Planning & Zoning Commission Minutes Tuesday July 16th, 2024 MINUTES PLANNING AND ZONING COMMISSION TUESDAY,JULY 16,2024 The Planning and Zoning Commission for the City of Midlothian met on Tuesday evening, in the City Hall Council Chambers located at 104 West Avenue E, Midlothian, Texas. The following Commissioners were present: Lee Skinner & Commissioner Jackie McDonald Commissioner Ron Bland Commissioner Dan Altman Commissioner Scott Koehler Vice-Chairman Mark Hill Commissioner The following Commissioners were absent: Maurice Osborn 8 Chairman REGULAR AGENDA Call to Order and Determination of Quorum. 001 Citizens to be heard-The Planning & Zoning Commission invites members of the public to address the Commission on any topic not scheduled for consideration for action on this agenda and present it to City Staff prior to the meeting. In accordance with Texas Open Meetings Act, the Commission cannot act on items not listed on the agenda. There were no citizens to be heard. 002 Staff review of the cases that were heard by City Council in the last sixty (60) days. CONSENT AGENDA 004 Consider and act upon a request for a Final Plat of Main Street Towne Crossing, Phase I, being 33.902 acres ofland, situated within the. J. Sharkey Survey, Abstract No. 1065, J.T. Rawls Survey, Abstract No. 933, and the W.P. Kerr Survey, Abstract No. 609, City of Midlothian, Elliott County, Texas. The property is generally located on West Main Street, east ofU.S. Highway 67. (Case No. FP0S-2024-055). Staff presented the consent agenda and welcomed questions from the Commissioners. Commissioner Altman moved to approve consent agenda as presented. Motion was seconded by Commissioner Skinner and carried unanimously (6-0). * Agenda Item 003 was removed from consent agenda. REGULAR AGENDA 003 Consider the minutes for the Planning and Zoning Commission meeting dated: a June 18, 2024 Planning & Zoning Commission Minutes Tuesday. July 16th, 2024 Staff presented the agenda item and welcomed questions from the Commissioners. Commissioner Altman moved to approve agenda item #003 with the condition that they added about changes by removing title of Vice-Chairman from Dan Altman and add Scott Koehler. Motion was seconded by Commissioner Skinner and carried unanimously (6-0). 005 Consider and act upon a request to allow direct residential driveway access onto Ledgestone Lane for Lot 27R, Block A, Plainview Manor, commonly known as 2611 Pergola Ct. (Case No. M06- 2024-56). *This agenda item has been withdrawn by the applicant. No voting action was taken* PUBLIC HEARING 006 Conduct a public hearing and consider and act upon an ordinance relating to the use and development of4610 Whitehead Road, being +/-2.807 acre ofland, Lot 33, of'Twin Oaks West Addition, Phase I, by changing the zoning from Agricultural (A). District to a Single Family' Two (SF-2) District. (Case No. Z14- 2024-53) Staff presented the agenda item and welcomed questions from the Commissioners. Commissioner Altman moved to close the public hearing. Motion was seconded by Commissioner Skinner and carried unanimously (6-0). Commissioner Hill moved to approve agenda Item# 006 as presented. Motion was seconded by Commissioner Skinner and carried unanimously (6-0). 007 Conduct a public hearing and consider and act upon an ordinance amending the city of Midlothian Zoning Ordinance by amending Section 3.5700 "Secondary Dwelling Units" relating to the regulation of Secondary Dwelling Units; and amending Section 100.100 "General Definitions" by adding the definition for "Secondary Dwelling Units." (Case No. 0Z01-2024-062). Staff presented the agenda item and welcomed questions from the Commissioners. Commissioner Altman moved to close the public hearing. Motion was seconded by Commissioner Bland and carried unanimously (6-0). Commissioner Altman moved to approve agenda Item# 007 with conditions listed below. Motion was seconded by Commissioner McDonald and carried unanimously (6-0). 1. Take further consideration as to clarifying definition of occupants whether it is limited to a blood relative or ifthere is leeway to: a. Caregivers or people of service roles b.
