NOTICE OF A SCHEDULED MEETING FOR THE CITY OF MIDLOTHIAN PLANNING & ZONING COMMISSION TUESDAY, FEBRUARY 18, 2025 The Planning and Zoning Commission for the City of Midlothian met on Tuesday evening, in the City Hall Council Chambers located at 215 N. gth Street, Midlothian, Texas 76065. The following Commissioners were present: Maurice Osborn S Chairman Scott Koehler Vice-Chairman Lee Skinner Commissioner Jackie McDonald Commissioner Ron Bland Commissioner Mark Hill Commissioner The following Commissioners were absent: REGULAR AGENDA Call to Order and Determination of Quorum. 001 Citizens to be heard- The Planning & Zoning Commission invites members of the public to address the Commission on any topic not scheduled for consideration for action on this agenda and present it to City Staff prior to the meeting. In accordance with the Texas Open Meetings Act, the Commission cannot act on items not listed on the agenda. There were no citizens to be heard. 002 Staff review of the cases that were heard by City Council in the last sixty (60) days. 003 Election of Officers Commissioner Hill moved to nominate Commissioner Osborn for Chair. Commissioner Koehler seconded that motion and was voted on unanimously 5-0 to pass. Commissioner McDonald moved to nominate Commissioner Skinner for Co-Chair. Commissioner Hill seconded that motion and was voted on unanimously 5-0 to pass. CONSENT AGENDA 004 Consider the minutes for the Planning and Zoning Commission meeting dated: January 21, 2025 Item #004 was pulled off of the consent agenda. 005 Consider and act upon a request for a Final Plat of Massey Heritage Addition, Block 1, Lots 1, and 3 through 11, being +20.849 acres out of the R.W. Tucker Survey, Abstract No. 1311. The property is generally located at the northeast corner of FM 1387 and Walnut Grove Road, City of Midlothian, Ellis County, Texas. (FP01-2025-004) Staff presented the consent agenda and answered questions from Commissioners. Commissioner Skinner moved to approve agenda item #005. Commissioner Bland seconded the motion and the item was passed unanimously 5-0. PUBLIC HEARINGS 004 Consider the minutes for the Planning and Zoning Commission meeting dated: January 21, 2025 Commissioner Bland moved to approve agenda item #004 with the correction of the attendance. Commissioner Skinner seconded that motion and was voted on unanimously 5-0 to pass. 006 The request is to conduct a public hearing and consider and act upon an ordinance for a Zoning Change to allow the use for a Single Family Residential Planned Development, being 48.59+ acres ofthe W.M. M. Shofner Survey, Abstract 1300, City ofMidlothian, Ellis County, Texas. The property is presently zoned Agriculture (A) district. (Z01-2025-001) Staff presented the agenda item and welcomed questions from the Commissioners. The public speakers to be heard were Kevin Coyne, Doris Stout, Dennis Barclay, Jared Orr, Melissa Orr, Rick Orr, and Don Phillips ofl Midlothian. Commissioner Skinner moved to close the public hearing. Motion was seconded by Commissioner Bland and carried unanimously (5-0). Commissioner Osborn moved to deny agenda Item# 006 as presented. Motion was seconded by Commissioner Skinner and went in favor 2-3, and it did not pass for a lack of four votes. Commissioner McDonald moved to approve if the setbacks were changed to meet the zoning standards, and that the emergency gate be approved. Motion was seconded by Commissioner Koehler. Motion went in favor 3-2, and it did not pass for a lack offour votes. Commissioner Osborn made a motion to move this to the next Planning and Zoning meeting. Motion was seconded by Commissioner Skinner. The motion was removed. Commissioner McDonald moved to approve if the setbacks were changed to meet the city standards. The motion was seconded by Commissioner Skinner. The motion was carried 4-1 with Commissioner Hill abstaining due to conflict of interest. 007 Conduct a public hearing and consider and act upon an ordinance amending the City of Midlothian Zoning Ordinance and Zoning Map, relating to the use and development of 16.24+ acres out of the Martha Brenan Survey, Abstract No. 43, City of Midlothian, Ellis County, Texas, by changing the zoning from Agriculture (A) District to Planned Development District No. 184 (PD-184) for Single Family Residential uses. The property is generally located on the west side of S. 14th Street, and north of McAlpin Road. (Z03-2025-003) Staff presented the agenda item and welcomed questions from the Commissioners. The public speakers to be heard were Scott Weidmann of Midlothian. Commissioner Skinner moved to close the public hearing. Motion was seconded by Commissioner McDonald and carried unanimously (5-0). Commissioner Skinner moved to approve agenda Item# 007 with noted changes to allow both side entry and J-swing driveways for not less than 50% of the residences, and an eight-foot privacy fence on the west side. Motion was seconded by Commissioner Bland and carried unanimously (6-0). 008 Conduct a public hearing and consider and act upon an ordinance relating to the use and development of 33.339+ acres in the JT Rawls Survey, Abstract No. 933, City of Midlothian, Ellis County, Texas, by changing the zoning from Planned Development No. 4 (PD-4) District to Planned Development No. 179 (PD-179) for Community Retail (CR) District uses. The property is generally located on the south side of West Main Street, west of State Highway 67, and northeast of US Highway 287. (Z16-2024-066) Staff presented the agenda item and welcomed questions from the Commissioners. Commissioner McDonald moved to close the public hearing. Motion was seconded by Commissioner Bland and carried unanimously (5-0). Commissioner Skinner moved to approve agenda Item# 008 as presented if TxDOT approves to put a traffic light in place prior to a Certificate of Occupancy for the first building constructed on the development. Motion was seconded by Commissioner Hill and passed 5-1. MISCELLANEOUS DISCUSSION.
