Planning & Zoning Commission Minutes Tuesday, December 17, 2024 MINUTES PLANNING AND ZONING COMMISSION TUESDAY, DECEMBER 17, 2024 The Planning and Zoning Commission for the City of] Midlothian met on Tuesday evening, in the City Hall Council Chambers located at 215 N. gth Street, Midlothian, Texas 76065. The following Commissioners were present: Maurice Osborn S Chairman Scott Koehler Vice-Chairman Lee Skinner Commissioner Jackie McDonald Commissioner Ron Bland Commissioner Dan Altman Commissioner The following Commissioners were absent: Mark Hill S Commissioner REGULAR AGENDA Call to Order and Determination of Quorum. 001 Citizens to be heard-The Planning & Zoning Commission invites citizens to address the Commission on any topic not already scheduled for a Public Hearing. Citizens wishing to speak should complete a "Citizen Participation Form" and present it to City Staff prior to the meeting. In accordance with the Texas Open Meetings Act, the Commission cannot act on items not listed on the agenda. There were no speakers to be heard. 002 Staff review of the cases that were heard by City Council in the last sixty (60) days. CONSENT AGENDA 003 Consider the minutes for the Planning and Zoning Commission meeting dated: e November 19, 2024 PUBLIC HEARING 004 Conduct a public hearing and consider and act upon an ordinance to amend the zoning regulations relating to the development and use of (1) 4.34t acres out of the H.F. Hinkley Survey, Abst. No. 459, presently zoned Light Industrial (LI) District; (2) 53.63 acres out of the W.M. Hawkins Survey, Abst. No. 465, presently zoned Light Industrial (LI) District; (3) 32.289L acres out ofthe W.M. Hawkins Survey, Abst. No. 465 and the B. Monroe Survey, Abst. No. 700, presently zoned Agricultural (A) District; (4) 67.7456L acres out ofH.F. Hinkley Survey, Abst. No. 459, presently zoned Residential-3 (R3) District and Community Retail (CR) District; and (5) 32.606 acres out of the B. Monroe Survey, Abst. No. 700, presently zoned Agricultural (A) District, all in the City of Midlothian, Ellis County, Texas, by changing the current zoning to a Planned Development (PD) District for Motor Freight Uses with a base zoning of Light Industrial (LI) and Commercial (C), said property being generally located west of Midlothian Parkway from its intersection with Mockingbird Lane on the north and Union Pacific Railway right of way on the south. Chairman Osborn entertained a motion to continue the case to the next P&Z meeting. Commissioner Altman made a motion to continue the case to the next P&Z meeting. Motion was seconded by Commissioner Koehler and carried unanimously (6-0). 005 Conduct a public hearing and consider and act upon an ordinance for a Specific Use Permit (SUP) for a "secondary dwelling" relating to the use and development of Lot 29, Block G, of Four Trees Estates, commonly known as 4010 Underwood Lane, City of Midlothian, Ellis County, Texas. The property is presently zoned Planned Development 77 (PD-77) District and is located on +1.61 acres. SUP16-2024-77) Staff presented the agenda item and welcomed questions from the Commissioners. Commissioner McDonald moved to close the public hearing. Motion was seconded by Commissioner Altman and carried unanimously (6-0). Commissioner McDonald moved to deny agenda Item# 005 as presented. Motion was seconded by Commissioner Koehler and carried unanimously (6-0). 006 Conduct a public hearing and consider and act upon an ordinance for a Zoning Change (Agriculture to Planned Development) to allow the use of a Single Family Residential Planned Development, being 48.59 acres of the WM M Shofner Survey, Abstract 1300, City of Midlothian, Ellis County, Texas. The property is presently zoned Agriculture (A) district. (Case No. Z27-2024-101) Staff presented the consent agenda and welcomed questions from the Commissioners. The public speakers to be heard were Dennis Barclay, Rick Orr, Nathaniel Arthur, Karen Wegley, and Melissa Orr of Midlothian. Commissioner Altman moved to close the public hearing. Motion was seconded by Commissioner McDonald and carried unanimously (6-0). Commissioner McDonald moved to deny agenda item#006 as presented. Motion was seconded by Commissioner Altman and carried unanimously (6-0). MISCELLANEOUS DISCUSSION.
