THESITYOF ZELKHART CITY OF ELKHART CITY COUNCIL REGULAR MEETING MINUTES October 16, 2023 6:00 pm City Hall A. CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Jennifer McCoy called the meeting to order at 6:00 p.m. Present: Mayor Jennifer McCoy, Councilmember Lucia Butler, Councilmember Tammy Baughman, Councilmember Randy McCoy, Public Works Director Eric Clark, Interim City Secretary Jan Stuteville, Sunshine Alcorta and Code Enforcement Tambara Farrell, Citizens Nathan Rodriguez, Robert Stuart, Ashley Stuart, Angela Hallmark, Karen Bridges, Traci Lipsey, Justin Cunningham, Steven Prater, Ronda Williams, and Tracy Tidrow. Absent: Councilmember Chuck Conner. Pledge of allegiance was followed by the invocation given by Mayor Pro Tem James Warren. B. PUBLIC COMMENTS Angela Hallmark representing Elkhart ISD regarding food trucks. Justin Cunningham representing EYAA. C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: 1. All aspect of Food Establishment Ordinance 0-06192022-01. Councilmember Randy McCoy made a motion, seconded by Mayor Pro Tem James Warren, to amend Ordinance 06192022-01 to include a yearly permit in the amount of $250.00 for Mobile food trucks. All in favor, motion carried. 2. Purchase of a new vehicle for public works. Mayor Pro Tem James Warren made a motion, seconded by Lucia Butler, to purchase a vehicle up to 55,000.00 for public works. All in favor, the motion carried. 3. Disconnect procedures. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman, to take no action. All in favor, motion carried. 4. Adopting Ordinance 09142023, Adopting the Budget for FY2023-2024. Councilmember Tammy Baughman made a motion, seconded by Councilmember Randy McCoy to adopt Ordinance 09142023, Adopting the Budget for FY2023-2024. All in favor, motion carried. D. PUBLIC WORKS REPORT. Public Works Director Eric Clark reported: 1. Water inspection went very well. 2. Wastewater inspection is scheduled for Wednesday. 3. Repairs to tower are about 80% completed. E. MUNCIPAL COURT Code Enforcement Tambra Farrell reported: 1. Reported 11 cases 4 closed and 7 open. 2. People are cleaning up. MAYOR REPORT Mayor McCoy reported: Halloween Trunk or Treat is on October 31, 2023, 5 to 7 at the First Methodist Church, we need candy and bring your vehicles. G. EMERGENCY MANAGEMENT REPORTS Emergency management Randy McCoy reported: NONE H. CLOSED SESSION Council will convene into Closed Session pursuant to Section 551.074 of the Texas Government Code regarding personnel matters as follows at 7:20 p.m: 1. Discuss and take action if any, of employment, evaluation, reassignment, duties, discipline, or dismissal of A. Tommy Farrell I. RECONVENE INTO REGULAR SESSION Council reconvened into Regular Session at 7:28 p.m. Discuss and take action on items discussed in Closed Session: 1. Councilmember Lucia Butler made a motion, seconded by Mayor Pro Tem James Warren to raise Tommy Farrell $.50 more an hour effective next pay period. J. COUNCIL COMMENTS NONE K. APPROVAL OF MINUTES Councilmember Tammy Baughman made a motion, seconded by Mayor Pro Tem James Warren to approve minutes from Budget workshop August 21, 2023, October 2, 2023. All in favor, motion carried. L.
