roadway Lighting Design Guide permits either the illuminance method or the luminance method to be used in the design of highway lighting. The luminance method requires a complex design process and knowledge of the reflective characteristics of the pavement surface used. These reflective characteristics change as the pavement ages and with variations in weather conditions, Itis for these reasons that the luminance method is not allowed by the City. Photometric analysis shall be utilized to calculate the theoretical spacing ofstreet lights to meet the illumination criteria based on the Street classification. The City Engineer should be consulted to determine the appropriate street classification. The minimum illumination criteria should be as shown in the table on the following page. Street Classification Minimum Maintained Average-to-Minimum Average Illumination Uniformity Ratio Arterial 1.3 foot-candles 3:1 Commercial Collector 0.9 foot-candles 4:1 Residential Collector 0.61 foot-candles 4:1 The street pavement surface is assumed to be the R3 reflective classification. The lighting loss factor shall be 1.0 for all photometric analysis. Only luminaires listed in the City's Approved Materials List shall be utilized for photometric analysis. D. PLACEMENT OF STREET LIGHT POLES. The actual spacing of street light poles should be the possible spacing nearest to the calculated theoretical spacing. At locations where additional lighting may be beneficial, such as around curves, at intersections, and at crosswalks, pole spacing may be reduced to increase lighting leveis. Street light poles shall have a minimum setback of three feet, measured from the back of curb to the center ofthe pole foundation. The minimum setback for a non-curbed street shall be six feet, measured from the edge of pavement to the center oft the pole foundation. Poles may be located in medians where the minimum setback requirements can be satisfied. In medians, poles shall be installed as close as possible to the center of the median, All poles in medians shall be a minimum of 15 feet behind the median nose. Poles located at the intersection of residential streets should desirably be placed SO the light pole can be used to mount stop and street name signs. That means the pole should be installed as near to the location where a vehicle should stop while maintaining the minimum setback ofthree feet from the back of curb. All poles installed in residential areas should ideally be located on or near property lines whenever possible. In the case of larger lots, poles cannot always be located on the property line. In these cases, in order not to exceed the maximum desired pole spacing, poles can be located within the lot. The designer should take care not to locate the pole in front of large windows of houses. Any pole located near a residential drive entrance should be located a minimum of five feet from the edge ofthe drive or concrete wing. The Design Engineer should also coordinate the location ofall poles with existing trees, such that the fixture does not extend into the tree canopy or such that the tree çanopy does not block the light output from the fixture. Street light poles should be located to have a minimum clearance of 10 feet from all overhead electrical utilities. Specific clearance requirements shall be determined by the utility company and/or National Electric Safety Code. A minimum clearance of three feet shall be maintained from any non-electric lines such as cable TV lines, aerial fiber lines, etc. The Design Engineer shall be responsible to determine if adequate clearance can be achieved and make adjustments to the pole locations or coordinate utility relocation if necessary. E. STREET LIGHT POLES. Street light pole types, differentiated by mounting height and bracket arm length, are illustrated in the Standard Drawings. Equipment to be utilized should be selected based on the following criteria. Luminaires should be installed at a maximum mounting height of 40 feet above the roadway. Poles mounted on structures, such as bridges and retaining walls, may require special pole lengths as not to exceed the maximum mounting height. Bracket arms should be selected to position the luminaire over the traveled way for greatest utilization of available light. The braçket arms should be oriented 90-degrees, or perpendicular, to the traveled way. Bracket arm lengths should be selected in order to position the luminaires in a relatively straight line when looking down the roadway. Decorative street light poles are not allowed unless approved by the City Engineer. F. STREET LIGHT POLE FOUNDATIONS Screw-in anchor foundations are assumed to be used for all poles wherever possible. Ifa screw-in anchor cannot be installed for any reason, such as encountering rock, then a concrete foundation shall be installed. Screw-in anchor foundations are not to be installed in soils that have been disturbed or filled to a depth of3 feet or more. G. LUMINAIRES. In general cobrahead style LED luminaires are rated as Class A through Class E depending on their ability to light a particular type of roadway and cross section. Recent advances in LED technology allow for fixtures with greater lumen output, which are rated as Class Z. Typically, the lowest class OfLED luminaire should be used in the design that satisfies the given lighting criteria. An approximate comparison between the different classes of LED luminaires and high pressure sodium (HPS) luminaires is as follows: Class ZLED - greater than 400 W HPS Class A LED - approximately equivalent to a 400W HPS Class B LED - approximately equivalent to a 310W HPS Class C LED - approximately equivalent to a 250W HPS Class D LED - approximately equivalent to a 150W HPS Class E LED - approximately equivalent to a 100W HPS The City uses only two LED luminaire models with field adjustable light outputs to achieve the different classes of lumen output. The Design Engineer should refer to the City's Approved Products List for the models of luminaires, light loss factors, and the photometric files that should be used for photometric analysis. H. CONDUIT. The distribution system shall be underground in 2-inch conduit. Conduit for street lighting systems shall be either Schedule 40 polyvinyl chloride (PVC) conduit or SDR 11 high density polyethylene (HDPE) conduit. Cable-in-duct may be installed for projects in mostly unpaved areas. Ifconduit is to be installed on a structure, rigid metal conduit (RMC) conduit should be used per the requirements ofthe Missouri Department of Transportation. In new concrete structures, PVC conduits can be embedded when structures are constructed. Except where it crosses under a street, the conduit shall be behind the back ofcurb or outside the edge of pavement. The conduit should be installed at a constant offset from the back of curb or edge of pavement preferably at the same distance as the pole setback, unless a common trench is being used. The minimum setback from the street to the center of the conduit should be the same as that specified for street light poles except in medians, where conduit setback may be closer to the back of curb to avoid landscaping. The setbacks may have to be adjusted in places to avoid storm sewers, utility conflicts, or other obstructions. In unpaved areas, conduit can be trenched or plowed. Conduit shall be bored under all sidewalks, drives, and streets unless otherwise approved by the City Engineer. Boring under streets shall be perpendicular to the roadway or the shortest possible crossing distance. The length of conduit is calculated by adding the center to center distances between equipment. All of the center to center distances should be subtotaled and multiplied by 102% to allow for bending of conduit to avoid obstructions. The method of conduit installation is not quantified. I. JUNCTIONAND PULL BOXES. Junction or pull boxes shall be installed at each location where splices in the distribution cable are required outside the pole base or where 90-degree bends in conduit runs are required. The distance between boxes and/or street light poles shall not exceed 300 feet to facilitate the pulling of cable. Boxes must be installed at least 10 feet away from street light poles to allow for conduit sweeps. The minimum setback from the street to the center of boxes should be the same as specified for street light poles. The installation of boxes in streets, driveways and curb ramps is unacceptable. In addition, the City prefers that boxes not be installed in the sidewalk. Boxes should be located on level ground, clear of ditches. Type junction boxes shall be used if one or two conduits enter/exit the box. Type 2junction boxes shall be used where three or four conduits enter/exit the box. A Class 1 pull box shall be located adjacent to each service enclosure, or where five or more conduits enter/exit the box. J. SERVICE ENCLOSURE. The Design Engineer shall coordinate and verify the location ofthe service enclosure with the electric utility company to ensure availability of service. Secondary service for street lighting shall be three-wire 120/240 Volt single phase. Service enclosures are typically located behind the sidewalk, or at least 10 feet from the back ofthe curb (or edge of pavement where there is no curb). Service enclosures should be generally located on level ground, clear of ditches, and clear of sight lines for right-turning traffic at intersections. Each service enclosure shall contain a photoelectric cell, to be oriented to the north or east. Four- circuit service enclosures are typically used for street lighting systems, unless otherwise approved by the City Engineer. A 3-inch Schedule 40 PVC conduit with power cables shall be installed from the service enclosure to the foundation of the secondary service point (utility pole, secondary pedestal, or pad-mount transformer) as designated by the electrical utility company. The conduit should be installed in a straight horizontal line in accordance with the Standard Drawings, and should be 100 feet or less in length. Junction or pull boxes are not permitted in the conduit run between the service enclosure and secondary service point unless authorized by the electrical utility company. Power cables shall be three #2 cables. The electrical utility company will supply the meter and connect the power cables to the transformer. K. CIRCUITS. All street lighting circuits shall be two-wire 240 volt (hot to hot) system with a ground wire. Distribution cable shall be sized sO that the voltage drop does not exceed 5% at any point in the system. The Design Engineer is required to submit voltage drop calculations for verification. Distribution cables shall be no larger than #4 and no smaller than #8. Voltage drop calculations shall be prepared using the full input wattage of the luminaire, even if the light output is designed to be adjusted in the field. Each street lighting circuit shall be contained in a separate conduit, except for the conduit raceway between a service enclosure and the adjacent class I pull box. For that raceway, two conduits will be required. The distribution cable for each of the lighting circuits shall be routed through one of these two conduits into the class 1 pull box, and then routed to the first pole for each circuit through separate conduits. Splices in the distribution cable should be minimized. Circuits shall not be spliced between the service enclosure and the first street light pole on each circuit. Splices in distribution cable should be made using insulated multi-cable connector kits. Splicing ofdistribution cable is only allowed in pole bases, pull boxes, or junction boxes. The length of distribution cable is calculated by adding the center to center distances between all equipment on a circuit. The length of all cable should be subtotaled and multiplied by 102% to allow for bending. Five feet of slaçk should be added at each light pole base or power supply. Slack should also be added for junction and pull boxes; two feet at each Type junction box, three feet at each Type 2 junction box, and six feet at each Class 1 pull box. L. POLE WIRING. Pole and bracket cable consists of a 3-conductor cable run inside the street light pole. Poles with dual luminaries will require two 3-conductor pole and bracket cables. The distribution cables are spliced to the pole and bracket conductors in the pole base using multiple tap connectors. Break-away disconnects are also installed on each pole and bracket conductor in the pole base. Fused disconnects should be used for each of the phase conductors, and a non- fused disconnect should be used for the ground conductor as shown in the Standard Drawings. The length of 3-conductor pole and bracket cable at each street light pole is calculated by adding the nominal pole height, the length of the bracket arm, and five feet of slack. This quantity is multiplied by the number ofluminaires on the pole. M. GROUNDING. All street light poles shall be bonded together to form a continuous system. Ground rod shall be installed adjacent to eaçh concrete street light pole foundation and each service enclosure. Ground rods are not required to be installed with to screw-in anchor foundations. The grounding conductor shall be bonded to each ground rod. N. POLE NUMBERING. Street light poles shal! be numbered using the service enclosure identification number followed by the circuit number and pole number. For example the first pole on circuit number 1, from service enclosure number 2F03 should be labeled as 2F03-1-1. The second pole on the circuit shall be labeled 2F03-1-2. PLAN REQUIREMENTS The street lighting plans shall include all information necessary to build and check the design of a street lighting system. Street lighting plans shall meet all public improvement project plan preparation requirements for the City of Liberty in addition to the requirements listed in this section. Street Lighting plans shall consist oft the following sheets: Title Sheet General Notes and Quantities Sheet Street Lighting Plan Sheet(s) Wiring Diagram Standard Detail Sheets Title Sheet: Title sheet is only required for stand-alone lighting projects. Ifstreet lighting plans are part ofa larger plan set, a title sheet is not necessary. The title sheet shall meet the City's plan requirements for public improvement projects. General Notes and Quantities Sheet: This sheet should contain the following: A. List of general notes to the Contractor B. Any project specific notes C. Legend of symbols that apply to all sheets D. Lighting design calculations and illumination criteria E. Recapitulation of quantities table Street Lighting Plan Sheet(s): The plan sheet(s) shall include the following information: A. One or more plan sheets adequately showing the street lighting system in relation to the streets and adjacent properties, with a north arrow, and a bar scale at a minimum scale of 1 inch equals 50 feet. B. All existing and proposed utilities such as power, gas, water, telephone, cable, sanitary sewer, storm sewer, and other items shall be accurately shown according to the best available information in the records of the owner of the facility, or field location, and shall be identified as to type, size, material, etc., as may be applicable. Existing utilities should be shown in gray. C. All existing and known proposed improvements within 50 feet each side of the right-of-way and 100 feet beyond the project limits shall be shown at their proper locations unless otherwise approved or required by the City Engineer. These improvements shall include items such as street pavement, curbs and gutters, sidewalks and driveways, storm and sanitary sewers, water mains and fire hydrants, utility poles and pedestals, trees and shrubs, fences and walls, buildings, and similar items, and shall be identified as to type, size, material, etc., as may be applicable. Irrelevant items may be omitted for new developments. Existing items should be shown in gray. New non-lighting items may be shown with a thin black line. Future non-lighting items may be shown with a thin dashed line. D. Typically, street lighting equipment does not need to be identified by station and offset unless stationing is available. Ifthe street lighting is part of an improvement project for which stationing and controls have been developed, street centerline stations should be shown and marked at 100-foot intervals for consistency between the signal and improvement plans. If station and offset are not indicated, the locations of proposed street lighting equipment should be referenced from existing features that appear on the base plans, such as the back of curb, edge of pavement, utility poles, etc. E. Each item to be constructed or installed for the project should be legibly noted. Each power supply should be labeled with the identification number assigned by the City Engineer. Street light poles should also be labeled with the power supply identification number, circuit number and pole number as previously described. F. There should be a table listing the pole number, station, offset, and braçket arm length, and luminaire type for all proposed poles. There should also be a table listing the box number, station, offset and type of box for all proposed junction and pull boxes. All proposed equipment shall be listed in the order in which it is located in the plans. Wiring Diagram: This sheet should include an overall schematic of the street lighting circuitry from each service enclosure. The center to center distance between street light equipment should be indicated on the diagram. A summary table for each circuit should also be included on this sheet indicating the conductor size, circuit length, input amperage, percent voltage drop. circuit assignment at the service enclosure, and branch circuit breaker trip rating. WATER CODE SS 7.002, 7.051, and 7.073, and that the Respondent is subject to TCEQ's jurisdiction. The TCEQ has jurisdiction in this matter pursuant to TEX. WATER CODE S 5.013 because it alleges violations of TEX. WATER CODE ch. 26 and the rules of the TCEQ. 3. The occurrence of any violation is in dispute and the entry of this Order shall not constitute an admission by the Respondent of any violation alleged in Section II ("Allegations"), nor of any statute or rule. 4. An administrative penalty in the amount of $12,750 is assessed by the Commission in settlement of the violations alleged in Section II ("'Allegations". Village of Salado, Texas Water Franchise Fee Ordinance Page I of 7 1.5 "Distribution System" shall mean all interrelated lines, equipment, pumps, and other appurtenances used or necessary for the transmission and distribution of water to consumers or customers within the Village. 1.6 "Franchise" shall mean this Ordinance, and all rights and obligations established herein or as it may be amended. 1.7 "Total Billed Water Usage" is the total amount of fee billed to consumers for water service provided by SWSC. 1.8 "Public easement" shall mean those easements held, owned, or controlled by the Village, the terms, conditions or limitations upon which are not inconsistent with the construction or maintenance of a water distribution and transmission system. 1.9 "Service lines" shall mean lines directly connected to SWSC's water distribution system and used to convey water therefrom to the customer's meter. 1.10 "Street" or "Alley" shall mean a publicly dedicated or maintained right-of-way, a portion of which is open to use by the public for vehicular travel. 1.11 "Water" shall mean potable drinking water. Section 2: Grant of Franchise. 2.1 To the extent allowed by law, there is hereby granted to SWSC a non-exclusive franchise to maintain, construct, equip, extend, replace, alter and otherwise establish and operate in the Village, as constituted as ofthe effective date ofthis Ordinance, or as may hereafter be constituted, works, systems, plants, distribution lines, and all related facilities (including those now in service) necessary or appropriate to sell, distribute, convey, or otherwise conduct, serve, supply and furnish the inhabitants in of the Village and others, and to the Village, whenever the Village may desire to contract therefore, water service, and SWSC is hereby granted passage and right-of-wayin, under, along, and across the streets, avenues, easements, right-of-way, alleys, highways, sidewalks, bridges, and other structures and places in the Village, as they now or hereafter may exist, for every and any such service, use, effect, and lawful purpose as herein mentioned; provided that all work, activity and undertakings by SWSC shall be subject to the terms and provisions of the Franchise and the continuing exercise by the Village ofits governmental and police powers; and provided further that nothing herein shall be construed to require or authorize SWSC to exceed any rights granted herein or by state or federal law. 2.2 SWSC shall be allowed to operate and maintain all lines existing on the effective date of this Franchise within Village parks, or then existing on land hereinafter designated as a Village park, but shall not undertake a replacement of such lines or install new lines within said parks. SWSC may directly petition the Aldermen for permission to cross Village park lands; provided that the grant of any such permission shall be in the sole discretion of the Aldermen. Village of Salado, Texas Water Franchise Fee Ordinance Page 2 of7 2.3 The construction, maintenance, and operation of the system and property ofsWSC within the Village shall be subject to this Franchise and the ordinances and regulations adopted by the Aldermen from time to time in the exercise of the Village's police and regulatory powers. 2.4 The term of this Franchise shall be for a period of five (5) years beginning on the effective date of this Ordinance. Thereafter, this Franchise shall automatically renew for additional five (5) year terms until modified in writing by the Village and SWSC. 2.5 SWSC shall not transfer this Franchise nor any rights and privileged granted herein without the written approval of the Aldermen expressed by Ordinance. Such approval shall not be unreasonably withheld. 2.6 Nothing contained in this Franchise shall be construed as granting any exclusive franchise or right. Section 3: Use of Streets and Easements. SWSC is hereby authorized, licensed, and empowered to do any and all things necessary and proper to be done and performed in executing the powers and utilizing the privileges herein mentioned and granted by this Franchise, provided the same do not conflict with existing electric power lines, telephone lines, cable lines and other authorized installations, and provided that all work done in said streets, avenues, easements, rights- of-way, alleys, highways, sidewalks, bridges, and other structures and places and public grounds by SWSC shall be done with reasonable diligence and without unnecessary inconvenience to the public or individuals. Section 4: Work by the Village and Others. The Village reserves the right to lay, and permit to be laid, cable, telephone, electric, and other lines, cables and conduits, and to do and permit to be done any underground or overhead work that may be necessary or proper in, across, along, over, or under any street, alley, highway, easement or public place occupied by SWSC SO long as it performs in accordance with TCEQ and/or PUC regulations and state law. The Village shall be liable to SWSC only for any damage to the lines, equipment or appurtenances of SWSC, the producing cause of which is the negligence ofthe Village, its employees, or subcontractors doing work for the Village. Damage caused to SWSC as a result of work done by persons other than the Village, its employees, or its sub-contractors shall be corrected through payment to SWSC by the responsible person. Removal and relocation expenses incurred by SWSC shall be reimbursed by the person for whom the removal or relocation is made. Section 5: Modification and Relocation of Facilities. 5.1 If, during the period ofthis Franchise, the Village shall elect to alter or change the grade or alignment ofany street, alley or other public right-of-way, or any water pipe, wastewater pipe, or any overhead or underground structure within the corporate limits or the extraterritorial jurisdiction of the Village, SO as to conflict with the transmission or distribution lines, equipment, or appurtenances ofSWSC, SWSC shall remove or relocate, as necessary, all ofits facilities, equipment, and appurtenances necessary at the expense of the Village. Schedules for this work shall be developed by designated representatives of SWSC and the Village. If such representatives cannot agree on the schedules, SWSC's Village of Salado, Texas Water Franchise Fee Ordinance Page 3 of 7 acting engineer, after consultation with the Village, shall establish a schedule. This schedule shall provide for a minimum of thirty (30) days between the time the schedule is furnished to SWSC and the time that any specific work to be done by SWSC covered in the schedule is to begin. 5.2 Whenever any such public works project is funded, in whole or in part, with federal or state highway monies, if federal or state law provides compensation for utility adjustments, the Village shall request that compensation be provided to SWSC by the funding authority. If the Village receives such requested utility adjustment compensation, it shall deliver same to SWSC. Section 6: Service to be Provided by SWSC. 6.1 Service may be provided by means of transmission and distribution lines, equipment, and appurtenances in the streets, alleys, easements, and other public rights-of-way. SWSC shall not place its transmission or distribution lines, equipment, and appurtenances where the same will obstruct or interfere with motor vehicle traffic, or any existing cable, electric, drainage, sewer or telephone facilities, traffic control signalization, streetlights, fire lines or communication lines. 6.2 SWSC shall furnish service consistent with the requirements and intent of this Franchise and its "service regulations" as now or hereafter adopted by SWSC, and state law or regulations; provided that consistent with such regulations, SWSC shall provide water service to all areas of the Village and within SWSC's certificated service area. 6.3 SWSC's system and appurtenances shall be located, installed, and maintained SO that none of the facilities shall unreasonably endanger the lives of persons, unreasonably interfere with any public improvements the Village may deem proper to make, or unnecessarily obstruct the free use ofthe streets, alleys, bridges, easements, or public property. 6.4 SWSC shall repair all excavations and work sites by SWSC or its subcontractors or agents in compliance with any applicable Village rules and regulations at SWSC's own cost; provided that in any event the area of excavation or work shall be, at minimum, repaired and replaced to as good or better condition. Section 7: SWSC Rules and Regulations. 7.1 SWSC' S rates, rules, and regulations shall be and remain in effect as adopted and amended from time to time by its governing body; subject to the right of the Village or the State of Texas to regulate any such rate, rule, or regulation to the fullest extent allowed by law. 7.2 SWSC shall be entitled to require from each and every customer to make such deposits and payments as required by SWSC, and to comply with the rules and regulations adopted by SWSC and state law. Village of Salado, Texas Water Franchise Fee Ordinance Page 4 of7 Section 8: Franchise and Rental Fees. 8.1 The streets, rights-of-way, and public easements to be used by SWSC in the operation of its system within the boundaries of the Village as such boundaries exist as ofthe effective date of this ordinance, are valuable public properties acquired and maintained by the Village at great expense to its taxpayers, without which SWSC would be required to invest in right-of-way costs and acquisitions, and since the Village will incur costs in regulating and administering this Franchise, SWSC shall through the term ofthis Franchise pay to the Village four percent (4%) billed on the total water usage fee collected from customers located within the Village for the duration ofthe Franchise. The fee shall be paid quarterly on or before the 15th day of the month following the end of the quarter, and the fee shall be based upon the total number of users as of July 15 of the previous year. For example, the franchise fee for the quarter ending June 30th shall be paid by July 15th. 8.2 The franchise fee shall be in lieu of any and all other Village imposed rentals or fees for the franchise, license, and privilege of occupying the Village streets and rights ofway, and any excise or revenue taxes or fees and all similar rentals or taxes (except as and when applicable ad valorem property taxes, special assessments for local improvements, Village sales tax, and such other charges for utility services imposed uniformly upon persons, firms, or corporations then engaged in business within the Village) upon or relating to the business, revenue, franchise, transmission and distribution lines, installations and systems, fixtures, and other facilities of SWSC and all other property of SWSC and its activities, or any part thereof, in the Village which relate to the operations of SWSC's water utility system. Section 9: Insurance Provided by SWSC. SWSC shall maintain throughout the term of this Franchise property damage coverage, general liability insurance, automobile liability insurance, and worker's compensation insurance, with an insurance company, or companies, licensed to do business in the State of Texas insuring against claims for liability and damages; provide that SWSC may in its continuing discretion provide all required coverage by a funded self-insured program. Section 10: Indemnification and Hold Harmless. SWSC agrees to save harmless the Village, its agents, officers, and employees, against and from any and all suits, claims, and judgments by or on behalf of any person, firm, corporation, or other entity, arising from SWSC's distribution system or operation within the Village, or arising from any act or omission of negligence ofSWSC, or any of its agents, contractors, servants, employees, or licensees. It is understood that it is not the intention ofe either the Village or SWSC to create any liability, right or claim for the benefit of third parties and this Franchise is intended and shall be construed oft the sole benefit ofthe Village and SWSC. Section 11: General Provisions. SWSC shall supply the Village with a map or maps showing the probable location(s) ofthe Water Supply System to be constructed and operated by SWSC after the date of this Franchise. Upon the completion of construction of any part or portion of the Water Supply System, or any addition Village of Salado, Texas Water Franchise Fee Ordinance Page 5 of7 thereto, within the Village, SWSC shall provide the Village with a map showing the location of such line, pipe, facility, or Water Supply System. With regard to information regarding the location(s) of the portion(s) of the Water supply System, SWSC shall not be responsible for the accuracy of the information or for providing maps to the Village showing lines or facilities constructed prior to SWSC's acquisition of the Water Supply System. However, to the extent SWSC subsequently determines that such information is inaccurate, it will provide the Village with information regarding the inaccuracy. Section 12: Severability. If any section, paragraph, subdivision, clause, part, or provision hereof shall be adjudged invalid or unconstitutional, the same shall not affect the validity hereof as a whole or any part or provision other than the part of parts held invalid or unconstitutional. Section 13: Governing Law. This Franchise shall be construed in accordance with the Constitution and laws of the State of Texas. Nothing in this Franchise is intended to expand upon the authorities or rights of either the Village or SWSC açcording to the Constitution and laws of the State of Texas. Nothing in the Franchise shall be construed as a waiver by either party of its authority or rights as provided by the Constitution ofthe State of Texas. Section 14: Open Meetings. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public, and public notice ofthe time, place and purpose of said meeting was given, as required by the Open Meetings Act, Chapter 551, Texas Government Code.
